#7&5 UNITED NATIONS WMft NATIONS UNIES (XI ' B ' 28) 'lONS, N V IOOI7 REFERENCE, c.N.452.1995.TREATIES-4 (Depositary Notification) EUROPEAN AGREEMENT ON MAIN INTERNATIONAL TRAFFIC ARTERIES (AGR) CONCLUDED AT GENEVA ON 15 NOVEMBER 1975 AMENDMENTS PROPOSED TO ANNEX I The Secretary-General of the United Nations, acting in his capacity as depositary, communicates the following: At its eighty-ninth session held in Geneva from 30 October to 1 November 1995, the Principal Working Party on Road Transport of the Inland Transport Committee of the Economic Commission for Europe, considered in accordance with paragraph 2 of article 8 of the above-mentioned Agreement, amendments to the explanatory notes in annex I to the Agreement which were elaborated by the Ad Hoc meeting (in which Croatia, Denmark, Finland, Italy, Poland, Portugal, Romania, the Russian Federation and Sweden participated) on implementation of AGR at its fourteenth session, as well as amendments to Annex I proposed by the Government of Germany in agreement with the Government of Austria. The proposed amendments were unanimously adopted by those present and voting, which included a majority of the Contracting Parties as reflected in the report of the Principal Working Party on Road Transport (doc. TRANS/SC.1/357 of 7 November 1995). In this connexion, the Secretary-General wishes to draw attention to paragraphs 1 to 5 of article 8, which read as follows: "i. Annex I to this Agreement may be amended by the procedure specified in this article. 2. Upon the request of a Contracting Party, any amendment proposed by it to annex I to this Agreement shall be considered in the Working Party on Road Transport of the Economic Commission for Europe (ECE). 3. If adopted by the majority of those present and voting and if such majority includes the majority of the Contracting Parties present and voting, the amendment shall be communicated by the Secretary-General to the competent administrations of the Contracting Parties directly concerned. The following shall be considered Contracting Parties directly concerned: (a) in the case of a new, or the modification of an existing class-A international road, any Contracting Party whose territory is crossed by that road; (b) in the case of a new, or the modification of an existing class-B international road, any Contracting Party contiguous to the requesting country, whose territory is crossed by the class-A international road or roads with which the class-B international road, whether new or to be modified, is connected. Two Contracting Parties having in their respective territories the terminal points of a sea link on the class-A international road or roads specified above shall also be considered contiguous for the purposes of this paragraph. EUROPEAN AGREEMENT ON MAIN INTERNATIONAL TRAFFIC ARTERIES (AGR)CONCLUDED AT GENEVA ON 15 NOVEMBER 1975

AMENDMENTS PROPOSED TO ANNEX I

The Secretary-General of the United Nations, acting in hiscapacity as depositary, communicates the following:

At its eighty-ninth session held in Geneva from 30 October to1 November 1995, the Principal Working Party on Road Transport of theInland Transport Committee of the Economic Commission for Europe,considered in accordance with paragraph 2 of article 8 of theabove-mentioned Agreement, amendments to the explanatory notes inannex I to the Agreement which were elaborated by the Ad Hoc meeting(in which Croatia, Denmark, Finland, Italy, Poland, Portugal,Romania, the Russian Federation and Sweden participated) onimplementation of AGR at its fourteenth session, as well asamendments to Annex I proposed by the Government of Germany inagreement with the Government of Austria.

The proposed amendments were unanimously adopted by thosepresent and voting, which included a majority of the ContractingParties as reflected in the report of the Principal Working Party onRoad Transport (doc. TRANS/SC.1/357 of 7 November 1995).

In this connexion, the Secretary-General wishes to drawattention to paragraphs 1 to 5 of article 8, which read as follows:

"i. Annex I to this Agreement may be amended by theprocedure specified in this article.

2. Upon the request of a Contracting Party, any amendmentproposed by it to annex I to this Agreement shall be consideredin the Working Party on Road Transport of the EconomicCommission for Europe (ECE).

3. If adopted by the majority of those present and votingand if such majority includes the majority of the ContractingParties present and voting, the amendment shall be communicatedby the Secretary-General to the competent administrations of theContracting Parties directly concerned. The following shall beconsidered Contracting Parties directly concerned:

(a) in the case of a new, or the modification of anexisting class-A international road, any Contracting Party whoseterritory is crossed by that road;

(b) in the case of a new, or the modification of anexisting class-B international road, any Contracting Partycontiguous to the requesting country, whose territory is crossedby the class-A international road or roads with which theclass-B international road, whether new or to be modified, isconnected. Two Contracting Parties having in their respectiveterritories the terminal points of a sea link on the class-Ainternational road or roads specified above shall also beconsidered contiguous for the purposes of this paragraph.

4. Any proposed amendments communicated in accordance withparagraph 3 of this article shall be accepted if within a periodof six months following the date of its communication none ofthe competent administrations of the Contracting Partiesdirectly concerned notify the Secretary-General of theirobjection to the amendment. If the administration of aContracting Party states that its national law obliges it tosubordinate its agreement to the grant of a specificauthorization or to the approval of a legislative body, thecompetent administration shall not be considered as havingconsented to the amendment to annex I to this Agreement, and theproposed amendment shall not be accepted, until such time as thesaid competent administration notifies the Secretary-Generalthat it has obtained the required authorization or approval. Ifsuch notification is not made within a period of eighteen monthsfollowing the date on which the proposed amendment wascommunicated to the said competent administration or if, withinthe period of six months specified above, the competentadministration of a Contracting Party directly concernedexpresses an objection to the proposed amendment, that amendmentshall not be accepted.

5. Any amendment accepted shall be communicated by theSecretary-General to all the Contracting Parties and shall comeinto force for all the Contracting Parties three months afterthe date of its communication."

Transmitted herewith, in accordance with the above-mentionedparagraph 3 of article 8, are copies of the English, French andRussian .texts of the proposed amendments (doc. TRANS/SC.1/357 of7 November 1995) for communication to the competent administrations.

In this connection, reference is made to paragraph 12 ofdocument TRANS/SC1/324 concerning the procedure under article 8 (3)of the Agreement, which paragraph reads as follows:

"12. Regarding such procedure, the Working Party agreed thatin order to make it more simple the draft amendments adoptedshould be communicated to all Contracting Parties and not onlyto the 'Contracting Parties directly concerned' as envisagedunder the Agreement, it being understood that for theiracceptance the provisions of article 8, paragraph 4 would applyfully."

In accordance with the above-quoted paragraph 4 of article 8,the proposed amendment shall be considered as having been acceptedif, within a period of six months following the date of the presentnotification, no objection has been received from a competentadministration or a Contracting Party directly concerned.

REPORT

ATTENDANCE

1. The Principal Working Party on Road Transport held its eighty-ninthsession from 30 October to 1 November 1995 under the chairmanship ofMr. S. Schimming (Germany). Representatives of the following member Statesparticipated: Austria; Bulgaria; Croatia; Czech Republic; Finland; France;Germany; Greece; Italy; Netherlands; Norway; Romania; Russian Federation;Slovakia; Spain; Switzerland; Turkey. The following intergovernmentalorganizations were represented: European Conference of Ministers of Transport(ECMT) ; International Road Traffic Organization ( I R T O ) . The following non-governmental organizations were also represented: International RoadTransport Union ( I R U ) ; International Touring Alliance/International AutomobileFederation (AIT/FIA); Council of Bureaux.

INTRODUCTORY STATEMENT

2. Addressing the session, the Director of the Transport Division stressedthe need for increased cooperation aimed at furthering facilitation ofinternational road transport while improving its safety and environmentalperformance in Europe in order to cope in an appropriate manner with thegrowing demand for such transport particularly in the east-west direction. Heunderlined the importance of the legal instruments developed in the frameworkof the Principal Working Party, invited the Principal Working Party to keepthem updated in line with the decisions taken by the Inland TransportCommittee in January 1995 and repdrted on the contribution of the secretariatto the implementation of such decisions.

ADOPTION OF THE AGENDA

3. The provisional agenda (TRANS/SC.1/356) was adopted.

ACTIVITIES OF ECE BODIES AND OTHER INTERNATIONAL ORGANIZATIONSOF INTEREST OF THE PRINCIPAL WORKING PARTY

( a ) Economic Commission for Europe

4. The Principal Working Party was informed about the results of the fiftiethsession of the Economic Commission for Europe (3-11 April 1995), particularlyregarding Decision H ( 5 0 ) on cooperation in the field of transport.

(b) Inland Transport Committee and its subsidiary bodies

5. The Principal Working Party was informed about the decisions taken by theInland Transport Committee at its fifty-seventh session as they relate to thePrincipal Working Party's work (ECE/TRANS/111, paras. 15, 16, 23, 4 7 - 6 2 ) .

6. It also took note of the recent work related to road transportinfrastructure and operation carried out by the Working Parties on TransportTrends and Economics ( W P . 5 ) and on Customs Questions affecting Transport( W P . 3 0 ) .

( c ) Other international organizations

7. The representatives of the European Conference of Ministers of Transport(ECMT) and the International Road Transport Union ( IRU) informed the PrincipalWorking Party about the recent work carried out by their organizations in thefield of international road transport.

8. The Principal Working Party took note of the report by the representativeof IRU regarding the difficulties in the TIR customs transit system and hiscall for supporting the measures taken by IRU in this matter. It also notedhis remarks about the different treatment of national and foreign driversinvolved in legal processes and invited IRU to submit a document on thissubject.

ROAD TRANSPORT INFRASTRUCTURE

( a ) European Agreement on Main International Traffic Arteries (AGR)

9. The Principal Working Party was informed that, in the period between itsprevious and present sessions, Georgia and Kazakhstan had become ContractingParties to the AGR Agreement and that the amendments to Annexes I and II toAGR adopted by the Principal Working Party at its eighty-eighth session(TRANS/SC. 1/355, Annex 1) had been accepted on 14 September 1995 and wouldenter into force on 14 December 1995.

10. The Principal Working Party took note of the preparatory work beingcarried out, by the Governments concerned and the secretariat, regarding thepossible extension of the E road network to Caucasian and central Asiancountries and, in particular, of the consideration of the subject during theseminar on ECE work in the field of transport including legal instruments heldin Geneva on 26 September 1995 (informal document No. 4). The representativeof Turkey stated that the maps included in informal document No. 4 did notreflect all possible international road connections in the region underconsideration. For the final establishment of the international road network,all countries concerned should be consulted and the results of various studieson this subject already carried out should be taken into account.

11. The Working Party decided:

(i) To invite Governments of States in those regions, which havenot yet done so, to consider the possibility of acceding tothe AGR Agreement making full use of the knowledge andexpertise of ECE regional advisers;

( i i ) To request the secretariat to continue its consultation withcountries concerned aimed at the final identification ofroads, important for international traffic, to be possiblyincluded in the E road network.

12. The Principal Working Party stressed the importance of the directconsultation with new ECE member States on various problems that arise fromtheir participation in ECE work, being carried out by regional advisers. Itinvited the Inland Transport Committee to support this activity by relevantdecisions including the encouragement of the Commission to provide necessaryfinancial means allowing regional advisers to continue their valuable work.

13. The Principal Working Party noted that there had been no progress inreaching agreements upon the inclusion -of certain roads in Eastern Europe inthe E road network, the decision on which having been postponed at its lastsession (TRANS/SC.1/355, para. 9 ( a ) ) , and requested the Governments ofBelarus, Latvia, Lithuania, Poland and the Russian Federation to consult theproposed amendments on a bilateral or, if possible, multilateral basis and totransmit to the secretariat information about any new developments in thismatter and/or the modified proposals, if any. It was decided to remove thisitem from the agenda if relevant information would not be made available.

14. In accordance with the provision of article 8 of the Agreement, thePrincipal Working Party unanimously adopted the amendment to Annex I to theAgreement (Explanatory notes) proposed by the fourteenth session of the ad hocMeeting on Implementation of AGR in which the following Contracting Parties tothe Agreement had participated: Croatia, Denmark, Finland, Italy, Poland,Portugal, Romania, Russian Federation and Sweden (TRANS/SC.I/AC.28, para. 7).The text of the proposed amendment appears in annex 1 to this report. ThePrincipal Working Party felt, however, that the further extension of theE road network might cause new numbering "problems. Therefore the problems ofnumbering and classifying E roads should, if necessary, be examined again inthe future.

15. Taking into account proposals made by the ad hoc Meeting(TRANS/SC. I /AC.5/28, paras. 8 and 9 ) , the Principal Working Party recommendedContracting Parties to AGR that:

(i) Wherever practicable, the extension of the existing east-west oriented roads should be considered rather than theintroduction of roads with new numbers, in order to avoiddifficulties in the numbering of east-west oriented E roadsthat might arise from the eastward extension of the E roadnetwork;

(ii) They should seek to ensure, wherever practicable, that newlinks they propose provide continuity for internationaltraffic and connect into the existing E road network. Toachieve this, they should consult and cooperate withneighbouring countries as appropriate.

16. In accordance with the decision of the Inland Transport Committee taken atits fifty-seventh session concerning the specific follow-up proposals to theSecond Pan-European Transport Conference contained in documents TRANS/R.401and Add.l (ECE/TRANS/111, para. 16), the Principal Working Party consideredthe possible modification of the AGR provisions concerning frontier posts(Annex II to AGR, para. IV. 7.4), taking into account views and proposals ofthe ad hoc Meeting on Implementation of AGR (TRANS/SC.I/AC.5/28, paras, 12 and13). It felt that, taking into account the current financial difficultiesfaced by the United Nations, it would be more appropriate to request thead hoc Meeting to consider in detail the possible development of more strictrequirements on frontier posts in the AGR rather than the establishment of anew informal group for this particular tasks.

17. The Principal Working Party took note of the synthesis of the inventory ofmain standards and parameters of the E road network prepared by thesecretariat on the basis of data received from Governments (TRANS/SC.1/R. 265and Add.l). It agreed upon the proposals made by the ad hoc Meeting topossibly extend the inventory in the future by the analysis of level ofservice, on the basis of the comparison of the geometric characteristics ofE roads with traffic volumes, utilizing data obtained during the 1995 Censusof Motor Traffic on E roads. It was also agreed that the results of theinventory should be considered in detail by the ad hoc Meeting with a view topreparing conclusions concerning a follow-up.

18. To this end the Principal Working Party decided to convene the ad hocMeeting in 1996 in order to consider subjects referred to in paragraphs 16 and17 above and any new amendments to AGR which might be submitted to thesecretariat in the meantime.

19. The Principal Working Party invited Governments, which have not yet do so,to transmit to the secretariat as soon as possible data on main standards andparameters of E roads on their territories to be included in the synthesis ofthe inventory of E roads.

20." The Principal Working Party also considered the comments made by theGovernment of Austria concerning the itinerary of road E 60 between Worgl andSalzburg on the territories of Austria and Germany (TRANS/SC. 1/R.267). Therepresentative of Germany informed the Principal Working Party that hisGovernment proposed that this particular stretch of road E 60 should bedefined as: Worgl - Rosenheim - Salzburg (as proposed by Austria) and thatthe section Worgl - St. Johann i.T. - Lofer - Salzburg be included in theE road network as a class-B E road. The representative of Austria said thathis Government agreed upon this proposal.

21. In accordance with the provisions of article 8 of the Agreement, thePrincipal Working Party unanimously adopted the amendments to Annex I to theAgreement mentioned in paragraph 20 above. The text of the proposedamendments appears in annex 1 to this report.

(b) Trans-European North-South Motorway (TEM) Prolect

22. In introducing the progress report, the increasing membership, the projectstatus and the main activities, including the cooperation inter alia withOECD, the United States Federal Highway Administration and the European Union,were mentioned. It was explained that the project had incorporated newlyindependent countries. Lately, requests had been made to extend the networktowards some other members of the Commonwealth of Independent States as wellas the Caucasian countries.

23. The representatives of the TEM member countries present expressed theeffectiveness of cooperating under the project and reported on TEMdevelopments in each country. The wish was stated that this cooperation underTEM should continue with ECE as Executing Agency in the next phase of projectimplementation.

24. As a result of the ensuing discussion, the Principal Working Party notedthe progress made in the project and expressed the wish to continue to beinformed of developments.

HARMONIZATION OF REQUIREMENTS CONCERNING INTERNATIONAL ROADTRANSPORT AND ITS OPERATION

( a ) Implementation of the AETR Agreement

25. The Principal Working Party took note of the following information on thestatus of the AETR Agreement provided by the secretariat:

(a) Amendments to AETR proposed by the Government of Norway and adopted by theInland Transport Committee on its f i f ty-f if th session entered into force on28 February 1995; the text of these amendments is reproduced in documentE/ECE/811 -E/ECE/TRANS/564/Amend. 3 ;

(b ) In addition to those states mentioned in Annex - Appendix 2 to the amendedtext of AETR, the following States became Contracting Parties to the Agreement

Bulgaria on 12 May 1995Kazakhstan on 17 July 1995.

In accordance with the amended numbering rules set out in Annex - Appendix 2to AETR, the above-mentioned new Contracting Parties received thedistinguishing numbers 34 and 35 respectively.

26. The Principal Working Party took note of information contained in theabove-mentioned documents and of information provided during the sessionconcerning the modifications of the rules governing weights and dimensions ofroad vehicles in the Netherlands and the United Kingdom and also additionalinformation concerning the rules in force in Romania including tariffs forvehicles registered in other states and performing international roadtransport through the Romanian territory.

( c ) Consideration of the content of and the status of reservations to theConsolidated Resolution on the Facilitation of Road Transport ( R . E . 4 )

27. The Principal Working Party noted that no reservation to the ConsolidatedResolution R.E.4 had been withdrawn in the period between its previous andpresent sessions.

28. In accordance with the decision of the Inland Transport Committee, takenat its fifty-seventh session concerning the proposals for follow-up to theSecond Pan-European Transport Conference contained in document TRANS/R.401 andAdd.l (ECE/TRANS/111, para. 16), the Principal Working Party considered thereview of the Consolidated Resolution R.E.4 in the light of the new Pan-European transport context with a view to its updating and, possibly, itsdevelopment into a legal instrument. It recognized that a legally bindinginstrument on the facilitation of international road transport was needed.However, it felt that, due to the circumstances of the existence of manyreservations to the Consolidated Resolution. R . E . 4 , it would be ratherdifficult to reach agreement upon legally binding provisions in this field.

29. The Principal Working Party invited Governments to continue to considerwithdrawing reservations to Consolidated Resolution R.E.4 and decided tomaintain this item in the agenda for its next session.

(d) Consideration of possibilities for agreements and other measures onborder crossings and border facilities for road transport betweenEastern and Western Europe

30. The Principal Working Party took note of information on the recentsituation in international road transport between Eastern and Western Europecontained in the above-mentioned documents and provided during the session.It noted that no major improvement had been reached in this respect and that

considerable hindrances to the operation of international road transportbetween Eastern and Western Europe still existed, including those that arisefrom the procedure for obtaining visas for international drivers.

31. It requested Governments and international organizations concerned totransmit to the secretariat information about measures aimed at facilitatingthe operation of international road transport already applied, or to beapplied, and decided to consider such information at its next session.

32. The Principal Working Party welcomed the decision of the Working Party onCustoms Questions affecting Transport ( W P . 3 0 ) taken at its eighty-thirdsession to consider the possible facilitation of visa issuing at its nextsessions. It asked the Working Party WP.30 to take into account, inter alia,the proposals made by IRU concerning this subject (TRANS/SC. 1 /R.264) .

( e ) Revision of the Convention on the Contract for the InternationalCarriage of Passengers and Luggage by Road ( C V R )

Documentation; ECE/TRANS/2; TRANS/SC.1/R. 269 .

33. The Principal Working Party noted that, in accordance with article 34 ofthe CVR Convention, this Convention could be amended or revised three yearsafter it entered into force, i.e. not earlier than after 12 April 1997, andfor this purpose a conference should be convened by the Secretary-General atthe request of a Contracting Party to the Convention.

34. The representative of IRU introduced document TRANS/SC. 1/R. 269 which hadbeen prepared by his organization, containing draft amendments to the CVRConvention accompanied by the background information and the justification ofthe need for revising the Convention. He advocated Governments, which havenot yet done so, to consider the possibility of acceding to the CVRConvention.

35. The Working Party:

(i) Expressed its gratitude to IRU for preparing the above-mentioned document;

(ii) Invited its members to consider in detail, in consultationwith the competent bodies in their countries, documentTRANS/SC. 1/R. 269 and to transmit to the secretariat notlater than 1 April 1996 their comments on the proposedamendment contained therein and any other comments and/orproposals for amending the Convention that they recognizedas appropriate;

(iii) Requested the secretariat to set up until 15 July 1996 adocument comprising all comments and proposals received fromGovernments, to be considered by the Principal Working Partyat its next session;

(iv) Requested the secretariat to consider the questions of thelegal possibilities to amend the Convention in accordancewith article 34 and the rules for the adoption of amendmentsat the conference referred to in this article;

(v) Invited Contracting Parties to the Convention and other ECEGovernments which would accede to the Convention before1 May 1997 to inform the Principal Working Party about theirreadiness for the initiation of the amending proceduredescribed in article 34 of the Convention.

36. The Principal Working Party drew the Inland Transport Committee'sattention to the various aspects of the revision of the CVR Conventiondescribed above and asked the Committee to take a decision on this matter.

(f) Review of the situation and questions concerning facilitation ofinternational road transport

(i) International Motor Insurance System (Green Card)

Documentation; TRANS/SC. 1/R.270 and informal documents No. 2 and 3transmitted by the Council of Bureaux.

37. The Principal Working Party took note of the chart of the Inter-BureauxAgreements (TRANS/SC.1/R.270) and the report of the Council of Bureaux, asummary of which is contained in annex 2 to this report. It also encouragedGovernments, which have not yet done so, to take the necessary legal andadministrative measures so that their countries might meet the requirementsfor the inclusion in the Green Card system.

38. The Principal Working Party adopted the draft amendments to the GreenCard, a pattern of which is included in the Consolidated Resolution R.E.4(Annex 2, Appendix 1), proposed by the Council of Bureaux (informal documentNo. 2).

(i i) Accession to and implementation of UN/ECE internationallegal instruments on road transport

39. The Principal Working Party was informed about the present status of theaccession to UN/ECE international legal instruments on road transport.

41. The Principal Working Party shared the opinion of the ad hoc Meeting onImplementation of the AGR, expressed at its fourteenth session, that theWorking Party WP.l should possibly pay more attention to infrastructuralfactors of road traffic safety (TRANS/SC.I /AC.5/28, para .16) . It invited theWorking Party WP. l to consider the possibility of studying the influence ofinfrastructure standards and parameters on road traffic safety and ofsubmitting to the next session of the Principal Working Party a proposal forinclusion of the relevant items in the programme of work.

42. The usefulness of seminars on various aspects of road safety organized sofar by the Working Party WP. l was stressed during the discussion. ThePrincipal Working Party invited the Working Party to continue this form of itsactivity in the future.

ASSISTANCE TO COUNTRIES IN TRANSITION

43. The Principal Working Party noted that there had been no specific requestsfrom countries in transition addressed to this body for assisting in problemsrelated to road transport issues. Recalling the Commission's decision H (50)the Principal Working Party invited:

(i) Governments of countries in transition to submit to thePrincipal Working Party their respective proposals and theirassessment of priorities in this matter;

( i i) Other member Governments and international organizationsconcerned to inform the Principal Working Party about theirpossibilities of offering assistance to countries intransition.

44. The Principal Working Party took note of information provided by therepresentative of IRU about the 3rd IRU/SA East-West Road Haulage Conferenceon "International Logistics for Road Haulage in Central and Eastern Europe" tobe held in Stockholm on 22 and 23 February 1996.

47. The Principal Working Party invited its members to provide the secretariatwith documents and/or information, to be submitted to its next session, exceptthose concerning the CVR Convention (para . 35 above), as soon as possible butnot later than 15 July 1996.

48. Referring to the report of the Working Party on Road Traffic Safety on itsfifty-fifth session (TRANS/SC. 1/WP. 1/50, para. 19), the representative ofItaly informed the Principal Working Party that his delegation intended toprepare a document reflecting its position concerning the use of an advancewarning triangle to be submitted to the Working Party on Road Traffic Safety.

49. The Principal Working Party decided that no restriction should be placedon the circulation of documents issued for the current session.

Annex 2

SUMMARY OF THE REPORT OF THE COUNCIL OF BUREAUX

1. The Council has embarked upon the task of preparing statistics concerningaccidents arising under the ambit of the Green Card System which give rise tothird party claims for bodily injury and property damage. At the end of 1993the total vehicle population of the 37 countries of the Green Card System was225 ,291 ,000 . The number of recorded accidents in the same year which resultedin third party claims involved the opening of 275,750 files.

2. Amendments to the Green Card were approved at the Meeting of the GeneralAssembly in May 1995 (informal document No. 2). The amendments do not relateto the format of the document and are more on the lines of improvements withthe special purposes of providing clearer information to frontier officials.

3. In view of the maintenance of the UN sanctions against the Republic ofIraq, the membership of the Bureau of that country continues to be suspended.The Council is now considering the applications from Andorra, Bosnia-Herzegovina, Cyprus, Libya and the Republic of Moldova.

4. The Council is undertaking a study with special regard to the countries ofEastern Europe, where there is an increasing need to service traffic betweenthe East and West, concerning the possibility of providing Green Cards for thebenefit of motorists resident in countries which, at present, have noCompulsory Third Party Insurance Law.

5. In view of the apparent interest of many countries, both inside andoutside of Europe, to become involved in the Green Card System, considerationis currently being given to what in future should be the geographical scope ofthe System.

6. The implementation of a more extensive assistance to visitors of a motorvehicle accident in the country visited (as referred to in the report to thelast session of the Principal Working Party) was delayed for certain technicalreasons. A number of Bureaux have now signed agreements on a bilateral basisand others are in the process of doing so.

Description; In order to adapt the European road network to present andfuture requirements and to extend it to central Asian and Caucasian ECE memberStates the Principal Working Party on Road Transport (SC.l) will take suitableaction for implementing the Agreement and for amending as necessary itsprovisions with regard, in particular, to the structure and numbering of thenetwork (Annex I), applicable technical standards (Annex II) and userinformation and safety, as well as for taking into account traffic flowevolution.

Work to be undertaken:

(i) Periodic review of the structure of the E road network andconditions to which it should conform and adoption of necessaryamendments to annexes I and II of the Agreement. (Continuing)

(ii) Consideration of the AGR Agreement with a view to especially:

PARTICIPATION

1. Le Groups de travail principal des transports routiers a tenusa quatre-vingt-neuvieme session du 30 octobre au ler novembre 1995,sous la presidence de M. S. Schimming (Allemagne). Y ont participe desrepresentants des pays membres suivants : Allemagne, Autriche, Bulgarie,Croatie, Espagne, Federation de Russie, Finlande, France, Grece, Italie,Pays-Has, Norvege, Republique tcheque, Roumanie, Slovaquie, Suisse et Turquie.Les organisations intergouvernementales suivantes etaient representees :Conference europeenne des ministres des transports (CEMT) et Organisationinternationale de la circulation routiere ( I R T O ) . Les organisations nongouvernementales suivantes etaient aussi representees : Union internationaledes transports routiers ( IRU) , Federation internationale de1'automobile/Agence internationale de tourisme (FIA/AIT) et Conseil desBureaux.

DECLARATION LIMINAIRE

2. S'adressant aux participants, le Directeur de la Division des transportsa souligne la necessite d'intensifier la cooperation visant a faciliterdavantage le transport routier international tout en ameliorant la securiteet le respect de 1'environnement en Europe afin d'apporter une reponseappropriee a la demande croissante de ce type de transport, notamment dans lesens Est-Ouest. II a souligne 1'importance des instruments juridiques elaboresdans le cadre du Groupe de travail principal, invite ce dernier a tenir cesinstruments a jour conformement aux decisions adoptees par le Comite destransports interieurs en Janvier 1995 et fait rapport sur la contributiondu secretariat a la mise en oeuvre de ces decisions.

a ) Commission economique pour I'Europe

4. Le Groupe de travail principal a ete informe des resultats de lacinquantieme session de la Commission economique pour 1'Europe(3-11 avril 1995), notamment en ce qui concerne la decision H ( 5 0 ) surla cooperation dans le domaine des transports.

II a aussi pris note des travaux recents effectues par le Groupe detravail charge d 'examiner les tendances et 1'economie des transports ( W P . 5 )et le Groupe de travail des problemes douaniers interessant les transports( W P . 3 0 ) en ce qui concerne 1 ' infrastructure et 1'exploitation des transportsroutiers.

c ) Autres organisations internationales

7. Les representants de la Conference europeenne des ministres destransports (CEMT) et de 1'Union Internationale des transports routiers ( IRU)ont informe le Groupe de travail principal des travaux recents de leurorganisation dans le domaine du transport routier international.

8. Le Groupe de travail principal a pris note du rapport du representant de1'IRU sur les difficultes que connait le systeme de transit douanier TIR et deson appel en faveur du soutien aux mesures prises par 1'IRU a ce sujet. II aaussi pris note de ses observations relatives au traitement different reserveaux conducteurs nationaux et etrangers impliques dans une action juridique,et il a invite 1'IRU a etablir un document sur la question.

INFRASTRUCTURE ROUTIERE

a ) Accord europeen sur les qrandes routes de trafic international ( A G R )

9. Le Groupe de travail principal a ete informe que, depuis sa sessionprecedente, la Georgie et le Kazakhstan etaient devenus Parties contractantesa 1'AGR; que les amendements aux annexes I et II de 1'AGR adoptes parle Groupe de travail principal a sa quatre-vingt-huitieme session(TRANS/SC.1/355, annexe 1) avaient ete acceptes le 14 septembre 1995et qu'ils entreraient en vigueur le 14 decembre 1995.

10. Le Groupe de travail principal a pris note des travaux preparatoiresentrepris par les gouvernements interesses et le secretariat au sujet duprolongement eventuel du reseau de routes E vers les pays du Caucaseet d'Asie centrale et en particulier de 1'examen de cette question lorsdu seminaire sur les travaux de la GEE dans le domaine des transports,y compris les instruments juridiques, tenu a Geneve le 26 septembre 1995(document informel No 4 ) . Le representant de la Turquie a dit que les cartesdu document informel No 4 n'indiquaient pas toutes les liaisons routieresinternationales possibles dans la region etudiee. Pour 1'etablissementdefinitif du reseau de routes internationales, tous les pays interessesdevraient etre consultes et les resultats des diverses etudes deja effectueessur la question devraient etre pris en consideration.

11. Le Groups de travail a decide :

i) d'inviter les gouvernements des Etats de ces regions qui ne1'avaient pas encore fa i t a envisager la possibilite d 'adherera 1'AGR et a tirer pleinement parti des connaissances etcompetences des conseillers regionaux de la CEE;

ii) de demander au secretariat de poursuivre ses consultations avecles pays interesses en vue de 1' identification definitive desroutes importantes pour le trafic international qui pourraienteventuellement etre incorporees au reseau de routes E.

12. Le Groups de travail principal a souligne 1'importance des consultationsdirectes avec de nouveaux Etats membres de la CEE sur divsrs problemessuscites par leur participation aux travaux de la CEE, en cours d'Executionpar des conseillers regionaux. Il a invite le Comite des transports interieursa soutenir cette activite en adoptant les decisions voulues et, notamment, enencourageant la Commission a donner les moyens financiers necessaires a lapoursuite de 1'important travail des coriseillsrs regionaux.

13. Le Groups de travail principal a note qu'aucun progres n'avait eteenregistre dans la conclusion d 'accords sur 1'incorporation de certainesroutes d'Europe orientale au reseau ds routss E (une decision sur la questionavait ete reportee lors de la derniere session (TRANS/SC. 1/355, par. 9 a ) ) ,et ii a prie les Gouvernements du Belarus, de la Lettonie, de la Lituanie, dela Pologne et de la Federation de Russie d'etudier les amendements proposessur une base bilaterale ou, si possible, multilaterale et de communiquer ausecretariat des informations au sujet des faits nouveaux, a cet egard et/oudes propositions modifises, le cas echsant. Il a ete decide que ce pointserait retire ds 1'ordrs du jour si Iss renseignements voulus n'etaientpas communiques.

14. Conformement aux dispositions de 1.'article 8 de 1'Accord, le Groups detravail principal a adopte a 1'unanimite 1'amendement a 1'annexe I de 1'Accord(notes explicatives) propose lors de la quatorzieme session de la Reunionspeciale sur 1'application de 1'AGR a laquelle avaient participe les Partiescontractantes a 1'Accord suivantes : Croatie, Danemark, Fsdsration ds Russis,Finlande, Italie, Pologne, Portugal, Roumanie et Susds (TRANS/SC.I/AC.28,par. 7 ) . Le texts ds 1'amsndement propose figurs dans 1'annsxs 1 au prsssntrapport. Le Groups de travail principal a toutsfois considsre que Isprolongement ulterieur du reseau ds routes E susciterait peut-etre de nouvsauxproblemes de numsrotation. Ces problemes, de meme que la classification desroutss E, dsvraient done, si necsssaire, etrs a nouveau abordes dans 1'avenir.

15. Tenant compte des propositions formulees pendant la Reunion speciale(TRANS/SC. I/AC. 5/28, par. 8 et 9 ) , le Groups de travail principal a recommandeaux Parties contractantes a 1'AGR :

i) d'envisager chaque fois que possible le prolongement des routesexistantes orientees est-ouest plutot qu'introduire des routesportant dss numeros nouveaux afin d'eviter des difficultes dans lanumerotatiqn des routes E orientees est-ouest auxquelles risqueraitde donner lisu le prolongsment vsrs 1'est du reseau de routes E;

ii) de s ' e f forcer de f a i r e en sorte, chaque fois que possible, que lesnouvelles liaisons qu'elles proposent assurent la continuite dutraf ic international et soient raccordees au reseau existant deroutes E. Pour ce fa i re , elles devraient consulter les pays voisinset cooperer avec eux comme il convient.

16. Conformement a la decision prise par le Comite des transports interieursa sa cinquante-septieme session au sujet des propositions specifiques pour lesuivi de la deuxieme Conference paneuropeenne sur les transports contenuesdans les documents TRANS/R.401 et Add.l (ECE/TRANS/111, par. 16), le Groupe detravail principal a envisage la modification eventuelle des dispositions de1'AGR concernant les postes frontiere (annexe II de 1'AGR, par. IV. 7 . 4 ) , entenant compte des points de vue et des propositions formules lors de laReunion speciale sur 1'application de 1'AGR (TRANS/SC. I /AC.5/28, par. 12et 13). Il a estime que, compte tenu des difficultes financieres actuellesde 1'Organisation des Nations Unies, il serait preferable de demander a laReunion speciale d'etudier attentivement la possibilite de rendre plusstrictes les prescriptions de 1'AGR relatives aux postes frontiere plutot quede creer un nouveau groupe informel qui serait charge de cette tacheparticuliere.

17. Le Groupe de travail principal a pris note de la synthese de 1'inventairedes normes et parametres principaux du reseau de routes E elaboree par lesecretariat sur la base des donnees communiquees par les gouvernements(TRANS/SC.1/R.265 et A d d . l ) . Il a approuve les propositions faites lors dela Reunion speciale d'elargir eventuellement cet inventaire a 1'avenir par1'analyse du niveau de service sur la base de la comparaison entre lescaracteristiques geometriques des routes E et les volumes de trafic, enutilisant les donnees obtenues au c'ours du Recensement de la circulationautomobile sur les routes E, 1995. Il a egalement ete convenu que lesresu.ltats de cet inventaire seraient etudies attentivement par la Reunionspeciale en vue de rediger des conclusions concernant des mesures de suivi.

18. A cette f in, le Groupe de travail principal a decide de convoquer laReunion speciale en 1996 en vue d'etudier les questions evoquees auxparagraphes 16 et 17 ci-dessus ainsi que tous nouveaux amendements a 1'AGRqui pourraient etre presentes au secretariat dans 1'intervalle.

19. Le Groupe de travail principal a invite les gouvernements qui ne1'avaient pas encore fait a communiquer au secretariat dans les meilleursdelais des donnees sur les normes et parametres principaux des routes Eexistant sur leur territoire afin. de les incorporer a la synthese de1'inventaire des routes E.

20. Le Groupe de travail principal a aussi examine les observations duGouvernement autrichien concernant 1'itineraire de la route E 60 entre Worglet Salzbourg en territoires autrichien et allemand (TRANS/SC. 1 /R .267) .Le representant de 1'Allemagne a informe le Groupe de trava'il principal queson gouvernement proposait de definir comme suit ce trongon precis de laroute E 60 : Worgl - Rosenheim - Salzbourg (comme propose par 1'Autriche) etd'incorporer le troncon Worgl - St. Johann i.T. - Lofer - Salzbourg au reseaude routes E en tant que route E de la classe B. Le representant de 1'Autrichea indique que son gouvernement approuvait cette proposition.

21. Conformement aux dispositions de 1'article 8 de 1'Accord, le Groupede travail principal a adopte a 1'unar.imite les amendements a 1'annexe I de1'Accord mentionnes au paragraphe 20 ci-clessus, Le texte des amendementsproposes figure dans 1'annexe 1 au present rapport.

b) Prolet d 'autoroute transeuropernne Nord-Sud ( T E M )

22. Lors de la presentation du rapport interimaire, il a ete question de1'augmentation du nombre de membres, du statut du projet et des principalesactivites, y compris la cooperation, notamment avec 1'OCDE, la FederalHighway Administration des Etats-Unis et 1'Union europeenne. Le projet,a-t-on explique, avait incorpore de nouveaux Etats independents. Recemment,des requetes ont ete presentees en vue d'etendre les reseaux a certains autresmembres de la Communaute d'Etats independents, ainsi qu'aux Etats caucasiens.

23. Les representants des pays membres du TEM qui etaient presents ont faitetat de 1'efficacite de la cooperation dans le cadre de ce projet et faitrapport sur les developpements relatifs au TEM dans chaque pays. Ils ontsouhaite que cette cooperation se poursuive, la GEE restant 1'agentd'execution de la prochaine phase du projet.

24. Apres la discussion qui a suivi, le Groupe de travail principal a prisacte des progres realises dans 1'execution du projet et forme le voeu d'etretenu informe de son evolution.

HARMONISATION DES PRESCRIPTIONS APPLICABLES AUX OPERATIONS DE TRANSPORTINTERNATIONAL PAR ROUTE ET FACILITATION DE CES OPERATIONS

a) Mise en oeuvre de 1'AETR

25. Le Groupe de travail principal a pris note des informations suivantesfournies par le secretariat au sujet de 1'Accord AETR :

a) Les amendements a 1'AETR proposes par le Gouvernement de la Norvegeet adoptes par le Comite des transports interieurs a sa cinquante-cinquiemesession sont entres en vigueur le 28 fevrier 1995; le texte de ces amendementsest reproduit dans le document E/ECE/811-E/ECE/TRANS/564/Amend. 3;

b) En plus des Etats mentionnes a 1'annexe - appendice 2 au textetnodifie de 1'AETR, les Etats suivants sont devenus Parties contractantesa 1'Accord :

Le Groupe de travail principal a pris note des informations contenuesdans les documents susmentionnes et. de celles fournies au cours de la sessionquant aux modifications apportees aux. regies applicables aux poids etdimensions des vehicules routiers aux Pays-Bas et au Royaume-Uni, tout commedes renseignements complementaires sur les regies en vigueur en Roumanie,y compris les droits de douane spplicables aux vehicules immatricules dansd'autres pays et assurant des transports internationaux routiers via leterritoire roumain.

c) Examen du contenu et de 1'etat des reserves a la Resolution d'ensemblesur la facilitation des transports routiers ( R . E . 4 )

27. Le Groupe de travail principal a note qu'aucune reserve a la Resolutiond'ensemble R . E . 4 n 'avai t ete levee depuis la derniere session.

28. Conformement a la decision prise par le Comite des transports interieursa sa cinquante-septieme session au sujet des propositions relatives au suivide la deuxieme Conference paneuropeenne des transports contenues dans ledocument TRANS/R.401 et Add.l (ECE/TRANS/111, par . 16) , le Groupe de travailprincipal a aborde 1'examen de la Resolution d'ensemble R . E . 4 sous 1'angle dunouveau contexte paneuropeen des transports en vue de sa mise a jour et,eventuellement, d 'en faire un instrument juridique. II a reconnu la necessited 'un instrument juridiquement contraignant pour la facilitation des transportsinternationaux routiers. Toutefois, il a estime que du fait des nombreusesreserves emises quant a la Resolution d'ensemble R . E . 4 , il ne serait guereaise de convenir de dispositions juridiquement contraignantes dans ce domaine.

29. Le Groupe de travail principal a invite les gouvernements a continuerd'envisager de lever leurs reserves a la Resolution d'ensemble R . E . 4 et adecide de maintenir ce point a 1'ordre du jour de sa prochaine session.

d) Examen des possibilites d'accords ou d'autres mesures concernantle passage des frontieres et des postes frontiere dans le transportroutier entre 1'Europe orientale et 1'Europe occidentale

30. Le Groupe de travail principal a pris note des informations relatives a1'evolution recente de la situation des transports routiers internationauxentre 1'Europe orientale et 1'Europe occidentale contenues dans les documentssusmentionnes et donnees au cours de la session. Il n 'a note aucun progressensible, et la bonne marche des transports internationaux routiers entre

1'Europe orientale et 1'Europe occidentale continuait d 'etre considerablemententravee du fai t , entre autres, des procedures de delivrance des visas auxconducteurs professionnels.

31. II a prie les gouvernements et les organisations internationalesconcernes de transtnettre au secretariat des renseignements sur les mesuresappliquees ou envisagees pour faciliter les transports routiersinternationaux, pour examen a sa prochaine session.

32. Le Groups de travail principal s'est felicite de la decision du Groupede travail sur les questions douanieres affectant les transports ( W P . 3 0 ) , asa quatre-vingt-troisieme session, d'etudier a ses prochaines sessions, lapossibilite de faciliter la delivrance des visas. II a demands au Groupe detravail WP.30 de tenir compte, entre autres, des propositions faites par 1'IRUa ce sujet (TRANS/SC.1/R.264).

e) Revision de la Convention relative au contrat de transport internationalde voyaqeurs et de bagages par route (CVR)

33. Le Groupe de travail principal a note que, conformement a 1'article 34 dela Convention CVR, la Convention pouvait etre amendee ou revisee trois ansapres son entree en vigueur, autrement dit pas avant le 12 avril 1997, etqu'il fallait pour cela que le Secretaire general convoque une conferencea la demande d 'une Partie contractante.

34. Le representant de 1'IRU a presente le document TRANS/SC.1/R.269etabli par son organisation. II contient des projets d'amendement a laConvention CVR, exposant le contexte general et justifiant la necessitede reviser la Convention. Le representant de 1'IRU a invite les gouvernementsqui n'auraient pas encore adhere a la Convention CVR a envisager de le faire.

35. r.e Groupe de travail :

i) a exprime sa gratitude a 1'IRU pour avoir etabli le documentsusmentionne;

ii) a invite ses membres a examiner le document TRANS/SC. 1/R.269 endetail, en consultation avec les organes competents de leur pays,et a transtnettre au secretariat le ler avril 1996 au plus tardleurs-observations sur les projets d'amendement qu'il contient ettoutes autres observations et/ou propositions visant 1'amendementde la Convention qu'ils jugent appropriees;

iii) a prie le secretariat d'etablir -juscfu'au 15 luillet 1996 undocument regroupant toutes les observations et propositions reguesdes gouvernements, pour examen par le Groupe de travail principal asa prochaine session;

v) a invite les Parties contractantes a la Convention et lesgouvernements des pays de la CEE susceptibles d 'adherer a laConvention avant le ler mai 1997 d ' infor tner le Groupe de travailprincipal s'ils sont disposes a engager la procedure d'amendementdecrite a 1'article 34 de la Convention.

36. Le Groupe de travail principal a attire 1'attention du Comitedes transports interieurs sur les divers aspects de la revision de laConvention CVR decrits ci-dessus et a demande au Comite de prendre unedecision a ce sujet.

f ) Examen de la situation concernant la facilitation du transport routierinternational et des questions y relatives

37. Le Groupe de travail principal a pris note du diagramme des Accordsinterbureaux ( T R A N S / S C . l / R . 2 7 0 ) et du rapport du Conseil des Bureaux, dontun resume est presente a 1'annexe 2 du present rapport. II a aussi encourageles gouvernements qui ne 1'ont pas encore fait de prendre les mesuresjuridiques et administratives necessaires pour que leur pays rassembleles conditions d'adhesion au systeme de la Carte verte.

ASSISTANCE AUX PAYS EN TRANSITION

43. Le Groupe de travail principal a pris note qu'aucun pays en transition nelui avait adresse de requete specifique en vue de beneficier d'une assistancedans le reglement des problemes touchant au transport routier. Rappelant ladecision H (50) de la Commission, le Groupe de travail principal a invite :

i) Les gouvernements des pays en transition a soumettre au Groupe detravail principal leurs propositions et leurs priorites dans cedomaine;

ii) Les autres Etats membres et organisations internationalesconcernees a informer le Groupe de travail principal despossibilites qu'ils ont d'apporter une assistance aux paysen transition.

44. Le Groupe de travail principal a pris note des informations fournies parle representant de 1'IRU quant a la troisieme Conference de l'IRU/SA sur letransport routier est-ouest, consacree a la "Logistique Internationale dutransport routier en Europe centrale et orientals", qui doit se tenir aStockholm les 22 et 23 fevrier 1996.

RESUME DU RAPPORT DU CONSEIL DBS BUREAUX

1. Le Conseil a entrepris d'etablir des statistiques sur les accidents guientrant dans le champ d'application du systeme de la Carte verte et donnentlieu a une action de la part d'un tiers en cas de blessure corporelle ou dedommage materiel. Fin 1993, 1'ensemble du pare automobile des 37 pays partiesau systeme de la Carte verte totalisait 225 291 000 vehicules. Cette memeannee, les accidents ayant donne lieu a une demande de dommages-inter e~tsa 1'egard des tiers ont entraine 1'ouverture de 275 750 dossiers.

2. En mai 1995, la reunion de 1'Assemblee generale a approuve desmodifications a la Carte verte (document informel No 2). Elles ne portent passur son format mais ont plutot trait a 1'amelioration de certaines rubriques,dans le but expres de fournir des informations plus claires aux diverspersonnels en poste aux frontieres.

3. En raison du tnaintien des sanctions de 1'ONU centre la Republique d'Iraq,les membres du Bureau de ce pays restent suspendus. A 1'heure actuelle, leConseil est saisi des candidatures de 1'Andorre, de la Bosnie-Herzegovine,de Chypre, de la Libye et de la Republique de Moldova.

4. Le Conseil a entrepris une etude ou il s'attache particulierement auxpays d'Europe orientale, qui ont de plus en plus besoin d'assurer le servicede la circulation entre 1'Est et 1'Quest, quant a la possibilite de delivrerdes cartes vertes aux automobilistes residents de pays ou il n'existe pas, a .1'heure actuelle, de loi sur 1'assurance obligatoire a 1'egard des tiers.

5. Devant 1'interet manifeste par de nombreux pays, d'Europe ou non, ala participation au systeme de la Carte verte, on etudie actuellement ceque pourrait etre a 1'avenir le champ d'application geographique du systeme.

6. Pour un certain nombre de raisons d'ordre technique, la possibilite demieux venir en aide aux etrangers qui, de passage dans un pays, sont victimesd'accidents de la route (voir rapport sur la derniere session du Groupe detravail principal) connait quelque retard. Un certain nombre de Bureaux ontmaintenant signe des accords bilateraux et d'autres ont pris des dispositionspour le faire.
