SITUATION SUMMARY

1. BP has "misappropriated my disclosure" to WINK News (Naples, FL) of my innovative solution to clean up the Deep Horizon oil spill occurring April 20, 2010.

2. WINK News Naples, FL conducted a live interview of me, Mark Wayne, disclosing/demonstrating gypsum and how to apply it to cleanup an oil spill on salt water on April 22, 2010.

3. BP has been "unjustly enriched" by using this innovative way of using gypsum (calcium carbonate) and method of application to solve a massive problem quickly.

4. They were spared the worst case scenario.5. As a result, Florida's coastline, inlets, and estuaries

were not inundated with oil dispersant treated waters and/or oil polluted water.

DEMAND SUMMARY

1. I have been injured both by not being recognized as the inventor of this solution and not being paid for my innovation.

2. I approached Wink News in good faith and with honest American business ethics. We had a national emergency and BP asked for the public's help.

3. I am now petitioning BP for $25 million in damages and/or .04% of the cost of the 4 million tons of the gypsum used to contain the contaminated waters of the Gulf oil spill from the Deep Horizon oil spill.

4. I am proposing $75 million lawsuit based upon antitrust law due to the fact that Gypsum was the sole solution.

5. It has been almost three years and I have not been compensated!

Timeline and DetailsApril 20, 2010: Gulf Oil Spill is a full blown crisisApril 21, 2010: I contact Doug Ohlin, field reporter for Wink News of Naples/Fort Myers Florida and request that he review my solution for the spill. Doug agrees and is at my house later that same day. Doug makes a video of my innovative way to use USG gypsum and takes the video back to the office for analysis.April 22, 2010: Wink News calls me to arrange a live interview April 22, 2010: Interview airs on 6 o'clock news

* Suggest a thorough investigation into Wink News field reporter Doug Ohlin's supervisors and staff members to discover and determine where the "insider trading/plundering" begins. We anticipate discovery of suspicious trader activity relevant to the cover up.

Timeline and Details...April 25, 2010: I receive a call from Perry Tuttle, Chief Archaeologist at United States Gypsum. Mr. Tuttle has questions on how the gypsum works. They were having problems duplicating the results from my Wink News video---making it work.

Mr. Tuttle said they were waiting on the EPA to approve the usage of the gypsum/calcium carbonate.

Mr. Tuttle said he would be in contact again and set up a conference call with him and others at United States Gypsum. See exhibit #2

I later discovered BP used four million tons of gypsum/calcium carbonate to cleanup the oil spill. BP/Halliburton petitioned OMAG of Utah , see exhibit #4, for use and purchase of additional calcium carbonate. See exhibit #3 which shows BP/Halliburton's relationship to the Deep Horizon oil spill.

April 30, 2010: United States Gypsum stock jumped from $18.71 on April 20, 2010 to $24.76 on April 30, 2010 at a gain of $6.05 in seven days.

April 22-28, 2010: United States Gypsum CEOs selloff stock shares trading volume rockets 5 million shares on April 23 2010. See exhibit #5

Exhibit 3: Halliburton - Wikipedia, the free encyclopedia

On September 8, 2010, an internal report released by BP into the Deepwater Horizon Incident claimed that poor practices of Halliburton staff had contributed to the disaster. Investigations carried out by the National Commission on the BP Deepwater Horizon Oil Spill and Offshore Drilling found that Halliburton was jointly at fault along with BP and Transocean for the spill. The cement that Halliburton used was an unstable mixture, and eventually caused hydrocarbons to leak into the well, eventually causing the explosion that started the crisis.

ROBERT, La. -- As BP labored for a second day Thursday to choke off the leak at the bottom of the Gulf of Mexico, dire new government estimate… Read morePROVO -- A Utah County mining company could soon be shipping a locally mined, super-absorbent mineral to the Gulf of Mexico to soak up millions of gallons of spilling oil from BP's leaking offshore drilling rig.Provo's Ophir Minerals & Aggregate Group for some time has extracted a mineral it calls "K'sorb" out of its Payson mine. The mineral itself -- calcium carbonate -- is not unique to Utah, but the crystalline structure of the local stuff is unique, and allows the all-natural, flour-like material to soak up eight to 10 times its own weight in oil.Something on the order of four million tons of K'sorb would soak up the spilled oil in the Gulf, OMAG president Al McKee said, and could ship soon. High-ranking government officials both in Utah and Louisiana and Alabama are now working around the clock to clear all the necessary hoops it would take to ship the product en masse down to the Gulf, McKee said.County Commissioner Gary Anderson said they were approached to help speed up the process. After seeing the stuff in action in water brought back from the gulf, Anderson said they reached Gov. Gary Herbert (who is from Orem) who in turn sent them to the Department of Environmental Quality for more demonstration. He said they're trying to make sure McKee has all the proper permits as fast as possible."We're going to get government out of his way to make sure he can do to what he needs to do," Anderson said."That was our role, we saved the gulf," he said with a laugh.OMAG has used the material in-house to soak up small diesel spills that occur during salt mining at the Great Salt Lake -- the environmental complexity of which makes for the perfect ocean laboratory, McKee said -- but has never been marketed it as such. A few days ago McKee got a call from Houston-based energy giant Halliburton Co., with whom OMAG has developed products in the past, asking what kind of solutions for the Gulf spill he had in mind."They just said, 'At this point any input would be good input,' " McKee said.OMAG offered up K'sorb, which goes on dry on surface oil slicks, attaches to the oil and, once bloated with oil, sinks to the ocean floor."It doesn't allow it to hit the shore," McKee said. "The problem is the oil is down there in tar form at the bottom of ocean. But it biodegrades -- oil's natural, and seawater will break it up. This will keep it off the shoreline."OMAG shipped a few thousand pounds of K'sorb to Halliburton for lab testing, the results of which were positive; it's now shipping 1,200 tons more for site testing. Meanwhile, state officials are clearing the red tape as quickly as possible. The Utah County Commission got OMAG in front of state representatives of the Environmental Protection Agency and the Division of Air Quality within a day, McKee said.Even if the material turns out to be a miracle cure, it still has to go through proper safety tests. But K'sorb is all-natural, straight from the ground, so McKee is optimistic about the safety requirements."

Jason Chaffetz told McKee that OMAG would soon be presenting its materials to the same corresponding officials on the other side of the aisle. However, stock market evidence/CEOs' stock selloff indicates USG's unethical insider trading activity suggesting that USG provided American mined gypsum for the gulf cleanup as well as OMAG who was solicited by Halliburton/BP for additional gypsum. SEC issues statement concerning insider trading rules have been violated. USG stock soars six dollars in five days based on my WINK news broadcast.
