REVISED UNIFORM RULES ON ADMINISTRATIVE CASES IN THE CIVIL SERVICE  The Civil Service Commission, through Resolution No. 99-1936 dated August 31,1999. adopted the new “Uniform Rules in Administrative Cases in the Civil Service” which will govern the conduct of disciplinary and non-disciplinary proceedings in administrative cases brought before this Commission and/or other government agencies, except where special law provides otherwise,  The said resolution was published in the Manila Standard on September 11. 1999 and thus it will take effect on September 27, 1999. In this regard, all concerned are enjoined to follow strictly the said new Rules.  (Sgd.) CORAZON ALMA G. Title I, Subtitle (A), Book V of Administrative Code of 1987 (Executive Order No. 292) empowers the Civil Service Commission to prescribe, amend and enforce rules and regulations to effectively carry out its mandate;  Whereas, Section 12 (11), Chapter 3, Title I, Subtitle (A), Book V of the same Code provides, in part, that the Commission shall hear and decide administrative cases instituted by or brought before it directly or on appeal, including contested appointments, and review decisions and actions of its offices and of the agencies attached to it; and  Whereas, the existing rules and regulations in administrative cases need to be updated and revised to make them more responsive to the demands for speedy, fair and judicious disposition of cases;   NOW, THEREF ORE, the Commission hereby adopts and promulgates the following rules that shall govern disciplinary and non-disciplinary proceedings in administrative cases. RULE I GENERAL PROVISIONS Section 1. Title. - These Rules shall be known as the Uniform Rules on Administrative Cases in the Civil Service. Section 2. Coverage and Definition of Terms. - These Rules shall be applicable to all cases  brought before the Civil Service Commission and other government agencies, except where a special law provides otherwise. The terms hereunder shall be construed as follows: a. CIVIL SERVICE is the generic term which refers to all men and women in all branches, subdivisions, instrumentalities and agencies of the Government, including government-owned or controlled corporations with original charters.  b. COMMISSION refers to the Civil Service Commission (Central Office and Regional Offices). c. COMMISSION PROPER refers to the Civil Service Commission-Central Office. d. CIVIL SERVICE REGIONAL OFFICES refer to the sixteen (16) Civil Service Regional Offices and those which may be subsequently created, each headed by a Regional Director. e. DEPARTMENT refers to any of the executive departments or entities having the category of a department, including the judiciary and the other constitutional commissions, and offices.

RULE I

GENERAL ROVISIONS

Section 1. Title. - These Rules shall &e *non as the "ni#orm Rules on Administrative Cases in

the Civil Service.

Section +. Coverage and Definition of Terms.  - These Rules shall &e applica&le to all cases

the service.

*. ERSON COMLAINED OF re#ers to the person ho is the su&ect o# a complaint &ut ho

5irector and other o##icers o# e@uivalent ran*.

 p. RO&ATIONAR! EMLO!EE re#ers to the emplo%ee ho is issued an original

appointment and ho is re@uired to undergo the #irst si( /60 months o# service on a pro&ationar%

status.

Section 3. Technical Rules in Administrative Investigations. - Administrative investigations shall

 &e conducted ithout necessaril% adhering strictl% to the technical rules o# procedure and evidence

applica&le to udicial proceedings.

Section 7. Jurisdiction of the Civil Service Commission. - The Civil Service Commission shall

hear and decide administrative cases instituted &%, or &rought &e#ore it, directl% or on appeal,

including contested appointments, and shall revie decisions and actions o# its o##ices and o# the

agencies attached to it.

(cept as otherise provided &% the Constitution or &% la, the Civil Service Commission shall

have the #inal authorit% to pass upon the removal, separation and suspension o# all o##icers andemplo%ees in the civil service and upon all matters relating to the conduct, discipline and

e##icienc% o# such o##icers and emplo%ees.

Section B. Jurisdiction of the Civil Service Commission Proper. - The Civil Service Commission

roper shall have urisdiction over the #olloing cases?

Section 6. Jurisdiction of Civil Service Regional Offices. - The Civil Service Regional ##ices

shall have urisdiction over the #olloing cases?

1. Complaints initiated &%, or &rought &e#ore, the Civil Service Regional ##ices providedthat the alleged acts or omissions ere committed ithin the urisdiction o# the Regional

##ice, including Civil Service e(amination anomalies or irregularities and the persons

complained o# are emplo%ees o# agencies, local or national, ithin said geographical

areas;

+. Complaints involving Civil Service Regional ##ice personnel ho are appointees o#

said o##ice; and

3. etitions to place respondent under reventive Suspension.

&. Non"Dis'i(lin)*+

1. 5isapproval o# appointments &rought &e#ore it on appeal;

+. rotests against the appointments o# #irst and second level emplo%ees &rought &e#ore itdirectl% or on appeal;

3. 5ecisions o# national agencies and local government units ithin their geographical

 &oundaries relative to personnel actions and non-disciplinar% cases &rought &e#ore it on

appeal; and

7. Re@uests #or accreditation o# services and corrections o# personal in#ormation in therecords o# the Commission.

Section . Jurisdiction of Heads of Agencies. - =eads o# 5epartments, agencies, provinces, cities,

municipalities and other instrumentalities shall have original concurrent urisdiction, ith the

Commission, over their respective o##icers and emplo%ees.

original concurrent urisdiction ith the Civil Service Regional ##ice concerned; and

+. Complaints on personnel actions and other non-disciplinar% actions o# their respective

 personnel.

RULE II

DISCILINAR! CASES

Section :. Complaint. - A complaint against a civil service o##icial or emplo%ee shall not &e given

due course unless it is in riting and su&scri&ed and sorn to &% the complainant. =oever, in

cases initiated &% the proper disciplining authorit%, the complaint need not &e under oath.

 No anon%mous complaint shall &e entertained unless there is o&vious truth or merit to the

allegations therein or supported &% documentar% or direct evidence, in hich case the person

complained o# ma% &e re@uired to comment.

The complaint should &e ritten in a clear, simple and concise language and in a s%stematic

manner as to apprise the civil servant concerned o# the nature and cause o# the accusation against

him and to ena&le him to intelligentl% prepare his de#ense or anser.

The complaint shall contain the #olloing?

a.. #ull name and address o# the complainant;

 &. #ull name and address o# the person complained o# as ell as his position and o##ice o#

emplo%ment;

c. a narration o# the relevant and material #acts hich shos the acts or omissions allegedl%

committed &% the civil servant;

d. certi#ied true copies o# documentar% evidence and a##idavits o# his itnesses, i# an%; and

e. certi#ication or statement o# non-#orum shopping.

n the a&sence o# an% one o# the a#orementioned re@uirements, the complaint shall &e dismissed.

Section 9. hen and here to !ile a Complaint. - (cept hen otherise provided #or &% la,

an administrative complaint ma% &e #iled at an%time ith the Commission, proper heads o#departments, agencies, provinces, cities, municipalities and other instrumentalities.

Section 1D. ithdra"al of the Complaint. - The ithdraal o# the complaint does not result in its

outright dismissal nor discharge the person complained o# #rom an% administrative lia&ilit%. <here

there is o&vious truth or merit to the allegation in the complaint or here there is documentar%

evidence that ould tend to prove the guilt o# the person complained o#, the same should &e given

due course.

Section 11. Action on the Complaint. - "pon receipt o# a complaint hich is su##icient in #orm

and su&stance, the disciplining authorit% shall re@uire the person complained o# to su&mit a

Counter-A##idavit'Comment under oath ithin three /30 da%s #rom receipt.

Section 1+. Preliminar# Investigation.  - A reliminar% nvestigation involves the e parte

e(amination o# records and documents su&mitted &% the complainant and the person complained

o#, as ell as documents readil% availa&le #rom other government o##ices. 5uring said

investigation, the parties are given the opportunit% to su&mit a##idavits and counter-a##idavits.

>ailure o# the person complained o# to su&mit his counter a##idavit shall &e considered as a aiver

thereo#.

Therea#ter, i# necessar%, the parties ma% &e summoned to a con#erence here the investigator ma%

 propound clari#icator% and other relevant @uestions.

"pon receipt o# the counter-a##idavit or comment under oath, the disciplining authorit% ma% nodetermine hether a prima #acie case e(ist to arrant the issuance o# a #ormal charge.

A #act-#inding investigation ma% &e conducted #urther or prior to the preliminar% investigation #or

the purpose o# ascertaining the truth. A preliminar% investigation necessaril% includes a #act-

#inding investigation.

>or this purpose, preliminar% investigation ma% &e entrusted &% the Commission to la%ers o#

other agencies pursuant to Section 9.

Section 13. Duration of the Investigation. - A preliminar% investigation shall commence not later

than #ive /B0 da%s #rom receipt o# the complaint &% the disciplining authorit% and shall &e

terminated ithin thirt% /3D0 da%s therea#ter.

Section 17. Investigation Report. - <ithin #ive /B0 da%s #rom the termination o# the preliminar%

investigation, the investigating o##icer shall su&mit the nvestigation Report and the complete

records o# the case to the disciplining authorit%.

Section 1B. Decision or Resolution After Preliminar# Investigation.  - # a prima #acie case is

esta&lished during the investigation, a #ormal charge shall &e issued &% the disciplining authorit% A

#ormal investigation shall #ollo.

n the a&sence o# a prima #acie case, the complaint shall &e dismissed.

Section 16. !ormal Charge. - A#ter a #inding o# a prima #acie case, the disciplining authorit% shall

#ormall% charge the person complained o#. The #ormal charge shall contain a speci#ication o#

charge/s0, a &rie# statement o# material or relevant #acts, accompanied &% certi#ied true copies o#

the documentar% evidence, i# an%, sorn statements covering the testimon% o# itnesses, a

directive to anser the charge/s0 in riting under oath in not less than sevent%-to /+0 hours

#rom receipt thereo#, an advice #or the respondent to indicate in his anser hether or not he

elects a #ormal investigation o# the charge/s0, and a notice that he is entitled to &e assisted &% a

counsel o# his choice.

# the respondent has su&mitted his comment and counter-a##idavits during the preliminar%investigation, he shall &e given the opportunit% to su&mit additional evidence.

The disciplining authorit% shall not entertain re@uests #or clari#ication, &ills o# particulars or

motions to dismiss hich are o&viousl% designed to dela% the administrative proceedings. # an% o#

these pleadings are interposed &% the respondent, the same shall &e considered as an anser and

shall &e evaluated as such.

Section 1. Ans"er. - The anser, hich is in riting and under oath, shall &e speci#ic and shall

contain material #acts and applica&le las, i# an%, including documentar% evidence, sorn

statements covering testimonies o# itnesses, i# there &e an%, in support o# his case. t shall also

include a statement indicating hether or not he elects a #ormal investigation.

Section 1:. !ailure to !ile an Ans"er. - # the respondent #ails or re#uses to #ile his anser to the

#ormal charge ithin #ive /B0 da%s #rom receipt thereo#, he shall &e considered to have aived hisright thereto and #ormal investigation ma% commence.

Section 19. Preventive Suspension.  - "pon petition o# the complainant or !otu proprio, the

 proper disciplining authorit% ma% issue an order o# preventive suspension upon service o# the

authorit% pending an investigation, i# the charge involves?

a. dishonest%;

 &. oppression;

c. grave misconduct;

d. neglect in the per#ormance o# dut%; or 

e. i# there are reasons to &elieve that the respondent is guilt% o# charges hich ould arrant hisremoval #rom the service.

An order o# preventive suspension ma% &e issued to temporaril% remove the respondent #rom the

scene o# his mis#easance or mal#easance and to preclude the possi&ilit% o# e(erting undue

in#luence or pressure on the itnesses against him or tampering o# documentar% evidence on #ile

ith his ##ice.

n lieu o# preventive suspension, #or the same purpose, the proper disciplining authorit% or head o#o##ice, ma% reassign respondent to another unit o# the agenc% during the #ormal hearings.

Section +D. Duration of Preventive Suspension. - <hen the administrative case against an o##icer

or emplo%ee under preventive suspension is not #inall% decided &% the disciplining authorit%

ithin the period o# ninet% /9D0 da%s a#ter the date o# his preventive suspension, unless otherise

 provided &% special la, he shall &e automaticall% reinstated in the service; provided that, hen

the dela% in the disposition o# the case is due to the #ault, negligence or petition o# the respondent,the period o# dela% should not &e included in the counting o# the 9D calendar da%s period o#

 preventive suspension. rovided #urther that should the respondent &e on )aternit%'aternit%

leave, said preventive suspension shall &e de#erred or interrupted until such time that said leave

has &een #ull% eno%ed.

Section +1. Remedies from the Order of Preventive Suspension.  - The respondent ma% #ile a

motion #or reconsideration ith the disciplining authorit% or ma% elevate the same to the Civil

Service Commission &% a% o# an appeal ithin #i#teen /1B0 da%s #rom receipt thereo#.

Section ++. Conduct of !ormal Investigation.  - Although the respondent does not re@uest a

#ormal investigation, one shall nevertheless &e conducted &% the disciplining authorit% here #rom

the allegations o# the complaint and the anser o# the respondent, including the supporting

documents o# &oth parties, the merits o# the case cannot &e decided udiciousl% ithout conducting

such investigation. The investigation shall &e held not earlier than #ive /B0 da%s nor later than ten

/1D0 da%s #rom receipt o# the respondentEs anser. Said investigation shall &e #inished ithin thirt%

/3D0 da%s #rom the issuance o# the #ormal charge or the receipt o# the anser unless the period ise(tended &% the disciplining authorit% in meritorious cases.

agencies pursuant to Section 9.

Section +3. Pro$Hearing Conference. - At the commencement o# the #ormal investigation, the

=earing ##icer ma% conduct a pre-hearing con#erence #or the parties to appear, consider and

agree on an% o# the #olloing?

a. Stipulation o# #acts;

 &. Simpli#ication o# issues;

c. denti#ication and mar*ing o# evidence o# the parties;

d. <aiver o# o&ections to admissi&ilit% o# evidence;

e. imiting the num&er o# itnesses, and their names;

Section +7. Continuous Hearing %ntil Terminated& Postponement. - =earings shall &e conducted

on the hearing dates set &% the =earing ##icer or as agreed upon during the pre-hearing

con#erence.

<here no pre-hearing con#erence is conducted, the parties, their counsel and itnesses, i# an%,

shall &e given a notice o# at least #ive /B0 da%s &e#ore the #irst scheduled hearing speci#%ing the

time, date and place o# the said hearing and su&se@uent hearings. Therea#ter, the schedule o#

hearings previousl% set shall &e strictl% #olloed ithout #urther notice. A part% shall &e granted

onl% three /30 postponements upon oral or ritten re@uests. A #ourth postponement ma% &e

granted onl% upon ritten re@uest and su&ect to the discretion o# the disciplining authorit%.

# the respondent #ails or re#uses to appear during the scheduled hearings despite due notice, the

investigation shall proceed e( parte and the respondent is deemed to have aived his right to &e present and to su&mit evidence in his #avor during those hearings.

Section +B. Preliminar# 'atters. - At the start o# the hearing, the hearing o##icer shall note the

appearances o# the parties and shall proceed ith the reception o# evidence #or the complainant.

# the respondent appears ithout the aid o# a counsel, he shall &e deemed to have aived his right

thereto.

8e#ore ta*ing the testimon% o# a itness, the hearing o##icer shall place him under oath and then

ta*e his name, address, civil status, age, and place o# emplo%ment.

A sorn statement o# a itness/es0 properl% identi#ied and a##irmed shall constitute his directtestimon%, cop% #urnished the other part%.

Section +6. Appearance of Counsel. - An% counsel appearing &e#ore an% hearing or investigation

shall mani#est orall% or in riting, his appearance #or either the respondent or complainant, stating

Section B6. Duration and effect of administrative penalties. - The #olloing rules shall govern in

d. The penalt% o# suspension shall result in the temporar% cessation o# or* #or a period not

e(ceeding one /10 %ear.

Suspension o# one da% or more shall &e considered a gap in the continuit% o# service. 5uring the

 period o# suspension, respondent shall not &e entitled to all mone% &ene#its including leave credits.

e. The penalt% o# #ine shall &e in an amount not e(ceeding si( /60 months salar% o# respondent.The computation thereo# shall &e &ased on the salar% rate o# the respondent hen the decision

Section B9. -ffect of -2oneration on Certain Penalties.

a. n case the penalt% imposed is a #ine, the same shall &e re#unded.

 &. n case the penalt% imposed is demotion, the e(onerated emplo%ee shall &e restored to his

#ormer position ithout loss o# seniorit% rights ith pa%ment o# salar% di##erentials.

c. n case the penalt% imposed is trans#er, he shall immediatel% &e restored to his #ormer post

unless he decides otherise. n case there is demotion in ran*, salar% or status, he shall &e restored

to his #ormer ran*, salar% or status.

d. n case the penalt% imposed s suspension, he shall immediatel% &e reinstated to his #ormer post

ithout loss o# seniorit% rights ith pa%ment o# &ac* salaries.

e. n case the penalt% imposed is dismissal, he shall immediatel% &e reinstated ithout loss o#

seniorit% rights ith pa%ment o# &ac* salaries.

RULE V

NON"DISCILINAR! CASES

A. ROTEST

Section 6D. ho ma# !ile a Protest and here to !ile. - A @uali#ied ne(t-in-ran* emplo%ee ma%

#ile a protest ith the appointing authorit% or ith the Civil Service Regional ##ice against anappointment made in #avor o# another ho does not possess the minimum @uali#ication

re@uirements.

=oever, an% protest against appointments to third level position shall &e #iled ith the

Commission roper.

Section 61. !orm and Content of Protest. - The protest shall &e su&scri&ed and sorn to and

ritten in clear, une@uivocal and concise language. t shall contain the #olloing?

a. the position &eing contested, including its item num&er, correct position title and the salar% per

annum;

 &. the #ull name, o##ice, position and salar% per annum o# &oth the protestant and the protestee;

c. the #acts and arguments constituting the grounds #or the protest; and

d. proo# o# pa%ment o# a #iling #ee o# Three =undred esos /3DD.DD0.

Section 6+. hen to !ile a Protest. - The protest ma% &e #iled ithin #i#teen /1B0 da%s #rom theissuance o# the appointment or promotion. n cases here the protest is #iled ith the Commission,

the protestant shall #urnish the appointing authorit%, a cop% o# his protest and su&mit proo# o#

service thereo#.

>or this purpose, all appointments or promotions shall &e dul% announced and'or posted in &ulletin

 &oards or at conspicuous places in the 5epartment or Agenc%.

Section 63. -ffect of Protest on the Appointment. - A protest shall not render an appointmentine##ective nor stop the approval thereo#, &% the Civil Service >ield or Regional ##ice, &ut the

approval shall &e su&ect to the #inal outcome o# the protest.

Section 67. -ffect of ithdra"al of Protest.  - A protest or an appeal in this case ma% &e

ithdran at an% time as a matter o# right. The ithdraal o# the protest or appeal shall terminate

the protest case.

Section 6B. hen Protest is Deemed !iled. - A protest is deemed #iled, in case the same is sent &%mail, on the postmar* date on the envelope hich shall &e attached to the records o# the case, and

in case o# personal deliver%, on the date stamped &% the agenc% or the Commission.

Section 66. Transmittal of Records. - n cases here the protest is #iled ith the Commission, the

head o# department or agenc% shall #orard his comment and the records o# the case ithin ten

/1D0 da%s #rom receipt o# the cop% o# the protest. The records shall &e s%stematicall% and

chronologicall% arranged, paged and securel% &ound to prevent loss and shall include the

#olloing?

a. Statement o# 5uties or Ho& description o# the contested position;

 &. 5ul% accomplished and updated personal data sheets o# the parties ith certi#ied statement o#

service records attached;

c. Certi#ied cop% o# the protested appointment; and

d. Comparative assessment o# the @uali#ications o# the protestant and protestee.

Section 6. Dismissal of Protest. - A protest shall &e dismissed on an% o# the #olloing grounds?

Section 6:. !inalit# of Decision. - 5ecision on a protest case shall &ecome #inal a#ter #i#teen /1B0

da%s #rom receipt thereo#.

Section 69. Availa(le Remedies.

a. The decision o# the regional o##ice or &ureau ma% &e appealed initiall% to the 5epartment

Secretar% then to the Civil Service Regional ##ice ithin #i#teen /1B0 da%s and #inall% to the

Commission roper. in cases here the protest is #iled ithin the department or agenc%, the

 protestant ma% #ile a motion #or reconsideration o# the adverse decision, ruling or action ithin

#i#teen /1B0 da%s #rom receipt ith the same agenc%.

 &. n cases here the protest is #iled ith the Civil Service Regional ##ice, a motion #orreconsideration ma% &e #iled ith the same o##ice ithin #i#teen /1B0 da%s #rom the receipt o# the

adverse decision then to the Commission roper ithin the same period.

The protestant shall #urnish a cop% o# his protest to the head o# agenc% concerned ho shall su&mit

his comment to the Civil Service Regional ##ice ithin ten /1D0 da%s.

Section D. -ffect of Decision.  - n case the protest is #inall% decided against the protestee, the

approval o# his appointment shall &e recalled and the appointment shall &e considereddisapproved. The protestee shall &e reverted to his #ormer position, i# applica&le.

&. OTHER ERSONNEL )n, NON"DISCILINAR! ACTIONS

Section 1. Complaint or Appeal to the Commission. - ther personnel actions, such as, &ut not

limited to, separation #rom the service due to unsatis#actor% conduct or ant o# capacit% during pro&ationar% period, dropping #rom the rolls due to A&sence <ithout ##icial eave /A<0,

 ph%sicall% and mentall% un#it, and unsatis#actor% or poor per#ormance, action on appointments

/disapproval, invalidation, recall, and revocation0, reassignment, trans#er, detail, secondment,demotion, or termination o# services, ma% &e &rought to the Commission, &% a% o# an appeal.

Section +. hen and here to !ile.- A decision or ruling o# a department or agenc% ma% &e

appealed ithin #i#teen /1B0 da%s #rom receipt thereo# &% the part% adversel% a##ected to the Civil

Service Regional ##ice and #inall%, to the Commission roper ithin the same period.

A motion #or reconsideration ma% &e #iled ith the same o##ice hich rendered the decision or

Section 3. Re+uirement of !iling.- The appellant shall #urnish a cop% o# his appeal to the head o#

department or agenc% concerned ho shall su&mit his comment, together ith the records, to the

Commission ithin ten /1D0 da%s #rom receipt thereo#. roo# o# service o# the appeal on the head

o# department o# agenc% shall &e su&mitted ith the Commission.

Section 7. rounds for Dismissal.  -An appeal involving non-disciplinar% cases shall &e

Section :1. Implementation of !inal Decisions. - The Civil Service Regional ##ices /CSRs0

shall monitor the immediate implementation o# these decisions.

Section :+. -ffect of Pendenc# of Petition for Revie"3Certiorari "ith the Court. - The #iling and

 pendenc% o# a petition #or revie ith the Court o# Appeals or certiorari ith the Supreme Court

shall not stop the e(ecution o# the #inal decision o# the Commission unless the Court issues a

restraining order or an inunction.

Section :3. 5on$e2ecution of Decision. - An% o##icer or emplo%ee ho ill#ull% re#uses or #ails to

implement the #inal resolution, decision, order or ruling o# the Commission to the preudice o# the

 pu&lic service and the a##ected part%, ma% &e cited in contempt o# the Commission and

administrativel% charged ith conduct preudicial to the &est interest o# the service or neglect o#

dut%.

Section :7. Computation of Period. - n computing an% period o# time prescri&ed &% these Rules,the #irst da% shall &e e(cluded and the last da% included unless it &e a Saturda% a Sunda% or a legalholida%, in hich case the period shall run until the end o# the ne(t or*ing da% hich is neither a

Saturda%, a Sunda% nor a legal holida%.

Copies o# decisions and other communications shall &e served on counsel &ut receipt &% either

counsel or part% shall &e deemed to &e a valid service. The period to per#ect a motion #or

reconsideration or an appeal shall &e rec*oned #rom the date o# receipt o# counsel or part%,

hichever is later.
