II STATUTE ( GENERAL PROVISIONS ) I. Name

The official name of the Games is “ KL’09, 5th ASEAN Para Games Kuala Lumpur 2009.

II. Host and Organizer.

The host of the Games is Kuala Lumpur, Malaysia. The organizing Committee is called the “Kuala Lumpur ASEAN Para Games Organizing Committee “or referred to as KLAPGOC.

III. Objectives

The objectives of the 5th ASEAN Para Games are:

1. Complete acceptance and rights of equality for person and athletes with disabilities in the society.

2. Lay a foundation for the development of sports and recreation for persons with disabilities.

3. Encourage the disabled in their determination for rehabilitation and to contribute to the improvement or social perspective towards the disabled.

4. To contribute, on an international level to the mutual friendship and cooperation among the disabled.

IV. Theme “ASEAN MOVING TOGETHER” is the theme of the Games. V. Competition Period

The KL’09, 5th ASEAN Para Games will be held from 15th to 19th August 2009. VI. Competition Venues

Competitions will be held in Kuala Lumpur, Malaysia and specifically, the venues are as listed in the table below:

VII. Sports

There will be eleven (11) sports offered as shown in the table 6. VIII. Qualifications for Participating in the Competition

1. Participating countries or territories must be official members of the ASEAN Para Sports Federation (APSF)

2. Non-member countries or territories may participate after their applications are

approved by the Executive Committee of the ASEAN Para Sports Federation (APSF).

3. The participating athletes must be citizens of the same country or territories as

their delegation. They must also meet the requirements as prescribed in the APSF Handbook.

IX. Rules for Participating in the Competition

1. It is encouraged to try to include thirty percents (30%) or more novice competitors who are competing in the ASEAN Para Games for the first time in each delegation.

2. The ratio between the number of officials ( including Chef De Mission, doctors,

coaches and accompanying persons ) and competitors must be less then or equal to 1:3. However, exception would be given in cases involving guide runner for the blinds (T11).

3. The entry fee for each delegation member including officials, coaches and

competitors will be USD470 (Capitation fee included). Extra officials will be charged USD800 each. Ten percent (10%) of the entry fee must be paid when returning the second entry Form. The balance of the amount must be paid when returning the final entry form.

4. The entry procedures are as follows:

4.1 First Entry Form ( Preliminary ).

The First (Preliminary) Entry Form will be sent out all ASEAN member organizations on 15th February 2009. Each delegation must fill up the reply form indicating its intention in participating in the 5th ASEAN Para Games. They must also indicate the expected sports and number of competitors and staff that will be participating in the 5th ASEAN Para Games and this entry must be returned to Secretariat before or on 15th March, 2009.

4.2 Second Entry Form ( Entry by number ).

The Second Entry Form will be sent out to all member countries and territories that have indicated their willingness to participate in the 5th ASEAN Para Games on the 28th February, 2009. Each delegation must notify the number of competitors that will participate in each event to Games Secretariat and this entry must be returned to Games Secretariat before or on 15th April, 2009.

4.3 Final Entry Form ( Entry by name ).

The Final Entry Form ( Entry by name ) will be sent out on 20th April, 2009. This entry must be returned to Games Secretariat before or on 15th June, 2009.

X. Inclusion of Sports

At least four (4) countries must participate in order to include any sports in the Games: 1. Intellectually Disabled Participation: The Intellectually Disabled Athletes (ClassT/F 20 and S14) can participate in

Athletic and Swimming event only. The I.D. athletes must bring Classification Card or medical report as proof for Classification purpose.

XI. Rules for Participating in the Competition Events

1. Team Events.

Each delegation can only field one (1) male and one (1) female in each team event.

2. Individual Events.

2.1 Each delegation can fields up to three (3) competitors in each event under an individual discipline.

2.2 Each competitor is allowed to participate in no more than three (3)

events in one (1) sport

2.3 In addition to the above, each competitor is allowed to compete in 2 relays in Athletics and Swimming.

3. Age

Participating competitors must be 15 years old on or before 31st December, 2009.

XII. Cancellation of Events

1. Event shall not be implemented unless a minimum of four (4) entries are received.

2. Participating delegations shall notify Secretariat for any cancellation of entries

after the final entries and before the beginning of classification. 3. When entries become less than four (4) due to cancellation of entry after the

sports programmed has been finalized, the sports events can be implemented even with one (1) participant.

XIII. Registration

Accreditation Cards and Classification Issuance will take place in Kuala Lumpur between 15th July to 11th August, 2009 and for the convenience of delegations, prior issuing of Accreditations Cards will be reviewed. Each delegation must inform Secretariat thirty (30) days in advance of arrival date, time and flight number and Games Secretariat must be notified of changes to flight schedule at least three (3) days before arrival.

XIV. Methods of Competition

1. Competition Rule.

The latest competition rules promulgated by IPC sport / International Sports Federation (ISF) shall be applied to the Games. (Amendments will be applied when all participating delegations have been notified).

2. Competition forms.

2.1 Team events : 1. Competition will proceed in one or more round robin series.

2.2 Individual events :

2. Competition will be conducted in accordance with the competition rules of each discipline / sport. In the case of disputes the organizing committee makes the final decision.

2.3 Grouping will be decided by organizing committee.

3. Classification appraisal must be examined and approved by the APSF Sports

Medicine and Science Committee before the competitors are allowed to join in the competition.

4. If there is only one (1) competitor left in an event due to a decision by

Classification Sub-Committee, the competitor may choose any of the following two (2) options a day before the competition.

4.1 Participate in another event.

4.2 Participate in a competition designed for competitors with less serious disabilities that is in a class higher in order, in the same event with the approval of the Sports Medicine and Science Committee.

5. After the Classification Sub-Committee readjusts the classification of a

competitor after examining their original appraisal, and the competitor is put in a class where there is no planned event, no new event will be introduced.

6. If there is only one (1) competitor left in an event due to a decision by

Classification Sub-Committee, and options mentioned in point 4 are not valid, the competitor shall undergo the event by oneself and the score of the competitor will be recorded, but the participating competitor will only receive a commemorative medal. To receive a gold medal and contribute to the medal tally, the competitor must break the ASEAN Para Games record.

7. Any athlete may be required to undergo doping control (test). 8. Appeals against ruling in competition and classification shall be filed in written

format and shall be handled according to relevant competition rules and the protest fee will be USD 100.

XV. Places and Award

1. Places.

1.1 For each team events and individual events, only top three (3) places will be recognized.

1.2 After registration, if there are less then four (4) teams or four (4)

competitors ( that is, only three (3) teams or competitors ) participating in a event, only top two (2) places will be recognized. When there are two (2) teams or two (2) competitors competing, only the top place will be recognized.

1.3 The policy for medal tally will be Minus One System.

2. Award.

Winners of top three (3) places in each event will receive gold, silver and bronze medal respectively. In team events, top three (3) placed teams will receive gold, silver and bronze medals respectively, according to the number of participating competitors in each team.

XVI. Umpire and Jury of Appeal.

1. A jury of appeal for each of each sport shall be formed. 2. Referees and judges of the Games will compose of accompanying referees

and judges of participating delegations and invited referees and judges. 3. Each delegation must bring accompanying referees and judges where specified

in the respective sport rules. 4. Organizing Committee can appoint judges for team events.

XVII. Arrival and Departure. All participating delegations shall arrive on 12th August, 2009 and depart by 20th August, 2009.

III. HOST COUNTRY INFORMATIONS

1.1 Located between 2 and 7 degrees north of the Equator, Peninsula Malaysia is separated from the states of Sabah and Sarawak by the South China Sea.

1.2 To the north of Peninsula Malaysia is Thailand while its southern neighbour is

Singapore. Sabah and Sarawak are bounded by Indonesia while Sarawak also shares a border with Brunei.

2. Area, Population & Capital City

AREA : 329,758 sq km. POPULATION : 22 million. CAPITAL CITY : Kuala Lumpur.

3. People & Culture

3.1 Malaysia has a combined population of over 22 million people. Because of its central location, between the Indian Ocean and the South China Sea, Malaysia has traditionally been a meeting point for traders and travelers from both the East and West.

3.2 As a result, Malaysia has a multicultural and multiracial population consisting of

Malays, Chinese, Indians and numerous indigenous peoples.

3.3 Although Malay is the official language, English is widely spoken, especially in business, and the English language is a compulsory subject in all schools.

3.4 With such a varying ethnic composition, it is no surprise that a great

diversity of religions is prevalent throughout Malaysia.

3.5 Although the official religion is Islam, freedom of worship is practiced. 3.6 As a result, it is a common to see temples, mosques and churches within the

same area. 4. Ethnic Groups

Malay and other indigenous : 59% Chinese : 32% Indian : 9%

5. Languages

Official Language : Malay (Bahasa Melayu) Second Language : English Chinese Languages : Mandarin, Cantonese, Hakka, Hokkien, etc. Indian Languages : Tamil, Telegu, Hindi, Malayalam, etc.

Tribal Languages : Iban, Kayan, Kenyah, Bidayuh, Kadazan etc. 6. Religions

6.1 Islam is the official religion but all other religions are practised freely. Muslim (primarily Malays), Buddhism (Chinese), Hindu (Indian) Christianity, Confucianism, Taoism and tribal religions.

7 Climate 7.1 Tropical climate with warm weather all year round. Temperatures range from

21 °C to 32°C. Annual rainfall varies from 2000mm to 2500mm 8. Currency 8.1 The unit of currency is the Malaysian Ringgit indicated as RM and and foreign

currencies can be converted at banks and money changers. 9. Electricity 9.1 Voltage is 220 - 240 volts A C at 50 cycles per second. 10. Time 10.1 Eight hours ahead of GMT and 16 hours ahead of U.S. Pacific Standard Time.

IV. COMPETITION INFORMATION 1. Period

1.1 The Sailing competition of the 5th ASEAN Para Games will be held from 15th to 19th August, 2009.

2. Venue 2.1. Competition Site

The Sailing competition will take place at the Admiral Marina Port Dickson, Negeri Sembilan.

2.2. Training Site The competition site will also be used for training. 3. Events 3.1 The Sailing competition will consist of the following events: 3.1.1 Access 2.3 3.1.2 Access Liberty

5. Participation

5.1 Only competitors who comply with the participation regulations of General Provisions of the Competition Regulations for the ASEAN Para Games shall participate in the sailing competition of the ASEAN Para Games.

5.2 Individual Events

5.2.1 Each delegation can only field up one competitor in each individual event. One male and one female in access 2.3, one men and one female in access liberty. One male and one female, each sailing solo in a single event, shall constitute a National Team. Each national may enter a maximum of four competitors- a male and female in the Liberty event and a male and female in the Access 2.3 event

6. Competition Regulations

6.1 The Sailing competition will be held in accordance with the latest rule and regulations of the International Foundation for Disabled Sailing (IFDS) and International Sailing Federation (ISAF). 6.1.1 The Regatta will be governed by the “rules” as defined in the ISAF

Racing Rules of Sailing (RRS), the IFDS Functional Classification System (FCS), and by the Class Rules of the International Access Class Association.

6.2 The Prescriptions and Special Regulations of the Malaysian Yachting

Association shall not apply. The Regatta is classified Category “C” in accordance with the ISAF Advertising Code.. Competitors may be required to display bow numbers and/or the names and/or logos of event sponsors 6.2.1 If required, the Organizing Authority will supply such items which shall

be affixed and/or worn as described in the Sailing Instructions. 6.2.2 The Organizing Authority reserves the right to refuse advertising by

a boat or competitor when it is considered in conflict with the interests of event sponsors or the laws of the Malaysian Government

7. Competition Implements

7.1 All equipments for the competition shall comply with the regulations of IFDS.

7.2 All facilities for an event shall be accessible for people with physical disabilities and negotiable by people with visual impairment.

8. Classification

8.1 Classification procedure will be held at the Classification Centre in the Admiral Marina & Leisure Club, Port Dickson 13th August 2009 by Classifiers authorized by IPC.

8.2 After being tested and confirmed of his/her classification class, athletes may

participate in the competition. 8.3 Any protest regarding the classification shall be made in writing and be

resolved in accordance with the appropriate rules and regulations. 8.4 A fee of USD$100 will accompany each protest in accordance with the article

XIII no. 8 of the General Provisions of the Competition Regulations. 8.5 Each entrant shall meet or exceed the minimal disability criteria as prescribed

in the 2005 IFDS Functional Classification System and present him/herself for classification by the event Classification Committee.

8.6 The Event Classification Committee will determine the eligibility for this

Regatta of (those who do not hold current IFDS FCS passports). 8.7 Prior to entry for the Regatta, each competitor is strongly advised to obtain

specialist medical opinions about the high likelihood of eligibility 8.8 For Classification Protest and Appeals please refer to section 5 or the IFDS

Functional Classification System and procedures manual 2005-2008.

9. Doping Control 9.1 Doping control will be conducted by KLAPGOC under the KL’09, 5th

ASEAN Para Games under the ASEAN Para Sport Federation (APSF) Sport Science and Medicine Committee’s supervision.

9.2 KL’09 in consultation with the APSF Sport Science and Medical Committee, will determine the number and distribution of test.

9.3 According to the IPC regulations, all athletes participating in an any competition of the 5th ASEAN Para Games is subject to doping test and test will be done through urine samples being tested at an authorized doping test centre.

9.4 The athlete who has been selected for doping will be informed after the award ceremony and the athlete then must report to the doping control room no later than one (1) hour after notification and comply with sample collection.

9.5 If the athlete does not report to the doping control room within the given time,

than the results are considered positive and results and place of the event will not be recognized.

V. COMPETITION MANAGEMENT 1. Competition Management

1.1 The Sailing competition or the 5th ASEAN Para Games Kuala Lumpur will be under the supervision of the Technical Delegates (TD) appointed by ISDF, will be responsible for the technical organization and the staging of the Sailing competition.

2. Technical Delegate and Chief Classifier

2.1 ISDF will appoint the Technical Delegate (TD) and the International Classifier for Sailing.

2.2 Sailing competition will be conducted by with ISDF sanction and ISDF TD and

authorized Technical officials appointed by KLAPGOC. 3. Protest

3.1 Protest shall be resolved according to the ISAF Racing Rules of Sailing. The protest must be made to the Jury of Appeal.

3.2 The time limit for protest shall and not less than 60 minutes after the docking

of the Race Committee Finish boat. Protest time shall be posted on the Official Notice Board.

3.3 It must be in writing and signed by competitor or their nominated

representative on their behalf and shall be accompanied by a deposit of USD$100, which will be forfeited if the protest is not upheld.

3.4 It the protest is upheld, the protest fee will be returned.

4. Uniform

4.1 All uniform worn by competitors and other participants must be the official uniforms of their delegations.

5. Commendation

5.1 Victory Ceremonies 5.1.1 Victory ceremonies will be held shortly after each final. The

competitors taking part in the victory ceremony shall wear their official NPC Uniforms.

5.2 Prizes

5.2.1 The following prizes will be awarded.

First prize : Gold medal and diploma to the winner in each event

Second prize : Silver medal and diploma to the runner-up in each event.

Third prize : Bronze medal and diploma to the Competitors placed equal third in each

event 6. Disclaimer of Liability

6.1 Competitors participating in the 5th ASEAN Para Games Sailing Competition entirely at their own risk. The Organizations Committee will not accept any liability for material damage or personal injury or death sustained in conjunction with or prior to, during, or after the competition.

7. Meeting

7.1 The Team Managers Meeting will be held : Time : 2100hrs Date : 14th August, 2009 Place : Meeting Room, Admiral Marina 7.2 Maximum of two (2) official representatives from each participating NSO

member may participate. 7.2 If necessary, the Attaché or an interpreter may attend. An information

brochure will be distributed to the team managers before the Meeting.
