    THE COURT: Okay, we are taking up in the matter of

    State of Oregon v. William James Esbensen, in case number 12-

    09-4824C and in the matter of State of Oregon v. Raymond Scott

    Kangas, in case number 12-09-4828C.

    So, when we ended yesterday we were trying to make

    sure we had all of Mr. Esbensen s exhibits correct because we

    had some number changing. So can we get that taken care of?

    MS. GERBER: Yes, judge. I do want to apologize

    (INAUDIBLE) for how late I am, but I had a mentally ill client at

    SRCI that I had to deal with; him and his family, and I apologize

    for that.

    THE COURT: Okay.

    MS. GERBER: Just had a conflict at the last minute. We

    had exhibits 1 through well, 1000 through 1037 we d move to

    admit at this point. Mr. Dugan s had a chance to see them. I m

    not sure if he has any...

    the way you go about impeachment.

    Alden Turner s petition to plead guilty.

    MR. DUGAN: Um, Mr. Turner didn t testify so that s,

    um, um, I m not sure what the relevance is at all, um, to that. It s

    not impeachment because he didn t testify, so we d object to that.

    THE COURT: I think this was the point of showing that

    other defendants got other offers; and I think I limited some of

    the discussion on that. I m going to go ahead and receive 1012.

    Then exhibit 1013 for Ryan Lowe, which would ve been

    the same.

    worked with the clinic. Uh, got her off of pills. We were raided

    and she got back on them and she went to rehab and got out a

    couple of months ago and was doing good, had a job, and wasn t

    actually using street pills anymore but using doctor prescribed

    pills.

    grower knew who their patient was. And they did sign and agree

    to not be in contact with the grower. And the main reason was for

    securities for the growers because medical marijuana is so

    valuable on the streets and for their privacy.

    And are there older people who come into your club?

    bsolutely. We had a couple customers we had they

    were bedridden and couldn t get out of their house.

    And Adrian Kershaw that was brought up and discussed,

    and I ll just handle that quickly. What was the issue between you

    and her, if any?

    A

    ell, a lot of our patients have a lot of different needs

    and stuff and we tried to accommodate them in any way we can.

    And she she she had some special needs when she came in

    and explained them to us. Um, I explained our program. It takes

    90 to 120 days to grow their medicine once we agree to become

    their grower and that s when they can start receiving one free

    ounce a month. And in her case I actually gave her an ounce

    immediately the day she signed up because she was in a lot of

    pain and stated that she really needed some medicine. And also I

    gave her two more ounces over the next 90 days and it just wasn t

    enough for her and she kind of made a scene in my office when

    there s other customers out in the lobby, and as she stated in her

    own testimony she stood up, and I stood up, and her mother stood

    up and I asked her to leave.

    You didn t attempt to assault her in any way?

    A

    ever, no.

    Okay. In fact you were um were you the patient

    caregiver or grower for her mother?

    And what was the circumstances underlying this?

    A

    m, they just realized the need of the club and the need

    of the patient and appreciated what we were doing there and

    wanted to help out in any way shape or form.

    And this is I know the judge wants to move along so

    you could maybe summarize this quickly. But in terms of what

    you knew about your ability to run that club, did you travel

    around the state at all and visit other collectives?

    A

    here in Malheur County. Can you tell me a little bit about this

    town hall meeting that you went to?

    State Police. I identified who I was, what we were doing or going

    to do to help facilitate the needs between the growers and the

    patients. And gave them my card, gave them my number, asked

    them if they had any questions or any concerns to contact me at

    any given time and I d love to meet them at the club and show

    them how it worked or I was willing to work with anybody.

    Okay. And were you a member locally of any boards

    chambers of commerce, anything like that where people knew who

    you were at what you were doing? Were you involved in the

    community at all?

    A

    es we were a member of the chamber of commerce for

    two years. And if I can go back to the previous question on the

    town hall meeting that I didn t answer. I we decided to have a

    town hall meeting and invite the sheriff, the city police, uh, we

    ran a newspaper article in the Argus Observer and invited the

    whole town to show up. We had speakers. We had a federal

    medical marijuana patient speak there. We had Lee Burger, a

    Portland attorney speak there on the laws of medical marijuana.

    And we had some other people who run other organizations, non-

    profits, for patients.

    And how long did the club exist before the raid?

    A 2 months.

    And had you been approached by anybody from the

    Malheur County Sheriff s office in that 22 months about whether

    or not you were operating a legal operation?
