    Report title: Court Realignment Data (Calendar Year 2018) Statutory citation: Penal Code section 13155 Date of report: April 11, 2019 The Judicial Council has submitted a report to the Legislature in accordance with Penal Code 13155. The following summary of the report is provided under the requirements of Government Code section 9795. This is the sixth annual Judicial Council report on the implementation of the 2011 Criminal Justice Realignment Act. This report includes statistics from January 1 through December 31, 2018, for each county regarding the dispositions of felonies at sentencing and petitions to revoke probation, mandatory supervision, postrelease community supervision, and parole.     Court Realignment Data (Calendar Year 2018)

    This report fulfills the requirement pursuant to Penal Code section 13155 that the Judicial Council submit data regarding the implementation of the 2011 Criminal Justice Realignment legislation to the California Department of Finance (DOF), the Board of State and Community Corrections (BSCC), and the Joint Legislative Budget Committee (JLBC). Please note the following:

    • The data presented in Tables 1–5 reflect the annual total of each item for all quarters reported by each court to the Judicial Council. The reporting period is calendar year 2018 (January 1, 2018–December 31, 2018). This information may be revised and amended to correct initial data reporting errors or to complete partially entered reports, but is current as of April 4, 2019. The reporting schedule for 2018 was as follows: • Quarter 1: January 1, 2018–March 31, 2018 (data due April 30, 2018) • Quarter 2: April 1, 2018–June 30, 2018 (data due July 31, 2018) • Quarter 3: July 1, 2018–September 30, 2018 (data due October 31, 2018) • Quarter 4: October 1, 2018–December 31, 2018 (data due January 31, 2019)

    • Many courts began implementing new case/data management systems, and are still in the process of transitioning to these systems. This has presented significant and ongoing barriers to reporting many of the data elements in the report. Despite these challenges, approximately 86 percent of the courts were able to report most (70 percent or more) of the requested data. The following notations are used for courts reporting partial data:

    * Reported one quarter of data. ** Reported two quarters of data.

    *** Reported three quarters of data.

    • Note that the sample size (n) for each data element is the total number of courts reporting any data for that item, including courts reporting fewer than four quarters. Please see Attachment B for a full description of each data point.

    PRESENTENCING 1. Number of new felony case filings

    A felony filing is defined as the beginning of a case by the court’s acceptance of the formal submission of a complaint or other document charging a defendant with a felony offense, or a transfer-in from another jurisdiction. Other documents, such as motions, are not counted as filings for caseload inventory purposes. • Each defendant named in the complaint is reported as one case filing. • Do not count a filing for defendants who are discharged prior to the filing of a complaint. • Do not count filings for Habeas Corpus. • Do not include violations of Postrelease Community Supervision (PRCS) or parole in

    this count.

    2. Number of presentence felony warrants issued for Failures to Appear (FTA).

    INITIAL SENTENCING 3. Number of cases in which a defendant is sentenced to state prison at initial sentencing.

    Do not include cases in which a defendant is sentenced to state prison on a violation of felony probation. These cases are counted in data point #9.
