I. EXECUTIVE SUMMARY

1. Indonesia has one of the lowest coverage rates of conventional off-site urban sewerage in Asia. Only 11 out of its 330 cities have partial sewerage systems, and only 2% of the national urban population is connected to central wastewater treatment plants (WWTPs); the remaining urban population depends on poorly constructed and maintained septic tanks and unlined pit latrines, which result in leachates penetrating the aquifers. The present sanitation services are inadequate and unintegrated, due to inadequate and poorly enforced regulations. The project will respond to the needs of urban communities (including low-income households) by constructing new separate sewerage systems and WWTPs, setting up local wastewater infrastructure management institutions, and strengthening the relevant regional government departments. 2. The project date of ADB loan effectiveness was 9 July 2014, with the current closing date on 31 December 2023 and a total amount of USD 120 Million (M). A loan extension was internally approved by ADB on 31 January 2020, with a closing date of 31 December 2023. On 2 October 2017, the Project Implementation Support Consultant (PISC) for the project - Loan No. 3123/-I8280 (AIF)-INO: Metropolitan Sanitation Management Investment Project was appointed by Directorate General of Housing Settlements (DGHS) to undertake tasks listed under Contract HK.02.03/MSMIP-KONS/X/11/2017. The PISC contract currently applies for the implementation support requirements for the local governments of Makassar, Pekanbaru, and Jambi.

3. Of the six civil works packages financed under OCR/AIF, the Makassar Sewer System B2 was awarded on 14 November 2019 (PT. Waskita Karya) with the commencement of work (COW) was on 14 November 2019. The contract award date for Makassar WWTP B1 was on 9 October 2020 with COW was on 25 November 2020. Pekanbaru WWTP B1 was awarded on 25 November 2020 (PT. PP (Persero) Tbk – PT. Panca Jasa Lingkunga, KSO), Pekanbaru Sewer System NC was on 8 September 2020, Jambi WWTP B1 was on 26 October 2020, and Jambi Sewer System B2 was on 9 October 2020. Following the aforementioned contract award and current procurement progress, the payment of compensation was completed in 2012 for Makassar subproject, December 2018 for Pekanbaru subproject, and December 2018 for Jambi subproject.

4. On the other hand, the progress of the civil works packages financed under State Budget (APBN) is as follows: Contract for Makassar C1 was awarded on 10 January 2020 (PT. Adhi Karya) and C2 was awarded on 10 January 2020 (PT. Waskita Karya) and Makassar C3 was on 27 February 2020 (PT. Karaga Indonusa Pratama). Pekanbaru SC1 was awarded on 1 November 2018 (Wika-Karaga, KSO) with COW was on 9 Nov 2018. SC2 was awarded on 1 November 2018 (PT. Hutama Karya - Rosa Lisca, KSO) with COW was on 9 November 2018. For Jambi C, the contract was awarded 14 December 2020. 5. The project is Category B for both environmental and social safeguards. There are no indigenous people that will be affected by it. Land Acquisition and Resettlement Plan (LARP)1 and Initial Environmental Examination (IEE) for each of the Subprojects were submitted in 2012 and 2013. 6. Updated LARP for Pekanbaru was submitted to Asian Development Bank (ADB) on 27 December 2018. ADB provided the comments on 17 January 2019 stated that the LARP is no longer relevant since all lands for the project have been acquired and there has been no change on the project design for the alignment of the Wastewater Collection System (WCS). The latest payment for pumping station is on 10 December 2018. The supporting documents for WWTP and pumping station have been included in the previous reports. LARP formulation for Makassar was recommended by ADB on 5 October 2018 to address detailed engineering design (DED) changes and impacts specifically on the access road to WWTP and Pump Station B. However, during Review Mission of ADB conducted from 9 November-11 December 2018, it was decided to formulate instead

a due diligence report.2 The updated Due Diligence Report (DDR) was approved on 27 August 2020. During the kickoff meeting for ADB Review Mission on 2 May 2019, it was agreed that updating LARP Jambi is no longer required since all required lands have already been acquired including the access land to the pump station. 7. Full disclosure and public consultation activities on construction design and plans have been conducted for all packages and will be continued before construction per road section. Monitoring of temporary impact during construction was conducted throughout the project. Interviews were conducted with 40 affected persons (APs) in Makassar B2 package. Temporary impacts such as dust, less parking space and access to the business area were mentioned by APs. Some APs also mentioned that many workers shopped in their place. No written proof of the income before and after construction. However, some APs mentioned that the income remain the same and others informed that there is an increasing.

As there are no vulnerable households found among the affected persons (APs), income restoration program formulation and implementation for APs/vulnerable households is not anticipated in the 3 subprojects based on review and monitoring of LARP implementation. However, there is one relocated household in Jambi and he has been compensated according to safeguard policy.

9. Land acquisition activities have been completed for all cities, unless for the access road to WWTP site. During the wrap up meeting of ADB review mission on 22 November 2019, it was agreed that the access road from the developer in Makassar was no longer an issue due to local government had another access road (as a contingency in case the developer did not provide). However, during wrap up meeting on 23 November 2020, ADB requested to submit the written agreement from the developer of Kota Bunga on the use of land for road access to the WWTP site by 14 December 2020. Up to this reporting period, the agreement has not been issued yet. The outstanding issue is to be settled and reported in the next monitoring period.

II. PROJECT IMPLEMENTATION AND SOCIAL SAFEGUARDS STATUS

1. PROJECT OVERVIEW

Only 11 out of its 330 cities have partial sewerage systems, and only 2% of the national urban population is connected to central wastewater treatment plants (WWTPs); the remaining urban population depends on poorly constructed and maintained septic tanks and unlined pit latrines, which result in leachates penetrating the aquifers. The present sanitation services are inadequate and unintegrated, due to inadequate and poorly enforced regulations. This results in limited desludging of septic tanks, inadequate septage treatment facilities, and fragmented operational responsibility. Improved access to safe water and basic sanitation is part of the Government of Indonesia’s effort to achieve its 2015 Millennium Development Goal (MDG) targets. While the government’s MDG reports suggest that good progress has been achieved with respect to sanitation, in practice the available facilities are substandard, and rely on unsustainable septage removal and treatment facilities. As a result, there is significant environmental pollution, widespread contamination of surface and groundwater with the associated spread of water-related diseases, and high infant mortality. The inadequate sanitation systems and their resulting environmental and health impacts produce economic opportunity losses of about $5.6 billion annually, equivalent to 2.3% of the country’s gross domestic product. These issues can be solved by the introduction of (i) public sewerage and wastewater treatment facilities; (ii) an institutional framework for their effective operation and maintenance (O&M); and (iii) public awareness of good sanitation practices. 2. The project will support the Government of Indonesia in the improvement of urban wastewater services in the cities of Jambi, Makassar, Palembang, and Pekanbaru, which currently lack any pipes sewerage and wastewater treatment facilities. The project will respond to the needs of urban communities (including low-income households) by constructing new separate sewerage systems and WWTPs, setting up local wastewater infrastructure management institutions, and strengthening the relevant regional government departments. 3. The project date of ADB loan effectiveness was 9 July 2014, with the current closing date on 31 December 2023 and a total amount of USD 120 Million (M). A loan extension was internally approved by ADB on 31 January 2020, with a closing date of 31 December 2023. The Government of Australia, through the Department of Foreign Affairs and Trade (DFAT) provides collaborative financing of $36.37 million grant to finance (i) the preparation of detailed engineering design (DED) for WWTPs and sewerage systems in Makassar, and (ii) the DED and capital costs for WWTP, pump station and construction supervision in Palembang. The central government provides $98.14 million equivalent to finance DED in Jambi and Pekanbaru, collection systems in Jambi, Makassar, Palembang, and Pekanbaru, awareness campaign, taxes and duties, and financial charges. The participating cities provide $55.57 million equivalent to finance land acquisition, involuntary resettlements, property connections and construction of community-based sanitation systems and in Palembang in particular, collection system in the north catchment area.

Key sub-project activities since last report:

Contract awarding: 02 October 2017 for the Project Implementation Support Consultant (PISC) for the project - Loan No. 3123-INO. Metropolitan Sanitation Management Investment Project to undertake tasks listed under Contract HK.02.03/MSMIPKONS/X/11/2017. The PISC consists of lead Consultant SMEC International Pty Ltd in joint venture with Stantec Australia Pty Ltd (ex-MWH) and in association with the following firms as subconsultants: PT. Infra Tama Yakti (ITY), PT. SMEC Denka Indonesia, PT. Amurwa International and PT. Widya Graha Asana (WGA). During this reporting period, the following contracts were awarded: Makassar B1 (9 Oct 2020), Pekanbaru B1 (25 Nov 2020), Pekanbaru NC (8 Sep 2020), Jambi B1 (26 Oct 2020), Jambi B2 (9 Oct 2020), and Jambi C (14 Dec 2020). Progress of work: 29.13 km total sewer laid to end of December 2020 for Pekanbaru. COW for Pekanbaru B1 was on 23 December 2020. No meaningful progress to date. COW date confirmed as 22 September 2020 for Pekanbaru NC and Pre-Contract Meeting (PCM) was held on 24 September 2020. The progress is 1% up to Dec 2020. For Pekanbaru SC1, construction was started on 25 March 2019, with delays for boring and pipe jacking operations. The progress is 70.07%. Construction was started on 26 March 2019 for Pekanbaru SC2, with delays for boring and pipe jacking operations and the progress is 64.92%. Construction was commenced on the sewer network for Makassar from June 2020. 12.4 km total length of pipeline was installed. The progress for Makassar B1 is 0%, B2 14.04%, C1 24.21 %, C2 18.79%, and C3 18.94%. (Source: MSMIP Quarterly Progress Report) Status of land: Land was handed over for civil works for Makassar B1 on 9 October 2020, Makassar B2 on 14 November 2019, Makassar C1&C2 on 10 January 2020, C3 on 27 February 2020, Pekanbaru SC1&SC2 on 7 November 2020, NC on 22 September 2020, and Jambi B1&B2 on 16 November 20204.

8. This is the 2nd Semi-annual Monitoring Report on Involuntary Resettlement covering the period 1 July to 31 December 2020. It is prepared by DGHS through CPMU and submitted to ADB in accordance with the safeguard monitoring and reporting requirements set out in the Project Administration Manual, Project Grant Agreement as well as the ADB Safeguard Policy Statement 2009 (SPS). The new internal monitoring format as recommended by ADB in October 2018 has been used in this report.

3. INSTITUTIONAL ARRANGEMENTS FOR INVOLUNTARY RESETTLEMENT IMPLEMENTATION AND MONITORING

The institutional arrangements described in the 1st semi-annual monitoring report for the period of January to June 2018 remain basically the same except for two changes – LPMU and LPIU is merged and in the provincial level there is only Satker/PPK (PPIU). 10. Acting on behalf of the City Government, LPMU will: (i) provide adequate budgetary support to carry out the updating and implementation of the Land Acquisition and Resettlement Plan (LARP); (ii) provide the main workforce in the updating and implementation of the LARP; (iii) advice the Office of the Mayor or Regent to issue a Decree for the organization of Land Acquisition Committee (LAC); (iv) engage the services of a duly licensed independent property appraisal firm or land valuation team for the appraisal of affected properties/assets as basis for setting up the unit replacement cost for affected lands and assets; (v) assist in the expeditious and judicious resolution of complaints of APs. The LPMU will coordinate with LAC and work closely with the staff of the PPIU and CPMU; (vi) monitor implementation of LARP and submit required internal monitoring report data on a regular basis to CPMU for incorporation in the monthly/quarterly/semi-annual report; and (vii) assist CPMU in the preparation of semi-annual safeguards monitoring report for submission to ADB. The detailed task of each member of LPMU can be seen in the Mayor decree of Makassar City No. 989/050.05/2018, Mayor Decree of Pekanbaru City No. 348/2018, and Mayor Decree of Jambi City No.330/20206. PPIU tasks are to provide construction contract’s supervision and closely monitors construction progress.

13. The following paragraphs give clarifications on the data above: 14. Makassar. The access road to Makassar WWTP site was no longer an issue as agreed during ADB wrap up meeting on 22 November 2019. Makassar City Government owned another access road to WWTP in case developer does not provide the access road. However, during wrap up meeting on 23 November 2020, the issue was brought up again and DGHS was requested to submit the written agreement from developer by 14 December 2020. Up to this reporting period, the agreement has not been issued yet. Regarding WWTP land, the final verdict in favor of the Makassar City Government was issued on 10 July 2019.

15. Pekanbaru. As stated in the previous report that the land acquisition has been completed for Pekanbaru subproject. All affected households (AHs) have been compensated in accordance with ADB safeguard policy. Based on Pekanbaru LARP (2013), AHs will be allowed to continue to harvest their trees and will be given at least four months advance notice to enable them to harvest the trees, before the project authorities take possession of the land for clearing and handing over for civil works. According to information from Pekanbaru Public Relations/Marketing Specialist, the community has been informed about the construction plan. In WWTP area, there are also signboards stated that the land belongs to Pekanbaru Local Government. The required land for construction was cleared while the other acquired land can be used for planting by the community before the construction started.

16. According to a letter9 dated 21 October 2020 from Regional Secretary of Pekanbaru to the Head of Center of Regional Settlement Infrastructure (Balai Prasarana Permukiman Wilayah Riau), land provided by Pekanbaru City Government for pumping station, WWTP and its access is currently still regional property (Barang Milik Daerah/BMD) so that all matters related to land use are subject to and obey to PP No. 27 of 2014 concerning Management of BMN/D (State/Regional Property) and Permendagri No. 19 of 2016 concerning Guidelines for BMD Management. Referring to the two regulations, the land management that can be applied at this time is the lend-use of BMD (Pinjam Pakai BMD). The period of lend-use agreement is maximum 5 years and can be extended one time only. 17. Jambi. The land certificate of WWTP land was issued by the land agency (BPN) on 12 December 2018 and pumping station was issued on 13 December 2018. These certificates can be seen in the 2nd semi-annual monitoring report (2019). The certificate of access road to the pumping station was issued on 1 July 2020 and can be seen in Appendix 32.

18. As can be seen in Table 4, there was no LARP prepared for Makassar. Instead, there was a Due Diligence Report and Corrective Action Plan approved by ADB in 2013 which did not cover budget for land acquisition and resettlement. The cumulative funds disbursement was based on the receipts of payment delivered to four affected households in 2011 and 2012. Receipt of payment can be seen in the appendix of 1st semi-annual monitoring report on involuntary resettlement monitoring report (January-June 2018). 19. LARP budget for Pekanbaru City can be seen in the approved June 2013 LARP. The cumulative funds disbursement was calculated from the compensation delivered to 27 affected households for WWTP land and 1 household for the pumping station land.

20. The cumulative funds disbursement for the WWTP land of Jambi can be seen in the appendix of 1st semi-annual social safeguards and involuntary resettlement monitoring report (January-June 2018). In addition to this is the compensation delivered to AHs who owned the pumping station land and the access to the pumping station as shown in the monitoring report for the period of January to June 2019.

1.1. Issues Affecting Timely Land Handover

21. There are no issues affecting to timely land handover encountered during this period.

2. RELOCATION

22. A relocated AH in Jambi has been compensated for his assets in December 2018 based on the appraisal price and he was satisfied due to value of compensation is more than expected and tax free. The management of documents is handled by the local government. Now he is living with his daughter.

23. There are no issues encountered during this period.

3. INCOME RESTORATION PROGRAM

3.1. Status of Income Restoration Program

24. There are no eligible APs in Makassar and Pekanbaru. There are seven female headed household in Pekanbaru, but they are not categorized as vulnerable. 2013 Pekanbaru LARP states: The incomes of the affected households (AHs) are higher than the City’s established poverty threshold. None of the households are reported to have any handicapped members. Based on the vulnerability criteria, none of the AHs are vulnerable and none of them belong to Indigenous peoples.” This information has been validated during consultation meetings with

several APs and RT/RW (neighborhood/community unit) officials conducted in July 2018, October 2018 and continued in July 2019. Based on the updated data during the site visit in 2018, the compensation given to five AHs with the loss of incomes from trees in excess of 10% of their household incomes is between 11 to 69 times the average incomes from trees. This will ensure restoration of their income and livelihood. Due diligence interviews with two of five AHs and the Head of RW 8 were recorded in the 2nd semi-annual monitoring report of 2019.

25. Income restoration program has been given to an eligible AP in Jambi. According to info from LPMU, he has received a Family Hope Program (KPM PKH10) in the form of social assistance of medium quality rice as much as 15 kg/month from Jambi City Social Agency since October 2020 for six months.

3.2. Consultation with Eligible AP for Income Restoration Program

26. Consultation with a relocated AP was carried out by Sekretariat Daerah Pemerintah Kota Jambi (Bagian Pemerintahan) related to land acquisition and resettlement. Consultation was started on 22 November 2018. He was informed about the project and consulted for about five times. He has never raised any complaint concerning the compensation and informed that the compensation given was fair enough for him. Consultation was continued by DGHS through PISC and Public Works staffs after he moved to his daughter’s house. He does not work at the time of consultation in March 2019 and he plans to open up a business from the compensation money. He is happy that he sells the house to the government.

4. DISCLOSURE, CONSULTATION & PARTICIPATION

28. All packages have been awarded in Makassar, Pekanbaru, and Jambi. A series of information disseminations were conducted with the community and stakeholders related to the project. There are 38 information dissemination through brochures distributions conducted in Makassar during this reporting period, which attended by 49% men and 51% women of 581 participants. Brochure consists of information such as background of MSMIP, purpose of the project, profile of WWTP, working methods, etc. Information was disseminated by delivering brochures to the community due to coronavirus outbreak. During brochures distribution, some questions arise such as working schedule and duration. During information dissemination about the project, Contractor, Satker and Consultants also expressed hopes for community cooperation regarding the works to be carried out. In Pekanbaru, brochure distributions (in Jl. Serati, Perkutut, A Yani, Pepaya and Rajawali) and interviews to respondents in 19 locations listed in Table 12 were conducted to 41% men and 59% women of 173 participants. 20 information disseminations attended by 77% men and 23% women of 107 participants were conducted in Jambi to provide information regarding MSMIP, WWTP and sewerage pipeline construction location, new PR Specialists in charge for information dissemination/consultation and other related information. Information was delivered to the Head of Subdistricts, Head of Wards (Lurah), PU, Bappeda, Environment Agency, etc. The details can be seen in the Table 11. 29. In November and December 2020, DGHS through PISC conducted site visits to each subproject. PISC and Contractors conducted information dissemination and interviews with community along the road to be constructed in Makassar B2, Pekanbaru NC, and Jambi B2. The shop owners have no objection to the project. Some suggestions to mitigate negative impacts mentioned by the community as follow: construction to be carried out per segment so that the disturbance of the business does not take a long time, work fast, if it is possible the works to be done at night, water the area around the construction site to reduce dust, ensure that waste materials are disposed of responsibly, provide access and alternative parking space, etc.

30. No Updated Resettlement Plan (URP) in each subproject. Project Information Booklets (PIBs) for Makassar, Pekanbaru, and Jambi as can be seen in Appendix 34 were approved by ADB on 8 September 2020. PISC requested CPMU through a letter dated 13 November 2020 to request PPKs in each city to circulate PIBs to APs and communities. Briefing on PIB was provided to the Contractor in Makassar on 20 November 2020 which was attended by 62% men and 38% women of total 8 participants, Pekanbaru was on 1 December 2020 and attended by 7 persons (57% men and 43% women), and Jambi was on 11 December 2020 with a total 15 participants (67% men and 33% women).

5.1. Narrative Summary of Grievances

31. Pekanbaru. The grievance cases are recorded well in Pekanbaru. Complaints can be delivered through the call center, local government or through social media such as Facebook. All grievance cases recorded during January to June 2020 have been addressed as can be seen in Appendix 30. During this reporting period, there are 19 grievances recorded by PR Specialists. The complaints received, such as material waste/sedimentation in the drainage, dusty road and request for regular watering, traffic jam, etc. as can be seen in the Appendix 35. 32. The complaints received by PR Specialists and LPMU have been informed to the Contractors in Pekanbaru. The issue such as dust and material waste in the drainage have been resolved by cleaning and watering the road regularly. A public facility (bridge in Jl. Nenas) that was broken due to heavy material is fixed by the Contractor. Flagman is standby in the crowded area. The other grievances during this period have been addressed by the Contractors as can be seen in the Appendix 35. No complaint was recorded regarding IR. 33. Makassar and Jambi. No complaints were recorded by PR Specialists during this reporting period.

6. OTHER ISSUES

34. There are no issues encountered during this period.

6.1. Institutional Matters and Capacity Training

35. The developments on institutional matters and training for this period for Makassar, Pekanbaru and Jambi are as follows:

(i) Deployment of safeguards-related staff within PMUs. The head of CPMU appointed 2 of her staff in July 2019 to be the counterpart of PISC on Environment and Social Safeguards aspects. Key activities conducted by PMU safeguards staff during reporting period are updating information on the safeguard’s reports submitted, discussion and decision on the issues raised by ADB such as the schedule to conduct the survey of temporary social impacts during construction, etc.

(ii) Capacity development training provided Orientation meetings held with LPMU and Satker in Makassar, Pekanbaru and Jambi in March 2018 on: ADB-SPS 2009; evaluation of the previous and on-going land acquisition process; and planning for the remaining land acquisition issues12.

Capacity Building on LARP was conducted on 25 October 2018 and 6 November 2018 for Pekanbaru and Makassar respectively13. Training on gender sensitization, Contractor’s Environmental Management Plan Report (CEMP) and social safeguard was delivered to Contractor of SC1 and SC2 package in Pekanbaru. Training on 13 January 2020 (SC1) and 14 January 2020 (SC2) was attended by 16 persons (5 women and 11 men). NC contractors received the training on 1 December 2020 and attended by 7 persons (3 women and 4 men). B1 Contractors are expected to receive the training in Q1 2021. Contractors in Makassar (B2, C1 and C2) received the training on 20 January 2020, attended by 16 participants (6 women and 10 men) and B1 package received training on 20 November 2020, attended by 8 participants (3 women and 5 men). Contractors in Jambi (B1 and B2) received training on 11 December 2020, attended by 15 persons (5 women and 10 men). C Contractors are expected to receive the training in Q1 2021.

(iii) Activities of community-based organizations (CBOs)/mass organizations (as applicable) Not applicable

(iv) Adequacy of resources for PMU staff and consultants.

PISC’s National Environmental cum Social Safeguards Specialist has been replaced in March and November 2019. There has no specific Social Safeguards Staff at city level hired. Instead, two Public Relations/Marketing Specialist were mobilized in each city. A Public Relations/Sanitation Marketing Specialist was mobilised for PISC in Pekanbaru on 28 August 2018, to identify the potential beneficiaries and assist the local government to carry out public campaign awareness activities, and a second PR Specialist was mobilised on 3 February 2020. A PR Specialist was mobilised for Makassar on 12 September 2018 (de-mobilised on 12 July 2019 and re-mobilised on 20 November 2019), and a second PR Specialist was mobilised on 3 February 2020. Similarly, PR Specialists were mobilized on 12 and 26 October 2020 in Jambi. No issue found so far regarding this arrangement. Regular coordination with CPMU and PISC Jakarta especially social safeguard team were held with PR Specialists in each city. Social safeguards meeting during ADB review mission are always attended by PR Specialists.

(v) Issues in undertaking roles/responsibilities of different agencies.

No issues found during the reporting period.

6.2. Temporary Impacts during Civil Works

36. In November 2020, DGHS through PISC conducted a site visit in Makassar to conduct detailed survey to AHs/APs in order to prepare temporary impact during construction report for sewerage package (B2). During the site visit, PISC visited WWTP area. Potential temporary social impact for WWTP area are dust, noise, accessibility and aesthetic disruption.

37. Due diligence interview was conducted to the shop owners/mobile vendors in the completed packages (recondition done) in Makassar B2 package. Interview was done to 40 respondents - 6 APs in Jl. Hati Mulia (chicken noodle seller, egg seller, ornamental fish seller, pot seller, coconut seller, workshop owner, car seat repair and drink seller) , 4 APs in Jl. Beruang (restaurant owner, daily necessities seller, cafe owner), 4 APs in Jl. Onta Baru (restaurant owner, grave flowers seller, package delivery shop owner, grocery shop owner), 5 APs in Jl. Serigala (food seller, grocery shop owner), 3 APs in Jl. Kancil Utara (grocery shop owners), 6 APs in Jl. Tupai (food seller, credit top up for mobile phone stall owner, drink (mixed ice, etc.) sellers, 5 APs in Jl. Badak (chicken noodle seller, grocery shop owner, food and drink shop owner, laundry and drinking water shop owner), 3 APs in Jl. Amirullah (coffee shop owner, grocery shop owner), and 3 APs in Jl. Mappanyukki (drink and snacks shop owner, food and

drink shop owner, chicken noodle seller). Among 40 respondents, 53% respondents are men and 48% are women. 25% of them are the head of household. The others are wife, family member and shop employee. Main livelihood activity of the head of HH is running business/entrepreneur. 33% of respondents are married, 5% respondents are single, and no available info for other respondents. None of them are categorized as elderly (above 65 years old) and physical condition are all normal. There are Bugis, Javanese, Flores, and Banjar ethnicity. The highest education level of the respondents is bachelor degree. Most of the respondents (35%) live in the project area for less than 4 years, followed by 28% live there for 4-19 years. The total monthly income of the entire AH ranging from IDR 3,000,000 – IDR 120,000,000. More detailed info on socio-economic profiles of the AHs can be seen in the Appendix 38.

38. The work methods are open trench and boring. The duration of disturbance for open trench is about 1 day for 30 m (including excavation, pipe installation and closure) and about 15 days till recondition. For boring works, the impact is only in pit (about 7 m) for 27 days. 39. The shops are still open during the construction. The impact mentioned by AHs in Jl. Hati Mulia are as follows. The impact mentioned by Pak Sukadi is dust in front of the shop, yet buyers increased as workers bought the chicken noodles from him. During construction, Pak Sukadi was still selling and moved to the opposite side of the road (in front of the school). During construction, Pak Joni was still selling eggs and earning the same as before construction. Pak Udin mentioned that there is limited access for customers, but there is still another access. During construction, Pak Udin was selling ornamental fish in the afternoon as usual and earning the same as before construction. Impact mentioned by Bu Anika (flower pot seller) and Pak Mallari (workshop owner) is increased dust. During construction, Bu Anika was still able to the pots and her income was relatively the same as before construction. Bu Harliana was still able to sell coconut ice. No data on the turnover before and after construction. However, based on the interview result, the income was increased due to the increase in buyers from project workers. Based on info from Bu Risna, the area in front of the shop was dusty during excavation. She informed that the turnover was increased Rp 200,000 per day due to increased buyers from project workers. 40. In Jl. Beruang, there are 4 interviewed AHs. Ibu Susan and Pak Abadi mentioned that negative impact is dusty road in front their restaurants. No data given by Ibu Ria Nursyamsi on the turnover of the shop (selling daily necessities). However, based on the interview result, turnover increased Rp 300,000 per day from the project workers. There was a temporary restriction to café belong to Pak Sudomo, but only for 1 day during open trench activities.

41. Pak Dion Ilham (employee in a restaurant), Bu Sitti (selling grave flowers), Pak Helmon (package delivery owner), and Pak Hamzah (selling groceries) in Jl. Onta Baru mentioned that dust increased in the excavated area in front of the shops. Beside dusty road, Sitti also mentioned that the access to the place was reduced. Pak Helmon mentioned that there is limited space for parking area in front of his shop, however, customers can park at the opposite site and the next building.

42. In Jl. Serigala, Pak Puddin (food seller with cart) informed that less parking space during the excavation work. Positive impact mentioned is increased number of customers from project workers. Pak Muhammad Nani (grocery shop owner) mentioned that there is limited access to the shop. However, there is increased buyers from project workers. Bu Sinta as grocery shop owner also mentioned that there were more buyers from project workers and she was happy with the project due to it will reduce drinking water pollution in densely populated residential location. Bu Marta mentioned about less parking space during excavation work. Many workers bought satay in her shop, but no info on the income before and after construction. Income remained the same for Bu Sefanya (mobile vendor, fried rice seller) and she also mentioned about increased dust in the excavated area in front her place.

43. In Jl. Kancil Utara, negative impacts mentioned by Bu Naharia, Bu Rosmawati, and Pak Muhammad Tan (grocery shop owners) is dusty road in the excavated area and less parking space. Positive impact mentioned are many project workers bought in their shops.

44. Impacts mentioned by 6 APs in Jl. Tupai are as follows. Bu Dian (food and beverage seller), Pak Hendra (food and phone credit shop seller), Bu Linda (grocery shop owner), Bu Erna (drink seller), Pak Muliyono (mix ice seller), and Pak Toni (drink seller) mentioned about dust in the excavated area in front of their shops. Bu Dian, Pak Hendra, Bu Linda, and Bu Erna also informed that parking space became limited. During construction, the customers can park for a while in the next building or in the opposite site of the building.

45. In Jl. Badak, Pak Wakilem (chicken noodle seller), Pak Edi (grocery shop owner), Pak Samsiah (grocery shop), Pak Sugeng Cahyono (food and beverage shop owner), and Bu Ranca (laundry and drinking water shop owner) mentioned about dust as negative impact. Beside dust, Samsiah and Sugeng Cahyono also mentioned about less parking space as temporary negative impact and increased customers as a positive impact. Bu Ranca also mentioned about limited access to the shop.

46. Bu Fatma mentioned that despite increased dust, many workers shopped in her café in Jl. Amirullah. Pak Sudirman (coffee shop) and Pak Yusril (grocery shop) mentioned that there is access limitation to the shops in Jl. Amirullah. Bu Jumriani (drink and snack seller) mentioned that there was an access limitation to the shop in Jl. Mappanyuki. Bu Musdalifah (food and beverage seller) informed that many workers bought in her shop in Jl. Mappanyuki even though there is dust increased. Bu Sutarni (mobile chicken noodle seller in Jl. Mappanyuki) also mentioned about the dust and limitation of access and parking space. 47. In order to mitigate the temporary social impacts, the contractor cleaned and watered the road regularly. Contractor also provided the temporary access in Jl. Hati Mulia, Jl. Tupai, Jl. Badak, and Jl. Mappanyukki so the shops can open like usual. During construction, the traffic signs were installed and flagmen were standby to control the traffic flow. Some documentation of mitigation done by the Contractor can be seen in Figure 1. Information dissemination and consultations were also conducted before construction in each road package.

48. The surveys were conducted in the end of November to December 2020 in Pekanbaru and Jambi. The temporary impact during construction reports are being prepared.

7. Resettlement Principles Compliance

49. Below is the compliance in loan covenant for resettlement related aspects and with resettlement policy set forth in LARP14.

The process for report preparation and submission will be continued and be monitored during project implementation period. The revised IEE for Makassar, Jambi, and Pekanbaru have been completed and are being disclosed to ADB website.

(c) Report any actual or potential breach of compliance with the measures and requirements set forth in the EMP or the RP promptly after becoming aware of the breach.

Para. 18 Grievance Redress Mechanism Comply.

Within 3 months of the Effective Date, the Borrower shall: (a) establish compliant and problem management mechanism acceptable to ADB and appoint grievance redress focal person in LPMU and each neighborhood committee to effectively: review and document eligible complaints of project stakeholders; (b) proactively address grievances; (c) provide the complainants with notice of the chosen mechanism/action; and (d) prepare periodic reports to summarize the number of complaints received and resolved, and final outcomes of the grievances and chosen actions and make these reports available to ADB as part of the quarterly progress reports.

Redress focal person has been appointed. GRM has been established and the complaints have been recorded in assistance of Contractor and DGHS through PISC in the field.

Consultation during LARP preparation (planning stage) has been conducted with the AHs, community surrounding and relevant stakeholders. In addition information dissemination in form of PIB also distributed. Initial Public consultations on project introduction at community level was done in 2011/2012 in all subprojects, as follows: - Makassar: 9 March 2012 and 16 October 2012

PIB and procedures for GRM during land acquisition and during the subproject construction were also given to the meeting participants.

- Pekanbaru: 22 October 2012 The following stakeholders were identified in that consultation: (i) district and village officials; (ii) community leaders; (iii) household heads of AHs; (iv) Office of Women Empowerment; and (v) BAPPEDA as well as the other offices of the City Government. The stakeholders have actively participated in the consultation but fewer issues were brought up on land acquisition as they were more interested on the Subproject’s environmental impacts. Related to land acquisition, one participant suggested for more community consultations as the other participant wanted the confirmation if the affected person will be paid for compensation on their properties. These issues were clarified by the MSMIP TA Resettlement Specialist and were already addressed in this LARP, such as the future consultation activities and the payment of compensation based on replacement costs.

- Jambi: In June 2011 and 21 September 2012 In June 2011, Mayor of Jambi held first meeting about MSMIP with the Bappeda and Dinas officials, heads of districts and villages. In 21 September 2012, the following stakeholders were identified in that consultation: (i) district and village officials; (ii) land owners; (iii) community leaders; (iv) Provincial Office of Public Works; and (v) BAPPEDA as well as the other offices of the City Government.

Consultations with AHs/APs and other relevant stakeholders was continued during the LARP implementation as reported in semi annual social safeguard monitoring reports.

v APs will be systematically informed and consulted about the Project, the rights and options available to them, the proposed mitigating measures, special assistance measures to vulnerable groups and the need for the preparation of LARP.

IV. CONCLUSION

50. Land acquisition activities in Makassar, Pekanbaru and Jambi have been completed. Land has been handed over for civil works for all packages. 51. Full disclosure and public consultation activities on construction schedule, methods, and temporary impacts and mitigation measures have been conducted in Makassar, Pekanbaru, and Jambi. The consultation will continuously be conducted before construction in each road package. 52. Actual physical displacement or actual resettlement impacts are not anticipated in Makassar, Pekanbaru. In Jambi, one AP has lost both land and house for the access to the pumping station and has to relocate. The local government has compensated him including providing an income restoration program according to RP.

53. Contractors have been mitigating the temporary social impact during construction by watering the dusty area, providing an access road, closing the open cut area in one day, installing traffic signs, repairing and reconditioning damaged roads, transporting construction waste/garbage to the landfill and immediately transporting the excavated soil to the disposal area, conducting information dissemination/consultation to the community along the construction site, etc. DGHS through PISC will monitor the implementation of the construction related to social safeguard.
