Withitsautonomyeverypersonhasthelegalcapacity(legalcompetence)toselfgovernandtomakedecisionconcerninghisownlife(i.e.signingwills,informedconsent,etc.)

Wheneverapersonisautonomoushaslegalcompetenceandviceversa.Whenapersondoesnotlegalcompetencehasnoautonomyandthatiswhyrelativesofnativeparents,etc.hastotakedecission (theyareentitledlegallyasrepresentatives,thereforelegallyobliged–tortlaw-).

Itispresumedthatweallhavefullpsychiccapacity,autonomy,legalcompetence.Thecontraryistobeproven.

• Doctormustbeassuredthatthepatientisabletoselfgovern,wishtoselfgovernandthenbelefttoselfgovern

• Doctorhasthedutytoassistthefreeexerciseofautonomyofhispatient.Howeverwheneverthepatienttakeawrongdecisionthedoctorhastoconvincehimofhiswrongfuldecisionwithoutforcing(beneficencevs.autonomy);

• Asmuchasthepatienthasautonomyhisdecisionsmustbefollowed.

• Whenthepatientisnotautonomousthedoctormustasktherelativesortakehimselfdecisioninemergencies(whentherelativesaremissing)
