GNCTD & Others wherein it had observed as follows:- "4. In view of the fact that the respondents have already informed the DSSSB - Recruiting Agency in this matter - we issue the following directions to DSSSB, i.e. Respondent NO.2:- a) To consider the applicant as having the educational qualification necessary for the said post in accordance with the letter issued by respondent no.3, i.e. Directorate of Education. b) To consequently send the dossier of the applicant for appointment to respondent no.3 within a period of 15 days of receipt of copy of this order; and c) Direct the respondent no.3 to consequently take necessary action within a period of one month from the date of receipt of dossier from the DSSSB". 2. In this context, the brief facts of the case are that the candidate, Ms. Geeta Tomar had qualified in the written examination conducted on 28.12.2014 and was shortlisted for the post of TGT (Natural Science) Female, Post Code-113/12 and placed at S.No.14 of the OBC Merit list. 3. However, on scrutiny of the documents submitted by the candidate, it was found that the candidate acquired graduation in Applied Science in Food Technology and subjects studied by her were not specifically mentioned in the Recruitment Rules for the post. 4. As per the Recruitment Rules, the main subject required for TGT (Natural Science) is Physics, Chemistry, Biology, Botany & Zoology. Besides this, the candidate should have studied the subjects concerned as mentioned in the Recruitment Rules In all parts/years of graduation. The elective word may also include main subject as practiced in different Universities. 5. Since the candidate, Ms. Geeta Tomar had studied certain subjects like Chemistry and Biology in her 1 st year of graduation and the nomenclature of the subjects studied in 2 nd & 3'd year were different from the subjects as mentioned in the Recruitrnent Rules. Accordingly, as the Recruitment Rules falls under the domain of User department, they were requested vide letter dated 08.08.2016 to clarifY(!

Whereas the Hon'ble CAT had passed orders dated 02.01.201 ~ in OA No. 4452/2017,titled Geeta Tomar Vs. GNCTD & Others wherein it had observed as follows:-

"4. In view of the fact that the respondents have already informedthe DSSSB - Recruiting Agency in this matter - we issue the followingdirections to DSSSB, i.e. Respondent NO.2:-

a) To consider the applicant as having the educational qualificationnecessary for the said post in accordance with the letter issued byrespondent no.3, i.e. Directorate of Education.

b) To consequently send the dossier of the applicant for appointmentto respondent no.3 within a period of 15 days of receipt of copy ofthis order; and

c) Direct the respondent no.3 to consequently take necessary actionwithin a period of one month from the date of receipt of dossierfrom the DSSSB".

The elective word may also include main subjectas practiced in different Universities.

5. alia, regarding her eligibility for the said post as per the Recruitment Rules, asshe has done her graduation in B.Sc. Applied Science.

6. Since no clarification was forthcoming from the User department and the Board couldnot wait for an indefinite period for want of clarification, despite several reminders to theUser Department. The Board had no other option than to reject the candidature ofMS.Geeta Tomar vide rejection notice No.121 dated 21.02.2017 for not having therequisite qualification as per RR.

7. That the Board thereafter closed the recruitment process and returned theunfilled vacancies to the User department on 03.04.2017.

8. That the User department after the closure of recruitment process hasinformed vide letter dated 1.8.2017 that the Competent Authority had approved thesubject studied by the candidate for consideration for the post of TGT (Natural Science).

9. The Board in response thereto vide its letter dated 16/10/2017 informed theDirectorate of Education, GNCTD, i.e. the User department that the Board had alreadyclosed the recruitment process and the unfilled vacancies were returned to the Userdepartment on 03.04.2017 and, therefore, requested to take necessary action.

10. The candidate, Ms. Geeta Tomar approached the Hon'ble CAT vide OA No.4452/2017and the Hon'ble CAT vide order dated 02.01.2019 as reproduced in para 1 of this notice,had ordered to consider the applicant as having the educational qualification necessaryfor the said post, in accordance with the letter dated 1.8.2017 issued by the Directorateof Education, GNCTD. The candidate has now approached the Hon'ble CATseeking contempt proceedings against the Board vide CP No.100/65/2019, forhaving failed to implement the orders dated 02.01.2019, as detailed in para 1of the notice hereinabove.

11. In compliance of the Hon'ble CAT order dated 02.01.2019 in OA No. 4452/2017,titled Geeta Tomar Vs. GNCTD & Others, since the candidate had qualified theexamination and was placed higher in merit than the last selected candidate in OBCcategory and as the single post had been returned unfilled in the particular category,coupled with the fact that user Department i.e. Directorate of Education, Govt. of NCT ofDelhi has since approved the subject for post of TGT (Natural Science) accepting hereducational qualification. Accordingly, the rejection notice No.121 dated21/02/2017 of the following candidate stands modified and she is provisionallynominated on the basis of written examination held on 28/12/2014 in the lightof clarification vide No.DE.3(54)/E-III/DR/pf(3)/2016/4749 dated01/08/2017 regarding eligibility of the candidate for the post of TGT (Natural Science)Female, Post Code-113/12 in Directorate of Education as under:-

12. The selection of the above candidates shall further be subject to genuineness of thedocuments on the basis of which they have claimed to have fulfilled all the eligibilityconditions as prescribed in the RRs and terms and conditions of advertisement invitingapplications and subject to thorough verification of their identity with reference to rhephotographs, signatures/handwriting etc. on the application form, admission certif te

etc. The candidature of the above candidates are liable to be cancelled by the UserDepartment also, in case the candidates are found not to be fulfilling the terms &conditions of the advertisement inviting applications for the said post code. The decisionof the User Department regarding the eligibility of the candidate shall be final andbinding on the candidate.

13. The User department shall also check the eligibility of the reservation benefit, if any.Further, if applicable, User Department shall verify the genuineness of the CasteCertificate furnished by the candidate prior to issuing offer of appointment to thecandidates.

14. The User Department shall also get the SC/ST/OBC certificates verified from theIssuing authority. Further, if applicable, User department shall verify the genuineness ofthe Caste certificate furnished by the candidate prior to issuing officer of appointment tothe candidates. in case of the OBC candidates, it may also be verified that the candidatedoes not belong to creamy layer of the schedule of Govt. of India, DOPT a.M.No.36012j 22j93-Estt.(SCT) dated 08.09.1993, a.M. No.36033j3j 2004-Estt.(Res) dated 09.03.2004 and 14.10.2009 and 36033j1j2013-Estt. (Res) dated27.05.2013.

15. The Competent Authority of the Department concerned shall Issue the appointmentletter to the candidates after being satisfied about their eligibility as laid down in therecruitment rules and after verification of the correctness of the information/documentsas furnished in the application for and e dossier vis-a-vis the original documents relatedto Educational Qualification, Age and other essential certificates as per Instructionsissued by Govt. of India in this regard vide MHA OM No.2j29j54-RRs 19-11-54.

16. The User department shall ensure that the appointment made is inconformity with DOPT guidelines and instructions of Govt issued from time totime.

17. Mere inclusion of name in the result notice does not confer any right uponthe candidate over the post unless the user department is satisfied after suchinquiry as may be considered necessary that the candidate is suitable

18. While every care has been taken in preparing the result, the DSSSB reservesthe right to rectify errors and omissions, if any.

19. This issues with the approval of Competent Authority, DSSSB.
