IT IS ORDERED THAT:
1 .Any interested party shall show cause to this Honourable Court sitting
at Harare on the 17th December 2014 why an order should not be made in
the following terms :-
1 .1 The Applicant, PM Manufacturing Private Limited be placed under
judicial management for an indefinite period.
1 .2 The costs of these proceedings be costs of judicial management.
1.3 Subject to provisions of Section 299 of the Companies Act (Chapter
24:03) (the Act), the Master shall appoint Mr. William Mandinde as
Judicial Manager of the Applicant companies with the powers and duties
set out in the Act.
1 .4 The Judicial Manager shall be entitled from the assets of the Applicant
companies of the payment of remuneration at a rate to be determined by
the Master of the High Court and to reimbursements of all out of pocket
expenses incurred by him during the course of his duties.2.Pending the granting of the order in terms of paragraph 1 hereof or the
discharge of this order;
2 . 1 The Applicant is placed under provisional judicial management.
2.2 The Master is hereby directed to appoint Mr William Mandinde as the
Provisional Judicial Manager of the Applicant with powers set out in the
Act.
2.3 All actions and applications and the execution of all writs, summonses
and other process against the Applicant Companies shall be stayed and
not be proceeded with without leave of this Honourabe Court.
3. This order shall be published in the Government Gazette and once in
the Newsday paper.
4. Any person intending to support or oppose this application on the
return day shall:-
4.1 Give notice to the Applicant c/o Messrs Chinawa Law Chambers
Legal Practitioners, 12th Floor, Causeway Building, Corner 3rd & Central
Avenue, Harare ( Mr T.E. Gumbo).
