NEW DELHI At a mega rally in Patna today, Bihar Chief Minister Nitish Kumar and Congress chief Sonia Gandhi targeted Prime Minister Narendra Modi, on land acquisition bill, saying he has been forced to bow "to the will of the people". "The rollback of the anti-farmer land bill is not PM Modi's Mann ki Baat, it is the nation's Mann ki Baat," Mr Kumar said, taking a dig at PM Modi's comments this morning on his monthly radio pro- gramme during which he said he was allowing the bill to lapse. The Prime Minister, Mr Kumar said, did not get the support of the legisla- ture or the people and "today he finally had to give in". Calling the government "anti-farmer" Mrs Gandhi, who addressed the rally before Mr Kumar, said, "It snatches land from farmers to divide it among its hand- ful of rich cronies". The government has finished one fourth of its time but has done nothing except "showbaazi," she added. Phizo,leader of the Naga NationalCouncil (NNC), who by 1960had shifted base to London.From London, Phizo wrote thatnothing short of independencewas acceptable to the Nagasbased on their history and tradi-tion. Phizo’s persistent writingsfrom London fuelled dissentagainst the 16-point agreementthat established Nagaland.

The latest agreement wassigned with NSCN (I-M), andother Naga armed groups such asNSCN (Khole-Kitovi) andNSCN (Reformation) haveeither resisted or welcomed theagreement. NSCN (Khole-Kitovi) pointed out on August 22at Dimapur that while they wel-comed any initiative that recog-nises Naga history, ethnicity andculture, they do not rejoice at theframework agreement, as it waslimited to just the NSCN (I-M).

Getting all actors on board

NSCN (Reformation) led byWangtin Naga and P. Tikhakhave applauded the peace initia-tive but have highlighted theimportance of an inclusive base.Members of the Naga Hoho andothers have volunteered to meetNSCN (Khaplang) in Myanmarto bring them into the consulta-tive process.

On August 25,at a People’s

ConsultativeMeeting on theaccord, Mr. Muivah spokeabout the criticality of gettingthe other Naga armed actors onboard. While explaining the ideaof a pan-Naga Hoho (a proposedstatutory body as part of theframework agreement) that willenjoy independent executive andbudgetary powers to look afterthe welfare of Naga inhabitedareas outside Nagaland, Mr.Muivah again called for mutualunderstanding and dialogueamong the Nagas. Niketu Iralu, arespected peace activist, presentat the meeting, highlighted thesignificance of consultation tobring on board those whoremained sceptical.

This consultative aspect leadsme to delve deeper into thechanging language, from one ofnegotiation to one that stressesdialogue. While negotiationaims at finding a concrete agree-

ment, dialogue aims at achanged relationship. Nagapeace negotiations have beenstalled for decades due to therigid postures of the main parties— like the government’s posi-tion that India’s territorialintegrity and sovereignty arenon-negotiable and the NSCN(I-M)’s insistence that any reso-

lution has

to be outside the framework ofthe Indian Constitution and mustinclude integration of all Nagainhabited areas.

According to Hal Sanders,from the International Institutefor Sustained Dialogue and theKettering Foundation, “Dialogueis a process of genuine interac-tion through which humanbeings listen to each otherdeeply enough to be changed bywhat they learn. Each makes aserious effort to take others’ con-cern into her or his own picture,even when disagreement per-sists. No participant gives up heror his identity, but each recognis-es enough of the other’s validhuman claims that he or she willact differently toward the other.”There are certain key compo-nents of a successful dialogue,namely, inclusiveness; joint

ownership; listening, learning,and adapting; empathy andhumanity; notions of ‘self’ andthe ‘other’; understanding ofcontext; transparency; and avision for the future.

Dialogue aims to bridge thegap between the notions of ‘self’and the ‘other’ and the construct-ed realities based on that distinc-

tion. The participants in thedialogue must have an

understanding ofthe historical

sensitive tothe changing politi-

cal and social context.Cultural knowledge and under-standing of the ‘way of the land’is critical. Any dialogue musthave a long-term vision for thefuture propelled by the recogni-tion that changed relationshipshold the key to conflict resolu-tion.

The primary participants in theNaga dialogue processes,besides the government, are list-ed in the table alongside.Besides this, ordinary citizenslike businessmen, intellectuals,and church leaders must beinvolved. The Naga dialoguesvary in participation from a min-imum of 20 to a maximum of10,000 people and the processranges from two days to amonth. The dialogues have beenmostly facilitated by the NagaHoho, the Forum for NagaReconciliation (FNR) and theJoint Forum for Gaonburahs and

Doibashis (JFGBDB). Thesecivil society actors see the con-flict as a response to the inade-quate fulfilment of basic humanneeds in Naga society. Thoughthey rarely believe that theNSCN (I-M)’s or NSCN (K)’smovements for an independenthomeland will succeed, theysupport the violent struggle as afight for justice and safeguardingethnic life-worlds.

Such consultative meetingshave been routinely held overthe years to address issues per-taining to the Naga conflict. Thetest for the current consultativeprocess is to absorb the princi-ples of dialogue identifiedabove, especially pertaining toinclusiveness, joint ownership,transparency, and a vision for thefuture. Resistance from theKhole-Kitovi, and Khaplang fac-tions to the August 3 agreementhas to be addressed within theframework of dialogue.

Moreover, the Naga intra-com-munity dialogue participantsmust evolve an ‘inter-dialogue’mechanism with conflicting eth-nic groups like the Meiteis, andgive a genuine hearing to theirconcerns of possible subjugationby the Nagas. Mr. Muivah indi-cated his desire to address theanxieties of other States inNortheast India on the Nagalimdemand in his August 13 speechat Dimapur. An inter-ethnic dia-logue on the Naga frameworkagreement across affected Statesin the North-east will be a goodstart to making it more inclusive.

Another confident launch

Sign accords but talk peace

Thirty years after theBhopal disaster, therecent upsurge of inter-

est in the Kodaikanal mercurypollution case has made onething clear. Neither the centralgovernment nor any State gov-ernment has done anythingtowards putting in place a poli-cy for environmental remedia-tion of contaminated sites orrehabilitation of affected peo-ple. On the contrary, the author-ities have actively colludedwith the polluters to diluteenvironmental standards andfrustrate efforts by communi-ties to seek compensation.

Every time a factory pollutesa neighbourhood or exposespeople to poisons, people haveto fight a hostile system thatrequires victims — mostly,indigent people — to conclu-sively prove that they and theenvironment have beenharmed. Arrayed against thoseaffected by pollution stands averitable army of scientificinstitutions, State and CentralPollution Control Boards, theEnvironment Ministry and thewealthy polluters with hugebudgets to hire lawyers, andbuy science and media space.

Toxic hotspots and affectedpeople can be found across thecountry alongside pollutingfactories — be it the cancercorridor between Vapi andBharuch in Gujarat, Jeedimetlain Andhra Pradesh,Udyogamandal near Kochi, theindustrial estates in Mettur,Thoothukudi or Cuddalore inTamil Nadu, or Singrauli andBhopal in Madhya Pradesh.Successive governments haveworked out elaborate policiesto promote industrialisation,

but none to address theinevitable fallout of unregulat-ed industrial activity.

Fourteen years after the 1984gas leak, Union Carbide in1998 dusted off a few shelvesin its Bhopal factory, movedsome toxic waste from the floorto sacks and drums, andhanded over the siteto the Stateg o v e r n -m e n t ,

claimingto havecleaned it up.But the factory siteremains dangerously con-taminated and continues toclaim lives and maim children.Now, activists are trying hardto uphold the ‘polluter pays’principle to ask for a thoroughclean-up of the site.

Lower standards

The case of Kodaikanalseems to be no different. Wherepublic participation, good sci-ence and ‘polluter pays’ oughtto be the legs on which any pol-icy for remediation stands, inKodaikanal, the Central andTamil Nadu Pollution ControlBoards (CPCB and TNPCB)have opted for secrecy, paid

science and ‘public pays’ as theprinciples for environmentalremediation following severemercury contamination aroundHindustan Unilever’s ther-mometer manufacturing facto-ry.

Emboldened bythe cooperation extended bystate regulators, Unilever isinsisting on a lower clean-upstandard. In the U.K.,Unilever’s home country, thesite would have to be cleanedup to 1 mg/kg to be fit for resi-dential purposes. In India,Unilever’s proposal is 20mg/kg, a number that is 20times more lax than Britishstandards, and 200 times morethan naturally occurring back-ground levels.

If the company’s numbers are

to be believed, such a clean-upwill leave more than a third ofthe mercury behind in the soilafter the company hands overthe ‘cleaned up’ site. But eventhese numbers are not credible.

After Unilever’s thermome-ter factory was shut down inMarch 2001, the company pre-pared a report that claimed toaccount for every kilogram ofmercury used in 18 years ofoperation. The report explainedthat of the 125,676 kg of mer-cury imported, all but 559 kgcould be accounted for, and thatthe latter figure was the loss tothe environment. As per thisfigure, only 170 kg of mercuryremained on site, mixed with

soil and vegetation and subjectto the proposed cleanup.

On the face of it, the mercurybalance was perfect. But as ex-workers pointed out, Unilever

had forgotten toinclude

10,810kg of mercury pur-

chased from Mumbai. Unfazed,Unilever’s consultant subse-quently redid the report toaccount for the additional mer-cury.

Supreme Court ignored

Before environmental reme-diation, a detailed and inde-pendent assessment of thedepth and spread of contamina-tion is required. Despiterequests from the public anddirections by the Supreme

Court Monitoring Committee(SCMC) urging the TNPCB toindependently assess contami-nation, the regulator has takennot a single soil sample in thelast 14 years and Unilever’sreport remains the basis for theclean-up.

questioned this report aswell as Unilever’s proposal toclean up the contaminated areasbased on a Dutch residentialstandard of 10 mg mercury perkilogram of soil. They pointedout that as the site was locatedatop a forest, it should becleaned up for targeted futureuse as a watershed and notmerely as a residential area. Inresponse, the TNPCB sidelinedthis ‘troublesome’ local com-mittee. It has not been con-vened since 2005.

Instead of commissioning astudy by itself, as directed bythe SCMC, TNPCB allowed

Unilever to engage the NationalEnvironment EngineeringInstitute (NEERI) directly toset the standards. Ironically,NEERI head and SCMC mem-ber Dr. Tapan Chakraborti, whohad insisted on a clean-up stan-dard of 2 mg/kg in May 2005,in a report submitted in 2007,backed Unilever’s case for arelaxed standard.

NEERI’s argument for dilut-ing the standard is candid: “Thebenefits likely to accrue out ofstricter norms are to be com-pared against the additionalcost [to Unilever] that may beincurred while undertakingsuch projects.” The proposedstandards were geared to pro-tect the financial health ofUnilever.

If the writ of experts such asthese is allowed to prevail, theKodaikanal site will remain asignificant reservoir of mercuryeven after the clean-up, leakingdeadly neuro and nephrotoxininto Kodaikanal’s lakes and thePambar Shola watershedforests. These forests form thecatchment area for southernTamil Nadu’s lifeline, the riverVaigai.

Any policy for remediationof contaminated sites should bebased on sound science. Andscience is sound only when sci-entists and their work are sub-ject to public scrutiny. That iswhy activists and residents arecalling for transparency andpublic participation as the onlyway to keep government bodiesand experts from toeing thecorporate line.

The Indian Space Research Organisation’s secondconsecutive successful launch of theGeosynchronous Satellite Launch Vehicle (GSLV),

with an indigenous cryogenic upper stage (CUS), provesthat its earlier success in January 2014 — which cameafter a failed launch in 2010 — was no fluke. Also, this isthe first time a GSLV rocket with an indigenous CUS hascrossed the two-tonne payload mark: the GSAT-6 that itlifted weighed all of 2,117 kg. The ability of ISRO scien-tists to learn from failures, and their resilience in overcom-ing technical obstacles, are commendable indeed. Gainingmastery in managing the CUS, which involves a complexprocess of using propellants at extremely low temperaturesin flight, requires higher-order skills in space technology.ISRO has not had a single launch failure in four and a halfyears, a fact that boosts the confidence level and morale ofthe scientific fraternity in the country. The record also but-tresses the image ISRO commands in the realm of spacelaunches, especially given that other global players are notvery generous with technology transfers. ISRO has regis-tered many a successful launch over the last few years,including its mission to the Mars. However, earning the‘operational rocket’ tag for the GSLV-Mk-II following thetwo consecutive successful launches will not immediatelymean much, as most of the communication satellites ISROcurrently makes are beyond the GSLV-Mk-II’s two-tonnecapability. India’s dependence on foreign space agenciesto launch those heavier satellites will continue till theGSLV-Mk-III is tested and declared operational. Indiaspends approximately Rs.500 crore per launch, and thecost is rising with each launch. The GSLV-Mk-II, at most,can save money on our own launches but it is not a rev-enue-earner yet. The INSAT-4A weighing over threetonnes was designed way back in 2005 by ISRO, and theGSLV-Mk-II has cleared two tonnes only a decade later.As global trends reflect an increase in the size of commu-nication satellites and a reduction in the size of earthobservation satellites, rocket-making should aim to matchfuture requirements besides being cost-effective. ForIndia, a developing country, every rupee spent has to beworth it. ISRO will require more flawless Mk-II launchesto understand GSLV behaviour adequately and develop therequisite confidence and expertise. But the paucity oflaunch pads might still limit the process. While the Marsmission and the experimental crew capsule mission arefeathers in ISRO’s cap, making rockets for satellitesshould be the priority. Even as ISRO expands its capabili-ties, how soon it would achieve true self-reliance will be acrucial factor.

The Naga internal consultativeprocess has tried to be inclusive of civil society bod-

ies, academia, student bodies, social organisations andarmed groups since the 1950s. The three Naga Peoples’

Conventions (NPCs) from 1957 to 1959 resulted in the formation of theState of Nagaland, established in 1963. However, this process, inclusive asit may have been, failed to garner the support of A.Z. Phizo, leader of theNaga National Council (NNC), who by 1960 had shifted base to London.

From London, Phizo wrote that nothing short of independence wasacceptable to the Nagas based on their history and tradition.

Mr Prasad let his outrage show. "I foughtfor social justice and you say I lorded over aJungle Raj. It is only because of me that back-ward leaders got some recognition in theBJP."

"You say this is Jungle Raj part 2. No, thisis Mangal Raj part 2 (the government of thegood). When two backward leaders cametogether, the BJP started panicking. Now,they are saying Jungle Raj," he added.

The Prime Minister timed his land ordi-nance move on a day Bihar Chief ministerNitish Kumar, RJD leader Lalu Prasad andCongress chief Sonia Gandhi come on oneplatform today to address the "Swabhimanrally" in Patna.

The government could not pass the land billduring the monsoon session that ended onAugust 13.

On Friday, the government issued a statuto-ry order to continue benefits for farmersunder the 2013 Land Acquisition Act. Itincludes 13 Central Acts like NationalHighway and Railways Acts to extend bene-fits to those farmers whose land is acquiredunder the Act, said sources. It was meant todo away with the need to issue the ordinancefor a record fourth time.

Around noon, having dug just a couple offeet into the ground, the team sighted a por-tion of the skeleton sticking out.

They learnt about Police Patil GaneshDhene of Hetevne village, who was presentwhen the body was found at the crime sceneon May 23, 2012, and also when it was laterburied there by the police the same day.

Mr Dhene, who has been Police Patil since2011, remembered that the body was buriednear a mango tree in 2012, which helped inidentifying the spot and leading the policeteam there.

As per the Bombay Village Police Act, aPolice Patil is directly subordinate to thePolice department and the taluka magistrate.In case a crime is committed in the limits ofvillage, he makes immediate report to thepolice station and renders necessary help tothe police officer to detect the offender.

Raghuram Rajan...the Kansas City Federal Reserve, said infla-

tion has come down in India, and replied inaffirmative when asked whether it was com-ing into RBI's comfort zone more quicklythan he had expected.

In an earlier interview also, to CNBC at thesame summit, Dr Rajan had said that he wasnot finished with rate cuts and RBI continuesto remain in accommodative mode.

When asked whether the capital flight andcurrency depreciation would put him in aposition to keep the rates unchanged, DrRajan told WSJ: "No, you know, capital isattracted to strong economies. What we haveseen in India is that for the most part we havebeen attracting capital.

"Now, emerging markets have suffered aloss of capital, outflows, in the last fewmonths. We have had some, nothing too par-ticularly dramatic. It's been a little out fromthe equity markets. The debt flows havestayed pretty much in."

On what would drive his decision betweengrowth and inflation, Dr Rajan said, "I thinkthe growth feeds in, to the extent that itaffects our inflation outlook. And if we feel,for example, that global growth is very weakand commodity prices are going to remainlow for a long time that feeds into our infla-tion outlook also.

"Our primary focus is on the inflation out-look. That's helped by a good monsoon. It'shelped by lower commodity prices. And, youknow, it's hurt by significant exchange-ratedepreciation."

To a specific question on whether he wasbiased towards easing of rates but was yet totake a call, Dr Rajan said, "We are on a phaseof accommodation. We are still in that phase.We are looking at the data to see what moreroom we have."

Truth vs Hype...rape in Mumbai, as well as new data from

the National Crime Records Bureau (NCRB)suggests the danger is far more likely to comewithin the Indian home, or in a familiarspace.

The NCRB numbers for 2014 show that

across the country, acquaintance rape is ashigh as 85 per cent of the total number ofcases. This is a drop of 10 per cent from theprevious year, but still a high figure.

In a far more detailed study, Majlis, aMumbai-based group working on sexual vio-lence cases, which examined 644 recordedrape cases in the city between 2008 and 2015and found that just 9 per cent were strangerrapes. In the 91 per cent remaining cases, theoffender was known to the victim.

"This is very disturbing because most ofour focus is on public rapes," Flavia Agnes,founder of Majlis, told NDTV. "And most ofour policy response is also thinking that mostrapes are in public."

These findings mirror a consistent patternof high prevalence of acquaintance rape. Arecent study by The Hindu of hundreds ofrape cases registered in Delhi in 2013 came tothe same conclusion. "Of 162 cases, just 12involved strangers and 30 involved family,while a 111 involved neighbors," saidRukmini Shrinivasan, the paper's NationalData Editor.

According to Majlis, within the ambit ofacquaintance rape, rape by a friend, neigh-bour or trusted person was nearly double thatof rape by a family member. But this mayalso be because abuse by family is the hard-est to report.

Tata Group's...by it.The total revenue rose by 5.3 per cent to

$108.78 billion, from $103.27 billion in thefiscal 2013-14.

In rupee terms, the total revenue rose by 6.5per cent to Rs 6,65,185 crore in 2014-15, whilesales were up 5.9 per cent at Rs 6,53,381 crore.

The revenue growth rate has, however, fall-en from 18.5 per cent recorded in the previousfiscal 2013-14.

While the profit figures were not disclosed,the group's international revenue rose by 5.8per cent to $73.41 billion. Revenue from glob-al operations had grown by 27 per cent in theprevious fiscal.

Total assets rose to $117.9 billion, from USD116.3 billion during the fiscal.

The group's total headcount stood at6,11,794 at the end of the fiscal 2014-15, outof which more than 3.5 lakh were in its IT andcommunications business. The engineeringbusiness had more than 93,000 employees,while materials business had over 80,000 andservices had nearly 44,000 staff members.

The consumer products business also hadmore than 22,000 employees, while energysegment had over 9,000.

In 2013-14, the group's employee count hadincreased by 6.8 per cent to 5,81,473.

In the group revenue during the latest fiscal,the engineering business accounted for thelargest pie of 41 per cent, followed by materi-als and the IT & communications at 21 percent each.

Services and energy business contributed 5per cent each to the group revenue, while con-sumer products' share was 4 per cent and thatof chemicals at about 3 per cent.

Founded by Jamsetji Tata in 1868, the Tatagroup has over 100 independent operatingcompanies across six continents, out of which30 are publicly listed entities with combinedmarket capitalisation of about Rs 8 lakh crore.

Tata Sons is the principal investment holdingcompany and promoter of the Tata companies.

Early actionmay be taken in this regard," the Committeechaired by Satish Chandra Misra said in itsreport.

"At this project, the number of directemployment would be a whopping 15,000,"Mr Siddaramaiah said.

The chief minister also said Rs 216 crorewill be invested at the Electronic City project,creating job opportunities for 3,500 techiesand alike.

Last year, India received $70.4 billionremittances from its worldwide diaspora.

The NRIs based in the UAE sent home$12.6 billion remittances in 2014, accordingto the World Bank.

The current fall in rupee is mostlyattributed to the falling oil prices as well asthe strengthening of the dollar.
