Compliance Now

The menu labeling compliance date has been postponed again.

As a result of language in the omnibus appropriations bill enacted December 18, 2015 (Public Law 114-113 Consolidated Appropriations Act, 2016), FDA is

delaying enforcement from December 1, 2016, to the date that is one year after it issues final, Level 1 guidance on menu labeling. The draft Level 1

guidance was issued on Sept. 11, 2015, and FDA is considering all comments received and will issue the final guidance as soon as possible. (FDA Statement

on Menu Labeling Enforcement)

That does not mean, however, that it’s a good idea to procrastinate!

Your Customers Want to Know

Consumers are increasingly interested in what is in their food, particularly calories, carbohydrates, protein, and fat. And they look to you to educate them. This is an opportunity to show them you want to meet their needs because it's important, not merely because it's required.

It’ll Take Time to PrepareThe process of getting compliant can take longer than you might think. Depending on the size of your menu, and what methods you use for analysis, it could take months. You don't want to risk falling behind and dealing with inspections and/or possible fines. Plus, starting early will leave you more time to fine-tune your analysis and make any menu changes you deem necessary.
