My dear fellow exporters,
I am glad to inform you that after many presentations from the Council to the Department ofCommerce on the need to halt the declining export trend in the Hand Tools Industry, five tarifflines in the Hand Tools Industry has now been included in the Focus Product Scheme. The Councilconveys its thanks to the Department of Commerce for recognizing the tremendous contributionthat the Hand Tools Industry has made not only in promoting export, but also in creatingemployment generation in the country for which it needs to be supported through progressivemeasures such as the Focus Product Scheme. I hope this will provide the necessary boosterfor Hand Tools Exporters and they will take necessary steps to reverse the declining export trendin their sector.
The confusion with regard to the export duty Notification No. 66/2008-Customs dated 10th May,2008 continues and the Council has also met Shri Vivek Johri, Joint Secretary (TRU), Ministryof Finance, Government of India, in this regard. Shri Johri has requested that in case of problemsrelated to such confusion being created at the Customs Offices, members may kindly intimatethe same by letter to Shri Johri. Members may kindly write to us mentioning the HS Codes ontheir products on which export duties are being charged by the Customs Authorities and can alsowrite directly to Shri Johri, which can be sent by Fax to him at the No. 011-2309 2031
As I had informed to you last week, the Indo-EU Trade Sub-Commission will be held in the monthof June 2008. The Council has made a detailed presentation to the Government in this regardhighlighting the problem faced by our member exporters on issues such as Visa, technicalstandards, high certification charges etc. We hope that at the Trade Sub-Commission meetingwill discuss threadbare these issues to enable Indian exporters to enhance their links with EuropeanUnion. Some members have also mentioned to us about the problems faced by them with regardto GSP and GSTP Certification at EIC offices. We have already taken up this matter with theDepartment of Commerce and we hope that steps would be taken to streamline this process.
I would also like to inform you that the Council has submitted an application for the World TPOAwards 2008 for the best TPO from a developing country category. This is, indeed, a prestigiousaward and TPO�s from various parts of the world apply for the award. We have presented anexcellent document along with our application to justify why EEPC should get the award in thiscategory and we hope that with your blessings, the Council will be able to achieve this milestone.

Libya offering Serbian economy joint appearance in Africa. Libya is the gateway to Africa for all European countries,
which means that Serbian companies should go for joint ventures with Libyan companies for the purpose of a joint
appearance on the African market. There is about Euros 8 billion in the investment fund, which is earmarked, among
other things, for linking the European Union to third world countries and countries of Asia and the Pacific.
Investment in Trayal to amount to Euros 17 million. Petar Petrov, the General Manager of the Krusevac-based Trayal
Company, announced an investment of Euros 17 million in the company this year. The investment should result in 60%
higher outputs of the tyre factories. The owner of Trayal announced the production of three new types of car tyres.

Dairy Imlek to invest EUR 10 million in 2008. Belgrade-based dairy company Imlek plans to invest about EUR 10 million
this year in live stock, stables, milking machinery, and food production equipment. Imlek, part of Danube Foods Group,

WEG Technology builds factory in Serbia. Serbian company for domestic appliances, audio and video devices production
and selling, WEG Technology would start to build a factory in June in Serbia of EUR 2 million of worth. The WEG group,
whose headquarters were located in Belgrade, momentarily produced their products in Turkey and China and the start
of production in Serbia was expected by the end of the year.

Electricity powered cars from Debeljaca soon. The Globus Auto Company plant in the village of Debeljaca will produce
20 electricity powered cars and 500 scooters by the end of the year. The plant in Debeljaca was opened in cooperation
with Chinese partners and added that the overall value of the investment will be Dinars 52 million (aprox. USD 1 million).
Globus Auto will start assembling its own models by the end of the year, perhaps including a sports vehicle and there
are plans to make electricity power buses and mini-buses for city transport.

Serbia, Croatia and Romania sign PEOP agreement
Serbia, Croatia and Romania signed an agreement on establishinga joint company that would participate in construction of the Pan-European Oil Pipeline (PEOP) in Bucharest. Slovenia and Italy willjoin the agreement, after they appoint companies which will take partin the project. PEOP would be 1,400 km long, whereas the annualcapacity should be 60-90 million tons of oil. The value of works hasbeen estimated to about USD 3.5 billion, and construction of the partgoing through Serbia is worth about USD 300 million.

Subject : Payment of amount under Rule 6 of the CENVAT Credit Rules, 2004 � reg.
The undersigned is directed to refer to Circular No. 599/36/2001-CX dated November, 2001, wherein the issue of theapplicability of the provision of section 11D of the Central Excise Act, 1944 in cases of payments made under erstwhile rule57CC (1) of the Central Excise Rules, 1944 was examined. It has been brought to the notice of the Board that there are somedecisions of the Tribunal contrary to the said circular. Further, rule 6 of the CENVAT Credit Rules, 2004, has been amendedw.e.f. 01.04.2008, necessitating re-examination of the circular of the circular in the light of these developments.
2. It is seen that the Larger Bench of the Tribunal in the case of Unison Metals Ltd. Versus Commissioner of Central Excise,Ahmedabad-I [2006(2004) E.L.T. 323 (Tri.-LB)] has held that section 11D provides that any amount which has been collectedas excise duty and not paid to the credit of the Central Government shall be liable to be recovered. The scheme of the Lawis that manufacturers shall not collect amounts falsely representing them as Central Excise duty and retain them, thus,unjustly benefiting themselves. However, in case of payments made under erstwhile rule 57CC(1), Section 11D of the Act isnot applicable since the amount of 8% or 10% has already been paid to the revenue and no amount is retained by theassessee. The said order of the Tribunal has been accepted by the Department.
3. The matter has been examined. Sub-rule (3) of rule 6 of the CENVAT Credit Rules, 2004 has been amended w.e.f.01.04.2008 to provide for payment of an amount equal to 10% of value of the exempted goods, instead of 10% of the priceof the exempted goods as provided earlier. The value is to be determined as per section 4 or 4A of the Central Excise Act,1944 read with rules made thereunder.
4. In the light of what is sated above, it is clarified that as long as the amount of 8% or 10% is paid to the Government interms of erstwhile rule 57CC of the Central Excise Rules, 1944 or rule 6 of the CENVAT Credit Rules, the provisions ofsection 11D shall not apply even if the amount is recovered from the buyers. However, it may be noted that the CENVATcredit of the said amount of 8% or 10% cannot be taken by the buyer since such payment is not a payment of duty in termsof rule 3(1) of the CENVAT Credit Rules, 2004. Therefore, the said 10% amount should be shown in the invoice as �10%amount paid under Rule 6 of the CENVAT Credit Rules, 2004�.
5. Board�s Circular No. 599/36/2001-CX dated November, 2001 stands withdrawn.

Exim Bank Extends US$ 30 mn Line of Credit to Malawi
Export-Import Bank of India has, at the behest of Government of India, extended a Line of Credit (LOC) of US$ 30 million to
the Government of Malawi. The LOC will be utilized to finance supply of irrigation, storage, tobacco threshing plant and one
village- one project in Malawi. Under the LOC, Exim Bank will reimburse 100% of contract value to the Indian project
exporter (s), upfront upon the shipment of goods/provision of services.
This is the first ever LOC extended by Exim Bank to Malawi, located in Southern Africa. Tobacco is the largest item,
contributing 48.8% of the total exports of Malawi followed by sugar, tea and cotton. Main products exported from India to
Malawi are : drugs & pharmaceuticals, machinery & instruments, manmade yarn & fabrics, transport equipment and plastic
and linoleum products.
Besides promoting India's exports, Exim Bank's LOCs enable demonstration of Indian expertise and project execution
capabilities in emerging markets. With the signing of this LOC Agreement, Exim Bank has now in place 90 Lines of Credit,
covering 89 countries in Africa, Asia, Latin America, Europe and the CIS, with credit commitments amounting to US$ 2.992
bn, available for utilization for financing exports from India. Exim Bank's LOCs afford a risk-free, non-recourse export
financing option to Indian exporters.
