Delhi HC pulls up Sudhir Guptafor 'delaying tactics' on AIIMSpleaNEW DELHI

The Delhi High Court on Monday pulled up AIIMSforensic department head Sudhir Kumar Gupta for notserving the copy of his reply to the institute and otherparties, observing that he was trying to "delay" theproceedings on a plea seeking his replacement.

"Counsel for petitioner (AIIMS) says that he has notreceived the copy of reply which has been filed by therespondent (Gupta). It has been found that copy ofreply was posted at the address of AIIMS, whichappears to be a delaying tactics on the part of respon-dent," a bench of Justices G S Sistani and SangitaDhingra Sehgal said.

During the brief hearing, Gupta who had earlieralleged discrimination after he claimed to haverefused to act unprofessionally in the SunandaPushkar autopsy matter, said the way his replacementwas being sought by All India Institute of MedicalScience (AIIMS) was not justified.

"Earlier, the convention adopted by the institute inreplacing the head of a department was that either theincumbent was unavailable or he or she resigns fromthe post, only in those cases a new person wasappointed," Gupta's counsel Senior AdvocateAmarendra Sharan said.

To this, the bench observed, "you can't continue tobe a head of department forever."

The counsel then alleged that Dr D N Bhardwaj,whose appointment as the new head of the ForensicMedicine and Toxicology Department is being soughtby AIIMS, is not a competent person to hold the post.

"He (Bhardwaj) has Parkinson's disease and he is theperson who has left a bullet during an autopsy of vic-tim in a Ponty Chadha case," Sharan alleged, addingthat Bhardwaj does not deserve to be the head of adepartment.

A day after the video of an apparent drunk cop trav-elling in a metro train went viral, Delhi PoliceCommissioner BS Bassi on Monday said that he hasbeen identified and placed under suspension.

“The cop has been identified and we have initiatedaction against him,” Bassi was quoted by ANI.

Delhi Police Commissioner issued a strict warningand added, “It is unacceptable if any police officer isfound drunk in uniform, even during off duty hours.This is one of its kind incident.”

Crying "conspiracy" over BJP chief Amit Shah's liftincident in Patna, Union Minister Ram Vilas Paswanon Monday wrote a letter to Home Minister RajnathSingh seeking a "high-level probe" into the matter.

In the letter, Paswan said that the incident whichhappened in the state guest house cannot be termed a"normal one."

"This can be the result of either gross negligence orsome conspiracy. I am of the view that there should bea high-level probe in this incident," Paswan, whoheads the NDA ally in Bihar Lok Janshakti Party, saidin the letter.

He requested the Home Minister to direct the stategovernment to hold a comprehensive probe into thematter.

Scaling up the issue, Paswan suggested that theCentre can also give directions on its own to somecompetent agency to probe the matter, so that therecurrence of such incidents are checked in future.

On August 21, Shah and Bihar BJP in-chargeBhupendra Yadav had been stuck in the state guesthouse lift in Patna for about 40 minutes after itstopped a little short of the first-floor alignment level.

While the state BJP called it "negligence" on the partof the state government, the Bihar government said thelift stopped because the weight limit of 340 kg wasexceeded. There were four people in the lift -- Shah,Bhupendra Yadav, another senior BJP leader SaudanSingh and RSS leader Nagendraji.

arrested a biker, a day after heharassed and intimidated a youngwoman in Tilak Nagar.

The biker was booked on chargesof sexual harassment and criminalintimidation.

"The accused was aware thatpolice was looking for him and assuch was on the run. We nabbed himfrom the same area (Tilak Nagar),"Joint commissioner of PoliceDependra Pathak told IANS.

"He has been taken to the policestation. More information will beshared with the media after investi-gation," he added.

Police said Delhi University stu-dent Jasleen Kaur was abused at atraffic signal in Tilak Nagar area inDelhi at around 8 pm on Sunday.

The minister also saidthe passage of Goods andServices (GST) bill couldhave helped in controllingonion prices.

After reviewing the sup-ply and the price situationhere today, Mr Paswanurged all state govern-ments to take stringentaction against hoarders torein in prices, while assur-ing that steps taken toimport the key kitchen sta-ple and curb exports willhelp control the rates.

On sharp rise in onionrates in Delhi, Mr Paswansaid, "Last year, adequatemeasures were takenagainst hoarders but thistime the state governmenthas not taken enoughsteps."

During 2014 monsoonwhen onion prices hadrisen, Delhi was under thePresident's rule and wasgoverned by LieutenantGovernor Najeeb Jung.

Terming price rise inonion as a temporary phe-nomena, Mr Paswan saidthere is no shortage assuch in the country buthoarders are trying to takeadvantage of the situation.

"There is a productionshortfall of only five lakhtonnes in the country.

Hoarders get active whenthere is production fall.The state governmentsshould take action againsthoarders to controlprices," Mr Paswan toldreporters.

Wholesale onion priceat Lasalgaon inMaharashtra, Asia'sbiggest onion market, hasincreased to almost Rs. 60per kg, while retail onionprices have risen up to Rs.80 per kg in the may partsof the country.

Asked as to why theBJP-ruled Maharashtra,the leading onion growingstate, not been able to con-trol the prices, Mr Paswansaid the passage of GSTwould facilitate for easymovement of onionsacross the country, therebyimprove supply and con-trol prices.

Highlighting the meas-ures taken to boost domes-tic onion supply, the min-ister said MMTC hasfloated a tender for importof 10,000 tonnes of onionand the tender will beopened on August 27.

The minimum exportprice of onion has alsobeen increased to USD700 per tonne from USD425 per tonne to restrictexports and the state gov-ernment has been asked toimpose stock holding lim-its on traders, he added.

Total onion productionis estimated to be at 189lakh tonnes in 2014-15crop year (July-June),slightly lower than 194lakh tonnes, a year ago.

The ex-servicemen want the samepension as those of the same rankwho are retiring now. The veteranswant pensions benchmarked at the2014 rates and reject the governmentoffer of 2011 rates. Governmentsources say it would mean an expen-diture of Rs. 20,000 crore instead ofthe expected Rs. 8,000 crore.

Except two students, restof them were dischargedafter preliminary treat-ment.

Police said they receiveda call at the PCR about theincident and an FIR hasbeen registered in this con-nection.

"An FIR has been regis-tered under IPC sections284 (negligent conductwith respect to poisonoussubstance) and 336(endangering life or per-sonal safety of others)against unidentified per-sons. Further investigationis underway," a seniorpolice official said.

The EducationDepartment authorities,however, said the samplesof the meal served todayhave been sent for testing.

"The same meal wasserved to over 400 stu-dents of the school.

However, since thesestudents complained ofstomachache after con-suming it, we have sent thesamples for testing,"Padmini Singhla, Directorof Education told PTI.

Recently, a RTI queryhad revealed that the qual-ity testing of the foodserved under the middaymeal programme in DelhiGovernment schools is onhold since four months dueto non-empanelment oftesting labs.

"The meeting is likely totake place tomorrow. PMwants Posco to stay in India

and in this regard, the meet-ing will find ways to makethat happen. The Centrecan also suggest a jointventure with Posco to setup a steel plant or a similararrangement," they added.

The PMO's interventioncomes against the backdropof the steel major temporar-ily suspending plans to setup an integrated steel plantproducing 12 milliontonnes per annum (mtpa)steel in Jagatsinghpur dis-trict in Odisha, the largestFDI in India so far.

The push to merge andstreamline labour lawscomes in the wake ofPrime Minister NarendraModi's promise to simpli-fy them. Last October, thePrime Minister hadannounced labourreforms with an eye toturning India into a manu-facturing hub. But the new law - whichis expected to be the cen-terpiece of the reforms --will replace the existingMinimum Wages Act,Payment of Wages Act,Payment of Bonus Actand Equal RemunerationAct, among others,sources said.

Under it, the fixationand revision of minimumwages will now be left tostates -- earlier it couldhave been done both the

Centre and the states. Thestates will also beempowered to multiplythe minimum wagesdepending on how diffi-cult the task is.

In a path-breakingmove, the new law isexpected to bring trans-genders into the officiallabour force, creating anew category for them.

It will also include pro-visions to punish errantemployers - including afine of Rs. 50,000 to 1lakh for employers who

The Rajasthan High Court,in a judgment on theAugust 10, 2015, declared

the Jain practice of Santhara,which involves a voluntary fast-unto-death, an offence punish-able under the Indian Penal Code(IPC). This decision in NikhilSoni v. Union of India, is likelyto have far-reaching conse-quences, not only amongst theJain community in Rajasthan butalso across the country.Unfortunately, it conflates sever-al important issues of constitu-tional law, and symbolises theconfusion over the fundamentalguarantee of religious freedomin our constitutional jurispru-dence.

The court’s judgment is super-ficially reasoned, misconstruesfindings of the Supreme Court,and, most significantly, ignoresvital considerations that go to theroot of a person’s right to ethicalindependence.

It is undeniable that Indiansecularism — a form quite dis-tinct from western conceptionsof the term — envisages theintervention of the state in mat-ters of religion, where generalsocial welfare or substantial civilliberties are at stake. But, whatour Constitution, properly inter-preted, does not permit is thebestowal of any specific discre-tion on the courts to tell us whichof our beliefs and practices areessential to the following of areligion. By directing the Stategovernment to move towardsabolishing the practice ofSanthara, and by holding that thepractice is tantamount to anattempt to commit suicide, pun-ishable under Section 309 of theIPC, the High Court in NikhilSoni has created a damagingprecedent, which requires imme-diate re-examination.

Santhara, which is increasing-ly widely practised by Jains in

India, is a voluntary tradition offasting till death, that Jainsbelieve will help them attain ulti-mate salvation. As pointed out inThe Hindu ( “Santhara in theeyes of the law”, August 15) byShekhar Hattangadi, Santhara isembedded in deeply philosophi-cal beliefs. The practice ispremised on a foundational ideathat the act of fasting, as an exer-cise of bodily autonomy, allowsa believer to attain a state of uttertranscendence. However, thecourt has now found that suchmatters of integrity, of choosinghow one wants to lead life, donot enjoy any constitutional pro-tection, and that voluntary fast-ing is nothing but a performancein self-destruction. By any rea-sonable construction, fastingought to be considered indistin-guishable from an act specifical-ly aimed at ending one’s ownlife.

Effectively, the judgment inNikhil Soni is predicated on twoprimary grounds. First, that theguarantee of a right to life doesnot include within its ambit apromise of a right to die, andtherefore, that the practice ofSanthara is not protected byArticle 21 . Second, thatSanthara, as a religious practice,is not an essential part ofJainism, and is hence not pro-tected by Article 25 , whichguarantees a person’s right toreligious freedom and con-science. While on the firstground, the court’s reasoning isdifficult to accept, on the secondground, the court’s finding ispremised on a wrongly consid-ered doctrine, carved by theSupreme Court in its earliest rul-ings on the right to freedom ofreligion.

As the Rajasthan High Courtcorrectly recognises in NikhilSoni, Section 309 , which crimi-nalises the attempt to commitsuicide, has been found to beconstitutionally valid by the

Supreme Court, in 1996, in thecase of Gian Kaur v. State ofPunjab. However, the SupremeCourt was concerned here pri-marily with the unnatural extin-guishment of life. To die throughan act of suicide, the court held,is not an extension, or a recog-nised corollary, of one’s right tolife under Article 21. But con-trary to what the High Courtholds in Nikhil Soni, as a recentintervention petition filed by theDelhi-based Vidhi Centre forLegal Policy points out, theSupreme Court in Gian Kaurexplicitly recognises that a per-son’s right to life also partakeswithin its ambit the right to livewith human dignity. “…Thismay include the right of a dyingman to also die with dignitywhen his life is ebbing out,” thecourt wrote, in Gian Kaur. “Butthe “right to die” with dignity atthe end of life is not to be con-fused or equated with the “rightto die” an unnatural death cur-tailing the natural span of life.”

A dignified choice

The Jaina practitioners con-tend that Santhara is not an exer-cise in trying to achieve anunnatural death, but is rather apractice intrinsic to a person’sethical choice to live with digni-ty until death. These argumentswere brushed aside by theRajasthan High Court. It simplyfound, based on an incorrectreading of Gian Kaur, that thereis no dignity whatsoever in theact of fasting, and that therefore,there exists no freedom to prac-tise Santhara as an extension ofone’s right to life under Article21. But, perhaps, even moredamagingly, the court in NikhilSoni also rejected arguments thatsought to locate such liberty inArticle 25. Here, though, thefolly in its reasoning wasn’t asmuch a product of its own mak-ing, as it was a consequence of avague doctrine established bythe Supreme Court.

Plainly read, Article 25 guar-antees to all persons an equalentitlement to freedom of con-science and the right to profess,practise and propagate religion.The right is subject only to pub-lic order, morality, and health,and other recognised fundamen-tal rights. However, as thedebates in the ConstituentAssembly demonstrate, thesecommunity exceptions wereincluded purely to ensure thatthe guarantee of religious free-dom did not come in the way ofthe state’s ability to correct age-old social inequities. It wasn’tthe Assembly’s intention toallow organs of state any sub-stantial latitude in determiningwhich religious practicesdeserved constitutional protec-tion. But, in practice, perhaps outof an anxiety to ensure that thestate is not constrained in pass-ing legislation to remedy socialevils, the Supreme Court hasinterpreted Article 25 in a man-ner that has greatly restricted thescope of religious liberty.

Interpreting religious practices

The court’s constriction of thisfreedom has been achieved byinvoking a rather curious princi-ple: that Article 25 protects onlythose exercises that are consid-ered “essential religious prac-tices.” Through the 1960s, thisdoctrine, which was first envis-aged in the Shirur Mutt case,decided in 1954, ingrained itselfas an integral part of India’s con-stitutional theory. The court, on acase-by-case basis, often exam-ined individual religious canonsto determine what constituted anessential religious practice.Significantly, the court began toexamine whether a particularexercise was indispensable to theproper practice of a religion.

This interpretation has allowedthe court authority to determinefor the people what their reli-gious beliefs and practices,through a correct reading of their

religious texts and customs,ought to comprise. Invariably,the determination of what consti-tutes an essential religious prac-tice, therefore, amounts to a veryparticular form of moral judg-ment — a form of cultural pater-nalism that is quite antithetical toa liberal democracy.

It is this authority, which theHigh Court in Nikhil Soni, hasinvoked to rule that the criminal-isation of Santhara would notbreach a Jain’s right to religiousfreedom. “We do not find that inany of the scriptures, preachings,articles or the practices followedby the Jain ascetics, theSanthara…has been treated as anessential religious practice, noris necessarily required for thepursuit of immortality or mok-sha,” the judgment states. Thisanalysis, as is evident, does notconsider whether a personindulging in Santhara performsthe act out of an intrinsic beliefthat the practice flows from hisreligion, but rather adopts analmost-avowedly paternalisticoutlook. It tells followers ofJainism that under a purportedlyproper interpretation of theirreligious texts, Santhara is sim-ply not an essential practice. As aresult, the question of whether aJain’s right to religious freedomis violated by prohibitingSanthara is examined in a whol-ly unsatisfactory manner.

If, and when, the SupremeCourt sits on appeal over thejudgment in Nikhil Soni, it mustask the right questions: ofwhether any social inequitiesarise out of the practice, ofwhether any other right of itspractitioners are violatedthrough Santhara, of whether therights of any other person areinfracted when a person goes onfast. In so doing, the court mustalso reconsider its now age-olddoctrine of essential practice,which has caused a substantialweakening of the state of reli-gious freedom in India.

No alternative to talks

The flawed reasoning in the Santhara ban

Courts, as institutions ofinterpretation, intriguecitizens, and often awe

them. The dignity of their ritu-al, the imprimatur of the offi-cial, the detailed litany of textu-al interpretations before a judg-ment is arrived at, are oftenimpressive. Judgments oftenhave the moral gravitas and thenarrative power of a novel. Yet,a badly done judgment, even ifit appeals to the secular mind,lacks conviction. One felt thatabout the judgments aroundnuclear energy; equally, onesenses these limits in the judi-cial reading of Santhara.

I refer to the Rajasthan HighCourt’s verdict againstSanthara, or the centuries-oldJain practice of voluntarilystarving to death. On August10, 2015, the court’s JaipurBench ruled on a public-inter-est litigation (PIL) filed in May2006 against the practice. Itheld that Santhara wouldhenceforth be treated as “sui-cide” and accordingly madepunishable under the relevantsections — Section 309(attempt to commit suicide) andSection 306 (abetment of sui-cide) — of the Indian PenalCode. It made its absoluterejection of the Jain philosophyunderlying the practiceunequivocally clear. An appealchallenging the order has nowbeen filed in the SupremeCourt.

A way of life

The word Santhara means away of life and encompasses away of dying as well. InJainism, the body is seen as atemporary residence for thesoul which is reborn. One must

remember that a word canembrace a multiplicity ofworlds and meanings. As aresult, translation is one of themost difficult of acts. Itdemands a delicacy of under-standing about words which, intheir consequences, can belethal. Equivalences are wel-come when we seek unity butwe need a unity that can sustainthe multiple senses of differ-ence.

The critical word here is sui-cide. One is almost tempted tobe facetious. I remember thatmoment of epiphany in the filmSholay when actorDharmendra, as the characterVeeru, standing up on a watertower, tells Basanti (played byHema Malini) that he will com-mit suicide. An old man in thecrowd asks: “what is suicide?”The answer is profoundly wise.It says when Englishmen killthemselves, the act is called‘suicide’.

I was struck by this scene as Iread the High Court judgmenton suicide in the case of NikhilSoni vs. Union of India. Therewas an element of irony to it.The scene in Sholay is straightfrom the 1969 classic, “TheSecret of Santa Vittoria” andyet, in the very moment ofmimicry, the movie emphasisesthe essential drama of differ-ence. The court judgment,while playing with the culturesof difference, eventually suc-cumbs to a reductive act whichis textually disappointing.

There are critical nuggets ofinformation in the initial pages.It claims that the Jain attitude tothe body is different from theChristian attitude to the bodyand that Santhara is a ritual

farewell to the body; it is an actof non-violence performed asan ethical act. The court hintsthat for the petitioners,Santhara cannot be suicide. Theetymology and the cosmologiesare radically different.

The English word ‘suicide’means a deliberate killing ofoneself. The EtymologyDictionary cites W.E.H. Lecky,in a History of EuropeanMorals where he writes of thestigma attached to suicide. Heclaims that even in 1749, “asuicide named Portier wasdragged through the streets ofParis with his face to theground, hung from the gallowsby his feet and then thrown intothe sewers.” Right from its ori-gins up to the FrenchRevolution, suicide was a markof stigma of criminality andpollution.

Different narrative

Santhara encapsulates a dif-ferent narrative. It is a ritual actof purification, done in consul-tation with a guru, and followsthe most detailed of proce-dures. It cannot be an impulsiveact or an egoistic one. It bearsthe imprimatur of theology andthe approval of society.

As India became colonised,many Indian rituals came underthe critical Anglo-Saxon lens,and translation and interpreta-tion became a critical part oflegal exegesis. Is Santhara agiving up of life or of takingdeath in one’s stride? For a cul-ture that believes in rebirth, isSanthara philosophically orethically suicide? The framewidens as the drama becomessociological because then therewill have to be a differentiation

made between sati, suicide andSantara.

French sociologist EmileDurkheim, in his Suicide, agroundbreaking book in thefield of sociology, basicallymade a differentiation betweenthree forms of suicide — theanomique, the egoistic and thealtruistic genres of suicide(based on the personalities ofpeople). Anomie is a state ofnormlessness of rootlessnesswhere an individual commitssuicide because nothing bindshim. It is associated with socialdisorganisation and imbalanceand Durkheim has tried to illus-trate this by giving examplesfrom economic life. Egoisticsuicide occurs when the indi-vidual feels full of himself.These are suicides committedby persons who are self-centredand to whom self-regard is thehighest regard. In altruistic sui-cide, a person sacrifices him-self. It is a form of sacrifice inwhich a person puts an end tohis life by some heroic meansin order to promote or furtherthe interest of the cause or ideadear to him. In a sociologicalsense, altruistic suicide comesclosest to Santhara. It is a ritualof giving up the body in timesof old age, famine or catastro-phe or when an individual feelsthe need to be closer to cosmiccycles.

As one looks at the colonialinterpretation, the critique ofsati, where a woman sacrificesherself for her husband,brought condemnation.Santhara was read in a differentway as an act of non-violencetuned to the deepest norms ofJain culture.

Language and interpretation

Experts cited indicate that itadds a dignity to dying, wheredeath is in continuum withrebirth. Shekhar Hattangadi, aMumbai-based professor ofconstitutional law, has soughtto outline some of these con-flicts in his award-winning doc-umentary, Santhara: AChallenge to IndianSecularism? But one cannotreduce it to an encounter withcolonialism. To place it in thealleged opposition of religionand secularism fails to read it asa failure of language. There is aflatness, a narrowness to theEnglish language which eventhe presence of James Joyce,William Blake, Gerard ManleyHopkins and Shakespearecould not contain. For example,the word ‘corruption’ lacks themultiple senses and the flair ofsociety which invents wordslike upari, dakshina, seva for abribe. Santhara is a multivalentterm which cannot be reducedto the dreariness of suicide asclosure or a termination. TheEnglish term cannot compre-hend Santhara in terms of beinga ritual exit and a rite of pas-sage to a different world.Santhara, performed correctly,is ritual non-violence. In fact, Iwould feel that the court’s judg-ment misinterprets both theword and world.

There are doubts aboutSanthara. Many people havepointed to the coercive, evenaspirational aspects of the prac-tice. Witnesses claim that fami-lies whose reputations are atstake often refuse to let a per-son change his mind. There isan aspirational aspect as fami-lies of the individual who wish-es to observe Santhara getrespect and status, so they often

tend to advertise the act. Here,Santara is often presented assati. Its voluntariness is forgot-ten.

The court had to make a dif-ferentiation between Santharaand euthanasia, sati and sui-cide. It has made brief andsuperficial attempts to do so.And in this abortive act of com-parative sociology, the ritualdignity of Santara has beenlost. In the confusion betweenthe literal and the symbol,between a construction of factand celebration, the meaning islost.

A narrow view

The court — after its abbrevi-ated move through philosophy,ethics, language and law — hasreduced the whole to one nar-row issue, namely the test ofessentiality. It asks whereSanthara is an essential tenet ofJainism and declares that it isnot. Such a litmus test mightwork in textbook chemistry butit fails to work in the contextu-ality and polysemy of culture.The court could have beenstrict about aberrations or devi-ations from Santhara but toreduce the ritual act to suicideamounts to an exhibition ofilliteracy. The court seemsmore worried about the debateson euthanasia and sati thanabout looking at Santhara as acultural practice with its ownrepertoire of meanings.

The court claims that somerights can encompass theiropposite. The freedom ofspeech does not compel one tospeak. Yet, a right to life doesnot include the right to dieunder certain circumstances.Ethics and religion loose out to

the wooden definitions ofSanthara, which, as a ritual, hasqualities of a controlled experi-ment. The court has held thatextinguishing life, sacrificing itor effacing it cannot be consid-ered as acts of dignity. A rightto die cannot be a part of a rightto life. In constructing such ajudgment, the court’s ethno-centricity becomes obvious. Itenshrines a piece of Christiantheology and Anglo-Saxon lawin its response to the logic ofSanthara. Eventually, the judg-ment creates a monologic senseof life and a standardised senseof what death and dying is. Infact, it has missed an opportu-nity to look at life and deathand the ethics of dignity anddying in a creative way. In cre-ating such a standardised theol-ogy, the fact of justice becomessecondary. This has widerimplications because words inone culture cannot lose theirmeaning in translation.Language and justice die or arediminished when language isdeprived of its right to polyse-my and to a multiplicity ofmeaning. When language isrendered captive, justice losesout in the long run.

The aridity of a reductive sec-ularism often comes out in dis-plays of language. In fact,translation becomes a test ofjustice. This is the epic tragedyof the Santhara judgment. Itconveys the fact that nationstates that can inflict and adju-dicate death, often feel lost inthe complexity of the phenom-enon.

The failure of India and Pakistan to hold the plannedmeeting between their National Security Advisers,as was agreed in Ufa six weeks ago, is unfortunate,

indeed disquieting. It should give pause to both Islamabadand New Delhi on what kind of relations they could possi-bly expect to have in the foreseeable future. Arguments tothe effect that there were earlier periods when they hadagreed to disagree are at best disingenuous. At Ufa therewas a limpid agreement on the agenda for the New Delhimeeting: that the NSAs would “discuss all issues connect-ed to terrorism”. Ufa had also yielded a discernible roadmap to bring about a modicum of peace and tranquillityalong the border and the Line of Control (LoC), which hasbeen witnessing rounds of wanton firing and unacceptablecasualties. External Affairs Minister Sushma Swaraj putthe number of ceasefire violations since Ufa at 91. Barelya week after Ufa raised modest hopes of an upturn in rela-tions, there was firing in the Akhnoor sector. ForeignSecretary S. Jaishankar spoke of four attempts made bythe Director-General of the Border Security Force to“make telephonic contact with Sector CommanderSialkot” as per laid-down procedures, which met with noresponse. He mentioned how this was unacceptable. Now,with the prospects of even a limited engagement havingreceded, the question that arises is: how will the twonuclear-capable neighbours deal with each other? There isno doubt that through its grandstanding on Kashmir andHurriyat, Islamabad reneged on the understanding reachedin Ufa. It is equally obvious that New Delhi has recalibrat-ed its Pakistan policy, willing perhaps to take a calculatedrisk that the world would be better disposed to its prefer-ences in the matter of dealing with Pakistan, almost 14years after 9/11. Yet, the new situation may have willy-nilly rendered India vulnerable to facing gratuitous advice,possibly worse. To assume that those who formulateIndia’s Pakistan policy believed Islamabad would respectthe sudden red line drawn on the Hurriyat, would stretchcredulity. The Hurriyat certainly does not have a place inbilateral processes. It is at best a Pakistani side-show withsome nuisance value and without much consequence.India had indeed learnt to tolerate that. Now, New Delhi’sactions may have the unintended effect of making the out-fit larger-than-life — which is an avoidable prospect.Pakistan has also not covered itself with glory by over-loading the agenda with issues that the two NSAs meetingfor an hour or two wouldn’t have been able to come togrips with. It is best at this point to open a discreet backchannel that ensures better bilateral deliverables than hasbeen the case over the last year and a half. There is simplyno alternative to talks.

The central government and the NationalSocialist Council of Nagaland (Isak-Muivah)signed a framework agreement on August 3that is expected to lead to a final peaceaccord.

Mr Muivah said this was a new agreementbecause there has been a lot of a develop-ment, "on both the Indian side and our side".

"But the solution has to be found from theframework that is already defined. The Indianside has officially acknowledged that the his-tory of the Nagas is unique and the situationis also unique. And it is the first time thatIndia has recognised the history of theNagas," he said.

Based on this uniqueness of Naga history, asolution would be worked out, he said.

Asked how long it would take to sign thefinal accord, Mr Muivah said it depended onthe central government.

"How close the Nagas will come to Indiawill depend on how far the government ofIndia respects the rights of the Nagas."

The NSCN-IM leader said that when theIndian government took this kind of signifi-cant step, "should we (Nagas) not try tounderstand the Indian side more? Should wenot understand their limitations?"

According to Mr Muivah, an interim gov-erning body would be formed after the finalaccord but it might take some time becauseadjustments would have to be made.

Asked if the accord would be based onNaga customary laws, he replied in the affir-mative, saying the Naga Hohos or tribal bod-ies would get more powers.

"That has to be done because the tribesthemselves must have a say because theyknow their benefits and they know theirrequirements," he said.

When pointed out that some individualsand groups have started saying that MrMuivah was from Manipur and Nagas fromNagaland should not expect much from theaccord, he said these people were "totallyconfused".

"Naga issue is a Naga national issue not astate-wise issue. We have been fighting for allthis after the creation of the Nagaland state. Ifthe 16-point agreement (that createdNagaland state) was final then we would nothave come up to this stage," he said.

"It was not the desire of the Naga peoplebut the act of the traitors who were used bythe Indians to sabotage the national politics."

He said the Indian government has nowofficially recognised the uniqueness and thehistory of the Naga issue and the situationtoo.

"We are seeking solution solely in the inter-est of all the Nagas. Those who are talking ofNagaland state in terms of Naga issue, sorry,I pity them. We have been fighting for therights of the Nagas wherever they may be butthe Naga politics should not be interpreted interms of the Nagaland state," he said.

Successful Naga....ups and downs in the past."The credit does not go to any particular

government and neither should they take it.Everyone contributed towards improving thesituation. It is the result (of these efforts) thattoday in Nagaland there has been a successfuldialogue with those people (NSCN(I-M)leaders).

Addressing a function in New Delhi tocommemorate the birth centenary of RaniGaidinliu, a spiritual Naga leader who wasborn in Manipur and fought for India's inde-pendence, PM Modi said the push of his gov-ernment has been on the development ofinfrastructure of the northeast region.

He said if the issue of connectivity isresolved then development would not be aproblem. He said efforts were on to providerailway connectivity to state capitals in theregion.

Referring to pineapples grown in the regionand chillis in Nagaland, he said the northeastcan become the "organic capital" of the coun-try.

Extolling the role of Rani Gaidinliu in thefreedom struggle, Modi said: "Can you imag-ine that she joined the freedom struggle at theage of 12-13? And soon after she was jailedfor life."

Born on January 26, 1915, Rani Gaidinliujoined her cousin Haipou Jadonang's move-ment at the age of 13 to drive out the Britishfrom Manipur.

In 1932, she was arrested at the age of 16and sentenced to life in prison. She wasreleased from Tura jail (now in Maghalaya)after having spent 14 years in various prisons.

She died on February 17, 1993, at Longkaoin Manipur.

India exports about $1.1 billion worth ofpetroleum products per annum to Nepal. Bulkof this volume will be transported throughthis pipeline.

"This will also ensure smooth, cost effec-tive and environment friendly supply ofpetroleum products to Nepal," it said.

The pipeline was first proposed in 2006 fortransportation of fuel from Raxaul toAmlekhgunj. The pipeline was to be funded50:50 by IOC and Nepal Oil Corp (NOC).The project, however, never took off as Nepalrefused to fund its share of cost.

IOC has now agreed to foot the Rs. 200crore cost in exchange for Nepal committingto buy products for at least 15 years.

Assam Seeks...Minister Tarun Gogoi said in a press con-

ference in Guwahati.The Assam government has adequate funds

for immediate relief operations, but theCentral assistance would be required to carryout repair works of the damage infrastructure,he said.

Mr Gogoi, however, lamented the Centrehas not released the amount that the stategovernment sought after floods last year.

Talking about the current situation, he saidthe rains have stopped in many places andwater level was slowly coming down. "Assoon as the water level goes down, we willstart assessing the damages of roads,embankments, bridges and other vital infra-structure," Mr Gogoi said.

Till yesterday, the floods had claimed thelives of 13 people across the state.

The floods have affected 18 districts withthe worst-hit being Dhubri, Goalpara,Chirang, Kokrajhar and Bongaigaon.

A population of 6.16 lakh people across1,291 villages has been affected by the floodsand 260 relief camps have been opened so farproviding shelter to 1.79 lakh of them.

Why Onion...A look at the data, however, suggests that

crop damage alone cannot explain the mas-sive jump in onion prices.

Despite the damage, compared to last year,the drop in monthly onion arrivals atLasalgaon from April to July was only 13.55per cent. But in August, arrivals droppednearly 70 per cent, pushing prices up by 300per cent - an indication that as the harvestseason comes to an end, farmers perhaps areholding stock back. This could be becausepoor rains have raised fears that the nextonion crop, harvested in September will alsobe hit, creating a future shortage.

Mr Chaturvedi, who is presently serving asDeputy Secretary in AIIMS, had approachedCAT on June 29 claiming that his promotionhas been kept pending due to his expose ofcorruption at AIIMS and his refusal to with-draw a case filed by him before SupremeCourt seeking a CBI probe against certainbureaucrats and politicians in Haryana fortheir alleged involvement in corruption.

The project is the single largest solar projectwhich has been constructed in an airport inIndia. It is spread over 50 acres.

With this, the airport will have 50,000 to60,000 units of electricity per day to be con-sumed for all its operational functions, whichtechnically makes the airport "absolutelypower neutral," CIAL said, adding, it is thefirst airport in the world to operate completelyon solar power.

on net neutrality, theInternet and MobileAssociation of India(IAMAI) on Monday saidit is "clearly and unam-biguously opposed to zero-rated plans of any type".

In its submission lastweek, industry bodyIAMAI held that "theseplans will ultimately harmInternet content and serv-ice providers by limitingcompetition among themand, by extension, limitconsumer choice".

Such plans will also"allow the operators, ifgiven the control of whatapps/services to push tothe consumers, to discrimi-nate and privilege certainweb services over others,and throttle innovation", itadded.

The association also reit-erated it did not supportany plans that violate prin-ciples of net neutrality"especially paid or unpaidprioritisation or other dis-criminatory practices".

The last date for submis-sion of suggestions and

comments on the commit-tee report on net neutralitythrough the discussionforum underwww.MyGov.in is August20.

The company is alsointroducing a multi-process architecture in itsWeb browser. CalledElectrolysis, this will allowthe Web browser to createseparate processes for eachtab. While this would bol-ster the overall security bylowering the expose of

Chrome Extensions Coming to Firefox as Mozilla Reveals Security Changes

"We are coming out with aconsultation paper on calldrops. We will consult all

the stakeholders on the vari-ous facets of call drops,"Telecom Regulatory Authorityof India (Trai) Chairman R SSharma told PTI.

The regulator is also exam-ining whether there are anytariff plans of the serviceproviders wherein call dropsactually incentivise or benefitthe companies, he added.

"We have called for theinformation from the compa-nies," Sharma said.

This follows a directionfrom the Department ofTelecom to Trai to suggest adisincentive mechanism forcall drops and also examinethe tariff plans of operators toascertain whether they incen-tivise call drops.

The industry has refutedcharges of deliberate calldrops and the companies haveinstead put the blame on lackof mobile towers and spec-trum for the problem.

Bharti Airtel (India andSouth Asia) Gopal Vittal hadrecently said that about 95percent plans are second-based, so they don't earn any-thing if a call gets dropped.

However, TelecomSecretary Rakesh Garg said

there are certain plans whereincustomers get some free min-utes and the billing is minute-based, which need to be exam-ined.

Hitting out at telecom oper-ators for lack of investment innetworks leading to call drops,the government said they cannot escape the responsibilityof meeting standards as it istheir basic service obligation.

Rejecting the reasons givenby the operators, such as shut-ting down of towers and radi-ation fears, the governmenthas said all these factors exist-ed earlier too but the problemhas worsened in the last sevenmonths.

Garg said if expenditure onspectrum is set aside, opera-

tors have invested only about13 percent of their revenueinto infrastructure.

A recent Trai report foundthat most of telecom operatorsin Delhi and Mumbai were notmeeting the prescribed stan-dards regarding call drops.

The industry is demanding auniform national policy fortowers to tackle the problem.

The operators said thatabout 7,000 - 10,000 sites arelocked or shut down acrossmajor cities like Delhi,Mumbai, Chandigarh,Bengaluru, Hyderabad, Patna,and Jaipur due to various rea-sons, including sealing ordersby local bodies without priornotice.
