The Transport Commission, in pursuance of section 64(5) of the Passenger Transport Services Act 2011 (the Act), hereby revokes the exemption from the operation of section 10 of the Act granted on 7 November 2016 to registered operators of a ride-sourcing vehicle specified in that notice.

PASSENGER TRANSPORT SERVICES ACT 2011

EXEMPTION

Section 64

The Transport Commission, in pursuance of section 64(1) of the Passenger Transport Services Act 2011 (the Act), grants to each registered operator of a ride-sourcing vehicle who falls within the class of persons specified below, on and from 11 September 2017 until 31 December 2019, an exemption from the operation of section 10 of the Act.

A.Interpretation

For the purposes of this exemption:

ride-sourcing vehicle means a light vehicle, as defined in the Vehicle and Traffic Act 1999, that is used, by a person in whose name the vehicle is registered in Tasmania, to carry on journeys passengers who -

(a) arrange, only by means of ride-sourcing software, to be so carried; and

(b) provide to the person financial consideration for such journeys only by means of a system for electronic transfer of funds that is provided as part of that software.

ride-sourcing software means a computer software system that enables all of the following: -

(a) requests, for passengers to be carried on journeys in light vehicles, to be received; and

(b) such requests to be communicated to, and accepted by, drivers of light vehicles; and

(c) such passengers to provide to such drivers financial consideration, for carriage on such journeys, only by way of the electronic transfer of funds by a system that is provided; and

(d) identification of, and recording of the details of, such drivers and vehicles and the origin, destination and duration of such journeys; and

(e) satisfaction rating services to be provided - only by means of the software.

For the purposes of this exemption, ride-sourcing software enables satisfaction rating services to be provided only by means of the software if the software enables all of following:-

(a) a person who has been, pursuant to a request communicated by the software to a driver, carried on a journey in a light vehicle driven by the driver, to record by means of the software the person's degree of satisfaction in relation to the driver and the journey; and

(b) automatic aggregation of such records in relation to such drivers and such journeys; and

(c) a rating, of a driver, derived from such records to be able to be made available to a person whose request to be carried on a journey in a light vehicle is accepted by the driver.

B. Class of persons to whom this exemption applies

For the purpose of this exemption, the class of persons to whom this exemption applies are those registered operators of a ride-sourcing vehicle who:

(a) have informed the Registrar of Motor Vehicles ("the Registrar") appointed or employed under section 5 of the Vehicle and Traffic Act 1999, in writing and in a form as determined by the Registrar, and accompanied by any information, evidence or declaration requested by the Registrar, that the person intends to operate a ride-sourcing vehicle; and

(b) hold a current and valid ancillary certificate authorising the holder to drive a public passenger vehicle issued by the Registrar under Part 3 of the Vehicle and Traffic (Driver Licensing and Vehicle Registration) Regulations 2010; and

(c) comply with the vehicle inspection requirements of regulation 102 of the Vehicle and Traffic (Driver Licensing and Vehicle Registration) Regulations 2010.

C. Conditions of exemption

This exemption is granted on condition that a person who has the benefit of the exemption complies with any reasonable request made by the Transport Commission or the Registrar to provide information or evidence relating to the operation of the ride-sourcing vehicle.

Investigations OfficerThe Australian Health Practitioner Regulation Agency (AHPRA) works in partnership with 14 National Boards to implement the national regulatory scheme for health professionals. The purpose of health practitioner regulation is to protect the public by ensuring that only health practitioners who have the skills, qualifications and knowledge to provide safe care are registered.As an Investigations Officer, you will help to manage notifications made about health practitioner’s health, conduct and performance. We are looking for a highly organised person with a professional and positive attitude who is able to work in a high volume environment. The successful candidate will demonstrate strong attention to detail, excellent time management skills, well developed written communication and interpersonal skills, sound analytical and problem solving skills and pride themselves on their service achievements

Skills & experience required:• Relevant tertiary qualification (i.e. Lawyer or a Health Practitioner within Nursing,

Medical or similar field);

• Knowledge and experience in the conduct of investigations or case management;

• Strong written skills including experience in writing reports and recommendations;

• Ability to apply legislation, policies and procedures in a regulatory environment;

• Well developed interpersonal and oral communication skills with the ability to build productive working relationships;

• Excellent organisational skills including the ability to prioritise, multi-task, meet deadlines while having strong attention to detail.

The following application for exemption from the provisions of the Anti-Discrimination Act 1998 (Tas) (the Act) has been granted:

1. Women's Health Tasmania Inc – 17/08/036 – Application for an exemption granted under section 57 of the Act for a period of three years.

This exemption has been granted to permit Women's Health Tasmania Inc to provide services to women only and for the benefit of women; recruit and employ women to work for the organisation; recruit women to the Board of Governance; and provide facilities to women and women’s groups on the basis that:

a) Women’s Health Tasmania Inc has been offering women only services since the 1980s and is considered a safe place for women especially those vulnerable to health inequity.

b) Women use the services because they will not encounter men. For some women this is important because they have experienced violence and abuse by men, and for other women they have a preference to see female health workers.Granted on the 8th day of September 2017.

The exemption is for the period of three (3) years subject to the fulfilment of the conditions that Women's Health Tasmania Inc:

a) report on or before 8 March 2018 to the Anti-Discrimination Commissioner on actions taken in reliance on this exemption; and

c) on at least one occasion in the 12 months immediately after this order is made, organise and promote community education for its staff, members including Board members and volunteers of Women's Health Tasmania Inc through the Equal Opportunity Tasmania’s community education program to increase awareness of rights and obligations under the Anti-Discrimination Act 1998 (Tas).

A person may apply to the Anti-Discrimination Tribunal for a review of the Commissioner’s decision within 28 days from the date of this notice being published.
