The scorecards reflect the votes of California representatives from Congress and the state Legislature. The votes of each legislator have been rated positive (+) or negative (-) depending on how closely their votes on relevant legislation corresponded with civil rights and social justice priorities identified by CAIR-CA. The criteria selected for each topic is rooted in legislation introduced and voted on in 2017–2018.

As the amount of legislation introduced in both Congress and the state Legislature is rather expansive, please note that elected officials should not be judged by these criteria alone. This scorecard is intended to provide a general profile to assist voters in better understanding the attitudes of elected officials toward key civil rights issues. CAIR-CA encourages voters to further research the actions of their local legislators before supporting any candidate. CAIR-CA makes no claims as to the favorability of one candidate over another.

At the end of the guide are CAIR-CA’s recommendations on statewide ballot propositions. As a nonprofit, nonpartisan organization, CAIR-CA cannot advocate for specific candidates for office, however it can endorse ballot propositions. H. AMDT. 185 TO H.R. 2810ALSO KNOWN AS FRANKS OF ARIZONA AMENDMENT NO. 13 – STRATEGIC ASSESSMENTS OF THE USE OF VIOLENT OR UNORTHODOX ISLAMIC RELIGIOUS DOCTRINE TO SUPPORT EXTREMIST OR TERRORIST MESSAGING AND JUSTIFICATION.FAILED TO PASS THE HOUSE ON JULY 14, 2017

CAIR-CA OPPOSED

Amendment No. 13 to H.R. 2810, the 2018 National Defense Authorization Act, would have required the Department of Defense to conduct two strategic assessments, one by governmental persons and the other by nongovernmental persons, on the “Use of Violent or Unorthodox Islam to Support Extremist or Terrorist Messaging.”1

H.R. 724 would have rescinded and defunded President Donald Trump’s first “Muslim Ban” Executive Order 13769, “Protecting the Nation from Foreign Terrorist Entry into the United States,” which banned refugees and travelers from seven Muslim-majority nations (Iran, Iraq, Libya, Somalia, Sudan, Syria and Yemen).2

Note: There were several instances of congressional legislation in opposition to the first and second Muslim Bans that were introduced and co-sponsored by many other members of Congress. CAIR-CA chose to highlight the SOLVE Act and S. 1979 because they included the greatest number of co-sponsors.

H.R. 2841 & S. 1324DISARM HATE ACTREFERRED TO THE COMMITTEE ON THE JUDICIARY’S SUBCOMMITTEE ON CRIME, TERRORISM, HOMELAND SECURITY, AND INVESTIGATIONS; REFERRED TO THE COMMITTEE ON THE JUDICIARY, RESPECTIVELY.

CAIR-CA SUPPORTED

Parallel bills H.R. 2841 and S. 1324 would ban gun sales to people who have been convicted of a hate crime or a misdemeanor that was committed out of hatred of a person’s race, religion, gender, sexual orientation, gender identity or disability. The Disarm Hate Act would amend the federal criminal code to include those convicted of a misdemeanor hate crime or an enhanced sentence crime that was partially motivated by hate. For an act to fall under this classification, it would need to involve the use, attempted use or the threat of using physical force or a weapon to inflict physical harm on a person based on one of the protected classification identities.4



H.R. 1498END RACIAL PROFILING ACT OF 2017S. 411END RACIAL AND RELIGIOUS PROFILING ACT OF 2017 (ERRPA)REFERRED TO THE COMMITTEE ON THE JUDICIARY’S SUBCOMMITTEE ON CRIME, TERRORISM, HOMELAND SECURITY, AND INVESTIGATIONS AND SUBCOMMITTEE ON THE CONSTITUTION AND CIVIL JUSTICE; REFERRED TO THE COMMITTEE ON THE JUDICIARY, RESPECTIVELY.

CAIR-CA SUPPORTED

Parallel bills H.R. 1498 and S. 411 would prohibit racial and religious profiling by a federal, state, local or tribal law enforcement agency or agent. They would empower the Department of Justice (DOJ), or an individual injured by racial profiling, to bring a civil action to enforce the prohibition. The bills would require federal law enforcement agencies to maintain policies and procedures to eliminate racial profiling, including training on racial profiling issues, the collection of data and procedures for handling complaints. DOJ would withhold or reduce grant funds from a state or unit of local government that fails to comply.5

Parallel bills H.R. 1697 and S. 720 would criminalize American business owners and individuals supporting any international boycott directed by the United Nations, the European Union or any other international governmental organization that is aimed at Israel’s illegal occupation of Palestinian territories with criminal financial penalties.6

H.R. 3440 & S. 1615DREAM ACT OF 2017REFERRED TO THE COMMITTEE ON THE JUDICIARY’S SUBCOMMITTEE ON IMMIGRATION AND BORDER SECURITY AND THE COMMITTEE ON EDUCATION AND THE WORKFORCE; REFERRED TO THE COMMITTEE ON THE JUDICIARY, RESPECTIVELY.

Parallel bills H.R. 3440 and S. 1615 would provide a pathway for the 800,000 undocumented young people, commonly referred to as “Dreamers” and brought to the United States as children, to become permanent residents and eventually apply for citizenship. The bills would direct the Department of Homeland Security (DHS) to cancel the removal of and grant lawful permanent resident status on a conditional basis to Dreamers who: (1) have been continuously physically present in the U.S. for four years preceding this bill’s enactment; (2) were younger than 18 years of age on the initial date of U.S. entry; (3) are not inadmissible on criminal, security, terrorism or other grounds; (4) have not participated in persecution; (5) have not been convicted of specified federal or state offenses; and (6) have fulfilled specified educational requirements.7

H. AMDT. 651 TO H.R. 5515ALSO KNOWN AS ENGEL OF NEW YORK AMENDMENT NO. 43 - MATTERS RELATING TO BURMAAPPROVED BY THE U.S. HOUSE OF REPRESENTATIVES 382-30 AND AMENDED TO THE HOUSE VERSION OF THE NATIONAL DEFENSE AUTHORIZATION ACT (NDAA) FOR FISCAL YEAR 2019 (H.R.5515). AMENDMENT WAS STRIPPED FROM THE FINAL VERSION OF THE NDAA.

CAIR-CA SUPPORTED

H. AMDT. 651 TO H.R. 5515 would authorize financial and visa sanctions against perpetrators of the ethnic cleansing of the Rohingya people by the Burmese military and security forces; limit U.S. military and security assistance to Burma until reforms take place; incentivize reform of the Burmese gemstone sector; and require a determination of what crimes the Burmese military committed, including genocide. The amendment is similar in nature to Rep. Engel’s H.R.5819 - BURMA Act of 2018.8

S. 2060 contains many similar provisions to H. Amdt. 651 to H.R. 5515. Additionally, the measure would appropriate $103,695,069 for the 2018 fiscal year for humanitarian assistance for Burma, Bangladesh and the region; appropriate $27,400,000 for the 2018 fiscal year for reconciliation programs in Burma; and reinstate U.S. import restrictions on jadeite from Burma.9

AB 2291 (CHIU)SCHOOL SAFETY: BULLYINGSIGNED BY THE GOVERNOR ON SEPTEMBER 18, 2018

CAIR-CA CO-SPONSORED

This bill requires local educational agencies to adopt specific new procedures to prevent bullying by December 31, 2019. The bill requires schools operated by a school district or a county office of education, along with charter schools, to annually make available an online training module developed by the California Department of Education (CDE) to all school-site employees who have regular interaction with pupils. The bill requires the CDE to post its online training module and an annually updated list of other available online training modules related to bullying or bullying prevention on its website.10

This bill prohibits a state or local agency from participating in a federal program to create a database on a person’s religious beliefs, national origin or ethnicity for law enforcement or immigration purposes. It also prevents state and local law enforcement agencies from collecting information on the religious beliefs, practices or affiliations of an individual except under certain limited circumstances.11

SB 54 (DE LEÓN)THE CALIFORNIA VALUES ACTSIGNED BY THE GOVERNOR ON OCTOBER 5, 2017

CAIR-CA SUPPORTED

This bill ensures that state and local resources are not used to fuel mass deportations and that public schools, state health facilities and courthouses remain safe and accessible to all California residents, regardless of their immigration status.12

AB 2184 (CHIU)IMMIGRANT BUSINESS INCLUSION ACTSIGNED BY THE GOVERNOR ON SEPTEMBER 14, 2018

This bill requires cities and counties that license businesses within their respective jurisdictions to accept a California driver’s license or identification number, individual taxpayer identification number or municipal identification number in lieu of a Social Security number, if the city or county otherwise requires a Social Security number for the issuance of a business license.13

AB 291 (CHIU)IMMIGRANT TENANT PROTECTION ACTSIGNED BY THE GOVERNOR ON OCTOBER 5, 2017

CAIR-CA SUPPORTED

This bill protects immigrant tenants from intimidation and retaliation from landlords. It codifies an existing defense to evictions based on immigration status and grants tenants new protections against unfair litigation practices, including a ban on questions about immigration status in housing-related cases and a prohibition on attorney threats to report tenants to immigration authorities.14

SB 29 (LARA)DIGNITY NOT DETENTIONSIGNED BY THE GOVERNOR ON OCTOBER 5, 2017

CAIR-CA SUPPORTED

This bill prevents local governments and local law enforcement agencies from entering into, renewing or modifying a contract with for-profit companies and U.S. Immigration and Customs Enforcement to detain immigrants. SB 29 also makes for-profit facilities that contract with a local government subject to the California Public Records Act and requires 180 days of public notice, including at least two public hearings, before a local city or county issues a permit to a for-profit detention company to build or expand.15

AB 1985 (TING)HATE CRIMES PREVENTIONSIGNED BY THE GOVERNOR ON JUNE 13, 2018

CAIR-CA SUPPORTED

This bill clarifies that a disability is protected under the law irrespective of whether the disability is temporary, permanent or the result of an individual’s advanced age. The bill also requires local law enforcement agencies that update or create a hate crime policy to include the model policy framework developed by the Commission on Peace Officer Standards and Training and information regarding bias motivation.16

SB 1421 (SKINNER)POLICE TRANSPARENCYSIGNED BY THE GOVERNOR ON SEPTEMBER 30, 2018

CAIR-CA SUPPORTED

This bill allows public access to police investigations and reprimands relating to deadly and serious uses of force. SB 1421 requires law enforcement agencies to provide public access to records related to:

1. Discharge of a firearm or use of force that results in death or great bodily injury;

2. Sexual harassment at work, including coercion or exchanging sex for lenience; and

3. Dishonesty in reporting, investigating or prosecuting a crime.

However, disclosure of information can be delayed when there is an open investigation or court proceeding.17

AB 1870 (REYES)STOP HARASSMENT AND REPORTING EXTENSION ACTPASSED THE STATE LEGISLATURE ON AUGUST 29, 2018

CAIR-CA SUPPORTED

This bill would extend the time for filing harassment and discrimination claims under California’s Fair Employment and Housing Act (FEHA) from one year to three years.18

AB 2845 (BONTA)PARDON PANEL REFORMPASSED THE STATE LEGISLATURE ON AUGUST 30, 2018

CAIR-CA SUPPORTED

This bill would allow individuals to petition the Parole Hearings Board for an expedited review of an application if a petitioner indicates an urgent need for a pardon or commutation, such as an upcoming immigration court hearing. AB 2845 would provide an applicant with notification when their application is received and when a decision is issued. The bill would also ensure that an applicant’s certificate of rehabilitation issued by a court be reviewed by the board within one year of receipt of the certificate. Additionally, AB 2845 would make the pardon application available online on the governor’s website.19

DEFINITIONS

Bonds on the Ballot in California

In California, the state sells general obligation bonds to investors, who are in effect providing funds to the state that the state will repay to the investors with interest over a period of time. The state repays bondholders through revenue from the General Fund. The California Constitution requires that general obligation bond issues of $300,000 or more be referred to voters for approval or rejection.20

Legislatively Referred State Statute

A legislatively referred state statute is a statute which appears on a state’s ballot as a ballot measure because the state Legislature voted to put it before the voters.21

The Ballot Initiative Process

There are four steps required to place an initiative on the ballot.

Step 1: Requires proponents of an initiative to file their proposal with the Attorney General’s Office. The Attorney General’s Office prepares the language to be used on petitions for the initiative.

Step 2: After the language is prepared, the initiative receives a title and summary. Once the initiative receives a title and summary, the proponents can begin collecting signatures. The secretary of state assigns a signature filing deadline to the initiative.

Step 3: Requires proponents to tell the Secretary of State’s Office that at least 25 percent of the required signatures have been collected for the initiative.

Step 4: Requires the proponents to submit the signatures for a ballot initiative or referendum. Failing to complete the four steps will prevent a ballot initiative or referendum from being included in the upcoming election.22

Initiated State Statute

An initiated state statute, also known as an initiative statute, is a new law that a state adopts via the ballot initiative process. The most common form of initiated state statute is when groups collect signatures to place the measure on the ballot for a vote. For an initiated state statute, a minimum of 365,880 signatures must be collected.23

Initiated Constitutional Amendment

An initiated constitutional amendment is an amendment to a state’s constitution that comes about through the initiative process. For an initiated constitutional amendment to qualify to be placed on the ballot, its proponents must gather 585,407 signatures.24

Proposition 5 would amend Proposition 13 (1978), which would allow homebuyers who are ages 55 and older or severely disabled to transfer the tax-assessed value from their prior home to their new home, no matter the new home’s market value, the new home’s location in the state or the number of moves. Currently, homebuyers who are ages 55 and older are eligible to transfer their tax assessments from their prior home to their new home if the new home’s market value is equal to or less than the prior home’s value and only once in their lifetime. According to the Legislative Analyst’s Office, schools and local governments each would lose more than $100 million in annual property taxes early on, growing to about $1 billion per year.29

SummaryWould repeal 2017’s fuel tax and vehicle fee increases and require a public vote on future increases. Currently, to increase a tax in California, a two-thirds vote of each state legislative chamber and the governor’s signature is required. Proposition 6 would add voter approval through ballot propositions to the current process to impose, increase or extend fuel taxes or vehicle fees. If passed, any taxes and tax rates on fuel taxes and vehicle fees created after January 1, 2017, would be repealed. Proposition 6 would also rescind the Road Repair and Accountability Act of 2017 (RRAA). Proposition 6 would reduce ongoing state revenues of $5.1 billion that resulted from the elimination of fuel and vehicle taxes passed by the state Legislature in 2017. These revenues primarily paid for highway and road maintenance and repairs, along with transit programs. Prop. 6’s voter approval requirement for new or increased fuel and vehicle taxes may result in lower revenues from such taxes.30

In addition, the RRAA would not be repealed.
