The California chapter of the Council on American-Islamic Relations (CAIR-CA) has compiled three resources to help guide community members as they plan to vote in the November 2018 election. Inside, you will find:

Congressional scorecardState scorecardStatewide proposition guide

The scorecards reflect the votes of California representatives from Congress and the state Legislature. The votes of each legislator have been rated positive (+) or negative (-) depending on how closely their votes on relevant legislation corresponded with civil rights and social justice priorities identified by CAIR-CA. The criteria selected for each topic is rooted in legislation introduced and voted on in 2017–2018.

As the amount of legislation introduced in both Congress and the state Legislature is rather expansive, please note that elected officials should not be judged by these criteria alone. This scorecard is intended to provide a general profile to assist voters in better understanding the attitudes of elected officials toward key civil rights issues. CAIR-CA encourages voters to further research the actions of their local legislators before supporting any candidate. CAIR-CA makes no claims as to the favorability of one candidate over another.

At the end of the guide are CAIR-CA’s recommendations on statewide ballot propositions. As a nonprofit, nonpartisan organization, CAIR-CA cannot advocate for specific candidates for office, however it can endorse ballot propositions. Please contact your local CAIR-CA office if you have any questions.

CAIR-CA OPPOSED

Amendment No. 13 to H.R. 2810, the 2018 National Defense Authorization Act, would have required the Department of Defense to conduct two strategic assessments, one by governmental persons and the other by nongovernmental persons, on the “Use of Violent or Unorthodox Islam to Support Extremist or Terrorist Messaging.”1

Note: There were several instances of congressional legislation in opposition to the first and second Muslim Bans that were introduced and co-sponsored by many other members of Congress. CAIR-CA chose to highlight the SOLVE Act and S. 1979 because they included the greatest number of co-sponsors.

H.R. 2841 & S. 1324DISARM HATE ACTREFERRED TO THE COMMITTEE ON THE JUDICIARY’S SUBCOMMITTEE ON CRIME, TERRORISM, HOMELAND SECURITY, AND INVESTIGATIONS; REFERRED TO THE COMMITTEE ON THE JUDICIARY, RESPECTIVELY.

Parallel bills H.R. 2841 and S. 1324 would ban gun sales to people who have been convicted of a hate crime or a misdemeanor that was committed out of hatred of a person’s race, religion, gender, sexual orientation, gender identity or disability. The Disarm Hate Act would amend the federal criminal code to include those convicted of a misdemeanor hate crime or an enhanced sentence crime that was partially motivated by hate. For an act to fall under this classification, it would need to involve the use, attempted use or the threat of using physical force or a weapon to inflict physical harm on a person based on one of the protected classification identities.4

PROPOSITION GUIDE

DEFINITIONS

Bonds on the Ballot in California

In California, the state sells general obligation bonds to investors, who are in effect providing funds to the state that the state will repay to the investors with interest over a period of time. The state repays bondholders through revenue from the General Fund. The California Constitution requires that general obligation bond issues of $300,000 or more be referred to voters for approval or rejection.20

Legislatively Referred State Statute

A legislatively referred state statute is a statute which appears on a state’s ballot as a ballot measure because the state Legislature voted to put it before the voters.21

The Ballot Initiative Process

There are four steps required to place an initiative on the ballot.

Step 1: Requires proponents of an initiative to file their proposal with the Attorney General’s Office. The Attorney General’s Office prepares the language to be used on petitions for the initiative.

Step 2: After the language is prepared, the initiative receives a title and summary. Once the initiative receives a title and summary, the proponents can begin collecting signatures. The secretary of state assigns a signature filing deadline to the initiative.

20 CALIFORNIA VOTER GUIDE 2018

Page 21: 2018 VOTER GUIDE - Council on American-Islamic …...3 The California chapter of the Council on American-Islamic Relations (CAIR-CA) has compiled three resources to help guide community

21

Step 3: Requires proponents to tell the Secretary of State’s Office that at least 25 percent of the required signatures have been collected for the initiative.

Step 4: Requires the proponents to submit the signatures for a ballot initiative or referendum. Failing to complete the four steps will prevent a ballot initiative or referendum from being included in the upcoming election.22

Initiated State Statute

An initiated state statute, also known as an initiative statute, is a new law that a state adopts via the ballot initiative process. The most common form of initiated state statute is when groups collect signatures to place the measure on the ballot for a vote. For an initiated state statute, a minimum of 365,880 signatures must be collected.23

Initiated Constitutional Amendment

An initiated constitutional amendment is an amendment to a state’s constitution that comes about through the initiative process. For an initiated constitutional amendment to qualify to be placed on the ballot, its proponents must gather 585,407 signatures.24

PROPOSITION 2AUTHORIZES BONDS TO FUND EXISTING HOUSING PROGRAM FOR INDIVIDUALS WITH MENTAL ILLNESS. (LEGISLATIVELY REFERRED STATE STATUTE)

CAIR-CA RECOMMENDATION: SUPPORT

SummaryWould authorize the state to use revenue from the Millionaire’s Tax for $2 billion in bonds and amend the state Welfare and Institutions Code, including Proposition 63 (2004), to allow the state to use the funds to help prevent homelessness. There is no cost to voters since funds would be coming from the Millionaire’s Tax revenue.26

What Your Vote MeansA YES would be a vote that supports authorizing the state to use revenue from the Millionaire’s Tax, which would amend Proposition 63 (2004) to allow funds to support homelessness prevention housing for persons who need mental health services.

24 CALIFORNIA VOTER GUIDE 2018

SummaryWould issue $8.877 billion in general obligation bonds for water-related infrastructure and environmental projects. According to state fiscal analysis, the bond would generate about $8.4 billion in interest over a 40-year period, which means it would cost the state a total of $17.3 billion.27

What Your Vote MeansA YES would be a vote in support of the measure authorizing $8.877 billion in general obligation bonds for water infrastructure; groundwater supplies and storage; surface water storage and dam repairs; watershed and fisheries improvements; habitat protection and restoration; and projects benefitting disadvantaged communities.

A NO would be a vote opposing the use of $8.877 billion in general obligation bonds for water infrastructure; groundwater supplies and storage; surface water storage and dam repairs; watershed and fisheries improvements; habitat protection and restoration; and projects benefitting disadvantaged communities.

PROPOSITION 4AUTHORIZES BONDS FUNDING CONSTRUCTION AT HOSPITALS PROVIDING CHILDREN’S HEALTH CARE. (INITIATED STATE STATUTE)

CAIR-CA RECOMMENDATION: NEUTRAL

SummaryWould authorize $1.5 billion in bonds for children’s hospitals through the Children’s Hospital Bond Act Fund. The fund would award grants to children’s hospitals for construction, expansion, renovation and equipment projects. The state estimates that interest on the bond would be $1.4 billion over 35 years, bringing the total cost to taxpayers to $2.9 billion.28

What Your Vote MeansA YES vote would mean supporting the authorization of $1.5 billion in bonds for the construction, expansion, renovation and equipping of children’s hospitals in California.

A NO vote would mean opposing the authorization of $1.5 billion in bonds for the construction, expansion, renovation and equipping of children’s hospitals in California.

25

PROPOSITION 5CHANGES REQUIREMENTS FOR CERTAIN PROPERTY OWNERS TO TRANSFER THEIR PROPERTY TAX BASE TO REPLACEMENT PROPERTY. (COMBINED CONSTITUTIONAL AMENDMENT AND STATE STATUTE)

CAIR-CA RECOMMENDATION: OPPOSE

SummaryWould revise the process for homebuyers who are ages 55 and older or severely disabled to transfer their tax assessments. Proposition 5 would amend Proposition 13 (1978), which would allow homebuyers who are ages 55 and older or severely disabled to transfer the tax-assessed value from their prior home to their new home, no matter the new home’s market value, the new home’s location in the state or the number of moves. Currently, homebuyers who are ages 55 and older are eligible to transfer their tax assessments from their prior home to their new home if the new home’s market value is equal to or less than the prior home’s value and only once in their lifetime. According to the Legislative Analyst’s Office, schools and local governments each would lose more than $100 million in annual property taxes early on, growing to about $1 billion per year.29

What Your Vote MeansA YES vote would mean supporting the amendment of Proposition 13 (1978) to allow homebuyers who are ages 55 and older or severely disabled to transfer their tax assessments, with a possible adjustment, from their prior home to their new home, no matter the new home’s market value, the new home’s location in the state or the buyer’s number of moves.

A NO vote would mean opposing the amendment of Proposition 13 (1978) to change how tax assessments are transferred between properties for homebuyers who are ages 55 and older or severely disabled.

PROPOSITION 6ELIMINATES RECENTLY ENACTED ROAD REPAIR AND TRANSPORTATION FUNDING BY REPEALING REVENUES DEDICATED FOR THOSE PURPOSES. REQUIRES THAT ANY MEASURE TO ENACT CERTAIN VEHICLE TAXES AND VEHICLE FEES BE SUBMITTED TO AND APPROVED BY THE ELECTORATE. (INITIATED CONSTITUTIONAL AMENDMENT)

CAIR-CA RECOMMENDATION: OPPOSE

PROPOSITION GUIDE

Page 26: 2018 VOTER GUIDE - Council on American-Islamic …...3 The California chapter of the Council on American-Islamic Relations (CAIR-CA) has compiled three resources to help guide community

26 CALIFORNIA VOTER GUIDE 2018

SummaryWould repeal 2017’s fuel tax and vehicle fee increases and require a public vote on future increases. Currently, to increase a tax in California, a two-thirds vote of each state legislative chamber and the governor’s signature is required. Proposition 6 would add voter approval through ballot propositions to the current process to impose, increase or extend fuel taxes or vehicle fees. If passed, any taxes and tax rates on fuel taxes and vehicle fees created after January 1, 2017, would be repealed. Proposition 6 would also rescind the Road Repair and Accountability Act of 2017 (RRAA). Proposition 6 would reduce ongoing state revenues of $5.1 billion that resulted from the elimination of fuel and vehicle taxes passed by the state Legislature in 2017. These revenues primarily paid for highway and road maintenance and repairs, along with transit programs. Prop. 6’s voter approval requirement for new or increased fuel and vehicle taxes may result in lower revenues from such taxes.30

What Your Vote MeansA YES vote would mean supporting the repeal of fuel tax increases and vehicle fees that were enacted through the RRAA of 2017 and require voter approval, through ballot propositions, for the California Legislature to impose, increase or extend fuel taxes or vehicle fees in the future.

A NO vote would oppose the addition of voter approval, through ballot propositions, for the California Legislature to impose, increase or extend fuel taxes or vehicle fees in the future. It would keep the current requirements that allow the state Legislature to impose, increase or extend fuel taxes or vehicle fees through a two-thirds vote of each chamber and without voter approval. In addition, the RRAA would not be repealed.

PROPOSITION 7CONFORMS CALIFORNIA DAYLIGHT SAVING TIME TO FEDERAL LAW. ALLOWS LEGISLATURE TO CHANGE DAYLIGHT SAVING TIME PERIOD. (LEGISLATIVELY REFERRED STATE STATUTE)

CAIR-CA RECOMMENDATION: NEUTRAL

SummaryProposition 7 would allow the California Legislature to establish permanent, year-round daylight saving time (DST) by a two-thirds vote, if the federal Uniform Time Act is changed. This measure currently does not have a direct fiscal effect because changes to DST would depend on future actions by the Legislature and potentially the federal government.31

Page 27: 2018 VOTER GUIDE - Council on American-Islamic …...3 The California chapter of the Council on American-Islamic Relations (CAIR-CA) has compiled three resources to help guide community

27

What Your Vote MeansA YES vote would mean allowing the California Legislature to establish permanent, year-round DST in California by a two-thirds vote, if federal law is changed to allow for permanent DST.

A NO vote would mean opposing the California Legislature establishing permanent, year-round DST in California by a two-thirds vote, if federal law is changed to allow for permanent DST.

PROPOSITION 8AUTHORIZES STATE REGULATION OF KIDNEY DIALYSIS CLINICS. LIMITS CHANGES FOR PATIENT CARE. (INITIATED STATE STATUTE)

CAIR-CA RECOMMENDATION: NEUTRAL

SummaryWould require dialysis clinics to issue refunds for revenue above a certain amount. According to the state Legislative Analyst’s Office, the overall annual effect on state and local governments would range from net positive impact in the low tens of millions of dollars to net negative impact in the tens of millions of dollars.32

What Your Vote MeansA YES vote would mean supporting the requirement for dialysis clinics to issue refunds to patients or patients’ payers for revenue above 115 percent of the costs of direct patient care and health care improvements.

A NO vote would mean opposing the requirement for dialysis clinics to issue refunds to patients or patients’ payers for revenue above 115 percent of the costs of direct patient care and health care improvements.

PROPOSITION 9Proposition 9 was removed from the ballot by the California Supreme Court.33

PROPOSITION 10EXPANDS LOCAL GOVERNMENTS’ AUTHORITY TO ENACT RENT CONTROL ON RESIDENTIAL PROPERTIES. (INITIATED STATE STATUTE)

CAIR-CA RECOMMENDATION: SUPPORT

PROPOSITION GUIDE

Page 28: 2018 VOTER GUIDE - Council on American-Islamic …...3 The California chapter of the Council on American-Islamic Relations (CAIR-CA) has compiled three resources to help guide community

28 CALIFORNIA VOTER GUIDE 2018

SummaryWould repeal the Costa-Hawkins Rental Housing Act (Costa-Hawkins), allowing local governments to adopt rent control ordinances — regulations that govern how much landlords can charge tenants for renting apartments and houses. According to the state Legislative Analyst’s Office, the potential net reduction in state and local revenue could be tens of millions of dollars per year in the long term. Depending on actions by local communities, revenue losses could be less or considerably more.34

What Your Vote MeansA YES vote would mean allowing local governments to adopt rent control, effectively repealing the Costa-Hawkins Rental Housing Act.

A NO vote would mean opposing local governments’ ability to adopt rent control, keeping the Costa-Hawkins Rental Housing Act as law.

PROPOSITION 11REQUIRES PRIVATE-SECTOR EMERGENCY AMBULANCE EMPLOYEES TO REMAIN ON CALL DURING WORK BREAKS. CHANGES OTHER CONDITIONS OF EMPLOYMENT. (INITIATED STATE STATUTE)

CAIR-CA RECOMMENDATION: NEUTRAL

SummaryWould allow ambulance providers to require workers to remain on call during paid breaks. According to the Legislative Analyst’s Office, there is a likely fiscal benefit to local governments with lower costs and higher revenues due to lower net ambulance company costs that could potentially be in the tens of millions of dollars each year.35

What Your Vote MeansA YES vote would mean allowing ambulance providers to require workers to remain on call during breaks paid at their regular rate; requiring employers to provide additional training for EMTs and paramedics; and requiring employers to provide EMTs and paramedics with some paid mental health services.

A NO vote would mean not allowing ambulance providers to require workers to remain on call during breaks paid at their regular rate; requiring employers to provide additional training for EMTs and paramedics; and requiring employers to provide EMTs and paramedics with some paid mental health services.

29

PROPOSITION 12ESTABLISHES NEW STANDARDS FOR CONFINEMENT OF CERTAIN FARM ANIMALS; BANS SALE OF CERTAIN NON-COMPLYING PRODUCTS. (INITIATED STATE STATUTE)

CAIR-CA RECOMMENDATION: SUPPORT

SummaryProp. 12 would ban the sale of meat and eggs from calves raised for veal, breeding pigs and egg-laying hens confined in areas below a specific number of square feet. The size restrictions based on animal behavior would be repealed and replaced. Beginning in 2021, producers would be required to confine egg-laying hens in cage-free housing systems based on the United Egg Producers’ 2017 cage-free guidelines. According to the Legislative Analyst’s Office, there may be a potential decrease in state income tax revenues from farm businesses, most likely no more than several million dollars annually. In addition, it will cost the state up to $10 million annually to enforce the measure.36

What Your Vote MeansA YES vote would mean supporting a ban on the sale of meat and eggs from calves raised for veal, breeding pigs and egg-laying hens confined in areas below a specific number of square feet.

A NO vote would mean allowing the sale of meat and eggs from calves raised for veal, breeding pigs and egg-laying hens confined in areas below a specific number of square feet.
