¡  After years of flatlined volumes, EPA proposed increases in BBD and advanced volumes.

¡  The volumes are meaningless if EPA does not address small refinery exemptions.

¡  NBB estimates small refinery exemptions reduced BBD demand by 300 million gallons.

¡  Independent analysis and EPA data verify our estimate.

¡  EPA continues to use flawed methodologies, including its “feedstock diversion” theory, and to disregard the importance of the BBD volume.

RFS RESET RULE

¡  When the 2019 RFS rule is finalized, EPA will have cut the overall volumes by more than 20 percent in two consecutive years.

¡  EPA is expected to rewrite the statutory volumes for 2020 – 2022.

¡  Rewrite could be concurrent with 2020 RFS rule.

RFS LITIGATION ON EXEMPTIONS

¡  Administrative petition to EPA regarding EPA’s failure to account for small refiner exemptions in annual RVOs. ¡  NBB and other trade associations.

¡  EPA must reconsider its 2010 regulations because they do not adjust RVOs when EPA grants retroactive small refinery exemptions.

¡  Lost RVOs: ¡  2015 = 292.5 million

¡  2016 = 790 million ¡  2017 = 1,460 million

¡  Lawsuit in D.C. Circuit regarding EPA’s failure to account for exemptions. ¡  NBB and other trade associations have filed

a lawsuit in the D.C. Circuit on the same grounds.

¡  The case is currently stayed pending EPA’s decision on the petition for reconsideration.

¡  Congress should extend the $1 per gallon incentive for 2018 and 2019;

¡  Provide long-term certainty – a permanent incentive at a level that fosters growth.

¡  Soybean oil represents just under half of U.S. feedstocks for biodiesel.

¡  Animal fats, recycled cooking oil represent nearly one-third.

¡  Distiller’s corn oil was commercialized only because of the RFS.

¡  engine particulate emissions by more than 45%;

¡  hydrocarbon emissions by 67%;

¡  processing wastewater by 79%; and

¡  hazardous waste by 96%

¡  when compared to petroleum diesel.
