Bonjour! The French Nest Open­Air Market is a premier outdoor artisan, vintage, antique, and collectibles market! This Vendor Handbook provides information and rules to ensure a pleasurable shopping experience for our customers as well as an enjoyable & profitable experience for our vendors.

Location

Civic Center Park 225 LaPorte Ave. Fort Collins, CO 80521 The 2.3 acre park is on the SE corner of Laporte & Howes behind the Larimer County Justice Ctr., 1 block north of the Downtown Fort Collins Farmer’s Market.

may not fit the category description for “antique”. Items must be in good, useable condition.

Retailer ­ Unique merchandise purchased from wholesaler or manufacturer. Brand name of

merchandise must be disclosed on the application.

Food Concessions ­ Must be licensed and prepared in licensed kitchen.

Other ­ Items that do not fit into the above categories may be submitted for consideration.

Application Process

Please submit an application in order to be considered for a vendor spot at The French Nest Open­Air

Market. We are a juried market meaning we will review your application and notify you of being

accepted to the market. Our intent is to offer a unique mix of high­quality vendors that enhance the

market experience for shoppers and vendors alike.

Once we receive your application, we will send you an e­mail stating whether or not you have

been accepted as a vendor at the Market. If you have been accepted, we will attach a Vendor

Agreement to the e­mail along with additional information.

Next, you will need to:

Booth space assignments are made on a “first come, first served” basis as payment is received. We reserve the right to assign booth spaces to best meet the overall market experience. Photos with the Application

As per the application process, potential vendors must submit a thorough description of merchandise

they intend to sell and photos are required of ALL vendors (new and returning). We not only want to

see your wonderful fare, but will use the pictures for advertising. Fantastique! We look forward to

experiencing your hand­crafted and hand­collected items!

Merchandise No No Our Market is committed to providing our guests with quality artisan, vintage, and antique merchandise.

We want our shoppers to discover amazing finds so please do not bring along any unwanted household

items, save them for your next garage sale! Merci!

Undisclosed Merchandise A vendor who brings merchandise they have not disclosed on their application may be asked to remove

the merchandise and may forfeit future Market dates and corresponding booth space rental fees. The

French Nest Market has sole discretion in determining what merchandise fits the culture of the Market in

order to make the experience unique for our shoppers and one all vendors can be proud to be a part of.

Merchandise Not Permitted Specific items not permitted : Alcoholic beverages (unless by an approved vendor), cigarettes, marijuana or other tobacc o/marijuana products or paraphernalia; b aseball caps, new souvenirs or memorabilia;

CD’s, DVD’s, video cassettes, cassette tapes, video games, gaming systems; commercial pictures or

posters (other than vintage); commercially produced jewelry; cosmetics, personal care items, bedding;

food or beverages (including bottled water) unless by an approved food vendor; knives, guns,

ammunition, firearms, and other weapons, potentially dangerous or hazardous items, merchandise that

infringes upon copyrighted designs or materials, bears counterfeit trademarks (i.e., brand knock­offs);

pornography; items not appropriate for the Market as determined by The French Nest Market.

Glass From the City of Fort Collins ­ “It will be allowed, as an exception, for a vendor to sell an item that is in

a glass container or made of glass (i.e. jelly, glass beads, etc.) as long as the item is placed in a bag

before leaving the vendor.” Please adhere to this city code! Bring your cutest bags !!

Booth Space Sizes, Rental Fees and Payment

Vendors can choose from two Booth sizes: Single or Double . Timing of payment and number of markets determines discounts/savings as follows (prices are subject to change):

Double Booth Space 10’ x 20’

$175 per market $165 per market, $825 total

$195 per market

PAYMENT POLICY: If you pay by May 1, 2017, you will receive the discount(s) as described above. If you choose not to take advantage of this discount opportunity, your payment is due a MINIMUM of

10 days prior to market day in order to receive a booth space assignment. If payment is not received 10 days prior to market day, we will assume you will not be attending the market and a booth space will not be assigned. If market capacity is reached, we may request payment earlier than 10 days in order to secure your booth space. Booth space assignments are made on a “first come first served” basis as payment is received. We reserve the right to assign spaces to best meet the overall market experience. Booth Space Sub­leasing

Vendors are not allowed under any circumstances to sub­lease their booth spaces. The vendor signing the contract is the vendor expected to attend the market. Unknown persons checking in on Market day will not be allowed to exhibit.

Sales Tax

It is the responsibility of the vendor to collect and submit local (city and county) and state sales tax as required by law. Vendors must show proof of sales tax licenses prior to participation in a market. Please direct all tax questions to either the city, county, or state. For more information, contact:

Vendors must report all sales during the Market in accordance with the appropriate sales tax regulations, collect all applicable sales taxes, and abide by all pertinent city, county, state, and federal laws. Current sales tax rates are as follows: State 2.9%; Larimer County 0.65%; City 3.85% = 7.40% Total.

Vendor Load­In

We will provide each vendor with an assigned window of time for arrival about 3­7 days prior to market date.

Set­up times will be staggered in order to allow all vendors vehicle access to the market entry points and reduce the likelihood of traffic back­up.

If you are going to be late on market day due to circumstances beyond your control, please give us a call to let us know you are on your way. If we think you are not coming, we may reassign your space as is best for the market.

Please note: All vehicles entering the Market must carry vehicle liability insurance . Vendors may be required to show proof of insurance prior to entering the Market area to unload. Failure to provide proof of insurance when asked may result in dismissal from the market and forfeiture of booth rental fees.

Vendor Parking

Please park your vehicle(s) in either of the two designated parking areas:

1) The public parking lot at City Hall, 300 Laporte Avenue (NE corner of Laporte Avenue and Meldrum Street ­ one block west of Civic Center Park). Free for the day.

2) The covered public parking lot on the southeast corner of Laporte Avenue and Mason Street (one block east of Civic Center Park). Parking in the covered lot is free for the first hour, then a charge is required.

DO NOT park your vehicle in the Civic Center Park parking lot on the west side of the park as this is reserved for handicap parking, vendor set in, and customer loading. If vendors park in the Civic Center Park parking lot, they will be asked to move their vehicles immediately to the vendor lot, and may forfeit future participation in the market and corresponding booth space fees.

Vendor Booth Set­up

Vendors need not check­in on market day; FN owners will watch for you! Please call if you will be late so we save your spot.

Please create a “boutique”­like atmosphere in your booth space! Our vendors are exceptionally creative and amazingly talented at this! Attention to detail will create an inspiring and alluring shopping experience! Please consider wearing a nametag or something to identify you as the booth owner for your customers’ convenience. Shop names should be prominently displayed!

Booth boundaries will be clearly marked and labeled with your vendor name.

­ We ask that our vendors please place merchandise within the specified booth boundaries in order to give neighboring vendors their space.

­ Sidewalks and walkways need to remain clear so that our guests may move about easily amongst all of the wonderful wares.

­ We will address any violations of booth boundaries. Should a vendor fail to comply with this provision, it will result in additional charges for space used and may result in vendor dismissal from that market and/or exclusion from future markets. What constitutes excessive space outside of booth boundaries and/or interference with other exhibitors will be the sole discretion of the French Nest Market owners.

­ Electricity is not available for vendor use except on an extremely limited and absolutely necessary basis. Please don’t use a generator, they are loud and drown out our music!

­ Remember we are in a beautiful park with cool grass and lovely pathways. Your booth space will not be level ; please come prepared with shims, etc. to accommodate. And sometimes the grass is a bit wet/muddy in areas ­ bring your matts!

Umbrellas, Tents and Tent Weights

Vendors are required to supply a 10x10 tent or canopy encompassing their booth space. In addition to providing shade/shelter for yourself and your merchandise, a tent or canopy provides an appealing appearance and will attract shoppers.

You KNOW how the wind can blow in Colorado! So vendors must take necessary and reasonable precautions to secure tents or canopies as follows:

Tents must be weighed down or anchored into the ground via tent weights (minimum 10

lbs weight per tent leg) or stakes. These are usually sold as an accessory and not part of

the tent itself. Stakes may not exceed 6 inches in length.

Tents may be checked for weights or stakes prior to market start time. If weights or stakes

are not used, vendors may be asked to take their tent down.

Tents must not display commercial printing/graphics other than the vendor’s business name.

Health and Safety on Grounds

Vendors may not use their space so as to interfere with or jeopardize the health or safety of other

vendors, patrons, or the general public. Vendors may not store any gasoline, petroleum, explosives, or

any other dangerous items or noxious products at any location at the Market site. Vendors are not

permitted to burn candles, incense, or any other spark or flame­producing device. Please do not smoke

in your booth or on the grounds.

Customer Loading of Treasures

A customer loading area will be designated at the market. Please direct your customers to this

designated area; do not direct your customers to load their purchases at another location. This will

make the day much smoother for all of us!

Tear­Down

In order to support a full and vibrant market, we count on all of our vendors to stay open and

operational from 9am – 3pm. Vendors closing down early could impact the vitality of the Market

which surely none of us want. So hang in there for those last minute shoppers! Should such early

closures occur, the vendor may forfeit future market dates and associated booth rental fees paid.

Trash and Abandoned Merchandise

Please remember to take everything out with you! Do not leave trash and unwanted merchandise of any

kind in your booth at days­end. Merci!!

Any merchandise left after 4:30pm will be considered abandoned and will be removed and/or discarded.

A minimum of a $100 (maximum $500) trash removal fee will be assessed for abandoned merchandise

and you may forfeit participation in future markets and corresponding booth space fees. The French

Nest Market has the right to make changes to the tear­down procedures as required in order to ensure a

safe and orderly process.

Refunds and Cancellations

Unfortunately, we cannot provide refunds in the event of a vendor cancellation. If possible, we ask that

Vendors provide 14­day advance notice if unable to participate on any given market day. Absences or

No Shows may exclude vendors from participating in future markets and forfeiture of any booth rental

fees paid.

Weather and Emergency Situations

The Market will be held rain or shine! However, if inclement weather forces us to close early, you will

be alerted by the French Nest Market to begin tearing down. We will alert vendors via email, over the

PA system, and/or in person.

Refunds will not be provided due to inclement/severe weather or emergency situations in the area which

may or may not result in market cancellation or park evacuation

Media Releases and Photographs

The French Nest Market may occasionally publish images of the market vendors’ names, likeness,

and/or products in promotional materials (including the French Nest Market website, Facebook page,

Instagram, Pinterest, Twitter, etc.) or the media. Pictures used may be those provided by vendors or

pictures/video taken by French Nest staff. By signing the Vendor Agreement, you agree to release The

French Nest Market to use these images and such use will be without compensation.

Important note: If you do not want images or your name or products included in promotional materials, please contact us to be excluded.

Advertising

We will advertise in various ways to attract shoppers and present a wonderfully unique event!

By signing this Vendor Agreement you acknowledge that you have read and

understand all of the information detailed in the Vendor Handbook.
