STUDENT TEACHING LmER OF AGREEMENT

Tier 1: Primary Partner

This Student Teaching Letter of Agreement (Agreement) is made between Western Governors University, a Utah

nonprofit corporation (WGUj, and Muscatine Community School District ("District"), and is effective as of the date of the last signature below ("Effective Date").

Thank you for working with Western Governors University (WGU) for the placement of student teachers. Our goal

is to establish a relationship of collaboration that benefits your district/school and WGU Teacher Candidates, and

that allows us to work together for continuous improvement. We look forward to working together for the benefit

of your future educators.

WGU is regionally accredited by the Northwest Commission on Colleges and Universities (NWCCU), and the WGU

Teacher Education programs are further accredited by the National Council for the Accreditation of Teacher

Education (NCATE). WGU represents that each Teacher Candidate assigned to the District for Student Teaching is validly enrolled in an approved WGU credentialing program and meets the District's background requirements .

A. Mutual Expectations

A Primary Partner is a district/school where WGU places Teacher Candidates for a Field Experience with Cooperating Teachers, with an aim to co-construct a mutually beneficial arrangement for clinical preparation and the continuous improvement of Teacher Candidates, and to share accountability for Teacher Candidate outcomes. The school administrator and Cooperating Teacher will have the opportunity to provide critical feedback to inform program improvement through surveys at the end of each cohort and will receive an invitation to participate in an annual focus group.

B. Cooperating Teacher Standards

District, with the input of WGU, will provide the Teacher Candidate with a Student Teaching assignment in a school and classes of District under the direct supervision and instruction of a Cooperating Teacher that meets the following minimum requirements:

• Holds a teaching credential or license for the subject area and/or grade level being taught;

• Has a minimum of 3 years of teaching experience with strong evaluations;

• Demonstrates a positive impact on student learning in the classroom;

• Demonstrates ability to serve as a positive role model and mentor;

• Demonstrates actions related to leadership qualities and collaborating with others;

• Successfully and with positive impact mentored teacher candidates, colleagues, and/or adults;

• Uses a computer to correspond with WGU staff and complete online evaluation forms; and

MUSCATINE COMMUNITY SCHOOL DISTRICT BOARD POLICY

501.2 ATTENDANCE

Students will be expected to attend classes regularly and to be on time in order to receive maximum beneit from the instructional program, to develop habits of punctuality, self‐discipline and responsibility, and to assist in keeping disruption of the educational environment to a minimum. Students who have good attendance records are most likely to achieve higher grades, enjoy school life to a greater degree, and have more employment opportunities after leaving school. Prospective employers expect promptness and regular attendance from employees and are reluctant to hire persons who have not established good habits of attendance and punctuality. Life‐long patterns of responsibility and self‐discipline are fostered by regular attendance and promptness during the years of school attendance.

While it is possible for an absent student to make up much of the school work missed, it is impossible to completely compensate for absence from classes. Absences always cause some disruption in the educational progress of the student who is absent. In order to maintain interest and understanding in a program of instruction, students should not be absent any more than is absolutely necessary. Students who are absent may not understand what the teacher is currently presenting, and may also become discouraged with the double burden of keeping current and making up missed work. Irregular attendance or tardiness by students not only retards their own studies, but also may interfere with the progress of those pupils who are regular and prompt in attendance.

There are times, however, when school oficials may determine that the problems associated with the absence from classes are outweighed by the advantages of another school activity. Attendance at such approved trips will not be considered an absence from school. Every effort will be made by school oficials to keep these absences from class to a minimum.

501.2(R1) ATTENDANCE POLICIES ‐ Administrative Regulations for Elementary Schools ELEMENTARY SCHOOLS Attendance Notiication

A. Whenever a student is absent from school for any reason, a parent or guardian should notify the school. (If the school isn't notiied, the ofice will attempt to contact parents to verify the student's absence.)

B. Whenever a student is absent from school on more than 5 occasions in one semester, the principal may convene a meeting of an attendance review committee consisting of the principal or the principal's designee, a counselor, and the student's teacher. This committee shall meet to review the student's attendance and make recommendations toward its improvement. An attempt will be made to contact the parent prior to any action or recommendations by the committee. This team approach should generate some possible solutions to the child's attendance problem. These recommendations may include such things as further counseling, probationary status, individualized attendance rules, or disciplinary action, etc. This committee will notify the parents or head of the household of its action and invite them to school to discuss the attendance of the child. If the parents or guardians are reluctant to visit the school, or if they make no contact, a school employee designated by the principal shall attempt to make a home visit in order to impress upon the family the importance of regular school attendance.

Tardiness

A. Students who are not in their homeroom when the bell rings will be tardy. B. Excessive tardiness of more than 5 days in one semester would also warrant a

conference with parents or guardian. C. Elementary students who arrive after, or leave before, 8:30 a.m. will be counted

tardy. The only exceptions are students who have dental or medical appointments and arrive before 10:00 a.m.

D. Elementary students who leave after 2:00 p.m. will be noted as leaving early. The only exceptions are students who have dental or medical appointments and leave after 2:00 p.m.

E. Students tardy to school will not be admitted to class without checking in with the school secretary.

Absences

A. Students who arrive after one‐half of the school day is completed will be counted one‐half day absent.

B. Absences will be considered valid for the following reasons: a. Personal illness b. Death or serious illness in the immediate family or household, and

emergency work at home when vital to the family welfare. c. The funeral of a relative or close friend. d. Medical or dental appointments which cannot be made other than during

school time, and for which veriication of the appointment is presented before the absence.

e. Short term suspension from school. f. Court appearances.

C. We do not recommend students be absent for the following: a. Shopping trips b. Vacations (see D below) c. Appointments that could be arranged at other than school time, or which are

not essential to the student's welfare. D. The school does not support, nor generally approve of students being absent from

school for vacation, and encourages parents to arrange vacations to coincide with school vacation time. Those family vacations which cannot be taken at such time, and during which the student would be without suitable adult supervision were he or she to remain in school, may be excused under the following provisions:

a. Advance notice must be given to the school by direct communication from the parents or head of household at least ive (5) school days before the absence.

b. All school work must be made up in advance, or arrangements made to make up the work, to the satisfaction of the teachers involved.

E. Other absences from school that can be justiied from an educational standpoint may be approved. Students who anticipate such an absence must give ive (5) days notice in advance of the anticipated absence. Such notiication shall be in writing and must include reasons why the absence can be justiied as educational. The student may be asked to submit a written report highlighting the educational signiicance of the absence.

F. School work missed (or its equivalent) due to any absence must be completed to the satisfaction of each teacher whose class or classes were missed. It is the student's

responsibility to arrange for this make‐up work, and these arrangements must be made in a way that does not interfere with normal classroom activities.

a. When students can anticipate absences, every effort must be made to see that school work is made up in advance of the absence, or arrangements made to the satisfaction of the teacher(s) involved. The principal may determine that the completion of school work in advance be a prerequisite to allowing the absence to be excused.

b. When an absence was not anticipated, all school work must be made up within the number of school days missed plus one. Absences of more than ive (5) days must be made up as arranged with the teachers involved.

c. Reduction of grades shall not be used as a disciplinary measure against a student because of absence from school, although failure to complete equivalent make‐up work may result in lowering of the grade.

d. Students shall receive full credit for schoolwork made up due to absence. G. Parents of students who were absent from school for any reason shall provide a note

stating the speciic reasons for the absence, the speciic days or times absent, veriication by doctor or dentist, if appropriate, and the signature of a parent or head of household. Parents and guardians are encouraged to phone the school prior to 8:30 a.m. regarding a student's absence on the day of the absence.

H. In the event that the principal determines that it is advisable to verify an excuse given for an absence, the principal may take appropriate steps to do so.

I. No later than four weeks following the close of each school quarter, the principal in charge of each attendance center will report to the superintendent regarding any attendance problems that were not resolved for the previous quarter.

J. Students with excessive truancies will be reported to the county attorney. Truancies are absences "without a reasonable excuse." Students who have been truant for more than eighteen days or who are projected to miss eighteen or more days in a school year will be reported to the county attorney. Chronic absences may also be reported. Chronically absent students are those who may have some kind of note from parents, but whose pattern of absences seems to continue no matter what interventions are tried. The building principals will collect truancy information and send it to the superintendent who will then make the appropriate referrals to the county attorney. The principal of the building that the child attends will participate in any mediation process that may be arranged by the county attorney.

Disciplinary Action

A. Students who are found to be absent without reasonable excuse may be subjected to one or more of the following disciplinary actions:

At the appointed time, the parties attending the review will meet to discuss the matter informally. Following the review, the principal shall afirm, reverse, or modify the decision.

B. Students, parents and teachers may obtain a review of the principal's decision under this absence rule by iling a written request for review within ive school days with the superintendent. The superintendent or designee will determine a mutually agreeable time, place and date for the review and notify the interested persons. At the conclusion of the review, the superintendent or the superintendent's designee shall afirm, reverse or modify the principal's decision.

501.2(R2) ATTENDANCE POLICIES ‐ Administrative Regulations for Middle Schools MIDDLE SCHOOL It is the responsibility of the parent/guardian to contact the school as soon as possible when a student is absent. A note from the parent/guardian is acceptable if they have not or cannot contact the school by phone. In the event that the principal or designee determines that it is advisable to verify an excuse given for an absence, the principal or designee may take appropriate steps to do so. When it is determined that an excuse is forged or misrepresents the facts, the principal or designee may take disciplinary action. Whenever a student is absent on more than six (6) occasions from school or from a class in one semester, the principal or designee shall begin proceedings to convene an attendance review core team consisting of the principal or the principal's designee, a counselor, and a teacher or team of teachers of the student, as well as any other personnel deemed pertinent to the situation. This committee shall meet to review the student's attendance and make recommendations toward its improvement. These recommendations may include such things as parent conference, further counseling, probationary status, individualized attendance contract, or disciplinary action. The following factors must be considered by counselor(s) and the principal in deciding what types of action to take:

What stage of the year is it? While it may be serious to miss 6 days in the irst six‐week period, it may not be serious to reach that point in the last month of school.

Reasons for the absences. Unexcused vs. excused absences. Grades and achievement. Effort and ability to make‐up work. Teacher concerns.

Guidelines for Action After six (6) absences, the parent/guardian will be notiied of the school’s concern. After twelve (12) absences, a letter will be sent home to arrange a conference with the parent/guardian, the child, and his or her counselor.

After eighteen (18) absences, the parent will be notiied that the superintendent and county attorney will be notiied. Iowa law mandates school attendance. If a student does not attend school on a regular basis, the parent/guardian is in violation of Iowa law and may be prosecuted. Where a student demonstrates chronic attendance problems, the county attorney and/or outside agencies may be notiied. The school does not support, nor generally approve, students being absent from school for a vacation and encourages parents to arrange vacations to coincide with school vacation time. When it is necessary for a student to miss school because of a family vacation, the parent/guardian must notify school at least ive days before the absence. Arrangements should be made for the completion of make‐up work to the satisfaction of the teachers involved. When an absence is not anticipated, all schoolwork must be made up within twice the number of school days missed or within a longer period of time to the satisfaction of the individual teacher(s) involved. Students shall receive credit, with no late penalty, for schoolwork made up due to absences. If a student will be absent for an extended period of time, the parent/guardian should contact the school counselor. Tardies Students who are not within their assigned instructional areas when the bell rings will be tardy unless properly excused. Tardies to school may be excused upon the same reasonable grounds as those allowed for absences. Two (2) tardies to school in one semester shall be excused. Excessive tardies will be handled through disciplinary action and parent involvement. Students who are tardy to school will not be admitted to class without the written permission of the principal or designee. Students who are tardy to class must have a written pass from the school employee responsible or the tardy will be recorded. Individual teachers are responsible for the disciplinary action regarding between class tardies. Consistent tardiness may result in ofice discipline.

501.2(R3) ATTENDANCE POLICIES ‐ Administrative Regulations for High School MUSCATINE HIGH SCHOOL Attendance at school on a regular basis is an extremely important ingredient for student success. Students perform better in school when they are in attendance regularly. Regular attendance and a sense of responsibilities are important to every job. It is the position at MHS that students should be in attendance at school every day that school is in session and should attend and participate in all scheduled classes. Every effort should be exercised on the part of the students and parents to assure regular attendance. The emphasis of the attendance program at MHS is to place accountability or ownership on the individual student. These guidelines will be followed:

A. School Attendance ‐ Students and parents are accountable for all absences from class and notiication must be received by the attendance ofice within 48 hours of the absence. Parents may account for the absence of their child by:

a. A telephone call to the school explaining the absence of the child (563‐263‐6141, extension 1133, 24 hours a day, seven days a week). You may also email our attendance ofice at [email protected]

b. Written notiication presented to the attendance ofice B. School Activities ‐ Students missing class because of participation in a school

501.2(R3) ATTENDANCE POLICIES ‐ Administrative Regulations for High School MUSCATINE HIGH SCHOOL Attendance at school on a regular basis is an extremely important ingredient for student success. Students perform better in school when they are in attendance regularly. Regular attendance and a sense of responsibilities are important to every job. It is the position at MHS that students should be in attendance at school every day that school is in session and should attend and participate in all scheduled classes. Every effort should be exercised on the part of the students and parents to assure regular attendance. The emphasis of the attendance program at MHS is to place accountability or ownership on the individual student. These guidelines will be followed:

A. School Attendance ‐ Students and parents are accountable for all absences from class and notiication must be received by the attendance ofice within 48 hours of the absence. Parents may account for the absence of their child by:

a. A telephone call to the school explaining the absence of the child (563‐263‐6141, extension 1133, 24 hours a day, seven days a week). You may also email our attendance ofice at [email protected]

E. Suspension/Exclusion Caused by Students' Inappropriate Behavior – When a student makes a decision to act inappropriately and the behavior results in an out of school suspension, the days out of school will not count as days of non‐attendance. However, the student must make up all work missed during the suspension within the time frame outlined in the Board policy and student agenda in order to receive credit for the time out of class.

F. Administrative Ofice/School Clearance – When a student is called to the Attendance Ofice or one of the administrative ofices at the request of an administrator or counselor, the student will be excused from class. The student may return to class with an admit from the ofice.

G. Administrative/Nurse/Counselor/School Emergencies ‐ Students having personal or medical problems at school should irst report to the assigned class instructor and then to the school nurse, administration, or guidance ofice. Leaving the building or being out of class without authorization will be recorded as an unexcused absence.

H. Attendance Notiication – Students are considered unexcused if they are not present in class and prior notiication has not been given by a parent to the Attendance Ofice.

a. Whenever a student is absent unexcused for at least one period, the school will attempt to contact the parents through the school’s automated calling system if the parents have not contacted the school. Notes are acceptable to account for an absence if parents cannot make contact by telephone. i. A phone call will be generated each day a class period is unexcused, or

that the student is more than 5 minutes late. A log will be maintained to verify attempts and possible results.

ii. At two unexcused absences, verbal and written notiication to students will be given by the classroom teacher. The student will be required to bring the notiication back to the teacher with student and parent/guardian signature conirming notiication of the absences.

iii. Only when a student of majority age (18 years or older, married , or with approval of self‐guardianship papers) is not residing with the student’s parents or guardian and not under parental insurance or tax credits, may the student present his or her own reason for absence without parental veriication. The principal or designee should be notiied in advance of any such circumstances.

iv. In the event that the principal or designee determines that it is advisable to verify a reason given for an absence, the principal or designee may take appropriate steps to do so. When it is determined that an excuse is forged or misrepresents the facts, the principal or

601.7 FOREIGN STUDY The Board of Directors recognizes the value of student and staff participation in study programs outside the country. Plans for such study programs must be approved in advance by the Board of Directors. Separate approval shall be gained for each new trip. Previously approved study programs that have demonstrated compliance with administrative guidelines need only to provide the Board with a statement of intent to continue and assurance that the same personnel are involved. 602.3R1 USE OF INFORMATION SERVICE ­ ADMIN REGS

Employees and students may make copies of copyrighted materials that fall within the following guidelines. Where there is reason to believe the material to be copied does not fall within these guidelines, prior permission shall be obtained from the publisher or producer with the assistance of the principal, teacher, teacher­librarian. Employees and students who fail to follow this procedure may be held personally liable for copyright infringement and may be subject to discipline by the board. Under the "fair use" doctrine, unauthorized reproduction of copyrighted materials is permissible for such purposes as criticism, comment, news reporting, teaching, scholarship or research. Under the fair use doctrine, each of the following four standards must be met in order to use the copyrighted document:

Purpose and Character of the Use – The use must be for such purposes as teaching or scholarship.

Nature of the Copyrighted Work – The type of work to be copied. Amount and Substantiality of the Portion Used – Copying the whole of a work cannot be

considered fair use; copying a small portion may be if these guidelines are followed. Effect of the Use Upon the Potential Market for or value of the Copyrighted Work – If

resulting economic loss to the copyright holder can be shown, even making a single copy of certain materials may be an infringement, and making multiple copies presents the danger of greater penalties.

Authorized Reproduction and Use of Copyrighted Material Reminders:

Materials on the Internet should be used with caution since they may, and likely are, copyrighted.

A teacher may make multiple copies not exceeding more than one per pupil, for classroom use or discussion, if the copying meets the tests of “brevity, spontaneity and cumulative effect” set by the following guidelines. Each copy must include a notice of copyright.

Brevity A complete poem, if less than 250 words and two pages long, may be copied;

excerpts from longer poems cannot exceed 250 words; Complete articles, stories or essays of less than 2500 words or excerpts from

prose works less than 1000 words or 10% of the work, whichever is less may be copied; in any event, the minimum is 500 words;

Each numerical limit may be expanded to permit the completion of an unfinished line of a poem or prose paragraph;

One chart, graph, diagram, drawing, cartoon or picture per book or periodical issue may be copied. “Special” works cannot be reproduced in full; this includes children's books combining poetry, prose or poetic prose. Short special works may be copied up to two published pages containing not more than 10 percent of the work.

Spontaneity – Should be at the “instance and inspiration” of the individual teacher when there is not a reasonable length of time to request and receive permission to copy.

Cumulative Effect – Teachers are limited to using copied material for only one course for which copies are made. No more than one short poem, article, story or two excerpts from the same author may be copied, and no more than three works can be copied from a collective work or periodical column during one class term. Teachers are limited to nine instances of multiple copying for one course during one class term. Limitations do not apply to current news periodicals, newspapers and current news sections of other periodicals.

Copying Limitations Circumstances will arise when employees are uncertain whether or not copying is prohibited. In those circumstances, the principal, teacher or teacher­librarian should be contacted. The following prohibitions have been expressly stated in federal guidelines:

Reproduction of copyrighted material shall not be used to create or substitute for anthologies, compilations or collective works.

Unless expressly permitted by agreement with the publisher and authorized by school district action, there shall be no copying from copyrighted consumable materials such as workbooks, exercises, test booklets, answer sheets and the like.

Reproduce or use copyrighted material at the direction of someone in higher authority or copy or use such material in emulation of some other teacher's use of copyrighted material without permission of the copyright owner.

Require other employees or students to violate the copyright law or fair use guidelines.

Authorized Reproduction and Use of Copyrighted Materials in the Library A library may make a single copy or three digital copies of:

An unpublished work in its collection; A published work in order to replace it because it is damaged, deteriorated, lost or

stolen, provided that an unused replacement cannot be obtained at a fair price. A work that is being considered for acquisition, although use is strictly limited to that

decision. Technological protection measures may be circumvented for purposes of copying materials in order to make an acquisition decision.

A library may provide a single copy of copyrighted material to a student or employee at no more than the actual cost of photocopying. The copy must be limited to one article of a periodical issue or a small part of other material, unless the library finds that the copyrighted work cannot be obtained elsewhere at a fair price. In the latter circumstance, the entire work may be copied. In any case, the copy shall contain the notice of copyright and the student or staff member shall be notified that the copy is to be used only for private study, scholarship or research. Any other use may subject the person to liability for copyright infringement. Authorized Reproduction and Use of Copyrighted Music or Dramatic Works Teachers may:

In an emergency, a teacher may make and use replacement copies of printed music for an imminent musical performance when the purchased copies have been lost, destroyed or are otherwise not available.

Make and retain a single recording of student performances of copyrighted material when it is made for purposes of evaluation or rehearsal;

Make and retain a single copy of excerpts from recordings of copyrighted musical works for use as aural exercises or examination questions; and,

Edit or simplify purchased copies of music or plays provided that the fundamental character of the work is not distorted. Lyrics shall not be altered or added if none exist.

Performance by teachers or students of copyrighted musical or dramatic works is permitted without the authorization of the copyright owner as part of a teaching activity in a classroom or instructional setting. The purpose shall be instructional rather than for entertainment. Performances of non­dramatic musical works that are copyrighted are permitted without the authorization of the copyright owner, provided that:

The performance is not for a commercial purpose; None of the performers, promoters or organizers are compensated; and, Admission fees are used for educational or charitable purposes only.

All other musical and dramatic performances require permission from the copyright owner. Parents or others wishing to record a performance should check with the sponsor to ensure compliance with copyright. Recording of Copyrighted Programs Television programs, excluding news programs, transmitted by commercial and non­commercial television stations for reception by the general public without charge may be recorded off­air simultaneously with broadcast transmission (including simultaneous cable retransmission) and retained by a school for a period not to exceed the first forty­five (45) consecutive calendar days after date of recording. Upon conclusion of this retention period, all off­air recordings must be erased or destroyed immediately. Certain programming such as that provided on public television may be exempt from this provision; check with the principal, teacher or teacher librarian or the subscription database, e.g. united streaming. Off­air recording may be used once by individual teachers in the course of instructional activities, and repeated once only when reinforcement is necessary, within a building, during the first 10 consecutive school days, excluding scheduled interruptions, in the 45 calendar day

retention period. Off­air recordings may be made only at the request of and used by individual teachers, and may not be regularly recorded in anticipation of requests. No broadcast program may be recorded off­air more than once at the request of the same teacher, regardless of the number of times the program may be broadcast. A limited number of copies may be reproduced from each off­air recording to meet the legitimate needs of teachers. Each additional copy shall be subject to all provisions governing the original recording. After the first ten consecutive school days, off­air recordings may be used up to the end of the 45 calendar day retention period only for evaluation purposes, i.e., to determine whether or not to include the broadcast program in the teaching curriculum. Permission must be secured from the publisher before the recording can be used for instructional purposes after the 10 day period. Off­air recordings need not be used in their entirety, but the recorded programs may not be altered from their original content. Off­air recordings may not be physically or electronically combined or merged to constitute teaching anthologies or compilations. All copies of off­air recordings must include the copyright notice on the broadcast program as recorded. Authorized Reproduction and Use of Copyrighted Computer Software Schools have a valid need for high­quality software at reasonable prices. To assure a fair return to the authors of software programs, the school district shall support the legal and ethical issues involved in copyright laws and any usage agreements that are incorporated into the acquisition of software programs. To this end, the following guidelines shall be in effect:

All copyright laws and publisher license agreements between the vendor and the school district shall be observed;

Staff members shall take reasonable precautions to prevent copying or the use of unauthorized copies on school equipment;

A back­up copy shall be purchased, for use as a replacement when a program is lost or damaged. If the vendor is not able to supply a replacement, the school district shall make a back­up copy that will be used for replacement purposes only;

A copy of the software license agreement shall be retained by the , [board secretary, technology director or teacher­librarian ­ choose all that apply or add others] ; and,

A computer program may be adapted by adding to the content or changing the language. The adapted program may not be distributed.

Fair Use Guidelines for Educational Multimedia Students may incorporate portions of copyrighted materials in producing educational multimedia projects such as videos, Power Points, podcasts and web sites for a specific course, and may perform, display or retain the projects.

In face­to­face instruction; In demonstrations and presentations, including conferences; In assignments to students; For remote instruction if distribution of the signal is limited; Over a network that cannot prevent duplication for fifteen days, after fifteen days a copy

may be saved on­site only; or, In their personal portfolios.

Educators may use copyrighted materials in a multimedia project for two years, after that permission must be requested and received. The following limitations restrict the portion of any given work that may be used pursuant of fair use in an educational multimedia project:

Motion media: ten percent or three minutes, whichever is less; Text materials: ten percent or 1,000 words, whichever is less; Poetry: an entire poem of fewer than 250 words, but no more than three poems from one

author or five poems from an anthology. For poems of greater than 250 words, excerpts of up to 250 words may be used, but no more than three excerpts from one poet or five excerpts from an anthology;

Music, lyrics and music video: Up to ten percent, but no more than thirty seconds. No alterations that change the basic melody or fundamental character of the work;

Illustrations, cartoons and photographs: No more than five images by an artist, and no more than ten percent or fifteen images whichever is less from a collective work;

Numerical data sets: Up to ten percent or 2,500 field or cell entries, whichever is less; Fair use does not include posting a student or teacher’s work on the Internet if it includes portions of copyrighted materials. Permission to copy shall be obtained from the original copyright holder(s) before such projects are placed online. The opening screen of such presentations shall include notice that permission was granted and materials are restricted from further use.

on our Fall 2017 count that were not on our Fall 2016 count. We will be paying

those districts for 28.6 students x $6,591/student or $188,502.60. We did not get

authority in Fall 2016 so we recommend asking SBRC for the authority in FY18.

2. English Language Learners (ELL) served beyond 5 years. We have 140 ELL

students we are serving beyond 5 years. These students can generate another

.22/student additional authority. 140 student’s x .22/student = 30.8 x $6,664 or

$205,251.20. We recommend asking SBRC for the authority in FY18.

Our cash reserve levy funds these requests.

Muscatine Community School District Early Retirement Incentive Program

November, 2018 These program guidelines are presented as written guidelines and procedures so that all may know the qualifications, eligibility, application and structure of the program. The plan requires eligible early retirees who are not taking district insurance to take their early retirement benefit in a 403(b) plan (see: 7(b)). This will give people in this group greater tax shelter than they would get taking the retirement benefit directly they don’t have to pay FICA using the 403(b). Members can take this money out of their 403(b) at any time as long as they are 55 or older and retired from Muscatine. 1. Eligibility:

A. To be eligible for the program an employee must be considered full-time and qualified for participation in the district’s health insurance plans.

2. Application:

A. To receive the benefit an employee must meet "A" & "B" below and submit a signed application on or before January 3rd, 2018.

3. Qualifications:

A. To qualify for the program an employee must be eligible (as defined under

paragraph 1(A)) and be under contract with the school district in the fiscal year prior to retirement. The person is no longer required to make application for IPERS.

B. To qualify for the program an employee must have served the Muscatine

Community School District for not less than fifteen academic years and be not less than 55 years of age at the date of retirement.

Whenever the term 65th birthday is used it no longer means the date at which a person may apply and receive full social security, but rather when they become eligible for Medicare which is a constant 65. So regardless of birth date the right to district insurance expires the month before the person qualifies for Medicare coverage. Retirees who are served by Medicare will find supplemental plans available through multiple firms willing to provide such coverage. 4. Benefits payable:

A. .03 times base annual earnings (minus Teacher Salary Supplement and any other compensation outlined in paragraph 5(A)) times the number of years of service not to exceed 33 years.

B. Maximum aggregate payment over five years will not exceed $50,000.

A. Base wages includes only the standard pay for the standard contract days along with

longevity. Base wages excludes any other forms of compensation including but not limited to: teacher quality monies, Teacher Salary Supplement, any and all supplemental contracts, schedule "C", tutoring, stipends, training pay, honorariums, extra days, overtime, summer school, evening school, additional duty pay, overload and annuities.

6. Years defined:

A. The contract year is 9-1-XX through 8-31-XX for teachers while it is 7-1-XX through 6-30-XX for all others.

B. The fiscal year is 7-1-XX through 6-30-XX for all.

7. Distribution: There are two methods of distribution:

A. Those retiring at the conclusion of fiscal year 2017 and enrolled in one of the school district’s health insurance plans may take their distribution as follows: we will pay in each quarter beginning the 20th day of July 2017 and running for twenty quarters (5 years), into a duly approved Health Reimbursement Arrangement (HRA). It will be the retiree’s responsibility to pay any administrative costs for their account plus any applicable fees, social security or taxes. Their account will be directed by them to pay the required insurance premium. Any remaining amount will be held in reserve for future use by the retiree. Any additional premium due will be the responsibility of the retiree to pay.

B. Those retiring at the conclusion of fiscal year 2017 and not enrolled in one of the school

district’s health insurance plans will have their distribution placed into a tax deferred, non-elective 403(b) plan. Payments to this plan will be made on the same quarterly schedule as described in section 7(A). It will be the retiree’s responsibility to pay any administrative costs for their account plus any applicable fees or taxes.

8. Insurance:

A. The school district agrees to include its retirees, until their 65th birthday, under the district's health insurance program and shall at all times attempt to grant its retirees and their dependent less than 65 the same rates as its employees and their dependents.

B. The school district shall modify its coverages and or, its charges based upon

negotiated settlements with its certified bargaining units without regard to its retirees.

C. The retirees shall have the right to drop their coverages at any time. However, once a

retiree opts out of the district's insurance coverage, the retiree has given up their rights to retain coverage under the district insurance program.

9. Beneficiary:

A. At the time of retirement the employee shall name a beneficiary by signing the appropriate paperwork with a disinterested witness attesting to their signature. Any sums due at the time of death shall be considered the property of the beneficiary.

B. The spouse of the deceased retiree may continue under the insurance program until

his/her 65th birthday provided premiums are paid or up to thirty six months whichever comes first. (These are the current regulations that we are subject to.)

10. Taxes:

A. For persons choosing to take their payments via distribution to a designated HRA as per 7-A above the school district shall withhold nothing leaving the retiree with $100.00 per $100.00 dollars as long as such action is allowed for HRA contributions under applicable state/federal law. The school district reserves the right to withhold any applicable state/federal taxes in the event that laws change which impact HRA’s tax status.

B. For persons choosing to take their payment via distribution as per paragraph 7-B

above, MCSD shall withhold all applicable state and federal taxes, in addition to OASDI and Medicare. This may be subject to variation depending on the employee’s tax rate and state/federal law.

C. All other taxes or other withholding is the responsibility of the retiree and the

district assumes no liability for any consequences from the retiree's subsequent action or inaction.

11. Right to waive rules:

A. The district reserves the right to waive these rules based upon extraordinary circumstances including, but not limited to, a severe medical hardship, disability or incapacity to perform.

12. Right of refusal:

A. The district shall under no circumstances be required to make any payment for persons whose separation is involuntary for just cause, typically known as termination for just cause.

13. Annual report and review:

A. The school board shall act upon all submitted requests.

B. The school board shall receive an annual report on the operation of the program. The

report shall include the number of retirees, ages, unit, wages, years of service and savings.

14. Modifications/Cancellation:

A. The Muscatine School Board reserves the right to cancel this program in whole or in part, if it is declared to be illegal, discriminatory or ineligible for funding from its Management fund.

B. The Muscatine School Board reserves the right to modify this program, as required,

without notice to any parties except those directly affected, so long as such modifications are administrative or clerical in nature and such modifications do not materially affect the benefit levels, e.g. [If we are notified by the IRS that we must withhold taxes in a manner different than we present herein, then we shall abide by IRS regulations.]

C. The Muscatine School Board agrees to fully fund an individual's payouts in the year

of retirement and to hold in trust such sums for the retiree's exclusive benefit. So in the event of a cancellation or modification a retiree knows at the date of retirement that said benefits will be paid when due regardless of subsequent action(s) of the board.

TEAM SERVICES TERMS AND CONDITIONS

PAYMENT TERMS _ Payment is due upon receipt of our invoice. If payment is not received within thirty days from the invoice date, Client agrees to pay a finance charge on the principal amount of the past due account of one and one_half percent per month. If one and one_half percent per month exceeds the maximum allowed by law, the charge shall automatically be reduced to the maximum legally allowable. Client agrees to pay all costs associated with collection of overdue invoices, including reasonable attorney’s fees.

In the event Client requests termination of the services prior to completion, a termination charge in an amount not to exceed thirty per cent of all charges incurred through the date services are stopped plus any shutdown costs may, at the discretion of TEAM Services be made. If during the execution of the services, TEAM Services is required to stop operations as a result of changes in the scope of services such as requests by the Client or requirements of third parties, additional charges will be applicable.

INSURANCE _ TEAM Services maintains Workers' Compensation and Employer's liability Insurance in conformance with applicable state law. In addition, we maintain Comprehensive General Liability Insurance and Automobile Liability Insurance with bodily injury limits of $500,000/$500,000 and property damage limits of $500,000. A certificate of insurance can be supplied evidencing such coverage which contains a clause providing that ten days written notice be given prior to cancellation. Cost of the above coverage is included in our quoted fees. If additional coverage or increased limits of liability are required, TEAM Services will endeavor to obtain the requested insurance and charge separately for costs associated with additional coverage or increased limits. TEAM Services shall maintain professional liability insurance in the amount of $1,000,000 (claims made basis).

STANDARD OF CARE _ The only warranty or guarantee made by TEAM Services in connection with the services performed hereunder, is that we will use that degree of care and skill ordinarily exercised under similar conditions by reputable members of our profession practicing in the same or similar locality. No other warranty, expressed or implied, is made or intended by our proposal for consulting services or by our furnishing oral or written reports.

SAMPLING OR TESTING LOCATION _ The fees included in this proposal do not include costs associated with surveying of the site or the accurate horizontal and vertical locations of tests. Field tests or boring locations described in TEAM Services' report or shown on sketches are based on specific information furnished by others or estimates made in the field by our technicians. Such dimensions, depths or elevations should be considered as approximations unless otherwise stated in the report.

RIGHT_OF_ENTRY _ Unless otherwise agreed, Client will furnish right of entry on the property for us to make the planned borings, surveys, tests, and/or explorations. We will take reasonable precautions to minimize damage to the property caused by our operations, but we have not included in our fee the cost of restoration of damage which may result. If Client desires us to restore the property to its former condition, we will accomplish this and add the cost to our fee.

DAMAGE TO EXISTING MANMADE OBJECTS _ It shall be the responsibility of the Client or his duly authorized representative to disclose the presence and accurate location of all hidden or obscure man_made objects relative to field tests or boring locations. TEAM Services' field personnel are trained to recognize clearly identifiable stakes or markings in the field and without special written instructions to initiate field testing drilling and/or sampling within a reasonable distance of each designated location. If TEAM Services is cautioned, advised or given data in writing that reveal the presence or potential presence of underground or overground obstructions, such as utilities, TEAM Services will give special instructions to its field personnel. As evidenced by Client's acceptance of this proposal, Client agrees to indemnify and save harmless from all claims, suits, losses, personal injuries, death and property liability resulting from unusual subsurface conditions or damages to subsurface structures, owned by Client or third parties, occurring in the performance of the proposed services, whose presence and exact locations were not revealed to TEAM Services in writing, and to reimburse TEAM Services for expenses in connection with any such claims or suits, including reasonable attorney's fees.

SAMPLE DISPOSAL AGREEMENT _ Unless otherwise requested, test specimens or samples will be disposed of immediately upon completion of tests and drilling samples or other specimens will be disposed of 60 days after submission of our report. Upon written request, TEAM Services will retain test specimens or drilling samples for a mutually acceptable storage charge and period of time.

OWNERSHIP OF DOCUMENTS _ All documents, including, but not limited to, drawings, specifications. reports, boring logs, field notes, laboratory test data, calculations and estimates, prepared by TEAM Services are instruments of service pursuant to this Agreement, shall be the sole property of TEAM Services. Client agrees that all documents of any nature furnished to Client or Client's agents or designees, if not paid for, will be returned upon demand and will not be used by Client for any purpose whatsoever. Client further agrees that under no circumstances shall any documents produced by, pursuant to this Agreement, be used at any location or for any project not expressly provided for in this Agreement without the written permission of TEAM Services. At the request and expense of Client, TEAM Services will provide Client with copies of documents created in the performance of the work for a period not exceeding five years following submission of the report contemplated by this Agreement.

SAFETY _ Should TEAM Services provide periodic observations or monitoring services at the job site during construction, Client agrees that in accordance with generally accepted construction practices, the contractor will be solely and completely responsible for working conditions on the job site, including safety of all persons and property during the performance of the work and compliance with OSHA regulations, and that these requirements will apply continuously and not be limited to normal working hours. Any monitoring of the contractor's procedures conducted by TEAM Services is not intended to include review of the adequacy of the contractor's safety measures in, on, adjacent to, or near the construction site.

SITE VISITS _ Client agrees that TEAM Services will not be expected to make exhaustive or continuous on-site inspections but that periodic observations appropriate to the construction stage shall be performed. It is further agreed that TEAM Services will not assume responsibility for the contractor's means, methods, techniques, sequences or procedures of construction, and it is understood that field services provided by TEAM Services will not relieve the contractor of his responsibilities for performing the work in accordance with the plans and specifications. The words "supervision," "inspection," or "control" are used to mean periodic observation of the work and the conducting of tests by TEAM Services to verify substantial compliance with the plans, specifications and design concepts. Continuous inspections by our employees does not mean that TEAM Services is observing placement of all materials. Full_time inspections mean that an employee of TEAM Services has been assigned for eight_hour days during regular business hours.

401.15 PERSONNEL RECORDS (moved from 705.3 Personnel Records) All personnel employment records shall be kept and preserved by the secretary of the Board, and shall be housed in the administrative ofices of the school district. The Board secretary shall be the School Board's authorized deputy of the records. The secretary of the Board shall not be required to preserve personnel records permanently, but is authorized, after microilming digitally storing them, to destroy by burning or shredding any records that have been in his/her custody for three years. A properly authenticated reproduction of any microilmed records meets the same legal requirements as the original record. The records will include, but not be limited to, records necessary for the daily administration of the school district, salary records, evaluations, application for employment, references, and other items needed to carry out board policy. Employee personnel iles are school district records and are considered conidential records and therefore are not generally open to public inspection or accessibility. Only in certain limited instances, when the employee has given a signed consent, will employee personnel records be accessible to individuals other than the employee or authorized school oficials. Employees may have access to their personnel iles, with the exception of letters of reference, and copy items from their personnel iles at a time mutually agreed upon between the superintendent and the employee. The school district may charge a reasonable fee for each copy made. Employees, however, will not be allowed access to the employment references written on behalf of the employee. 803 DISPOSAL OF SCHOOL EQUIPMENT School property, such as equipment, furnishings, or supplies will be disposed of when it is no longer of use to the school district. It shall be the objective of the district when disposing of equipment to achieve the best available price or most economical disposal. The Board shall determine the manner in which the equipment shall be disposed. If the equipment to be disposed of has a value of $25,000 or more, a public hearing shall be held regarding the disposal prior to the Board’s final decision. In the case of a sale, advertisements for bids shall be taken. If the bids received are deemed inadequate, the Board may decline to sell and re­advertise. Obsolete equipment having a value of less than $5,000 will be sold or disposed of in a manner determined by the board. Property valued at $5,000 or less will be disposed by auction, on­line sale, or by published sale. Property that has little or no value will be disposed or salvaged. However, the sale of equipment, furnishings or supplies disposed of in this manner will be published in a newspaper of general circulation. The publication of the sale or disposition will be published with at least one insertion each week for two consecutive weeks. Any other disposition may be done in any other manner so with only one insertion in same newspaper. A public hearing will be held regarding the disposal of the equipment with a value of $5,000 or more prior to the board's final decision. The board will adopt a resolution announcing the proposed sale and will publish notice of the time and place of the public hearing and the description of the property will be in the resolution. Notice of the public hearing will be published at least once, but not less than 10 days and not more than 20 days, prior to the hearing date. Upon completion of the public hearing, the board may dispose of the equipment. 805 CRISIS MANAGEMENT AND RESPONSE PLAN The District will develop a Crisis Management and Response Plan in collaboration with local emergency responders (police, ire, etc.). The plan will include the following components: · Prevention · Mitigation · Response · Recovery A district Safety Committee will be established and given the responsibility of reviewing the plan annually. The results of the review will be reported to the Superintendent and the Board of Education with recommendations for revision and improvement. Copies of the plan will be kept in each building. Students are informed of this system according to board policy. Each classroom and ofice will have a plan for helping those in need of assistance to safety during an emergency. This will include, but not be limited to, students and employees with disabilities. Licensed employees are responsible for instructing students on the proper techniques to be followed during an emergency. It is the responsibility of the superintendent to develop administrative regulations regarding this policy. The plan will be included in the district’s Comprehensive School Improvement Plan (CSIP) and will serve as a guideline or crisis prevention, management, intervention and recovery. 806.3 EDUCATIONAL SPECIFICATIONS FOR BUILDINGS & SITES ‐ NEW Buildings and sites considered for purchase or construction by the board or currently owned by the school district and used for the education program must meet, or upon improvement be able to meet, the speciications set by the board. The board will make this determination. Prior to remodeling or other construction of buildings and sites, the board may appoint a committee of consultants, employees, citizens, or others to assist the board in developing the speciications for the new or improved buildings and sites. These speciications will be consistent with the education program, and they will provide the architect with the information necessary to determine what is expected from the facility. It is within the discretion of the board to determine whether a committee is appointed. The education speciications will include, but not be limited to, the inancial resources available for the project, the deinition and character of classrooms, the functional use to be made of the rooms, description of specialized needs, and other pertinent information as the board deems necessary. It is the responsibility of the superintendent to make a recommendation to the board regarding the speciications of buildings and sites. It is the responsibility of the superintendent to develop energy conservation guidelines for employees and students. Employees and students will abide by these guidelines. 808 LEASE, SALE OR DISPOSAL OF SCHOOL DISTRICT BUILDINGS & SITES ‐ NEW Decisions regarding the lease, sale, or disposal of school district real property are made by the board. In making its decision the board will consider the needs of the education program and the eficient use of public funds. Prior to the board's inal decision regarding real property, a public hearing will be held. The board will adopt a resolution announcing the proposed sale which will contain notice of the time and place of the public hearing and the description of the property or locally known address. Notice of the time and place of the public hearing will be published at least once, but not less than 10 days and not more than 20 days, prior to the hearing date. Upon completion of the public hearing, the board may dispose of the property. If the real property contains less than two acres, is located outside of a city, is not adjacent to a city and was previously used as a schoolhouse site, the property may revert to the owner of the tract from whom the property was taken following the procedures set forth in Iowa Code §§ 297.15‐.25.[LJ1] In the case of a sale or lease of school district real property not being used for the education program, unless otherwise exempted, advertisements for bids will be taken. If the bids received by the board are deemed inadequate, the board may decline to sell or lease the property and re‐advertise. In the case of the razing of a school district facility, in an amount in excess of the statutory minimum required by law, the board will advertise and take bids for the purpose of awarding the contract for the project. The superintendent is responsible for coordinating the action necessary for the board to accomplish the lease, sale, or disposal of school district real property, including student‐constructed buildings. 900.2 RELEASES TO NEWS MEDIA ‐‐ INTERNAL UNIT NEWS It shall be the policy of the Board to have news releases prepared on internal matters of the schools and to disseminate such releases to all news media in the area. The superintendent or designee shall be responsible for clearance of all news releases originating from a school source. Information not of a personal or conidential nature should be made available to all news media upon request to the superintendent or designee. [LJ1] In order to establish and maintain a cooperative effort in our public relations program, open communications should be maintained with personnel representing the various news medias. All news media personnel must be cleared through the superintendent’s ofice prior to entering the buildings. The superintendent should be notiied prior to the presence of news media personnel in the building. (from 403.9) The superintendent will determine when a news release about internal school district and board matters will be issued. In making this determination, the superintendent will strive to keep the media and the school district community accurately and objectively informed. Further, the superintendent will strive to create and maintain a positive image for the school district. It is the responsibility of the superintendent to approve news releases originating within the school district prior to their release. MUSCATINE COMMUNITY SCHOOL DISTRICT BOARD POLICY

900.5 VISITATION BY STUDENTS, ADULTS, GROUPS, OR AGENCIES TO THE MUSCATINE COMMUNITY SCHOOLS Parents, guardians, and other members of the school community are encouraged to visit schools for observations and conferences regarding their children. No student or adult will be permitted access to the Muscatine Community School District classroom buildings while school is in session unless the building principal grants permission. Persons who wish to visit a classroom while school is in session are asked to notify the principal and obtain approval from the principal prior to the visit so appropriate arrangements can be made and so class disruption can be minimized. Teachers and other employees will not take time from their duties to discuss matters with visitors. The reason for the visit should be in keeping with the role of the school as an educational institution. Groups, agencies, or individuals, other than parents, will not be permitted access to the schools while school is in session unless they qualify in one or more of the following ways:

1. The visit constitutes educational business with the Muscatine School System. 2. The visit is required by law. 3. The visit involves the representation of post secondary career agencies. The visitation of

post secondary career agencies will be limited to not more than one visit per month per agency.

Admission to school buildings by groups, agencies, or individuals meeting the above criteria will be allowed after approval by the building principal at his or her discretion. LEG REF: Iowa Code §§ 279.8; 716.

News conferences and interviews planned or pre‐arranged for school district activities will include the board and the superintendent. News conferences for issues requiring an immediate response may be held by the superintendent. 900.11 LIVE BROADCAST OR VIDEOTAPING ‐ NEW Individuals may broadcast or record public school district events, including open board meetings, as long as it does not interfere with, or disrupt, the school district event and it does not create an undue burden in adapting the buildings and sites to accommodate the request. It is within the discretion of the superintendent to determine whether the request is unduly burdensome and whether the broadcast or recording will interfere with or disrupt the school district event. Recording of classroom activities will be allowed at the discretion of the superintendent. Parents will be notiied prior to recording of classroom activities. It is the responsibility of the superintendent to develop administrative regulations outlining the procedures for making the request and the rules for operation if the request is granted. 505.3 COMMUNICABLE DISEASES [LJ1] Students with a communicable disease will be allowed to attend school provided their presence does not create a substantial risk of illness or transmission to other students or employees. The term “communicable disease” shall mean an infectious or contagious disease spread from person to person, or animal to person, or as defined by law. Prevention and control of communicable diseases shall be included in the school district’s bloodborne pathogens exposure control plan. The procedures shall include scope and application, definitions, exposure control, methods of compliance, universal precautions, vaccination, post­exposure evaluation, follow­up, communication of hazards to employees and record keeping. This plan shall be reviewed annually by the superintendent and school nurse. The health risk to immunodepressed students shall be determined by their personal physician. The health risk to others in the school district environment from the presence of a student with a communicable disease shall be determined on a case­by­case basis by the student’s personal physician, a physician chosen by the school district or public health officials. A student shall notify the superintendent or the school nurse when the student learns the student has a communicable disease. It shall be the responsibility of the superintendent, when the superintendent or school nurse, upon investigation, has knowledge that a reportable communicable disease is present, to notify the Iowa Department of Public Health. Health data of a student is confidential and it shall not be disclosed to third parties. It shall be the responsibility of the superintendent, in conjunction with the school nurse, to develop administrative regulations stating the procedures for dealing with students with a communicable disease. 506.4 GRADUATION HONORS Students graduating with a grade point average of 3.0 or better shall be recognized at commencement. Only units of credit earned at a public school or accredited private school will be used to determine grade point average. For a student to be included in class rank and to be eligible for special honors for accumulative grade point average, the student must have received letter grades and full credits in all required (non‐elective) courses necessary to receive a Muscatine High School diploma. Homework is defined to be the extra-class activities and assignments that may properly be considered as extensions and enrichment of the regular classroom instructional program.

The purpose of carefully assigned homework should be:

1. practicing research and exploratory activities 2. sharing and discussing ideas 3. reviewing and summarizing materials studied 4. becoming acquainted with references and resource materials 5. organizing students' thoughts and thinking processes in
