In pursuance of the powers conferred upon it by the Local Government Act 1995 and under all other powers enabling it, the Council of the Shire of Esperance resolved on 28th July 2015 to make the following local law.
1.1 Citation
This local law may be cited as the Shire of Esperance Repeal Local Law 2015.
1.2 Commencement
This local law comes into operation 14 days after the date of its publication in the Government Gazette.
1.3 Repeal
The following local laws are repealed—
(a) Shire of Esperance Pest Plants By-Laws 1979, published in the Government Gazette on 18th July 1980 and as amended and published in the Government Gazette on 22nd December 1998; and
(b) Shire of Esperance Local Laws Relating to Signs 2004, published in the Government Gazette on 13th January 2004.

The FES Commissioner is the prescribed hazard management agency for emergency management for the whole of the State for the hazard of fire.
I, Lloyd Bailey, Deputy Commissioner of the Department of Fire and Emergency Services do hereby declare an emergency situation in respect of the Murray Road Incident.
The area of the State to which the emergency situation declaration applies is—

This emergency situation declaration has effect from 2100hrs 7th January 2016 and remains in force until—
(a) expiry; or
(b) it is revoked under section 53 of the Emergency Management Act 2005; or
(c) the expiry of any extension of the emergency situation declaration made by the State Emergency Coordinator under section 52 of the Emergency Management Act 2005.
This emergency situation declaration is made under section 50 of the Emergency Management Act 2005.

This instrument is the Mackerel Managed Fishery Management Plan Amendment 2016.
2. Management Plan amended
The amendments in this instrument are to the Mackerel Managed Fishery Management Plan 2011.
3. Clauses 7A and 7B inserted
After clause 7 insert—
7A. Additional criteria for the grant of a licence
Further to clause 7, the CEO may grant a person a licence where—
(a) on 30 December 2014 the person held Mackerel Managed Fishery Licence MACL2897; and
(b) the person establishes to the satisfaction of the CEO that an application for the renewal of the licence referred to in paragraph (a) was not made due to the inadvertence of the holder; and
(c) the person applies for a licence before 31 March 2016.
7B. Fee for an application made under clause 7A
Where a person makes an application for a licence under clause 7A, a fee of $2,000 is payable in respect of the costs of administering the Act.
4. Clause 12 amended
In clause 12(a)(i) delete “ 205,000 ” and insert—

5. Clause 24 amended
In paragraph 24 (1)(b) delete “ 7(2) ” and insert—

Acting pursuant to the powers conferred by Regulation 38B of the Rottnest Island Regulations 1988, the Rottnest Island Authority hereby closes the following waters to all vessels, excluding bona fide emergency and authorised vessels, between 0:01am on Monday 25 January 2016 to 8.00am Tuesday 26 January 2016.
Thomson Bay
All the waters within 25 metres of the shoreline from the Fuel Jetty to 66 metres south of the Hotel Jetty. Together with waters encompassing the Hotel Jetty from a point 44 metres north of the hotel and 25 metres from the shoreline to the northern most tip of the Hotel Jetty; along the eastern face of the jetty then to a point in the water 25 metres from the shore line in the water 66 metres south of the Hotel Jetty

Tenders (max vessel length 3.75m) are permitted to access the beach starting from the Fuel Jetty to a point 140 metres south towards the Hotel Jetty.
Due to the large number of persons attending this special event the closure has been introduced to assist in the management of people and vessels to ensure public safety. Appropriate signage will be placed on site.
Mariners are advised to navigate with caution and maintain a safe clearance when transiting this area.
