    1. Washington State has a total of 103 delegates and 7 alternates. (Call I & Call Appendix 6 B) 7

    8 2. The delegate selection process is governed by the Charter and Bylaws of the Democratic 9

    Party of the United States, the Delegate Selection Rules for the 2016 Democratic National 10 Convention (Rules), the Call for the 2016 Democratic National Convention (Call), the 11 Regulations of the Rules and Bylaws Committee for the 2016 Democratic National Convention 12 (Reg.), the rules of the Democratic Party of Washington State, the Washington State 13 election code, and this Delegate Selection Plan. (Call II.A.) 14

    15 3. Following the adoption of this Delegate Selection Plan by the State Party Committee, 16

    it shall be submitted for review and approval by the DNC Rules and Bylaws 17 Committee (RBC). The State Democratic Chair shall be empowered to make any 18 technical revisions to this document as required by the RBC to correct any omissions 19 and/or deficiencies as found by the RBC to ensure its full compliance with Party 20 Rules. Such corrections shall be made by the State Democratic Chair and the Plan 21 resubmitted to the RBC within 30 days of receipt of notice of the RBCs findings. (Reg. 22 2.5, Reg. 2.6 & Reg. 2.7) 23

    24 4. Once this Plan has been found in Compliance by the RBC, any amendment to the Plan 25

    by the State Party will be submitted to and approved by the RBC before it becomes 26 effective. (Reg. 2.9) 27

    28 B. Description of Delegate Selection Process 29 30

    1. Washington State will use a proportional representation system based on the results 31 of caucuses for apportioning delegates to the 2016 Democratic National Convention. 32

    33 2. The first determining step of Washington States delegate selection process will 34

    occur with precinct caucuses on Saturday, March 26, 2016 commencing at 10:00 a.m. 35 36

    3. Voter Participation in Process 37 38

    a. Participation in Washington States delegate selection process is open to all 39 voters who wish to participate as Democrats. Those who wish to participate in 40 the caucus and convention process who are not currently registered to vote may 41 register to vote at the caucus or convention and then participate on the same day. 42 This includes any 17 year old who will be eligible to vote on November 8, 2016. 43 44

    b. Washington States voter registration or enrollment procedures, including the 1 party caucus, deadline to register to vote for purposes of determining 2 participation are in compliance with DNC rules. Voters participating in the 3 delegate selection process at the precinct caucuses will publicly declare their 4 Democratic Party preference and have that preference publicly recorded through 5 the use of caucus registration forms that will clearly state at the top of the page I 6 am a registered voter in the precinct named above. I consider myself to be a 7 Democrat and I agree that my attendance at this caucus is a matter of public 8 record. (Rule 2.A & Reg. 4.3) 9

    10 c. In order to assess and improve participation with respect to presidential 11

    preference and delegate selection contests and procedures, an attendee may 12 submit a surrogate form if religious observance, military service, disability, 13 illness or work schedule prevents an attendee from participating in person at the 14 precinct caucus. Official Surrogate Affidavit forms for religious observance, 15 military service, disability, illness or work schedule may be downloaded from 16 the State Party website or acquired from the State Party office. (Rule 2.I) 17

    18 d. At no stage of Washington States delegate selection process shall any person be 19

    required, directly or indirectly, to pay a cost or fee as a condition for 20 participating. Voluntary contributions to the Party may be made, but under no 21 circumstances shall a contribution be mandatory for participation. Optional 22 contributions may be requested, but will in no way be required. (Rule 2.D & Reg. 23 4.4) 24

    25 e. No persons shall participate or vote in the nominating process for the Democratic 26

    presidential candidate who also participates in the nominating process of any 27 other party for the corresponding elections. (Rule 2.E) 28

    29 f. No person shall vote in more than one meeting that is the first meeting in the 30

    delegate selection process. (Rule 3.E & Reg. 4.6) 31 32

    g. Proxy voting shall not be allowed in the delegate selection process. 33 34

    4. Scheduling of Delegate Selection Meetings 35 The dates, times and places for all official Party meetings and events related to the 36 states delegate selection process have been scheduled to encourage the participation 37

    of all Democrats. Such meetings will begin and end at reasonable hours. The State 38 Party has selected the dates and times of all official meetings and events, and will 39 ensure that proper facilities are selected. Meetings have been scheduled with 40 consideration for religious observations that could significantly affect participation. 41 (Rule 3.A & Reg. 4.5) 42

    3 A. Ballot Access 4

    There are no filing requirements for Presidential Candidates to participate in the caucuses. (Rule 5 1.A.7 & Rule 1.A.8) 6

    7 B. Other Requirements 8 1. Each presidential candidate shall certify in writing to the State Democratic Chair, the 9

    name(s) of his or her authorized representative(s) by Friday, February 26, 2016. (Rule 10 12.D.1) 11

    12 2. Each presidential candidate (including uncommitted status) shall use his or her best efforts 13

    to ensure that his or her respective delegation within the state delegation achieves the 14 affirmative action and inclusion goals established by this Plan and is equally divided 15 between men and women. (Rule 6.I & Rule 7) 16

    3 A. Congressional District-Level Delegates 4 5

    1. Washington State is allocated 56 congressional district-level delegates. (Rule 8.C, Call 6 I.B, Call I.I, Call Appendix B & Reg. 4.31) 7

    8 2. Congressional district-level delegates shall be elected by the following Caucus System: 9

    10 a. The first tier precinct caucuses will be held on Saturday, March 26, 2016 11

    commencing at 10:00 a.m. Delegates are elected to the legislative district caucuses 12 and county conventions. The size of each legislative district delegation is 13 determined by a formula giving equal weight to the number of active registered 14 voters in each legislative district and an average of the Democratic presidential 15 and gubernatorial vote in the 2012 general election. Resolutions and platform 16 issues are forwarded for consideration at the appropriate legislative district 17 caucus or county convention. 18

    19 b. The second tier legislative district caucuses are on Sunday, April 17, 2016 20

    commencing at 1:00 p.m. Delegates to the congressional district caucuses are 21 elected. 22

    23 c. County conventions will be held on Sunday, May 1, 2016 commencing at 1:00 24

    p.m. County platforms are adopted and resolutions are passed on issues of 25 concern to the body. 26

    27 d. The third tier congressional district caucuses are held on Saturday, May 21, 2016 28

    commencing at a time and site designated by the State Democratic Chair 56 29 congressional district-level delegates are elected at this level based upon the will 30 of those delegates properly credentialed and registered at the meeting. 31

    32 3. Apportionment of Congressional District-Level Delegates 33

    34 a. Washington States congressional district-level delegates are apportioned among 35

    the congressional districts based on a formula giving equal weight to the vote for 36 the Democratic candidates in the 2012 presidential and gubernatorial elections. 37 (Rule 8.A; Reg. 4.10, Reg. 4.11 & Call Appendix A) 38

    39 (1) Given that: 40

    41 (a) Washington State does not permit voters to register or enroll in a 42

    specific party. 43 44

    (b) Washington State has used this formula for apportioning congressional 1 district-level delegates since at least 2004. 2

    3 b. The states total number of congressional district-level delegates will be equally 4

    divided between men and women. The overall variance between men and 5 women cannot exceed one. (Rule 6.C.1 & Reg. 4.8) 6

    7 c. The congressional district-level delegates are apportioned to districts as indicated 8

    11 4. Congressional District-Level Delegate Filing Requirements 12

    13 a. A congressional district-level delegate candidate may run for election only 14

    within the district in which he or she is registered to vote. (Rule 12.H) 15 16

    b. An individual can qualify as a candidate for congressional district-level delegate 17 to the 2016 Democratic National Convention by filing a statement of candidacy 18 designating his or her singular presidential (or uncommitted) preference and a 19 signed pledge of support for the presidential candidate (including uncommitted 20 status) with the State Party no sooner than Monday, March 14, 2016 and no later 21 than Friday, May 6, 2016 at 5:00 p.m. A delegate or alternate candidate may 22 modify his or her singular presidential preference by submitting an updated 23 pledge of support no later than the filing deadline. (Rule 12.B, Rule 14.F, & Reg. 24 4.21) 25

    5. Presidential Candidate Right of Review for Congressional District-Level Delegates 1 2

    a. The State Democratic Chair shall convey to the presidential candidate, or that 3 candidates authorized representative(s), not later than Friday, May 13, 2016 at 4 12:00 p.m. a list of all persons who have filed for delegate pledged to that 5 presidential candidate. (Rule 12.D & Rule 12.F) 6

    7 b. Each presidential candidate, or that candidates authorized representative(s), 8

    must then file with the State Democratic Chair by Thursday, May 19, 2016 at 5:00 9 p.m. a list of all such candidates he or she has approved, provided that approval 10 be given to at least three (3) times the number of candidates for delegate men and 11 three (3) times the number of candidates for delegate women to be selected. (Rule 12 12.E.1, Reg. 4.24) 13

    14 c. Failure to respond will be deemed approval of all delegate candidates submitted 15

    to the presidential candidate unless the presidential candidate, or the authorized 16 representative(s), signifies otherwise in writing to the State Democratic Chair not 17 later than Thursday, May 19, 2016 at 5:00 p.m. 18

    19 d. National convention delegate candidates removed from the list of bona fide 20

    supporters by a presidential candidate, or that candidates authorized 21 representative(s), may not be elected as a delegate at that level pledged to that 22 presidential candidate (including uncommitted status). (Rule 12.E & Reg. 4.23) 23

    24 e. The State Democratic Chair shall certify in writing to the Co-Chairs of the DNC 25

    Rules and Bylaws Committee whether each presidential candidate (including 26 uncommitted status) has used their best efforts to ensure that their respective 27 congressional district-level delegate candidates meet the affirmative action and 28 inclusion considerations and goals detailed in the Affirmative Action section of 29 this Plan within three (3) business days of returning the list of approved 30 congressional district-level delegate candidates as indicated in section III.A.5.b of 31 this Plan. 32

    33 6. Fair Reflection of Presidential Preference 34 35

    a. Caucus/Convention Proportional Representation Plan (Rule 13.A, Rule 13.B & 36 Rule 13.D) 37 Washington State is a caucus/convention state. Accordingly, delegate positions 38 shall be allocated so as to fairly reflect the expressed presidential preference or 39 uncommitted status of the caucus participants in each district. Therefore, the 40 National Convention delegates elected at the congressional district-level shall be 41 allocated in proportion to the percentage of the caucus vote won in that district 42 by each preference, except that preferences falling below a 15% threshold shall 43 not be awarded any delegates or alternates. (Rule 13.B) 44

    b. Within a district, if no presidential preference reaches a 15% threshold, the 1 threshold shall be the percentage of the vote received in that district by the front-2 runner minus 10%. (Rule 13.F) 3

    4 7. Equal Division of Congressional District-Level Delegates 5

    6 a. In order to ensure the congressional district-level delegates are equally divided 7

    between men and women, delegate positions within each district will be 8 designated by presidential preference beginning with the highest vote-getting 9 presidential preference. This assignment of delegate positions, alternating by sex 10 as mathematically practicable, will continue with the next highest vote-getting 11 preferences in descending order until the gender of each position has been 12 assigned. (Rule 6.C.1 & Reg. 4.8) 13

    14 b. The delegate positions shall be pre-designated so that the gender of the first 15

    position to be filled by the winning presidential candidate is pre-determined. 16 Once the allocation of district delegates among presidential preference(s) has 17 been calculated, the remaining delegate positions can be assigned to the 18 presidential preference(s), in order of vote won, alternating by gender beginning 19 with female delegates. 20

    21 8. The State Democratic Chair shall certify in writing to the Secretary of the Democratic 22

    National Committee (DNC) the election of the states congressional district-level 23 delegates and alternates to the Democratic National Convention within ten (10) days 24 after their election. (Rule 8.C & Call IV.A) 25

    26 B. UNPLEDGED DELEGATES 27 28

    1. Unpledged Party Leaders and Elected Officials 29 30

    a. The following categories (if applicable) shall constitute the Unpledged Party 31 Leaders and Elected Official delegate positions: 32

    33 (1) Members of the Democratic National Committee who legally reside in the 34

    state; (Rule 9.A.1, Call I.F, Call I.J, & Reg. 4.13) 35 36

    (2) Democratic President and Democratic Vice President (if applicable); (Rule 37 9.A.2 & Call I.G) 38

    39 (3) All of Washington States Democratic Members of the U.S. House of 40

    Representatives and the U.S. Senate; (Rule 9.A.3, Call I.H & Call I.J) 41 42

    (4) The Democratic Governor (if applicable); (Rule 9.A.4, Call I.H & Call I.J) 43 44

    (5) Distinguished Party Leader delegates who legally reside in the state (if 1 applicable). (Rule 9.A.5, Call I.G, & Reg. 4.13) 2

    3 b. The certification process for the Unpledged Party Leader and Elected Official 4

    delegates is as follows: 5 6

    (1) Not later than March 1, 2016, the Secretary of the Democratic National 7 Committee shall officially confirm to the State Democratic Chair the names 8 of the unpledged delegates who legally reside in Washington State. (Rule 9 9.A) 10

    11 (2) Official confirmation by the Secretary shall constitute verification of the 12

    unpledged delegates from the categories indicated above. (Call IV.B.1) 13 14

    (3) The State Democratic Chair shall certify in writing to the Secretary of the 15 DNC the presidential preference of states unpledged delegates 10 days 16

    after the completion of the States Delegate Selection Process. (Call IV.C) 17 18

    2. For purposes of achieving equal division between delegate men and delegate women 19 within the states entire convention delegation, the entire delegation includes all 20

    pledged and unpledged delegates. (Rule 6.C) 21 22 C. PLEDGED PARTY LEADER AND ELECTED OFFICIAL (PLEO) DELEGATES 23 24

    1. Washington State is allotted 11 pledged Party Leader and Elected Official (PLEO) 25 delegates. (Call I.D., Call I.E. & Call Appendix B) 26

    27 2. Pledged PLEO Delegate Filing Requirements 28

    29 a. Individuals shall be eligible for the pledged Party Leader and Elected Official 30

    delegate positions according to the following priority: big city mayors and state-31 wide elected officials (to be given equal consideration); state legislative leaders, 32 state legislators, and other state, county and local elected officials and party 33 leaders. (Rule 9.B.1 & Reg. 4.15) 34

    35 b. An individual can qualify as a candidate for a position as a pledged PLEO 36

    delegate by filing a statement of candidacy and pledge of presidential preference 37 or uncommitted with the State Democratic Chair no sooner than Monday, March 38 14, 2016, and not later than Friday, June 10, 2016 at 5:00 p.m. (Rule 9.B.3, Rule 39 14.G, Reg. 4.16. & Reg. 4.21) 40

    3. Presidential Candidate Right of Review 1 2

    a. The State Democratic Chair shall convey to the presidential candidate, or that 3 candidates authorized representative(s), not later than Wednesday, June 15, 2016 4 at 5:00 p.m., a list of all persons who have filed for a party and elected official 5 delegate pledged to that presidential candidate. (Rule 9.B.3 & Rule 12.D) 6

    7 b. Each presidential candidate, or that candidates authorized representative(s), 8

    must file with the State Democratic Chair, by Thursday, June 16, 2016 at 5:00 p.m. 9 a list of all such candidates he or she has approved, as long as approval is given 10 to at least two (2) names for every position to which the presidential candidate is 11 entitled. (Rule 12.E.2 & Reg. 4.24) 12

    13 c. Failure to respond will be deemed approval of all delegate candidates submitted 14

    to the presidential candidate unless the presidential candidate or the authorized 15 representative(s) signifies otherwise in writing to the State Democratic Chair not 16 later than Friday, June 17, 2016 at 5:00 p.m. 17

    18 d. The State Democratic Chair shall certify in writing to the Co-Chairs of the DNC 19

    Rules and Bylaws Committee whether each presidential candidate (including 20 uncommitted status) has used their best efforts to ensure that their respective 21 pledged PLEO delegate candidates meet the affirmative action and inclusion 22 considerations and goals detailed in the Affirmative Action section of this Plan 23 within three (3) business days of returning the list of approved pledged PLEO 24 candidates as indicated in section III.C.3.b of this Plan. 25 26

    4. Selection of Pledged Party Leader and Elected Official Delegates 27 28

    a. The pledged PLEO slots shall be allocated among presidential preferences on the 29 same basis as the at-large delegates. (Rule 9.B.2, Rule 10.C, Rule 13.E & Rule 13.F) 30

    31 b. Selection of the pledged PLEO delegates will occur on Sunday, June 19, 2016 at 32

    9:00 a.m. at a site designated by the State Democratic Chair, which is after the 33 election of congressional district-level delegates and prior to the selection of at-34 large delegates and alternates. (Rule 9.B) 35

    36 c. These delegates will be selected by the members of the State Party Committee 37

    representing Legislative Districts: (Rule 9.C) 38 39

    (1) Given that: 40 41

    (a) Members of the State Party Committee representing Legislative 42 Districts are apportioned in a way that each pair of such members 43 represents a district of equal population. (Rule 9.C.1 & Reg. 4.17.A) 44

    (b) Members of the State Party Committee have been elected through 1 open processes by elected and appointed Democratic precinct 2 committee officers no earlier than December 1, 2014, in conformity 3 with the basic procedural guarantees utilized for delegate selection. 4 (Rule 9.C.2 & Reg. 4.17.B) 5

    6 (c) Such delegates are elected at a public meeting subsequent to the 7

    election of congressional district-level delegates. (Rule 9.C.3) 8 9

    (d) Members of the State Party Committee shall have been elected no 10 earlier than December 1, 2014, which is subsequent to the calendar 11 year of the previous national convention. (Rule 9.C.4) 12

    13 (e) Membership of the State Party Committee is equally divided between 14

    men and women, complying with the equal division requirements of 15 Article 9, Section 16 of the Charter of the Democratic Party of the 16 United States. (Rule 9.C.5 & Reg. 4.17.C) 17

    18 (2) Alternates are not selected at the pledged Party Leader and Elected Official 19

    level. These alternates are combined with the at-large alternates and 20 selected as one unit. (Reg. 4.31) 21

    22 5. The State Democratic Chair shall certify in writing to the Secretary of the Democratic 23

    National Committee the election of the states pledged Party Leader and Elected 24 Official delegates to the Democratic National Convention within ten (10) days after 25 their election. (Rule 8.D & Call IV.A) 26 27

    D. At-Large Delegates and Alternates 28 29

    1. The state of Washington State is allotted 19 at-large delegates and 7 at-large alternates. 30 (Rule 8.C., Call I.B., Call II, Call Appendix B & Reg. 4.31) 31

    32 2. At-Large Delegate and Alternate Filing Requirements 33

    34 a. Persons desiring to seek at-large delegate or alternate positions may file a 35

    statement of candidacy designating their singular presidential or uncommitted 36 preference and a signed pledge of support for the presidential candidates 37 (including uncommitted status) with the State Party no sooner than Monday, 38 March 14, 2016, and not later than Friday, June 10, 2016 at 5:00 p.m. A delegate or 39 alternate candidate may modify his or her singular presidential preference by 40 submitting an updated pledge of support no later than the filing deadline. (Rule 41 12.B, Rule 14.G, Reg. 4.22, Reg. 4.28 & Reg. 4.31.) 42

    b. PLEO candidates not selected as PLEO delegates will automatically be 1 considered candidates for the at-large positions if they choose to run subject to 2 approval by the presidential campaigns. 3

    4 c. The statement of candidacy for at-large delegates and for at-large alternates will 5

    be the same. After the at-large delegates are elected by the members of the State 6 Party Committee representing Legislative Districts those persons not chosen will 7 then be considered candidates for at-large alternate positions unless they specify 8 otherwise when filing. (Rule 18.A) 9

    10 3. Presidential Candidate Right of Review 11

    12 a. The State Democratic Chair shall convey to the presidential candidate, or that 13

    candidates authorized representative(s), not later than Wednesday, June 15, 2016 14 at 5:00 p.m. a list of all persons who have filed for delegate or alternate pledged 15 to that presidential candidate at that time. (Rule 12.D, Reg. 4.23 & Reg. 4.28) 16

    17 b. The State Democratic Chair shall convey to the presidential candidate, or that 18

    candidates authorized representative(s), not later than one (1) hour before the at-19 large delegates are selected a list of all PLEO candidate not selected as PLEO 20 delegates who have chosen to be automatically considered candidates for the at-21 large positions. 22

    23 c. Each presidential candidate, or that candidates authorized representative(s), 24

    must then file with the State Democratic Chair, not later than thirty (30) minutes 25 before the at-large delegates are selected a list of all such candidates he or she has 26 approved, provided that, at a minimum, two (2) names remain for every national 27 convention delegate or alternate position to which the presidential candidate is 28 entitled. (Rule 12.D.4, Rule 12.E.2 & Reg. 4.24.) 29

    30 d. Failure to respond will be deemed approval of all delegate candidates submitted 31

    to the presidential candidate unless the presidential candidate or the authorized 32 representative(s) signifies otherwise in writing to the State Democratic Chair not 33 later than thirty (30) minutes before the at-large delegates are selected. 34

    35 e. The State Democratic Chair shall certify in writing to the Co-Chairs of the DNC 36

    Rules and Bylaws Committee whether each presidential candidate (including 37 uncommitted status) has used their best efforts to ensure that their respective at-38 large delegate candidates and at-large alternate candidates meet the affirmative 39 action and inclusion considerations and goals detailed in the Affirmative Action 40 section of this Plan within three (3) business days of returning the list of 41 approved at-large delegate candidates and at-large alternate candidates as 42 indicated in section III.D.3.b of this Plan. 43

    4. Fair Reflection of Presidential Preference 1 2

    a. At-large delegate and alternate positions shall be allocated among presidential 3 preferences according to the division of preferences among congressional 4 district-level delegates at the time of congressional district-level selection. (Rule 5 10.C) 6 7

    b. Preferences that have not attained a 15% threshold on a state-wide basis shall not 8 be entitled to any at-large delegates. (Rule 13.E) 9

    10 c. If no presidential preference reaches a 15% threshold, the threshold shall be the 11

    percentage of the statewide vote received by the front-runner, minus 10%. (Rule 12 13.F) 13 14

    d. If a presidential candidate is no longer a candidate at the time of selection of the 15 at-large delegates, then those at-large slots that would have been allocated to the 16 candidate will be proportionally divided among the remaining preferences 17 entitled to an allocation. (Rule 10.C) 18

    19 e. If a given presidential preference is entitled to one or more delegate positions but 20

    would not otherwise be entitled to an alternate position, that preference shall be 21 allotted one at-large alternate position. (Rule 18.B, Call I.I. & Reg. 4.30) 22

    23 5. Selection of At-Large Delegates and Alternates 24

    25 a. The selection of the at-large delegates and alternates will occur on Sunday, June 26

    19, 2016 one hour after the election of PLEO delegates has been completed, but 27 no earlier than 10:00 a.m., at a site determined by the State Democratic Chair, 28 which is after all pledged Party Leader and Elected Official delegates have been 29 selected. (Rule 8.D & Call III) 30

    31 b. These delegates and alternates will be selected by the members of the State Party 32

    Committee representing Legislative Districts: (Rule 10.B & Rule 8.E) 33 34

    (1) Given that: 35 36

    (a) Members of the State Party Committee representing Legislative 37 Districts are apportioned in a way that each pair of such members 38 represents a district of equal population. (Rule 9.C.1 & Reg. 4.17.A) 39

    40 (b) Members of the State Party Committee have been elected through 41

    open processes by elected and appointed Democratic precinct 42 committee officers no earlier than December 1, 2014, in conformity 43 with the basic procedural guarantees utilized for delegate selection. 44 (Rule 9.C.2 & Reg. 4.17.B) 45

    (c) Such delegates are elected at a public meeting subsequent to the 1 election of congressional district-level delegates. (Rule 9.C.3) 2

    3 (d) Members of the State Party Committee shall have been elected no 4

    earlier than December 1, 2014, which is subsequent to the calendar 5 year of the previous national convention. (Rule 9.C.4) 6

    7 (e) Membership of the State Party Committee is equally divided between 8

    men and women, complying with the equal division requirements of 9 Article 9, Section 16 of the Charter of the Democratic Party of the 10 United States. (Rule 9.C.5 & Reg. 4.17.C) 11

    12 c. Priority of Consideration 13

    14 (1) In the selection of the at-large delegation priority of consideration shall be 15

    given to African Americans, Hispanics, Enrolled Native Americans, Asian 16 Americans and Pacific Islanders and women. (Rule 6.A) 17

    18 (2) In order to continue the Democratic Partys ongoing efforts to include 19

    groups historically under-represented in the Democratic Partys affairs and 20 to assist in the achievement of full participation by these groups, priority of 21 consideration shall be given other groups by virtue of race/ethnicity, age, 22 sexual orientation, gender identity or disability. (Rules 5.C, Rule 6.A.3 & 23 Reg. 4.7) 24

    25 (3) The election of at-large delegates and alternates shall be used, if necessary, 26

    to achieve the equal division of positions between men and women, and 27 may be used to achieve the representation goals established in the 28 Affirmative Action section of this Plan. (Rule 6.A & Rule 6.C) 29

    30 (4) Delegates and alternates are to be considered separate groups for this 31

    purpose. (Rule 6.A. 3, Rule 10.A, Reg. 4.8 & Reg. 4.19) 32 33

    6. The State Democratic Chair shall certify in writing to the Secretary of the Democratic 34 National Committee the election of the states at-large delegates and alternates to the 35 Democratic National Convention within ten (10) days after their election. (Rule 8.C & 36 Call IV.A) 37

    E. Replacement of Delegates and Alternates 1 2

    1. A pledged delegate or alternate may be replaced according to the following 3 guidelines: 4

    5 a. Permanent Replacement of a Delegate: (Rule 18.D.3) 6

    7 (1) A permanent replacement occurs when a delegate resigns or dies prior to or 8

    during the national convention and the alternate replaces the delegate for 9 the remainder of the National Convention. 10 11

    (2) Any alternate permanently replacing a delegate shall be of the same 12 presidential preference (including uncommitted status) and sex of the 13 delegate he/she replaces, and to the extent possible shall be from the same 14 political subdivision within the state as the delegate. 15

    16 (a) In the case where the presidential candidate has only one (1) alternate, 17

    that alternate shall become the certified delegate. 18 19

    (b) If a presidential candidate has only one (1) alternate, and that alternate 20 permanently replaces a delegate of the opposite sex, thereby causing 21 the delegation to no longer be equally divided, the delegation shall not 22 be considered in violation of Rule 6.C. In such a case, notwithstanding 23 Rule 18.D.2, the State Party Committee shall, at the time of a 24 subsequent permanent replacement, replace a delegate with a person 25 of the opposite sex, in order to return the delegation to equal division 26 of men and women. (Reg. 4.33) 27

    28 (3) If a delegate or alternate candidate who has been elected but not certified to 29

    the DNC Secretary resigns, dies or is no longer eligible to serve, he or she 30 shall be replaced, after consultation with the State Party, by the authorized 31 representative of the presidential candidate to whom he or she is pledged. 32 (Rule 18.D.2) 33 34

    b. Temporary Replacement of a Delegate: (Rule 18.D.3) 35 36

    (1) A temporary replacement occurs when a delegate is to be absent for a 37 limited period of time during the convention and an alternate temporarily 38 acts in the delegates place. 39

    40 (2) Any alternate who temporarily replaces a delegate must be of the same 41

    presidential preference (including uncommitted status) as the delegate 42 he/she replaces, and to the extent possible shall be of the same sex and from 43 the same political subdivision within the state as the delegate. 44

    c. The following system will be used to select permanent and temporary 1 replacements of delegates: the delegate chooses the alternate, except that if the 2 delegate is not available to name a replacement, then the delegation shall choose 3 the replacement. (Rule 18.D.1) 4 5

    d. Certification of Replacements 6 7

    (1) Any alternate who permanently replaces a delegate shall be certified in 8 writing to the Secretary of the DNC by the State Democratic Chair. (Rule 9 18.D.3) 10 11

    (2) Permanent replacement of a delegate (as specified above) by an alternate 12 and replacement of a vacant alternate position shall be certified in writing 13 by the State Democratic Chair to the Secretary of the Democratic National 14 Committee within three (3) days after the replacement is selected. (Call 15 IV.D.1) 16

    17 (3) Certification of permanent replacements will be accepted by the Secretary 18

    up to 72 hours before the first official session of the Convention is scheduled 19 to convene. (Call IV.D.1 & Reg. 4.32) 20

    21 (4) In the case where a pledged delegate is permanently replaced after 72 hours 22

    before the time the first session is scheduled to convene or, in the case 23 where a pledged delegate is not on the floor of the Convention Hall at the 24 time a roll call vote is taken, an alternate may be designated (as specified 25 above) to cast the delegates vote. In such case, the Delegation Chair shall 26 indicate the name of the alternate casting the respective delegates vote on 27 the delegation tally sheet (Call VIII.F.3.d, Call VIII.F.3.b & Reg. 5.6) 28

    29 e. A vacant alternate position shall be filled by the delegation. The replacement 30

    shall be of the same presidential preference (or uncommitted status), of the same 31 sex and, to the extent possible, from the same political subdivision as the 32 alternate being replaced. (Rule 18.E) 33

    2. Unpledged delegates shall not be entitled to a replacement, nor shall the state be 1 entitled to a replacement, except under the following circumstances: (Rule 18.E & Reg. 2 4.33) 3

    4 a. Members of Congress and the Democratic Governor shall not be entitled to name 5

    a replacement. In the event of changes or vacancies in the states Congressional 6 Delegation, following the official confirmation and prior to the commencement 7 of the National Convention, the DNC Secretary shall recognize only such 8 changes as have been officially recognized by the Democratic Caucus of the U.S. 9 House of Representatives or the Democratic Conference of the U.S. Senate. In the 10 event of a change or vacancy in the states office of Governor, the DNC shall 11 recognize only such changes as have been officially recognized by the 12 Democratic Governors Association. (Call IV.D.2.a) 13

    14 b. Members of the Democratic National Committee shall not be entitled to a 15

    replacement, nor shall the state be entitled to a replacement, except in the case of 16 death of such delegates. In the case where the states DNC membership changes 17 following the DNC Secretarys official confirmation, but prior to the 18 commencement of the 2016 Democratic National Convention, acknowledgment 19 by the Secretary of the new DNC member certification shall constitute 20 verification of the corresponding change of unpledged delegates. (Call IV.D.2.b) 21

    22 c. Unpledged distinguished Party Leader delegates allocated to the state pursuant 23

    to Rule 9.A.5, shall not be entitled to name a replacement, nor shall the state be 24 entitled to name a replacement. (Call IV.C.2.c) 25

    26 d. In no case may an alternate cast a vote for an unpledged delegate. (Call 27

    VIII.F.3.d) 28 29 F. Rules for Delegate Selection Meetings 30

    31 The following rules apply to each meeting during the delegate selection process. Meetings 32 include precinct caucuses, legislative district caucuses, county conventions, congressional 33 district caucuses, and the State Convention. 34

    35 1. Alternates shall be listed and seated in the order in which they were elected, and 36

    must be of the same initial presidential preference, and, to the extent possible, of the 37 same gender and from the same electing jurisdiction as the delegate being replaced. 38 Any duly elected delegate or alternate who moves from the jurisdiction from which 39 he or she was elected, shall automatically forfeit his or her seat and an alternate shall 40 be seated in his or her place. 41 42

    2. The indication of presidential preference or as uncommitted shall be considered a 43 vote at the meeting for the purpose of allocating delegates. 44

    3. The meeting chair shall announce a preliminary vote count and delegate allocation, 1 including the number of votes needed to qualify for the 15% threshold (except at the 2 precinct caucus level where no threshold is required). This announcement shall be 3 followed by a reasonable period of time to allow caucus participants to change their 4 presidential preference. The State Democratic Chair shall provide procedures for the 5 conduct of the caucus to ensure the maximum participation and clearly demonstrate 6 that those supporting candidates who are not meeting the 15% threshold may 7 consider switching candidates to remain active in the process. 8

    9 4. Each presidential preference, which receives 15% or more of the votes cast at a 10

    meeting, (except at the precinct caucus level where no threshold is required) shall 11 receive his or her share of the delegates allotted. If no presidential preference reaches 12 the 15% threshold, the threshold shall be the highest percentage received by a 13 presidential preference minus 10%. Alternates shall be allocated in the same 14 proportion as delegates. These calculations shall be made pursuant to Rule 13 of the 15 2016 Delegate Selection Rules for the Democratic National Committee as follows: 16

    17 Step 1: Tabulate the percentage of the vote that each presidential preference 18

    receives to three decimals, 19 20 Step 2: Retabulate the percentage of the vote, to three decimals, received by each 21

    presidential preference excluding the votes of presidential preference 22 whose percentage in Step 1 falls below 15%, 23

    24 Step 3: Multiply the number of delegates to be allocated by the re-tabulated 25

    percentage received by each presidential preference. 26 27 Step 4: Delegates shall be allocated to each presidential preference based on the 28

    whole numbers that result from the multiplication in Step 3. 29 30 Step 5: Remaining delegates, if any, shall be awarded to the highest fractional 31

    remainders in Step 3. Ties shall be determined by lot. 32 33 5. Delegates for each presidential preference will caucus and vote separately for the 34

    number of delegates and alternates allocated to their presidential preference. Any 35 delegate allocation slot for which no person is available for election shall go unfilled. 36 All candidates for delegate must be resident, registered voters in the jurisdiction from 37 which they are elected and must be identified as to presidential preference. A 38 candidate who is not a delegate to the meeting or who is not present must signify in 39 advance, in writing individually, her or his presidential preference, that she or he will 40 serve if elected and that she or he is a Democrat and is willing to be known as such. 41 Said letter shall be delivered to the caucus convener at or prior to the caucus, shall be 42 read at the meeting by the chair and shall constitute a nomination at a precinct or 43 legislative district caucus or county convention. Alternates shall be nominated and 44 elected in the same manner. 45

    6. Voting for delegates and alternates shall be by written ballot at the precinct caucus 1 and by signed ballot at all other meetings. A ballot to be counted must have all 2 positions filled with no duplications. The vote shall not be weighted. Except at the 3 precinct caucus, an unsigned ballot is invalid and shall not be counted in the tally to 4 determine whether a plurality has been obtained. Each meeting chair shall give clear 5 notice to delegates that they must vote for the allotted number of candidates and the 6 chair must also give adequate time to do so and ask voting delegates to check ballots 7 before turning them in. A simple plurality is required for the election of a delegate or 8 alternate. Uncontested elections may be by acclamation. The chair shall provide the 9 ballots. A quorum as defined in Section VI.H. must be present in order to select 10 delegates to the next tier of the caucus system. 11

    12 7. The delegation elected by each legislative district and county shall be equally divided 13

    between men and women in both the delegate and alternate categories unless there 14 are an insufficient number of nominees from one gender to fill the available 15 positions. 16

    17 8. A person need not be a delegate at one caucus level to run for a delegate seat to the 18

    next caucus level. 19 20

    G. Precinct Caucuses 21 22 1. The principal business of the precinct caucuses shall be the election of delegates and 23

    alternates to legislative district caucuses (who will also serve as delegates and 24 alternates to county conventions). 25

    26 2. Delegates and alternates to legislative district caucuses and county conventions shall 27

    be apportioned among precincts existing as of November 3, 2015 according to the 28 following formula and criteria: 29

    30 a. In precincts that have the same boundaries as existed on Tuesday, November 6, 31

    2012, each precinct shall be entitled to elect one (1) delegate and one (1) alternate 32 for each seventy five (75) votes or portion thereof cast in the 2012 general election 33 for Barack Obama for President. 34

    35 b. In precincts where boundaries were altered after Tuesday, November 6, 2012, 36

    each precinct shall be entitled to elect one (1) delegate and one (1) alternate for 37 each two hundred and twenty five (225) registered voters (active and inactive 38 voters combined) or portion thereof, as reported by the Washington Secretary of 39 State in the November 3, 2015 public release of the statewide Voter Registration 40 Database (VRDB). 41

    c. At the discretion of the County Chair, an exception may be made to b) above and 1 a) substituted, in precincts where the boundaries of two (2) or more former 2 precincts were combined or altered after Tuesday, November 6, 2012 in such a 3 manner that the number of votes cast in the 2012 general election for Barack 4 Obama for President within the voting precinct may be precisely determined. 5

    6 d. At the discretion of the County Chair, an exception may be made to b) above, in 7

    precincts where the boundaries of two (2) or more former precincts were 8 combined or altered after Tuesday, November 6, 2012 in such a manner that the 9 number of votes cast in the 2012 general election for Barack Obama for President 10 within the voting precinct cannot be precisely determined, but where the Obama 11 vote may be precisely determined for a group of two or more voting precincts; in 12 such cases, the number of delegates and alternates that the group of precincts 13 would have been allocated based on its combined Obama vote under a) above if 14 the group was a single precinct shall be determined, and the total number of 15 registered voters as of the November 3, 2015 VRDB for each voting precinct and 16 the combined group shall be determined; then the total registration of each 17 precinct shall be divided by the combined group registration, and each voting 18 precinct shall be allocated delegates and alternates from the group allocation 19 based upon its share of combined group registration; provided that that no 20 voting precinct in such a group shall receive fewer delegates than it would be 21 entitled to under b) above. 22

    23 3. Precinct caucuses throughout the state shall be held on Saturday, March 26, 2016 at 24

    10:00 a.m. Notice shall be given at least ten (10) days in advance to all precinct 25 committee officers and the news media by the county chair. All caucuses shall be at a 26 location within each precinct if reasonably practicable, or within a reasonable 27 distance there from. Two (2) or more precincts may meet together to discuss and 28 present resolutions, but must caucus separately to elect delegates and alternates. 29

    30 4. Washington State residents who are not qualified to register to vote because of age or 31

    citizenship shall be allowed to participate in the platform and resolution discussions, 32 but not vote on the election of delegates or alternates, nor may they be elected as 33 delegates or alternates. 34

    35 5. Voters participating in the delegate selection process at the precinct caucuses will 36

    publicly declare their Democratic Party preference and have that preference publicly 37 recorded through the use of caucus registration forms which will clearly state at the 38 top of the page I am a registered voter in the precinct named above. I consider 39 myself to be a Democrat and I agree that my attendance at this caucus is a matter of 40 public record. The registration form will also include a section for recording a 41 voters presidential preference. 42

    6. Precinct caucuses shall be called to order by the precinct committee officer and 1 he/she shall serve as permanent chair, providing the precinct committee officer was 2 serving prior to Friday, February 26, 2016, and is the sole precinct committee officer 3 in that precinct. In other precincts a person designated by the county chair shall call 4 the meeting to order and the first order of business shall be the election of a 5 permanent chair. Lacking such designation, precinct people may meet at the 6 designated time and place, elect a permanent chair and proceed with business. The 7 permanent chair shall appoint a secretary of the caucus and shall instruct the caucus 8 in the specific items of business: 9 10 a. Discussion and action on issues and resolutions. Resolutions pertaining to 11

    political matters at any level of government may be presented, discussed and 12 forwarded on to the County Chair. 13

    14 b. Election of delegates and alternates to the legislative district caucus and county 15

    convention, and the purpose, objectives and numerical goals of the state 16 Affirmative Action Plan. Election of delegates shall not begin until at least 10:30 17 a.m. and the caucus cannot be closed until at least 11:00 a.m. 18

    19 c. Minutes of the caucus shall be prepared by its secretary and approved and 20

    signed by its chair. The permanent chair shall transmit the minutes along with 21 the registration sheet and all ballots to the County or Legislative District Chair 22 within twenty-four (24) hours after the caucus. These precinct caucus records 23 including the names, mailing addresses, telephone numbers, email addresses, 24 and presidential preference of delegates and alternates will be forwarded to the 25 State Party office within two (2) days of receipt and will be retained by the State 26 Party Chair until the conclusion of the 2016 Democratic State Convention. 27 Alternates shall be listed in the order in which they were elected. 28

    29 7. Each duly elected delegate and alternate shall receive at the precinct caucus a 30

    Certificate of Election to be presented to the credentials committee at the time of 31

    the legislative district caucus and county convention. Alternates shall be listed in the 32 order in which they were elected. The certificate must be signed by the permanent 33 chair of the caucus and is not transferable. The caucus chair shall transmit a list of 34 duly elected delegates and alternates with their correct addresses, zip codes, 35 telephone numbers, e-mails; and presidential preference; the original copy of the 36 caucus minutes, sign in forms, and resolutions presented, any proceeds collected to 37 cover the costs of the precinct caucuses to the County or Legislative District Chair 38 within (2) days after the caucus. 39

    H. Legislative District Caucuses 1 2 1. The principal business of the legislative district caucuses shall be the election of 3

    delegates and alternates to the 2016 Democratic State Convention and congressional 4 district caucuses. Legislative district caucuses may also adopt platforms and 5 resolutions. 6

    7 2. Delegates and alternates to the State Convention and congressional district caucuses 8

    shall be apportioned among the legislative districts based on a formula giving equal 9 weight to the number of registered voters in January 2016, and to the average of 10 Democratic presidential and gubernatorial votes cast in the 2012 general election, as 11 indicated in Attachment 11 (This document will not be ready until January of 2016), 12 according to the following criteria: 13

    14 a. The number of registered voters (active and inactive voters combined) shall be as 15

    reported by the Washington Secretary of State in the January 2016 public release 16 of the statewide Voter Registration Database (VRDB) excluding registered voters 17 not attributed to a specific geographic precinct. 18

    19 b. The average of the votes cast for Barack Obama for President and Jay Inslee for 20

    Governor shall be as certified by each county auditor and the Washington 21 Secretary of State excluding votes cast but not attributed to a specific geographic 22 precinct. 23

    24 c. For purposes of delegate and alternate allocation, precincts in the same county 25

    and congressional district and legislative district shall be grouped together and 26 allocations determined individually for each such grouping, with the exception 27 of the following inpracticably small groupings: 28

    29 (1) Precincts included in King County and the 1st Congressional District and 30

    the 39th Legislative District shall be grouped with precincts included in 31 Snohomish County and the 1st Congressional District and the 39th 32 Legislative District. 33

    34 (2) Precincts included in King County and the 9th Congressional District and 35

    the 5th Legislative District shall be grouped with precincts included in King 36 County and the 9th Congressional District and the 11th Legislative District. 37

    3. Legislative district caucuses shall be held on Sunday, April 17, 2016, commencing at 1 1:00 p.m., in all legislative districts that do not select delegates at a county convention. 2 The time (Sunday, April 17, 2016 at 1:00 p.m.) and the locations of the legislative 3 district caucuses shall be announced no later than Friday, April 8, 2016. Notice shall be 4 mailed or emailed, as allowed by a jurisdictions bylaws, at least five (5) days in 5 advance to each delegate and alternate and shall include at least the following 6 information: 7

    8 a. The authority giving the notice 9 b. Who is eligible to participate 10 c. Starting time, place and address of the meeting 11 d. Proposed agenda 12 e. Proposed operating rules 13 f. Officers to be elected, if any 14 g. Nominations for elective office, if any 15 h. Other pertinent, concise information to prepare the delegate or alternate for the 16

    work to be accomplished 17 18

    4. Delegates to the legislative district caucus shall be the duly elected delegates or 19 alternates from the precincts within the legislative district. Delegates and alternates to 20 the State Convention and congressional district caucuses shall be elected as follows: 21

    22 a. Delegates and alternates to the state convention and congressional district 23

    caucuses shall be elected at the legislative district caucuses in the following 24 legislative districts: 1st, 2nd, 3rd, 4th, 5th, 6th, 11th, 21st, 25th, 27th, 28th, 29th, 25 30th, 31st, 32nd, 33rd, 34th, 36th, 37th, 38th, 41st, 43rd, 44th, 45th, 46th, 47th and 26 48th. They may be elected in other legislative district caucuses by agreement 27 with the county central committees affected. 28

    29 b. A county that is wholly within a legislative district may choose its delegates and 30

    alternates to the state convention and congressional district caucuses at the 31 county convention. 32

    33 c. A county that is in more than one legislative district may choose its delegates and 34

    alternates to the state convention and congressional district caucuses at 35 legislative district caucuses during the county convention at a sub-caucus of 36 delegates from each legislative district on the date of the convention. 37

    38 d. A legislative district operating under (a), (b) or (c), above, must notify the State 39

    Democratic Chair, by certified letter with return receipt requested, no later than 40 Friday, February 26, 2016, to allow for adequate public notice. 41

    5. The legislative district central committee or executive board shall select a legislative 1 district caucus credentials chair and committee not less than thirty (30) days prior to 2 the caucus. The final credentials report shall be adopted prior to the conduct of any 3 other official business, but no earlier than 2:00 p.m. Individuals who arrive and sign 4 in after the final credentials report may participate and vote, but their presence will 5 not affect a quorum call. The Credentials Committee shall prepare a report for 6 submission to the State Party (Affirmative Action Report) which shall include the 7 demographic profile of the caucus attendees germane to the delegate selection and 8 affirmative action plan. 9

    10 6. The legislative district central committee or executive board shall select a legislative 11

    district caucus rules chair and committee not less than thirty (30) days prior to the 12 caucus. It shall meet in advance of the caucus and shall propose rules for the caucus. 13

    14 7. The legislative district caucus chair shall transmit the Affirmative Action Report, and 15

    the names, demographic profiles germane to the delegate selection and affirmative 16 action plan, mailing addresses, telephone numbers, email addresses, and presidential 17 preference of delegates and alternates elected at the legislative district caucus to the 18 State Democratic Chair within five (5) days of their election. Alternates shall be listed 19 in the order in which they were elected. 20

    21 I. County Conventions 22

    23 1. The business of county conventions shall include the adoption of a platform or 24

    resolutions. If the county convention holds legislative district caucuses to elect 25 delegates and alternates to the State Convention and congressional district caucuses, 26 those caucuses shall be conducted pursuant to the applicable provisions relating to 27 legislative district caucuses at a sub-caucus meeting, not as part of the general 28 business of the convention. 29 30

    2. County conventions shall be held at the option of the county central committee or 31 executive board. All scheduled county conventions shall be held on Sunday, May 1, 32 2016, commencing at 1:00 p.m. 33

    rules chair and committee not less than thirty (30) days prior to the convention. It 34 shall meet in advance of the convention and shall propose rules for the convention. 35

    36 J. Congressional District Caucuses 37

    38 1. The principal business of the congressional district caucuses shall be the election of 39

    delegates and alternates to the National Convention. Each congressional district 40 caucus shall also elect one Presidential Elector and an alternate Elector. 41

    2. Congressional district caucuses shall be held on Saturday, May 21, 2016 commencing 1 at times and sites designated by the State Democratic Chair. Notice shall be given at 2 least ten (10) days in advance to each delegate and alternate and to the news media 3 by the State Democratic Chair, who shall appoint a chair and a secretary for each 4 congressional district caucus. Delegates to the congressional district caucuses shall be 5 the duly elected delegates or alternates from the legislative district caucuses (or 6 legislative district subcaucuses held in conjunction with county conventions) within 7 each congressional district. 8

    9 3. The congressional district caucus secretary shall certify the number of delegates 10

    present, the number of delegates for each presidential preference, an affirmative 11 action report of delegates and alternates, and the allocation of delegates and 12 alternates for each presidential preference, which shall constitute the final credentials 13 report. 14

    15 4. Each candidate for congressional district-level delegate or alternate to the National 16

    Convention may use up to one (1) minute on his or her own behalf for nominating 17 and seconding speeches and a speech by the candidate. The one (1) minute may be 18 allocated at the candidate's discretion. 19

    20 5. Each candidate for Elector may use up to one (1) minute on his or her own behalf for 21

    nominating and seconding speeches and a speech by the candidate. The (1) minute 22 may be allocated at the candidates discretion. 23

    24 6. The Elector shall be elected by a majority of those present and voting. Each delegate 25

    to the caucus may vote for one candidate. If no candidate receives a majority on the 26 initial vote, the top female and top male candidate shall compete in a runoff election, 27 with the winner selected as Elector and the other candidate selected as alternate 28 Elector. If a candidate does receive a majority on the initial vote, the top vote-getter of 29 the opposite gender shall be selected as alternate Elector. 30

    31 K. State Convention 32

    33 1. The Democratic State Convention shall commence on Saturday, June 18, 2016, at 9:00 34

    a.m. in Tacoma, Washington. Notice shall be given at least ten (10) days in advance to 35 each delegate and alternate by the State Democratic Chair. The State Democratic 36 Chair is authorized to appoint the temporary chair, the secretary, and the sergeants-37 at-arms. 38

    39 2. There will be 1,400 elected delegates and 700 elected alternates to the State 40

    Convention. Any county with less than ten (10) delegates may send up to ten (10) 41 people, with fractional votes, to the convention. 42

    3. State Convention delegates shall be requested to pay a $50.00 State Convention 1 registration to the State Party Committee. No person shall be excluded or disqualified 2 at any level on the basis of non-payment of such registration or any fee. 3

    4 4. Alternates shall be listed and seated in the order in which they were elected and shall 5

    serve only for their respective legislative districts, provided that in delegations from 6 legislative districts containing more than one county, an alternate from the same 7 county as an absent delegate shall be seated prior to any other alternate from the 8 legislative district. Should no same county alternate be present, the eligible alternate 9 from within the legislative district shall be seated. 10

    11 5. The business of the State Convention shall be proposed by the State Convention 12

    Rules Committee and confirmed by the State Convention, including, but not limited 13 to the election of at-large Presidential Electors and alternates, one male and one 14 female each and the nomination of any required candidates office. A platform shall 15 also be adopted. It may also include the selection of nominees for partisan office. 16 Workshops may be held at the discretion of the State Chair. 17

    18 6. Each Elector shall be elected by a majority of those present and voting. Each delegate 19

    to the State Convention may vote for one candidate of each gender. If no candidate 20 receives a majority on the initial vote, the top two female candidates and top two 21 male candidates shall compete in a runoff election, with the winner selected as 22 Elector and the other candidate selected as alternate Elector. If a candidate does 23 receive a majority on the initial vote, the candidate with the second most votes shall 24 be selected as alternate Elector. 25

    26 7. Standing Committees of the State Convention. 27

    28 a. The Credentials Committee shall have the power to certify delegates as 29

    submitted by the legislative districts and counties, and to recommend settlement 30 of all disputes pertaining to seating of delegates. The final credentials report shall 31 be adopted prior to the conduct of any other official business and shall include 32 the number of delegates registered for each presidential preference. It shall also 33 produce a post-convention Affirmative Action Report of delegates and 34 alternates. A member of the Affirmative Action Committee will serve on the 35 Credentials Committee. 36

    37 b. The Platform Committee shall hold hearings and shall meet and consider 38

    resolutions and platforms as submitted by the various counties and/or 39 legislative districts, and draft a proposed platform and resolutions, which shall 40 be mailed or emailed to all delegates and alternates to the State Convention at 41 least ten (10) days prior to the Convention. 42

    c. The Rules Committee shall draft proposed rules and a proposed agenda for the 1 conduct of the Convention that shall be mailed or emailed to all delegates and 2 alternates to the State Convention at least ten (10) days prior to the Convention. 3 A member of the Affirmative Action Committee will serve on the Rules 4 Committee. The Rules Committee will ensure compliance with the partys 5 affirmative action goals. 6 7

    d. Committees shall hold an initial meeting in advance of the State Convention at a 8 time and place to be determined by the State Democratic Chair. 9

    10 e. The State Democratic Chair shall appoint the chair or co-chairs of the 11

    Credentials, Rules and Platform Committees no later than December 31, 2015. 12 The appointment shall be confirmed by the State Committee at its next meeting. 13 Each legislative district and county organization shall elect one member to serve 14 on each of the three committees no later than Friday, March 11, 2016. 15

    9 2. Members of the Convention Standing Committees need not be delegates or alternates 10

    to the 2016 Democratic National Convention. (Call VII.A.3) 11 12 3. These members will be selected in accordance with the procedures indicated below. 13

    1. Selection Meeting 18 19

    a. The members of the standing committees shall be elected by a quorum of 20 Washington States National Convention delegates, at a meeting to be held on 21 Sunday, June 19, 2016. (Call VII.B.1) 22

    23 b. All members of the delegation shall receive adequate notice of the time, date and 24

    place of the meeting to select the standing committee members. (Call VII.B.1) 25 26

    2. Allocation of Members 27 28

    a. The members of the standing committees allocated to Washington StateError! 29 Reference source not found. shall proportionately represent the presidential 30 preference of all candidates (including uncommitted status) receiving the 31 threshold percentage used in the states delegation to calculate the at-large 32 apportionment pursuant to Rule 13.E. of the Delegate Selection Rules. (Call 33 VII.C.1 & Reg. 5.8) 34

    35 b. The presidential preference of each candidate receiving the applicable percentage 36

    or more within the delegation shall be multiplied by the total number of standing 37 committee positions allocated to Washington State. If the result of such 38 multiplication does not equal 0.455 or above, the presidential preference in 39 question is not entitled to representation on the standing committee. If the result 40 of such multiplication is equal to or more than 0.455 but less than 1.455, the 41 presidential preference is entitled to one (1) position. Those preferences securing 42 equal to or more than 1.455 but less than 2.455 are entitled to two (2) positions, 43 etc. (Call VII.C.2) 44

    1 c. Where the application of this formula results in the total allocation exceeding the 2

    total number of committee positions, the presidential candidate whose original 3 figure of representation is farthest from its eventual rounded-off total shall be 4 denied that one (1) additional position. Where the application of this formula 5 results in the total allocation falling short of the total number of committee 6 positions, the presidential candidate whose original figure of representation is 7 closest to the next rounding level shall be allotted an additional committee 8 position. (Call VII.C.3) 9 10

    d. Standing committee positions allocated to a presidential candidate shall be 11 proportionately allocated, to the extent practicable, to each of the three standing 12 committees. When such allocation results in an unequal distribution of standing 13 committee positions by candidate preference, a drawing shall be conducted to 14 distribute the additional positions. (Call VII.C.4) 15

    16 3. Presidential Candidate Right of Review 17

    18 a. Each presidential candidate, or that candidates authorized representative(s), 19

    shall be given adequate notice of the date, time and location of the meeting of the 20 states delegation authorized to elect standing committee members. (Call VII.D.1) 21

    22 b. Each presidential candidate, or that candidates authorized representative(s), 23

    must submit to the State Democratic Chair, by Sunday, June 19, 2016, 24 immediately after the election of the at-large delegates and alternates, a 25 minimum of one (1) name for each slot awarded to that candidate for members 26 of each committee. The delegation shall select the standing committee members 27 from among the names submitted by the presidential candidates (including 28 uncommitted status). Presidential candidates shall not be required to submit the 29 name of more than one (1) person for each slot awarded to such candidate for 30 members of standing committees. (Call VII.D.2) 31

    32 4. Selection Procedure to Achieve Equal Division 33

    34 a. Presidential candidates (including uncommitted status) shall use their best 35

    efforts to ensure that their respective delegation of standing committee members 36 shall achieve Washington States affirmative action goals and that their 37 respective members are equally divided between men and women. (Rule 6.I & 38 Reg. 4.9) 39

    b. Each position on each standing committee shall be assigned by gender. For 1 example, the first position on the Credentials Committee of the presidential 2 candidate with the most standing committee positions shall be designated for a 3 male, the second position for a female, and the remaining positions shall be 4 designated in like fashion, alternating between males and females. Positions for 5 presidential candidates on each committee shall be ranked according to the total 6 number of standing positions allocated to each such candidate. After positions 7 on the Credentials Committee are designated by sex, the designation shall 8 continue with the Platform Committee, then the Rules Committee. 9

    10 (1) A separate election shall be conducted for membership on each standing 11

    committee. 12 13

    (2) The membership of the standing committees shall be as equally divided as 14 possible under the state allocation; if the number is even, the membership 15 shall be equally divided between men and women; if the number is odd, the 16 variance between men and women may not exceed one (1), and the 17 advantaged gender must not remain constant for the three standing 18 committees. (Call VII.E.1) 19

    20 (3) The positions allocated to each presidential candidate on each committee 21

    shall be voted on separately, and the winners shall be the highest vote-22 getter(s) of the appropriate sex. 23

    24 5. Certification and Substitution 25

    26 a. The State Democratic Chair shall certify the standing committee members in 27

    writing to the Secretary of the Democratic National Committee within three (3) 28 days after their selection. (Call VII.B.3) 29

    30 b. No substitutions will be permitted in the case of standing committee members, 31

    except in the case of resignation or death. Substitutions must be made in 32 accordance with the rules and the election procedures specified in this section, 33 and must be certified in writing to the Secretary of the Democratic National 34 Committee within three (3) days after the substitute member is selected.     21 C. Convention Pages 22 23

    1. Three (3) individuals will be selected to serve as Washington States Convention Pages 24 by the State Democratic Chair in consultation with the members of the Democratic 25 National Committee from the state. This selection will take place on Sunday, June 19, 26 2016. (Call IV.F.3, Call Appendix C & Reg. 5.7) 27

    28 2. The Convention Pages shall be as evenly divided between men and women as 29

    possible under the state allocation and shall reflect as much as possible, the 30 Affirmative Action guidelines in the Affirmative Action Plan. (Reg. 5.7.A) 31

    32 3. The State Democratic Chair shall certify the individuals to serve as Washington States 33

    Convention Pages in writing to the Secretary of the Democratic National Committee 34 within three (3) days after the selection. (Call IV.F.3 & Reg. 5.6.B) 35

    3 A. The Washington State Democratic Party reaffirms its commitment to an open party by 4

    incorporating the six basic elements as listed below. These provisions demonstrate the 5 intention of the Democratic Party to ensure a full opportunity for all minority group members to 6 participate in the delegate selection process. (Rule 4.A & Rule 4.C) 7

    8 1. All public meetings at all levels of the Democratic Party in Washington State should 9

    be open to all members of the Democratic Party regardless of race, sex, age, color, 10 creed, national origin, religion, ethnic identity, sexual orientation, gender identity, 11 economic status or physical disability (hereinafter collectively referred to as status). 12 (Rule 4.B.1) 13

    14 2. No test for membership in, nor any oaths of loyalty to the Democratic Party in 15

    Washington State should be required or used that has the effect of requiring 16 prospective or current members of the Democratic Party to acquiesce in, condone or 17 support discrimination based on status. (Rule 4.B.2) 18

    19 3. The time and place for all public meetings of the Democratic Party in Washington 20

    State on all levels should be publicized fully and in such manner as to assure timely 21 notice to all interested persons. Such meetings must be held in places accessible to all 22 Party members and large enough to accommodate all interested persons. (Rule 4.B.3) 23

    24 4. The Democratic Party in Washington State, on all levels, should support the broadest 25

    possible registration without discrimination based on status. (Rule 4.B.4) 26 27 5. The Democratic Party in Washington State should publicize fully and in such a 28

    manner as to assure notice to all interested parties a full description of the legal and 29 practical procedures for selection of Democratic Party officers and representatives on 30 all levels. Publication of these procedures should be done in such fashion that all 31 prospective and current members of each State Democratic Party will be fully and 32 adequately informed of the pertinent procedures in time to participate in each 33 selection procedure at all levels of the Democratic Party organization. (Rule 4.B.5) 34

    35 6. The Democratic Party in Washington State should publicize fully and in such a 36

    manner as to assure notice to all interested parties, a complete description of the legal 37 and practical qualifications of all positions as officers and representatives of the State 38 Democratic Party. Such publication should be done in timely fashion so that all 39 prospective candidates or applicants for any elected or appointed position within each 40 State Democratic Party will have full and adequate opportunity to compete for office. 41 (Rule 4.B.6) 42

    43 B. Discrimination on the basis of status in the conduct of Democratic Party affairs is prohibited. 44

    C. Washington States delegation shall be equally divided between delegate men and delegate 1 women, and alternate men and alternate women. Such goal applies to the entire delegation, 2 which includes all pledged delegates and alternates and all unpledged delegates. Delegates and 3 alternates shall be considered separate groups for purposes of achieving equal division. (Rule 4 6.C) 5

    6 D. All delegate and alternate candidates must be identified as to presidential preference or 7

    uncommitted status at all levels which determine presidential preference. (Rule 12.A) 8 9 E. No delegate at any level of the delegate selection process shall be mandated by law or Party 10

    rules to vote contrary to that persons presidential choice as expressed at the time the delegate is 11 elected. (Rule 12.I) 12

    13 F. Delegates elected to the national convention pledged to a presidential candidate shall in all good 14

    conscience reflect the sentiments of those who elected them. (Rule 12.J) 15 16 G. All delegates, alternates and standing committee members must be bona fide Democrats who 17

    have the interests, welfare and success of the Democratic Party of the United States at heart, who 18 subscribe to the substance, intent and principles of the Charter and Bylaws of the Democratic 19 Party of the United States, and who will participate in the Convention in good faith. (Rule 12.H 20 & Reg. 4.25) 21

    22 H. Forty percent (40%) the members of any Party body above the first level of the delegate selection 23

    process shall constitute a quorum for any business pertaining to the selection of National 24 Convention delegates, alternates, standing committee members, and other official Convention 25 participants, as well as Presidential Electors. (Rule 15) 26

    27 I. The unit rule, or any rule or practice whereby all members of a Party unit or delegation may be 28

    required to cast their votes in accordance with the will of a majority of the body, shall not be 29 used at any stage of the delegate selection process. (Rule 17.A) 30

    31 J. Any individual or group of Democrats may sponsor or endorse a slate of candidates for 32

    convention delegates. But no slate may, by virtue of such endorsement, receive a preferential 33 place on a delegate selection ballot or be publicly identified on the ballot as the official 34 Democratic Party organization slate, and all slates must meet identical qualifying requirements 35 for appearing on a ballot at all levels of the delegate selection process. (Rule 17.B) 36

    37 K. All steps in the delegate selection process, including the filing of presidential candidates, must 38

    take place within the calendar year of the Democratic National Convention, except with respect 39 to the implementation of the Affirmative Action Plan. (Rule 1.F. & Rule 11.B) 40

    L. In electing and certifying delegates and alternates to the 2016 Democratic National Convention, 1 Washington State thereby undertakes to assure all Democratic voters in the state full, timely and 2 equal opportunity to participate in the delegate selection process and in all Party affairs and to 3 implement affirmative action programs toward that end; that the delegates and alternates to the 4 Convention shall be selected in accordance with the Delegate Selection Rules for the 2016 5 Democratic National Convention; and that the delegates certified will not publicly support or 6 campaign for any candidate for President or Vice President other than the nominees of the 7 Democratic National Convention.
