CHAPTER I

GENERAL PROVISIONS

Article 1. Subjects of application, assignment for execution management:

1. This Regulation specifies the management of land use indicators on each plot, the technical specifications and requirements for technical infrastructure management, control principles, management on space, architecture, landscape and environmental protection under the Detailed plan (scale 1/500) Long Binh New urban area, Long Binh Ward, District 9 which has been approved by City People's Committee via Decision No. : 3045/QD-UBND dated 24 June, 2015, as the basis for urban construction management.

2. The Employer of Urban development projects, Management Boards of urban development areas, People's Committee of District 9, Departments, related organizations and individuals are responsible for compliance with the contents of this Regulation in the process of implementation of detailed plan (scale 1/500) Long Binh New urban area, Long Binh Ward, District 9.

Article 2. Boundaries, acreage planning area:

Location: The planning Site locate in Long Binh Ward, District 9, Ho Chi Minh City Boundary of planned Sites:

In North: border on the National Cultural Historey Park.

In West: border on existing residential area.

In East: border on the existing residential area.

In South: border on Thu Duc golf course.

Planning area: 917.900 m.- Nature area planning: The new urban area- Population: 19.500 people.

2. Control Principles on Landscape, Architectural Space:

- Building height, building podiums, roof, and height and overhang length of 1st floor canopy, vertical percentile, horizontal percentile, porosity, density, window layout, entrance door towards the street to ensure the continuity, harmony for the architecture of the entire route.

- Urban utilities such as stay seat, lines for the disabilities, lighting posts and signs, signposts must ensure the beauty, safety, convenience, unification, harmony with the architecture work scale.

- Sidewalks, walkways in urban areas must be built synchronously, with appropriate height, materials, colors of each street, each area in the urban areas; planting pit should have appropriate dimension, to ensure safety for pedestrians, especially for people with disabilities; facilitate the protection and care for trees.

- The natural landscape in the planning area must be strictly protected, to maintain the natural topographic features of the area.

- Natural landscape, vegetation, natural ecosystems, hill, water surface which have direct or indirect influence on environmental quality and sustainable development of urban areas should be zoned; instructed with detailed usage and protection instructions.

- About the color of construction works:

In the main street, main route of the planning area, the use of colors, finishing materials for the outside of the works must ensure the harmony for the entire route, the area and must be specified in Construction permits; to present the formality, unique, harmony, elegance or requirements on conservation to the original status and adhere to the following requirements:

+ The outside surface of the house (Facade, Side) do not use hot colors (red, black), brilliant color (yellow, orange) on the entire facade.

+ Do not use dark tiles with highly polished to cover the entire facades of buildings.

+ Do not use reflective materials with more than 70% for the entire facade.

- For fencing of the structures:

Unless otherwise specifically requested, the fence must have light airy architectural, aesthetics and unified form according to the provisions of each sector and in compliance with the following requirements:

+ The maximum height of fences is 2.6 m (calculated from the existing stable sidewalk surface at construction site). + The fencing area towards the street and the alley from the height of 0.6m or more must be designed to be cleared from obstructions. The clear part accounts for at least 75% of the vertical plan of the fence(* explain this how to plan whether following the experience or discussing with DPA, etc, whether it may affect this bussness) > The provision of fence,60% is different from 50% on 24page, explain this in detail! Adjusted to 75% so as to be in accordance with Article 8Article 4. Major Provisions on Technical Infrastructrue System

It's necessary to organize and manage the planned benchmarks to strictly manage the land fund.

- The connection of regional infrastructure system of the area to general infrastructure of the municipality (road, metro, etc.) must be synchronized with the current state of existing infrastructure and development orientation in the future, consistent with planned technical infrastructure which has been approved and other relevant current legal documents. The investment projects in infrastructure in the planning areas must comply with the approved plans with unified development scheme to ensure uniformity in the implementation process.

- The connection of transportation road to the National Highway (if any) must comply with Decree No. 11/2010/ND-CP dated 24/02/2010 of the Government Regulating the management and protection of road infrastructures.

- Activities related to urban underground spatial construction planning within the scope should comply with the provisions of Decree No. 39/2010/ND-CP dated 04/04/2010 of the Government on Management of urban underground spatial construction and Circular No. 11/2010/TT-BXD dated 17/08/2010 of the Ministry of Construction Guiding the database management of urban underground works.

- Agencies specializing in technical infrastructure management are responsible for instructing the suitable solutions to connect technical infrastructure as prescribed if requested by concerned organizations and individuals.

4.1. Planning of Ground Altitude and Surface Water Drainage: Planning of ground altitude Based on the essence of building H 2.50 m, and based on the situation of flooding of the area as well as a number of other technical elements from it as the basis of leveling for the project as follows:

Essence construction inside the building must ensure H2.50m. Which areas have lower altitudes 2.50m should proceed to leveling for the construction levels H2.50m,Area along river or lake is H 2.20 m to restrict the volume of land cut and fill, while creating drainage slopes as well as additional factors relating to the area of fine design. Rainwater drainage system planning The drainage system for the area is separately designed for public, domestic and wastewater.

Using the underground culvert for rainwater drainage and avoiding local flood.

Calculation of rainwater drainage network with frequency is T = 10 years. Horizontal culvert is 400mm dia. Culvert size varies from 400mm - 1200mm dia. Horizontal culvert is 400mm dia. dividing the area into several major drainage basins to gather the amount of surface water from elevated places going to the receiving source in a fast way, it also aims to avoid passing traffic on basins and decrease aperture diameter.

Rainwater over the entire surface will be collected on the main traffic axes, then discharged into the receiving sources according to the shortest way through the outlet system of the local channels, Central Lake and Dong Nai River.

4.2. Traffic Network Planning Traffic planning design ensuring economic requirements, technical criteria, of the urban landscape.

External traffic axis consisting of two routes are Ring No. 3 (existing Nguyen Xien road) and Road no. 11 to connect the project. There are also main roads across the planned area, which are D1 Road and D6 Road.

The road lines are in specific areas as follows:

Road D1 with a width of 40 m, running through the area, connecting to road no. 11. Road D6 with a width of 30 m, connecting from road no. 11 to ring 3 (Nguyen Xien street). Road D2 with a width of 25 m, the local routes connect to road D1 in the area. Road D11 with a width of 25 m, connecting from road D6 in the area. Roads D7, D9, D10 with a width of 20 m, the local routes connect to in the area. In addition, there are other internal roads for each residential block with a width of 10 m.4.3. Power Supply Planning and lighting:

Power source Power supplies of the beginning stage are from the outlet of Thu Duc Dong intermediate station of 110/2KV of 2x63MVA power and Tang Nhon Phu intermediate station of 110/2KV of 2x63MVA power The total demand for electricity is P tt = 41,196KW (Stt = 48,466KVA).

Grid Building the medium voltage underground cable lines 3M40mm - XLPE-24KV from head office positions existing connections to the power supply for the station . The medium voltage underground cable is threaded in the block of pipe. Use underground cable box connected to medium voltage cable segments of length on the 200 meters.

To set up a new transformer station of 22/0.4 KV close to the layout in the villa, commercial-Site to supply power for domestic use and public, commercial lighting, roads in the area. Use the types of transformers of kiot form. Use 22/0.4KvA transformer capacity: 320KVA - 2000 KVA

The distribution substation 22 / 0.4 kV power supply for each form of public housing areas, commercial and office complex secondary by investors in investment and construction put in place in zone.

Road lighting electric supply network: Use HPS lamps of 150W/100W lighting for the technical infrastructure in the Site , the lights on the high zinc steel 8 m poles between the poles from 25-30 m. Use the plastic insulation underground cables of Cu/XLPE/DSTA/PVC 4xC 16 mm for the entire areas electrical lighting supply.

4.4. Telecommunication System Planning : Supply

Communication system will connect to the existing fiber optic lines running along the road No. 11 and Nguyen Xien street of the communication system to center Station. Scheduled subscription for the planning area are as follows:

Site A: 3,249 subscriber

Site B: 5,232 subscriber

Total Subscriber 8,481 subscriber

The main cable from the cable distribution system extending to the type of the cable box is to be threaded in HDPE plastic pipe 130 away from the sewage tank.

4.5. Water supply , Sewage drainage, Environmental Sanitation Water supply planning

Sources of water Site A: Connected with the pipeline 200 for water supply road No. 11 outside the planning boundary with road D4 of Site A, this pipeline receives and consumes water from Thu Duc water plant of output 850,000 m3/day. Site B: Connected with the pipeline 350 for water supply on road Nguyen Xien street outside the planning boundary with road D6 of Site B, this pipeline receives and consumes water from Thu Duc water plant of output 850,000 m3/day. Later stage will connect to the water supply pipe 500 on Nguyen Xien street outside the planning boundary. Water demand calculation

Site A: Q = 2,160 (m3/day)

Site B: Q = 3,810 (m3/day)

The whole water demand

Q = QA + QB = 2,160 + 3,810 = 5,970 (m3/day)

Design solution for water supply pipeline network

Design of water supply pipeline network for the entire area.

Use the ring network in conjunction with Penguin network for water supply to ensure a safe water supply to individual households.

From booster pump station design of pipelines of 200mm, 150mm and 100mm, to supply every household and the works in the area.

Hydrant lay-out of pipelines of diameter, 200mm, 150mm & 100mm to make sure the serving radius for the firefighter head is 120m -150m. Hydrant layout at the junction of the roads to facilitate the fire.

Sewage drainage planning

Prediction of total amount of sewage Site A: Q = 1,900 (m3/day)

Site B: Q = 3,370 (m3/day)

Sewage flow of the entire area

Q = QA + QB = 1,900 + 3,370 = 5,270 (m3/day)

Drainage plan

Construction of sewage drainage system separate from the rainwater drainage system.

Sewage in Site A is placed in Site A processing station with a capacity of Qxl-A = 1,900 m3/day, after being processed in the processing stations must meet the standard stated in column B QCVN 14: 2008/BTNMT (national technical regulation on waste water) prior to release of the drainage system in the area. Sewage in Site B is placed in Site B processing station with a capacity of Qxl-B = 3,370 m3/day, after being processed, the processing stations must meet the standards stated in column B QCVN 14: 2008/BTNMT (national technical regulation on waste water) prior to release of the drainage system in the area. The technical wells are built enclosed, with lid to collect domestic sewage, and technical inspections. The sewer is deployed along the road, lying on the pavement, coating the soil drains at least 0.7 m measured from the ground to the top of the drain. Environmental Sanitation

Build a transit station of solid waste for Site A:

Transit station capacity of solid waste: W = 9.2 tons per round day

Build the transit station of solid waste for Site B: Transit station capacity of solid waste: W = 16.2 tons per round day

Solid waste is transferred to the garbage dump in Site A and Site B, then be transported to the garbage dump expected (according to the overall planning for the construction of District 9 to 2020 was approved) located Nguyen Xien street. Then, the garbage is transported to the city's complex treatment of solid waste. 4.6. Strategic environment assessment

Solid waste should be separated at the sourse. Then, the solid waste is collected and transported to the citys complex treatment of solid waste.

Sewage is treated at sewage treatment station, ensure according the standard QCVN 14: 2008/BTNMT (national technical regulation on waste water) prior to discharge to the drainage system in the area in short-term phase. In long-term phase, sewage is collected and focused at the citys sewage treatment plant and treated according standard TCVN 7222 : 2002. The green area is placed in this site to protect air environment, ensure according QCVN 05:2009/BTNMT and the noise ensure according QCVN 26:2010/ BTNMT.

Solutions which adapt and reduce impacts of climate change are integrated in the planning solutions.

According decree 29/2011/N-CP was issued on 18/04/2011 of the government provide regulations on Strategic environment assessment, environmental impact assessment, environmental protection commitments, the list of projects to implement environmental impact assessment include: apartment projects have size 500 people or 100 households, the hospital project, the sewage treatment stations have capacity 500 m3.CHAPTER II

For the high density residential(>low risedwelling area?) land, the minimum setback for all buildings along the roads is 3.0 m and the minimum setback for commercial residential area is 3m(>6m?) (* Is this mistake?) from the ground to the first storey and for the public land, the minimum setback is 6.0 m along the axis of road D1 and road D6. The multifunctional residential & multifunctional commercial land is a combination of structures consisting of the structural base and the upper tower, the setback of 0.0m is applied for the structural base and for the upper tower under construction height respectively of each section from the ground (pavement altitude). (*I cant understand this sentence exactly, explain this paragraph in detail) Designed elevation of the transport system is recorded at the cross point of the center line at the intersections in the Drawing of embankment elevation and surface water drainage.

Article 7. The scope of protection, safety corridors for infrastructure construction and underground engineering: Transformer station, RMU switch station in Kiosk form protected by signaling Board.

Wastewater treatment system, pumping station and garbage transit station should be arranged into guarding corridor at least 20m.

The ditches and embankments along the lake should be arranged as guarding corridor of 5m. The underground infrastructural lines should comply with the following Table:

Article 8: Regulations on architectural form and works fence, dominant materials of construction works: 8.1 Residential:

- Architectural form:

For apartments: apartment blocks should be designed in harmony with the surrounding space; the faade from all directions has to be studied simultaneously. Apartment architectural forms need to be diversified, modern architecture style is encouraged, in accordance with the characteristics of the climate, living habits and urban civilized lifestyle.

For townhouses: a group of adjacent townhouses in about 10 to 12 units needs to be designed with similar architectural form. Townhouses in the same group should have similar height and form of the roof. To create emphases, a certain number of positions such as the corner of a group of townhouses can have different height but not exceeding 2 floors or 1/4 of the group height. In a residential area, the architectural form of each group needs to be diversified, avoiding stereotypes. For villas: architectural forms should be diversified and in harmony with the adjacent villa and surrounding landscape.

For mixed-use buildings: Architectural works should be designed in harmony with the space of the main road, the faade from all sides has to be studied simultaneously. Architectural forms need to be diversified, encouraging modern architectural style, in accordance with the characteristics of the climate, living habits and urban civilized lifestyle.

- Building fence:

In harmony with the space, landscape and architecture of the surrounding area;

Detailed design, color, construction materials should be harmonious with the building;

Fence height is not allowed to exceed 2,6m from the sidewalk level; fence pedestal (if have) is not allowed to exceed 0,6m; Encourage sparse fence design, in combination with green space to improve urban landscape.

For apartments: Fence of apartment building bordering the roads to ensure minimum porosity level of 75%. Fences are not encouraged for apartment buildings or fence should be designed low, in combination with lawn, flower beds, decorative ponds soothing, green and vivid landscape. For villas: Fence of villas bordering the roads to ensure minimum porosity level of 75%. Fence bordering the neighboring land lot can be concrete wall.

For mixed-use buildings: fence are not encouraged, fence in front of the building with the entrance for pedestrians combines with lawn, flower beds, decorative ponds to create gentle, green and vivid landscape and convenience for pedestrians. If there is fence, design should ensure a minimum porosity level of 75%.

- Colors:

The colors of the buildings must be in harmony with the landscape and architecture of the area and neighboring buildings, and tally with the architectural style of the building. Do not use reflective, deep or showy color.

Individual houses: encourage maximum use of 03 colors for external walls of the building.

Apartment, complex buildings: encourage the use of cold soft tones. Podiums serving as service & commercial area can use vivid, bright colors.

- Finishing material of buildings:

Building materials have to conform to regulations, building standards, suit the architectural style and be in harmony with the architecture and landscape of the area.

Do not use materials with reflective, dark or flashy colors which can affect the urban landscape.

Complex building: encourage the use of beautiful, durable, high-quality, low dust materials which can withstand climate conditions such as rain, sunlight. Examples are natural stone, stone paint, artificial stone with rough surface, glass, high-quality aluminum, especially for ground floor and areas with large number of users.- External details of buildings:

Decoration details of facades (front, side) must comply with the building code and standards, be in harmony with landscape architecture of the region. Use of cumbersome architectural details is not encouraged.

There should be architectural solutions to shield the technical systems of buildings such as air conditioning, water tank, solar plant, technical pipeline so as not to be seen from public spaces. Discharge pipes, ditch for storm water, yard cleaning water and waste water of all kinds to sidewalks and public roads are not allowed; ramps, gates encroaching public sidewalk are not allowed.8.2 For public works:

- Architectural forms: Encourage modern architecture, open and environmentally friendly.

Article 9: Provisions on the object architecture, public green tree, garden yard, tree-lined streets, water surface, open space, highlights

Architectural objects in parks, flower gardens or playgrounds should be built according to the rules of the red line, building line, height, small scale, building density on the green land plot to a maximum of 5%. The works have simple, modern architecture, pure linguistic color in line with the general landscape of the region, adorn the landscape environment and serve the social utility for the user. Make sure the vision for the routes; ultimately use the landscape to create beautiful vision and architectural highlight in the planning area. Public green tree, garden yard, tree-lined streets should be planted, cared, maintained, protected, classified and arranged under the planning, standards and current legislation. Encourage planting of trees to ensure the ecological environment, harmonious and vivid color to creat a typical area. With regard to artificial landscape, open space and urban space highlights etc., is to be logically designed, built in sync, and in harmony with the landscape, the environment and in accordance with regional characteristics & function. The lakes in the planning area must be retained and invested in accordance with the approved plan, taking advantage of the natural landscape of water, steep hills creating general landscapes for the planning area.Chapter III

EXECUTIVE ARTICLEArticle 10.

1. Responsible agencies under the provisions should publish the plan and regulate the Management according to this urban planning scheme within 30 days after signing the approval decision.

2. Based on urban planning schemes and management regulations according to approved urban planning schemes, the responsible authority should:

- Organize to prepare, appraise and approve the tasks, Benchmark establishment documents and implement the benchmark establishment as stipulated in Circular No.15/2010/TT-BXD dated 27/08/2010 of Ministry of Construction about the Regulation of Benchmark establishment and benchmark management according to urban planning and the provisions of the City People's Committee.- Organize to make the urban design (if not prepared in accordance with Circular 06/2013/TT-BXD dated 13/05/2013).

- Prepare the investment project for construction as prescribed (for the detailed plan of the investment project for construction of works).

3. In the process of implementation under planning, the current status of housing and land of organizations and individuals in the functional areas as planned within the project area are managed according to the current regulations and policy (about housing, land; construction investment - for detailed plan for management works).

Article 11.

People's Committee of District 9, The Employer of construction investment projects of Long Binh new urban area is responsible for coordinating with Department of Planning - Architecture and related departments to organize the implementation of this Management Regulations. In case the urban planning detailed plan (scale 1/500) is revised (partial or total), this Management Regulation will be revised accordingly. During implementation process, if there are any problems, disputes arising, organizations and individuals in the planning area should report to the Employer of Long Binh New urban area project, Peoples Committee of District 9 or Department of Planning Architecture for review, instruction or report to Peoples Committee of the City for solutions./.
