(b) Prepare and verifies summons, notices of hearings, noticesof order and decision, certification, endorsements,transmittals, letters and other communications.

(c) Computes/recomputes judgment awards.

4. Preparation andmanagement of caserecords

(a) Archive case records (settled/decided)

(b) Index cases, and attach minutes ofproceeding to the case records

(c) Paginate records as pleadings and orders received/issued;transmit records of appealed cases to the CommissionProper; and prepare table of contents of completeness ofrecords of appealed case for transmittal to the CA/SC.

5. Performance of other

functions

(a) Attend queries as to status of cases; supervise/assist in thesupervision of all the activities and output of the office; andperform other functions as may be assigned by the LaborArbiter, including research on jurisprudence and labor-lawsrelated.

(d) Proofread draft decisions/resolutions/orders.

4. Preparation andmanagement of caserecords

(a) Archive case records on appeal.

3. Sheriffs in the Regional Arbitration Branches (RABs) and CommissionProper:

(a) Serve writs of execution within three (3) days from receipt.

(b) Serve notice of garnishments upon banks, bondingcompanies and receivables of respondents, receive repliesfrom different banks and copy furnished pleadings fromparties.

(c) Serve notice of levy on personal and real properties.

(d) Serve & enforce order of reinstatement, break open orderor contempt order and request assistance from police ormilitary.

(e) Serve & implement order of release of garnished account.

2. Preparation & submissionof execution reports &related legal documents

(a) Prepare & submit monthly execution reports on IndividualReceived Writ (Sheriffs' Form 1); Individual AccomplishedWrit (Sheriffs' Form 2) and Temporary Deferment to theRIPD.

(b) Prepare & submit sheriffs progress report, return writ ofexecution, minutes of public auction, certificate of sale, bid

form, notice of garnishment, notice of levy and notice ofsheriffs sale.

(c) Posting and publication of required legal documents relatedto execution (e.g. notice of levy, notice of sheriffs sale,etc.)

3. Monitoring of the processand other incidental

proceedings related toexecution

(a) Conduct public auctions of levied properties, and complywith other incidental proceedings related to execution.

4. Performance of other

functions

(a) Follow-ups reply to notice of garnishment, ensurecompliance with the requirements of public auction, andremits/deposits judgment award.

III. PROCEDURES

a. Validating Committee

The PBB Committee will consolidate and validate all reports and Individual PerformanceCommitment Review (IPCR) submitted by the Commissioners, Labor Arbiters, and generaland administrative support staff. Other relevant documents such as but not limited toexisting Performance Evaluation System (PES) are also considered. Based on theconsolidated reports, the Committee will determine the performance of the each deliveryunits and individual performance of employees in accordance with the criteria set forth bythe Committee and the guidelines issued by the DBM and DOLE. After determination, thedelivery units and the individual employees will be forced rank in accordance with thedistribution of percentage under the PBB.

b. Documents Required

The following documents are required to determine the performance of the LaborArbiters and Commissioners: (1) Individual Performance Commitment Review (IPCR); (2)inventory of cases; (3) individual monthly received cases; (4) individual monthly disposedcases; (5) individual monthly ageing of cases; and (6) consolidated monthly report. For theGeneral and Administrative Support Staff: (1) Individual Performance Commitment Review(IPCR); and other supporting documents provided by the Human Resource DevelopmentServices (HRDS). Other relevant documents such as but not limited to existing PerformanceEvaluation System (PES) are also considered.

c. Reference Period

12-month period (January to December 2015).
