LEGISLATIVE UPDATEThe 109th General Assembly convened on January 13, 2015, and adjourned on April 22, 2015. Several bills impacting the Board and its registrants wereintroduced in the General Assembly this year. These bills included:

Senate Bill (SB) 0081/House Bill (HB) 0071, which amended Tennessee Code•Annotated, Title 62, Chapter 2, to authorize the Board to deny certaincertificates of registration to persons with felony convictions and to removecertain board notifications to governmental entities when revoking orsuspending certificates of registration. The bill also amends the engineeringstatutes to remove the requirement for engineer intern candidates to applyfor admission to the Fundamentals of Engineering (FE) examination, and todelete an obsolete provision regarding payment of a reexamination fee.This bill passed and became Public Chapter 291.

SB 0978/HB 0823, which increases, from $25,000 to $50,000, the threshold•for public works projects that require a registered architect, engineer, orlandscape architect in Tennessee Code Annotated § 62-2-107. This bill passedand became Public Chapter 403.

Proposed Rule 0120-02-.02•Proper Conduct of Practice isamended to delete gender-specific language and to statethat if a registrant becomesaware of a decision taken byan employer, client, orcontractor, against theregistrant’s advice, whichviolates applicable Federal,State or Local Laws,Regulations, and Codeswhich may affect adverselythe safety, health andwelfare of the public, theregistrant shall report thedecision to the authorityhaving jurisdiction chargedwith the enforcement of theapplicable Federal, State orLocal Laws, Regulations, andCodes. The current languageof the rule requiresreporting such decisions tolocal building inspectors orother public officials, whichrestricts its applicability to

registrants who designbuildings. Additionally,paragraph (6) of the rule,which addressesqualifications-basedselection, is amended toupdate a statutory citationand to clarify that aregistrant may not submitany information as part of aproposal for a public projectto the state or any of itspolitical subdivisions thatwould enable thegovernmental entity toevaluate the proposal on anybasis other than thecompetence andqualifications of theregistrant to provide theservices required. Thisreflects current law asprescribed at Tenn. CodeAnn. § 12-4-107(a).

However, Case Code: BC98-03 states that potable waterstorage heaters (hot water heaters) that do not exceed aheat input of 400,000 BTU/hr areexempt from the clearancerequirements of Rule 0800-3-3-.04(13)(a), provided the nameplate and code stamping isin view or as stated inRule 0800-3-3-.03(23).There is a minimumclearance of at least oneand one-half feet betweenall sides of the vessel unlessfurther permitted in Rule 0800-3-3-.04(13)(b) [requires a variance].

Commonly construction/renovation plans do not providefor the 18 inch inspection clearance required by thejurisdiction. Often improper alternative clearancessuggested in accordance with the manufacturer’srecommendations are used due to the absence of clearlystated jurisdictional requirements. Consequently,improperly installed items have to be relocated, as well asassociated piping and equipment, delaying construction andgreatly adding to project cost.

Compounding the problem is that some designs don’tprovide equipment areas large enough to accommodate theitems being installed or moved. Rooms are oftenovercrowded with other equipment that has also notproperly been accounted for. Further compounding theproblem are designs submitted from firms outside ofTennessee who are not familiar with these requirements.

JURISDICTIONALREQUIREMENTS FORBOILER AND WATERHEATER INSPECTIONCLEARANCES

The Boiler Unit of the Tennessee Department of Labor andWorkforce Development’s Workplace Regulations andCompliance Division has requested assistance from theBoard of Architectural and Engineering Examiners to shareinformation regarding the correct inspection clearance forthe placement of boilers and water heaters in newconstruction and buildings undergoing renovations wherethe boiler or water heater size or placement has changed.

The jurisdiction mandates that boilers and water heaters100,000 BTU/hr of heat input and above (including wall-mounted instantaneous water heaters) submit an“Application for Permission to Install” so that these itemscan be registered and inspected. Those units 200,000BTU/hr and above have the additional requirement of beingbuilt to the ASME Code of Construction, while those lessthan 100,000 BTU/hr are exempt from registration andinspection.

The inspection clearance required during installation setforth by both the National Board Inspection Code [NBIC2.3.3 Clearances] and the Tennessee Boiler Rules andRegulations [Rule 0800-3-3-.04(13) Clearance] is three feet.There are additional requirements for boilers placed in abattery or with top-opening manholes.

IDP STREAMLINE WENT INTO EFFECT JULY 1

On July 1, 2015, the National Council of Architectural Registration Boards (NCARB) streamlined the InternDevelopment Program (IDP) by no longer requiring elective hours. Effective July 1, the IDP requires 3,740 total

hours defined by the existing 17 experience areas. Tennessee’s laws and rules currently require a minimum of three(3) years of architectural experience and completion of IDP for registration as an architect (see Tenn. Code Ann. § 62-2-501 and Rule 0120-01-.11). Although the Tennessee Board will recognize applicants with 3,740 hours as havingcompleted the IDP requirement, additional experience may be necessary in order to meet Tennessee’s minimumexperience duration requirement. NCARB recommends that interns continue to report all experience. Doing so willhelp facilitate licensure and reciprocity in jurisdictions like Tennessee that require additional experience. ACCEPTS THIRTEEN SCHOOLS FOR “INTEGRATED PATH” TO LICENSURE

As part of its ongoing efforts to facilitate architecturallicensure, the National Council of ArchitecturalRegistration Boards (NCARB) has accepted proposals fromthirteen (13) architecture schools to implement anintegrated path to licensure within academic programsaccredited by the National Architectural AccreditingBoard (NAAB). This initiative will result in a morestructured experience for students enrolled in an NCARB-accepted path that offers the ability to complete therequirements for architectural licensure at the time ofgraduation. The NCARB Integrated Path initiative invitesprograms accredited by the NAAB to propose approachesthat would result in completing the requirements of theIntern Development Program (IDP) and the opportunityto take each division of the Architect RegistrationExamination® (ARE®) before graduation. Passing all AREdivisions prior to graduation is not required.

The acceptance of initial participants culminates a two-year effort of the Council’s Licensure Task Force (LTF) todesign an integrated path framework that promotesindividual academic program flexibility while addressingall regulatory requirements for architectural licensure.The LTF, composed of licensing board members, formerpresidents of related architectural organizations, recently

licensed architects and aspiring architects, deans andinstructors, and members of the public, reviewed existingprograms requiring experience as a pre-graduationrequisite and conducted a Request for Interest &Information and a formal Request for Proposals as part ofits deliberations.

NCARB has established a new Integrated Path EvaluationCommittee (IPEC) to oversee the ongoing work of thisinitiative. It is anticipated that the IPEC will continue tocoach accepted programs, promote engagement withjurisdictional licensing boards regarding necessary law orrule changes to incorporate integrated path candidates,and oversee the acceptance of future program applicants.

The first thirteen (13) accepted schools represent a widerange of accredited B.Arch and M.Arch programs in ninejurisdictions, and are split between public and privateinstitutions. Each program will implement the integratedpath according to the schedule developed with theiradministration and faculty. Starting dates may vary fromschool to school. Integrated path students in eachprogram will be part of existing accredited degreeprograms. A list of accepted programs is available on theNCARB website (www.ncarb.org).

The following issues were discussed at the NCARB AnnualMeetings in Philadelphia, Pennsylvania on June 18-22, 2014, and in New Orleans, Louisiana on June 17-20, 2015:

• Proposed BEA Changes: In 2014, annual meetingattendees received an overview of proposed changesto streamline the Broadly Experienced Architect(BEA) program. The BEA program allows applicantsto demonstrate their learning through experienceto meet the education requirements of the NCARBEducation Standard. A resolution was presented atthe 2015 Annual Meeting that would have amendedthe Certification Guidelines to discontinue the BEAProgram and replace it with alternative educationand experience requirements for certification. Theoriginal resolution would have required five (5)years of continuous licensure in any U.S. jurisdictionand documentation of work experience verified in

accordance with the requirements of the InternDevelopment Program (IDP). Applicants with a pre-professional degree in architecture would have beenrequired to document two times (2x) the experiencerequirement of IDP; all other applicants (includingthose without a college degree) would have beenrequired to document five times (5x) the experiencerequirement of IDP. An amendment passedrequiring applicants to hold a four (4) yearbaccalaureate degree, and requiring applicants witha degree in a field other than architecture todocument three times (3x) the experiencerequirement of IDP. However, the amendedresolution failed to obtain the absolute majority ofvotes required by the Bylaws and did not pass.NCARB will continue to engage its members on thisissue in order to reach a consensus view on the

The Tennessee Board of Architectural and Engineering Examiners continues to participate in meetings of the followingnational regulatory councils: the National Council of Architectural Registration Boards (NCARB), the National Council ofExaminers for Engineering and Surveying (NCEES), the Council of Landscape Architectural Registration Boards (CLARB),and the Council for Interior Design Qualification (CIDQ). The national councils assist member boards by developinguniform national examinations and model laws and regulations, among other responsibilities.

revised criteria for certification.

• BEFA Changes: In 2014, attendees also received anoverview of proposed changes to streamline theBroadly Experienced Foreign Architect (BEFA)program. Under the current BEFA program, foreignarchitects must have a recognized educationcredential and seven years of post-licensureexperience in their home country. They are alsorequired to submit an experience dossier andparticipate in an interview. A resolution passed atthe 2015 Annual Meeting to discontinue the currentBEFA program and amend the requirements forcertification of foreign architects to require foreignarchitects to record IDP experience and pass theArchitect Registration Examination (ARE) in orderto obtain an NCARB Certificate. This change willtake effect on July 1, 2016.

• IDP Changes: Proposed changes to the InternDevelopment Program (IDP) were also presented atthe 2014 Annual Meeting. The proposed changesincluded the removal of the elective hourrequirement (thus requiring 3,740 core hours) and amodification of the framework to reduce theexperience areas to 6 areas corresponding to the 6divisions of ARE 5.0. These changes were laterapproved by the NCARB Board of Directors (see the“NCARB Update” article in the 2014 newsletter andthe “IDP Streamline” article in this newsletter foradditional details).

Prior to the 2014 annual meeting, the Board ofDirectors approved a proposed change to allowinterns to earn partial IDP credit for valid workexperience not previously reported within the six-month timeframe specified by the reportingrequirement. This change became effective on July1, 2014.

At the 2015 Annual Meeting, delegates werepresented with an outline of a “BroadlyExperienced Intern” proposal that would provide anew experience path for professionals with validwork experience that falls outside the limits of theIntern Development Program (IDP). NCARB iscurrently seeking feedback from member boards tohelp shape a final proposal.

• Future Title Task Force: A Future Title Task Forcewas formed to review the terminology used forthose who are architect candidates and those whoare licensed architects. The task forcerecommended the sunsetting of the term “intern”while reserving the title “architect” for licensedpersons. NCARB has begun the process of removingthe term “intern” from program names andpublications.

• Bylaws Changes: A resolution passed in 2014amending the qualifications for serving as aregional director on the NCARB Board of Directorsin the Bylaws. Effective March 1, 2017, all regional

directors and officers must hold an active NCARBCertificate. Another resolution passed in 2015amending the Bylaws to allow public membersserving on member boards to serve as PublicDirector members on the NCARB Board of Directors.

The following issues were discussed at the NCEES AnnualMeetings in Seattle, Washington on August 20-23, 2014, and inWilliamsburg, Virginia on August 19-22, 2015:

• Decoupling of Experience and ExaminationRequirements: A motion passed at the 2014 AnnualMeeting to amend the Model Law to disconnect (ordecouple) the experience requirement from thetaking of the PE exam. This change would allowcandidates to sit for the PE exam before completingthe required experience.

• Continuing Education Registry: A motion passed in2014 to task NCEES with developing a continuingeducation registry that will allow registrants toupload, track, and maintain a record of continuingeducation activities.

• Additional Education Requirements for EngineeringLicensure: A position statement on futureengineering education requirements for licensureas a professional engineer was adopted at the 2015Annual Meeting (NCEES Position Statement 35). Thedevelopment of the position statement follows a2014 vote to remove from the NCEES Model Law andModel Rules the additional education requirementsfor engineering licensure that were set to take effectin 2020 in order to allow work on implementation tocontinue without a set effective date. Theserequirements called for an engineering licensurecandidate to obtain a master’s degree or itsequivalent before initial licensure.

• Expanding International Use of Exams: In 2014, theCouncil voted to authorize the negotiation of acontract for examinations and/or examinationservices between NCEES and the Chinese Instituteof Engineers (CIE) for offering the examinations inTaiwan. At the 2015 Annual Meeting, delegatesvoted to authorize the negotiation of a contract withthe Egyptian Engineering Syndicate to offer theFundamentals of Engineering exam in Egypt tograduates of the country’s engineering programs,regardless of whether they are accredited by theABET Engineering Accreditation Commission.

• Promoting the Surveying Profession: In 2015,member boards voted to fund two initiatives topromote surveying education and licensure. NCEESmember boards voted to fund a meeting ofsurveying organizations to discuss how to bestattract a diverse cross section of people to theprofession. The group will recommend additionaloutreach opportunities to promote surveying as acareer, including potential collaborations with

other organizations. Delegates also voted toimplement a new initiative to support surveyingeducation at the college level. The program willrecognize up to ten professional surveyingprograms of distinction each year, awarding each upto $10,000.

• Structural Engineering Licensure: A 2015 motioncalling for a committee or task force to be chargedwith amending the Model Law and Model Rules toprovide for a protected Structural Engineer title andrestricted structural engineering practice failed by anarrow margin (32-31).

The following issues were discussed at the CLARB Annual Meeting in Reston, Virginia on September 24-27, 2014:

• Member Board Executives (MBEs) discussed positiveregulatory public relations and communications,streamlining the licensure process, emerging trendsin regulation, and best practices. Following theexchange, MBEs met at CLARB headquarters andreceived information on Council Records, paths toCLARB certification, the Landscape ArchitectRegistration Examination (LARE) registration andexam process, and online resources for memberboards.

• A proposal to simplify CLARB’s Exam EligibilityStandard was presented. Under this proposal, examcandidates must either hold an accredited degree inlandscape architecture or be approved by a memberboard.

• Attendees participated in a discussion of howchanging demographics (a bigger, older, and morediverse population) will impact the future oflicensure and regulation.

• Critical Conversations addressed (1) proposedchanges to CLARB governance (e.g., adding a MBE tothe CLARB Board of Directors, adding an “at-large”member to the Board of Directors, changes to theNominations Committee, and either eliminating theAlternate Regional Director position or redefiningthe position), (2) a “Model Board” proposal toencourage strategic thinking among boards, and (3)LARE data and trends. It was revealed that mostexam candidates (89%) have an accredited degree inlandscape architecture, and most candidates waittwo or more years to start the LARE. Manycandidates are unaware that they can sit for theLARE immediately after graduation in mostjurisdictions (including Tennessee). Additionally,most candidates take only one exam section at atime. Section 4 (Grading, Drainage andConstruction Documentation) has the lowest passrate.

• Attendees participated in a mini-forum on thefuture of licensure, during which drivers and trendsin education, experience, and examination were

discussed. Member Board Members alsoparticipated in a full-day training programdelivered by the Council on Licensure andRegulation (CLEAR) designed to prepare regulatoryboard members for effective service.

The following issues were discussed at the CIDQ AnnualCouncil of Delegates Meeting in Albuquerque, New Mexico on November 14-15, 2014:

The theme for the meeting was “Forty andForward,” marking the 40th anniversary of theNational Council for Interior Design Qualification(NCIDQ) examination.

NCIDQ Examination Updates:•o The number of candidates sitting for the Interior

DesignFundamentals Exam (IDFX) and InteriorDesignProfessional Exam (IDPX) has increased,while the number of Practicum candidatesremains steady.

o Translation of the exam into French is underway.The first French exam will be offered in fall 2015.

o The Practicum exam will be computerized in 2017.Like the next version of the ARE (ARE 5.0), thecomputerized Practicum exam will include newitem types (e.g., “drag and drop” questions).

2014 Accomplishments: •o A practice analysis was conducted, and over 700

responses were received. The practice analysiswill be used to guide exam development. Over$10,000 was raised in the “Forty and Forward”campaign, which helped fund the practiceanalysis.

o Several technology improvements wereannounced, including changes to MyNCIDQ forexam candidates and certificate holders and newsoftware being used to ensure fair grading ofPracticum exams. All CIDQ data is now “cloud-based.”

o The first proposed revision would decrease thenumber of CIDQ Directors that must have servedas a member of a CIDQ member board.

Since the program began in 2002, theBoard has awarded over $2.9 million ingrant funds. Funding is providedannually from the Board’s revenues orreserve funds. The Tennessee GeneralAssembly and Governor Bill Haslamauthorized funding for the grants (2014Public Acts, Chapter 919, Section 7, Item26).

“The Board appreciates the opportunityto assist in the education of architecture,engineering, landscape architecture, andinterior design students,” said JohnCothron, Board Executive Director.“Education is the foundation fordeveloping the knowledge and skillsneeded to practice the design professionsand to protect the public’s health, safetyand welfare.”

Grant funds cover a range of usesincluding purchasing computers,laboratory or instructional equipment,library resources, or paying the costs ofintern development program fees orexamination fees for students inaccredited architectural, engineering,landscape architectural and interiordesign programs.

Universities receiving grant funds thisyear include:

• Christian Brothers University —$14,477 to the School of Engineering.Funds will be utilized to purchase ahorizontal band saw, materialstesting equipment, a glass digitaltemperature controller,microprocessor stations, andflowmeters.

• Lipscomb University — $13,501 to theCollege of Engineering. Funds will beutilized to pay Fundamentals ofEngineering (FE) examination feesfor students and to purchase 3D

printers, 3D digitizers, and aservomotor, which is used tointroduce students to basic controlconcepts. The FE exam is typically thefirst step in the process leading tolicensure as a Professional Engineer(PE), and may be taken by students inthe senior year of an engineeringcurriculum.

• Middle Tennessee State University, —$1,372 to the College of Behavioraland Health Sciences for the interiordesign program. Funds will beutilized to purchase LED light metersand reference materials.

• O’More College of Design—$1,342 tothe School of Interior Design. Fundswill be utilized to purchase aninteractive projector for a lectureroom.

• Tennessee State University—$18,867to the College of Engineering. Fundswill be utilized to purchase a solarconcepts learning system, a lightmeter, infrared thermometer kits,and desktop computers.

• Tennessee Technological University—$39,813 to the College of Engineering.Funds will be utilized to purchasevideo conferencing equipment tofacilitate distance educationpartnerships with other higher-education institutions in Tennessee.

• Union University—$12,306 to theDepartment of Engineering. Fundswill be utilized to pay FEexamination fees for students and topurchase a 3D printer.

• University of Memphis—$21,624 tothe College of Engineering; $22,798 tothe College of Communication andFine Arts for the architecture and

interior design programs. Funds willbe utilized to purchase a four-axismilling machine for the College ofEngineering, and enhancements toinstructional and presentation spacesfor the architecture and interior design programs.

• University of Tennessee-Chattanooga—$26,036 to the Collegeof Engineering and ComputerScience; $1,593 to the College ofHealth, Education and ProfessionalStudies for the interior designprogram. Funds will be utilized topurchase equipment and software formechanical engineering classes andlaboratories, and cameras withaccessories for the interior designprogram.

• University of Tennessee-Knoxville—$43,095 to the College of Architectureand Design; $42,973 to the College ofEngineering. Funds will be utilized topurchase a desktop scanning electronmicroscope for the College ofEngineering, and computer software,a plotter, and large LCD displays forthe College of Architecture andDesign.

REVISED POLICY FOR REVIEW OFSPRINKLER SHOPDRAWINGSThe following revised policywas adopted by the Board on June 4, 2015:

A fire protection sprinkler systemcontractor registered pursuant toTennessee Code Annotated, Title 62,Chapter 32, Part 1, through itsresponsible managing employee,shall submit shop drawings ofproposed fire protection sprinklersystem installations. After receipt ofthe shop drawings, the authorityhaving jurisdiction (AHJ) will reviewthe drawings and will approve ordisapprove the shop drawings.

This policy is not intended tocircumvent the requirement for plansprepared and sealed by registeredarchitects and/or engineers whereappropriate; rather, the policy isintended to allow the sprinklersystem contractor to submit shopdrawings to provide for theinstallation of the sprinkler systems.These drawings shall be coordinatedwith the architect or engineer ofrecord. The architect or engineer ofrecord shall always provide thedesign intent of the system and shallreview and approve or disapprove theshop drawings submitted by thesprinkler system contractor. Attachedand incorporated herein by referenceis a copy of the policy of theTennessee State Board ofArchitectural and EngineeringExaminers which sets forth thearchitect's or engineer's designresponsibilities concerning sprinklerdrawings. The goal is for the designdrawings to provide sufficientinformation to indicate compliancewith applicable building codes andensure that the builder or installingcontractor will not be required tomake engineering decisions. • Principles and Practice of Engineering (PE) and Structural Engineering Examinations —

The application deadline for newapplicants for the spring Principles andPractice of Engineering/StructuralEngineering exams is December 1. Thefall deadline is June 15. All supporting

documents (references, transcripts, etc.)are due in the Board office within thirty(30) days after the application deadline.The exams will be given in Nashville,Knoxville, and Memphis on:

To facilitate scheduling of the exams,retake requests should be received bythe Board office by February 1 for thespring exam and by August 15 for the fallexam. The exam isdivided into three sections: the Interior Design FundamentalsExam (IDFX), the Interior Design Professional Exam (IDPX),and a Practicum Exam (PRAC). To obtain an application forthe exam, call the Council for Interior Design Qualification(CIDQ) at 202-721-0220, or visit www.ncidqexam.org. Afterpassing the exam and becoming NCIDQ certified, you mayapply to the state board for registration as a registeredinterior designer.

Other Issues: •o The Board of Directors is studying new pathways

to NCIDQ Certification for educators andindividuals with degrees from accreditedarchitecture programs.

o Presentations were delivered on the importanceof interior design regulation, the impact ofinterior design on the public’s health, safety andwelfare, and legislative strategies.

o Several ideas and topics were discussed duringbreakout sessions, including:• The need for CIDQ to adopt and maintainmodel practice act language.• Increasing the value of CIDQ membership for member boards.• The unification of interior design professional societies.• The development of a white paper by CIDQ andthe interior design professional societies topromote practice acts.

Proposed Rule 0120-02-.07 Misconduct is amended•to delete gender-specific language, to add a newparagraph (6) stating that a registrant may notutilize the seal of another registrant without theother registrant’s knowledge or consent, and todelete language regarding failure to pay theprofessional privilege tax. Due to a change in thelaw, registrants who are delinquent paying theprofessional privilege tax now have their renewalsheld in abeyance without the need for a formalhearing and discipline by the Board.

A proposed rule (Rule 0120-01-.28 Military Applicants – Spouses– Expedited Registration) was filed with the Secretary of Stateon May 21, 2015, to provide for expedited issuance of licensesfor veterans and their spouses, waiver of renewal requirementsfor those on active duty, and the acceptance of militaryeducation, training or experience if substantially equivalent tostate standards, as required by 2013 Public Acts, Chapter 122.This rule took effect on August 19, 2015.
