SETTLEMENT AGREEMENT
In full and final settlement of Grievance IUEC-8 and all other grievances and issues related
to the manufacture, assembly and installation of Schindler's Model 3300 elevator, including but
not limited the following local union grievances: 8-120, 14-16, 19c34, 23-11, 25-105, 25-106, 25-
110,25-59,25-71,25-84, 25c87, 25-88, 25-90, 25-92, 25-95, 25-113, 27-9, 28-1, 28-37, 32-34,
33-57,33-68,33-72,33-84,33-88,35-33,35-35,38-12, 48-8,48-9,48-10,49-17,74-28,74-78,
85-1, 85-10, 85-11, 85-21, 85-23, 85-31,85-33, 85-40, 85-5, 85-9, 126-5, 140-10; along with any
and all other IDEC or local union grievances pertaining to the Model 3300 (referred to herein
collectively as the "Grievances"), the International Union of Elevator Constructors, for and on
behalf of its local Unions (the "Union''), and Schindler Elevator Corporation ("Schindler" or the
"Company) agree as follows.
Sections A through N below correspond to sections of Grievance lUEC-8:
A. "Overhead beam assembly". Schindler agrees those holes in the bedplate, mounting
structure, main and counterweight rails Where the machine/bedplate unit is to be pinned will be
located, drilled and pinned in the field by Elevator Constructors. The Union agrees all other holes
in the "overhead beam assembly" may be located and cut/drilled in the factory. In exchange,
Schindler will redesign the system to locate the drive on a wall-mounted bracket, which bracket
and the drive will be installed by Elevator Constructors in the field. All other issues are withdrawn.
B. Machine. Schindler will modify the extended wiring from the machine not to
exceed the length of a six foot pigtail. There will not be preinstailed plug connectors on this
extended wiring, with the exception of the two leads for the encOder connectorS (one twelve feet
long and one six feet long) whichmayhave preinstalled plug connectors. Completion of the wiring
and all connections from the machine to the controller/drive will be performed by Elevator
Constructors in the field .
C. Counterweight. Counterweight guide shoes may be shipped to the job site installed
but will be removed and reinstalled by Elevator Constructors in the field. The Union's claims with
respect to "sheaves installed in the factory" are withdrawn.
D. Dome. The raceway is a structural part of the car-top/domeand is not a violation.
The two guide shoes and ml)1mting plates in the dome will be shipped to the job site unattached
and will be installed by Elevator Constructors in the field. The nutserts used for attachment of the
cab wall supports, cab panels, transo~ guide shoes and guide shoe mounting plates may be
installed in the factory. Rear cab panel tabs will be shipped separately and installed in the field by
Elevator Constructors. The emergency exit switch will be shipped separately but with extended
wiring attached, to be installed in the field by Elevator Constructors who will complete the wiring
and all connections. The car control unit (referred to in Section D-6 of the Union's grievance as a
"controller") is installed in the field by Elevator Constructors, not in the factory as alleged in the
grievance. The car control unit is shipped without extended wiring.
E. SafetvPlank:. The Union's claims withrespectto "sheaves installed in the factory"
are withdrawn. The two guide shoes in the safety plank: will be shipped to the job site unattached
and will be installed by Elevator Constructors in the field. The load weighing switch will be
shipped separately to be installed by Elevator Constructors in the field; and the wiring with plug
connectors on each end will be connected in the field by Elevator Constructors. The S.O.S. switch
will be shipped separately for mounting by Elevator Constructors in the field, but may have
extended wiring pre-attached. Field employees will complete the wiring and all connections. The
travel cable bracket on the safety plank will be removed and reinstalled by Elevator Constructors
in the field. The platfonn braces will be installed by Elevator Constructors in the field.
F. Platfonn. There are no violations with respect to the issues asserted in the
grievances.
G. Combination Rail Brackets. Combination rail brackets may be assembled in the
factory but will be loosened and field adjusted by Elevator Constructors.
H. Rails and Fish Plates. There are no violations with respect to the issues asserted in
the grievances.
I. Governor Bracket. The Union agrees as part of this settlement to withdraw all
issues asserted in the grievances.
J. Dead and Hitch plate. Schindler will ship the slack cable switch not mounted, to
be mounted by Elevator Constructors in the field. The slack cable switch will be shipped without
extended wiring already attached. The Union agrees as part of this settlement to withdraw all other
issues.
K. Governor. The governor will be shipped with an attached pigtail (approx. three
feet long). Pigtail wires will terminate in an adjacent J-box mounted approximately three feet from
the governor to be Installed in the field by Elevator Constructors who will complete the wiring and
all connections.
L. Governor Tail Sheave. The governor tail sheave.switch will be shipped unattached,
with an attached pigtail (pigtail wires will tenninate in a J-box at or near the location of the pit
light switch and mounted in the hoistway) to be installed in the field by Elevator Constructors who
will complete the wiring and all connections.
M. Hoistwav Entrances. The spring closer for "T2" doors may be shipped attached but
will be detached and reattached by Elevator Constructors in the field. The spring closer for "C2"
doors will be shipped separately and will be installed by Elevator Constructors in the field.
Regarding the Union's claim of "door lock contacts with extended wiring installed in the factory,"
the parties agree as follows: The brand of door locks come with extended wiring. The extended
wiring will be removed and replaced in the field by Elevator Constructors. Regarding the Union's
claim "nutserts for attachment of fixtures installed in the factory," the parties agree as follows: The
Company will discontinue the use of nutserts and utilize J-cJips instead, which will be installed in
the field by Elevator Constructors. The Union withdraws its claim with respect to ''raceway in
door buck installed in factory."
N. Hatch door Equipment. The spring closer for "T2" doors may be shipped attached
but will be detached and reattached by Elevator Constructors in the field. The spring closer for
"C2" doors will be shipped separately and will be installed by Elevator Constructors in the field.
The interlock assembly is shipped unattached and attached to the door hanger by Elevator
Constructors in the field. There is no violation with respect to "nutserts for the attachment of door
hangers."
Note: Where the Agreement recites that components may be shipped with extended wiring (Sections B, D, E, J, K, and M), if Schindler's specifications for completing "the wiring and connections call for the use of conduit (for example, to meet code requirements In some jurisdictions), the work of installing the conduit and fittings will be performed by" Elevator Constructors in the field. This Settlement Agreement does not create any requirement to use conduit and fittings; and it is understood that conduit and fittings may not be specified or required in some jnrisdictions.
All remaining claims (including but not limited to those asserted in Grievance IDEC-8, a copy of which is attached to this Settlement and all related grievances) are withdrawn. '{be parties agree that all issues related to Schlndler's Model 3300 Elevators which are in existence as of this date are fully and finally resolved. Should Schindler redesign any or all fixtnres, components or related devices, the Union reserves the right to grieve the redesigned fixture, component or related device. This Agreement does not constitute an admission that either party has or has not violated the collective bargaining agreement This Settlement Agreement is made without prejudice or precedent and shall not be cited or be of evidentiary value in any other matter with exceptiOIt of a dispute mvolving compliance with the ternlS of this Settlement Agreement
