Criminal Procedure Amendment Rules 2013

Made by the Judges of the Supreme Court.

1. Citation

These rules are the Criminal Procedure Amendment Rules 2013.

2. Commencement

These rules come into operation as follows —

(a) rules 1 and 2 — on the day on which these rules are

published in the Gazette (gazettal day);

(b) the rest of the rules — on the day after gazettal day.

3. Rules amended

These rules amend the Criminal Procedure Rules 2005.

4. Part 2A inserted

After rule 4 insert:

Part 2A — Registrars’ jurisdiction

Division 1 — Delegation to registrars

5A. Delegation to registrars

(1) In this rule —

legally qualified registrar means a registrar who is an

Australian lawyer as defined in the Legal Profession

Act 2008 section 4.

(2) Each legally qualified registrar of the court is delegated

the jurisdiction the court has, including under any other

written law, other than the following jurisdiction —

(a) to find a person guilty or not guilty of an

offence;

(b) to discharge an accused from a charge;

(c) to consent to the discontinuance of a charge in a

case where the accused does not consent to the

discontinuance;

(d) to stay a prosecution;

(e) to set aside a committal;

(f) to find a person guilty of contempt of the court.

5B. Registrar may refer matter to judge

(1) A registrar exercising jurisdiction delegated under

rule 5A may refer any proceedings before him or her to

a judge who may deal with the proceedings or refer

them back with or without directions.

(2) Pending the determination of the proceedings the

registrar may make an interim order.

Division 2 — Appeal from decision of registrar

5C. Appeal from decision of registrar

(1) An appeal from a decision made by a registrar

exercising jurisdiction delegated under rule 5A must be

commenced by filing and serving a notice that —

(a) sets out the particulars of the registrar’s

decision or that part of it to which the appeal

relates; and

(b) sets out the final orders that it is proposed the

court should make on the appeal.

(2) The appeal does not operate as a stay of proceeding

unless a judge orders otherwise.

Made by the judges of the Supreme Court.

1. Citation

These rules are the Supreme Court Amendment Rules

(No. 2) 2013.

2. Commencement

These rules come into operation as follows —

Order 81D — Arbitration law rules

1. Terms used

In this Order —

arbitration law means —

(a) the International Arbitration Act 1974

(Commonwealth);

(b) the Commercial Arbitration Act 2012;

(c) subsidiary legislation in force under any of the

above laws;

arbitrator means a person who, under whatever title,

conducts arbitration proceedings under an arbitration

law.

2. Application of this Order

This Order applies to proceedings that can be or are

commenced in the Court under an arbitration law in

relation to arbitration provided for by such a law or

provided under such a law.

3. Court documents, headings on

The heading of every document filed in proceedings to

which this Order applies must include the title of the

arbitration law under which the proceedings are being

conducted.

4. Commencing proceedings

(1) To commence proceedings to which this Order applies

in the Court, a person must file —

(a) an originating summons; and

5. Subpoena to appear etc. before arbitrator

If, under an arbitration law, the Court issues a

subpoena requiring a person —

(a) to appear before an arbitrator; or

(b) to produce any thing to an arbitrator; or

(c) to do both of those,

Order 36B, with any necessary changes, applies to and

in relation to the subpoena.

6. Taking evidence for arbitrator

If, under an arbitration law, the Court agrees to a

request for assistance in taking evidence, Order 38,

with any necessary changes, applies to and in relation

to executing the request.

7. Costs of arbitration, assessing

Order 66, with any necessary changes, applies if the

Court is required to assess the costs of an arbitration

(other than the fees or expenses of an arbitrator).

6. Schedule 2 amended

In Schedule 2 delete Forms 105, 106 and 107.

MINDARIE REGIONAL COUNCIL

Waste Facility Site Amendment Local Law 2013

Under the powers conferred by the Local Government Act 1995 and under all other powers enabling it, the Mindarie Regional Council resolved on 7 March, 2013 to make the following local law.

1. Citation

This local law may be cited as the Mindarie Regional Council Waste Facility Site Amendment Local Law 2013.

2. Commencement

This local law will come into operation 14 days after the day on which it is published in the Government Gazette.

3. Principal Local Law Amended

The Mindarie Regional Council Waste Facility Site Local Law 2012, as

published in the Government Gazette on 11 May 2012, is referred to as the principal local law. The principal local law is amended.

4. Clause 16 amended

In Clause 16 delete subclause (1) and renumber the remaining subclauses accordingly.

5. Clause 18 amended

Clause 18 is amended as follows—

(a) in Clause 18 delete “(1)” at the start of the paragraph; and

(b) in Clause 18 insert “or” after the semi colon at the end of subparagraph (b).

6. Clause 22 amended

In Clause 22 after “on the site” insert “.”.

7. Clause 23 amended

Clause 23 is amended as follows—

(a) in subclause (1) delete “camping” and insert “camp”; and

(b) in subclause (2) after “on the site” insert “without”.

Shire of Harvey

FIRE BREAK ORDER 2012/2013

All landowners within the Shire of Harvey are reminded of their responsibility to manage their property to reduce the risk of bush fire. With reference to Section 33 of the Bush Fires Act 1954, all landowners are required to carry out fire prevention work on land owned or occupied, in accordance with the provisions of this order.

Work must be completed by the 30th November, 2012, and maintained until 26th April, 2013.

A. RURAL LAND/SPECIAL RURAL LAND

Firebreaks not less than 3 metres wide must be provided in the following positions—

(a) within 10 metres inside and along all boundaries of all land.

(b) so as to divide the land into areas of not more than 120 ha (300 acres).

(c) around all groups of buildings, haystacks (includes two or more round bales placed in a paddock for storage purposes) and fuel installations but not closer than 6 metres.

(d) Irrigation Areas— Owners or occupiers may be exempted from all or part of the requirements of the above. Contact Council’s Law and Safety Services.

B. URBAN LAND/SPECIAL RESIDENTIAL

(Residential, Commercial and Industrial land within a townsite or any other area subdivided for residential purposes)

(a) where the area of land is 2,024m2 (approx. ½ acre) or less, remove all flammable material on the land except live standing trees, shrubs and plants, from the whole of the land;

(b) where the area of land exceeds 2,024m2 (approx. ½ acre) provide firebreaks of at least 2 metres wide and within 6 metres of the inside of all external boundaries of the land, cleared hardstand areas and reticulated grassed areas maintained in a green state maybe considered acceptable as an adequate fire break.

Note: Myalup and Binningup—The following are accepted in lieu of item (a) of the above requirements. Firebreaks 2 metres wide inside and around all boundaries of land are accepted in lieu of item (a) of the above requirements—

1. Firebreaks 2 metres wide inside and around all boundaries of land.

2. Slashing of the entire block to remove flammable materials.

3. Removal of isolated fire flammable materials on the block.

FIRE BREAK DEFINITION

Firebreak means an area of land which must be maintained totally clear of all flammable material (living or dead) and any overhanging trees or other vegetation (up to a height of four (4) metres from ground level at any point) for the whole of the compliance period 1st December to 26th April.

IRRIGATION LAND DEFINITION

Irrigation land is defined as land that is watered, kept fully watered and is maintained in a non flammable state for the whole of the restricted and prohibited burning periods.

BURNING OF GARDEN REFUSE

Burning of garden refuse is not permitted within the prohibited burning period.

They then run along a dirt track which follows the railway line and turns into Main Street East as it approaches Cunderdin. Runners then turn left into Eaton Road/Carter Drive and then right into Lundy Avenue to the finish line which will be located on Lundy Avenue near the Cunderdin swimming pool. There is also a shorter 5km event with a start line on the dirt track parallel to the east end of Main Street East, where runners continue down Main Street East, past the start of the 1km event which commences on Main Street East, approximately 300m east of the intersection of Cubbine Road and Main Street East in Cunderdin. The participants will run west along Main Street East and right into Cubbine Street left into Lundy Avenue and then run down Lundy Avenue to the fnish line which will be located on Lundy Avenue near the Cunderdin swimming pool, in the Shire of Cunderdin.
