    On November 15, 2012, the Commission conducted a duly noticed public hearing at a regularly

    scheduledmeetingonConditionalUseApplicationNo.2012.0853CV.

    TheProjectisexemptfromtheCaliforniaEnvironmentalQualityAct(CEQA)asaClass1categorical

    exemptionunderCEQA.

    TheCommissionhasheardandconsidered the testimonypresentedto itat thepublichearingandhas

    furtherconsideredwrittenmaterialsandoraltestimonypresentedonbehalfoftheapplicant,Department

    staff,andotherinterestedparties.

    MOVED, that the Commission hereby authorizes theConditionalUse requested inApplicationNo.

    2012.0853CV,subjecttotheconditionscontainedinEXHIBITAofthismotion,basedonthefollowing

    findings:

    Having reviewed thematerials identified in thepreambleabove, andhavingheard all testimonyand

    arguments,thisCommissionfinds,concludes,anddeterminesasfollows:

    4. ProjectDescription. Theproject sponsor seeksaConditionalUseAuthorization,pursuant to

    PlanningCodeSections209.3(f)and303forachangeofusetoestablishachildcarefacility(d.b.a.GrowingTreeChildCare)providinglessthan24hourcarefor15ormorechildrenattheproject

    site. Theproposedchildcarefacilitywouldoccupytheexistingtwostorybuildinganddoesnot

    involveanyexterioralterations. Theprojectsitealsohasapproximately1,300squarefeetofopen

    spaceat the frontof the lotwhichwillbeutilizedasasupervisedplayarea forchildren. The

    proposed facilitywould operateMonday through Friday from 7:30AM to 5:30 PM, serving

    childrenup to five years old, andwillbe operatedby a staff of sixtoeight employees. The

    projectsponsorexpectstheproposedfacilitytoprovidecareforupto60childrenthroughoutthe

    day.Aspartoftheoperationofthechildcarefacility,theprojectsponsorintendstoapplyfora

    passenger loading and unloading white zone curb along GreatHighway, at the front the

    subjectproperty. Theproject sponsorwillalsobe required toobtainaState issued license to

    operatetheproposedchildcare facilityandadheretotheChildCareCenterGeneralLicensing

    RequirementsoftheStateofCalifornia.

    5. PublicComment. Todate theDepartmenthasreceived twowrittencorrespondencesandone

    phone call from neighbors citing concernswith onstreet parkingdemands, traffic, and noise

    generatedbytheproject.

    6. Planning Code Compliance: The Commission finds that the Project is consistentwith the

    relevantprovisionsofthePlanningCodeinthefollowingmanner:

    A Institutions Child Care Facility Planning Code Section 209 3(f) requires Conditional Use

    7. PlanningCodeSection303establishescriteria for thePlanningCommission toconsiderwhen

    reviewingapplicationsforConditionalUseapproval. Onbalance,theprojectdoescomplywith

    saidcriteriainthat:

    A. The proposed new uses andbuilding, at the size and intensity contemplated and at the

    proposedlocation,willprovideadevelopmentthatisnecessaryordesirable,andcompatible

    with,theneighborhoodorthecommunity.

    Theproject iscompatiblewith thesurroundingneighborhoodas theproposedchildcarefacilitywill

    notphysically expandoralter thesubjectbuildingpreviouslyoccupiedbyachurch. Therefore, the

    projectwillnotcreateanyphysicalimpactsuponlight,airormidblockopenspace. Additionally,the

    useisdesirableasitwillprovideavitalservicefortheresidentsoftheneighborhood.

    B. Theproposedprojectwillnotbedetrimental to thehealth, safety, convenienceorgeneral

    welfareofpersonsresidingorworking in thevicinity. Therearenofeaturesoftheproject

    thatcouldbedetrimental to thehealth,safetyorconvenienceof thoseresidingorworking

    thearea,

    in

    that:

    i. Natureofproposedsite,includingitssizeandshape,andtheproposedsize,shapeand

    arrangementofstructures;

    Theprojectisnotdetrimentaltotheareasinceitdoesnotinvolveanyphysicalexpansiontothe

    C. That theuseasproposedwillcomplywith theapplicableprovisionsof thePlanningCode

    Theproject complies with all relevant requirements and standards of the Planning Code and is

    consistentwithobjectivesandpoliciesoftheGeneralPlanasdetailedbelow.

    8. General Plan Compliance. The Project is consistentwith theObjectives and Policies of the

    Due to thenature of theproject there arenoanticipated adverse effectsuponMUNI serviceoron

    E. Thatadiverseeconomicbasebemaintainedbyprotectingourindustrialandservicesectors

    fromdisplacementduetocommercialofficedevelopment,andthatfutureopportunitiesfor

    residentemploymentandownershipinthesesectorsbeenhanced.

    Approval of thisprojectwillnotadverselyaffectany industrialor service sectorjobs rather itwill

    createnewservicesectoremploymentopportunitiesforworkersofthatsector.

    F. ThattheCityachievethegreatestpossiblepreparednesstoprotectagainstinjuryandlossof

    lifeinanearthquake.

    Theprojectwillnot impact thesubjectpropertysability towithstandanearthquakeandall tenant

    PERFORMANCE

    1. ValidityandExpiration. Theauthorizationandrightvestedbyvirtueofthisactionisvalidforthree

    years from the effectivedateof theMotion. Abuildingpermit from theDepartmentofBuilding

    Inspection to construct the project and/or commence the approved use must be issued as this

    Conditional Use authorization is only an approval of the proposed project and conveys no

    independent right to construct the project or to commence the approved use. The PlanningCommissionmay, inapublichearing,consider therevocationof theapprovalsgranted ifasiteor

    buildingpermithasnotbeenobtainedwithinthree(3)yearsofthedateoftheMotionapprovingthe

    Project. Once a siteorbuildingpermithasbeen issued, constructionmust commencewithin the

    timeframe required by the Department of Building Inspection and be continued diligently to
