Peterborough Garden Show Rules - 2018

1. By signing this Exhibitors’ Agreement (the “Agreement”) you are agreeing to abide by rules set up by the Show Management and the Rules as set out herein.

2. “Show Management” means the Peterborough Horticultural Society and its members, the Peterborough Master Gardeners, the Show Coordinator, The Corporation of the City of Peterborough and their respective officers, directors, members, employees, and managers.

3. This application is a binding contract only if the required deposit is paid in full and the post-dated cheques as required in the Agreement are received within the time prescribed, failing which this contract is null and void and the booth space may be reassigned without further notice to you.

4. You understand and agree that your occupation and use of the Exhibitor Booth and the Evinrude Centre (the “Facilities”) is at your own risk and you agree to forever discharge, waive, release and to indemnify and hold harmless, the Show Management, (including their respective officers, directors, employees, contractors, and subcontractors) from any and all claims, demands, injuries, damages, actions, or courses of action, for all acts of active or passive negligence on the part of the Show Management on account of physical injury, mental anguish, death, and/or property damage arising from any mishap, accident, loss, damage, or injury suffered by the Exhibitor, its employees, officers, directors, owners, guests or invitees or others resulting from, connected with or caused by my/our use of the Exhibitor’s Booth or the Evinrude Centre, including, but not limited to any injury resulting from mechanical defects, any failure of any equipment or devices used in such Facilities, theft, vandalism, and damage to property. Show Management is not responsible for the security of your Exhibit Booth or its contents.

5. You must obtain and maintain liability insurance of not less than $1,000,000 for the duration of your use and occupation of the Exhibitor’s Booth. You are required to submit your insurance certificate along with your 2018 Peterborough Garden Show application upon registration in order to deem your application valid and accepted. Your insurance coverage must comply with the following: a. Your insurance certificate must reflect a minimum of $1,000,000 in liability coverage; b. your insurance certificate must include the Peterborough Horticultural Society named as an additional insured; c. your coverage must include the show dates, in addition to the dates that you set up and tear down your booth; and, d. you must have a copy of your certificate with you at your booth for the full duration of the show, including set-up and tear-down.

6. Your exhibit, including all products and services, must be garden related, in accordance with Show Management. No barbeque's or hot-tubs are permitted. Lawn and patio furniture are at the discretion of the Show Management.

7. You agree not to block access of the public, Show Management, other vendors with or without vehicles, carts, volunteers and/or staff members without the prior consent of Show Management.

8. Your exhibit must stay within the boundaries of your Exhibitor Booth and you cannot fasten anything to the floor or damage the Evinrude Centre Facilities in any way. Exhibitors will be liable for damage to the building. If the space remains unoccupied by 3:00pm on the opening day, Show Management reserves the right to reassign your booth(s).

9. Your exhibit must comply with all municipal, provincial, and federal laws, including building codes, municipal by-laws, electrical codes, fire code regulations, and environmental laws and regulations. The Evinrude Centre prohibits the use of any open flame anywhere in the building.

10. Show Management specifically reserves the right to terminate this Agreement immediately and without refund or compensation to you if your behaviour or that of your employees, staff, volunteers, guests, or invitees creates a disturbance, nuisance, or interferes with the use or enjoyment of other exhibitors, the Show Management or the guests or invitees of the Peterborough Garden Show. The use of a mic or P/A system is strictly prohibited.

11. In approving your application, you understand and agree that the Show Management is approving the type and nature of your product and, by signing this application, you are agreeing to sell the product as represented to the Show Management and that neither you, nor anyone connected to you, may sell any other products, from your Exhibitor’s Booth or anywhere else in the Facilities, unless previously approved by the Show Management.

12. As an Exhibitor you understand and agree that you are not permitted to share your booth with, or bring in another company, organization and/or business without the advance knowledge and written approval of the Show Management.

13. You agree that your Exhibit may only be set up and taken down during dates and times set out below in rule number 14. and, further, that your booth will be staffed, by your staff or your volunteers(s), at all times during the Peterborough Garden Show hours of operation.

14. The following outlines set up, tear down and hours of show operations:

15. Returning vendors will be offered the same Exhibitor’s Booth as they had in the previous year until August 31, 2017,

unless, at the sole discretion of the Show Management, the layout needs to be changed. You agree that failure to confirm your space on or before August 31, 2017, by way of application submission with your deposit and two post-dated cheques, means that the Exhibitor Booth may be released to other exhibitors.

16. After August 31, 2017, the booths will be assigned at the sole discretion of the Show Management, but the Show Management will use its best efforts to take into account your expressed preferences for an Exhibitor Booth in a new location. You agree that you will not set up your booth in any location other than that assigned to you.

17. You agree that you will not remove unsold stock during the hours of operation and will not disrupt the show by restocking during hours of operation.

18. Volunteers are available to cover for you at your booth for the purpose of a lunch break, bathroom break, or other show vendor related matter for a maximum of 20 minutes. Situations that may require a longer time frame must be approved by Show Management in advance. Emergencies are excluded.

19. Booth drapes are provided. You understand and agree that you are not permitted to remove them and that you are responsible for any damage to them caused by you or your employees, staff, and/or volunteers. You are not permitted to cut, tear, puncture, staple, or apply adhesive to any draping. Tie wraps are prohibited for use with drapes.

20. You agree to remove all of your belongings from the Evinrude Centre by noon on the Monday following the show, leaving your booth(s) in the same condition as at your arrival, after which time you will be charged for any costs of removal and/or clean-up.

21. You understand and agree that Exhibitors are prohibited from selling food of any kind unless the Show Management gives approval in advance.

22. You understand and agree that there will be no alcohol or illegal drugs allowed on the premises, and we reserve the right to remove anyone who is intoxicated, impaired, or disruptive.

23. You understand and agree that Exhibitors must not park in the fire routes around the building or block any entrance. Vehicles in these areas will be subject to ticketing and removal without notice to the owner.

24. There is Exhibitor parking at the rear of the Evinrude and you understand and agree that you are not allowed to park in the front lot of the Evinrude.

25. A $100.00 non-refundable deposit is required on signing this Agreement. Post-dated cheques dated November 15, 2017 and January 15, 2018, each for 50% of the balance, must accompany this Agreement. No refund will be issued for any monies if the Exhibitor cancels after January 15, 2018.

We are excited to invite you to the Peterborough Garden Show 2018 and we’d like to make sure that your application is not held back. Please find below a check list of items that will ensure that your application is processed promptly without unnecessary delays due to missing information or incorrect payment. NOTED POINTS BELOW APPLY TO ALL VENDORS - PLEASE READ THROUGH AND CHECK ALL POINTS - Thank you!

INSURANCE: It is a requirement that all of our vendors have proper insurance coverage for the duration of their time at our show – set-up and tear-down included. We ask that your insurance certificate be submitted along with your application. If you have any concerns about obtaining insurance, please contact your own home/personal insurance provider, or you can purchase short term insurance at www.palcanada.com, which is reasonably priced. Alternatively, PHS insurance coverage may be available to you. For more information, or if you have any questions please feel free to call Sandy at either of the phone numbers noted above. Your insurance coverage must comply with the following:

a. Your insurance certificate must reflect a minimum of $1,000,000 in liability coverage; b. your insurance certificate must include the Peterborough Horticultural Society named as an additional insured; c. your coverage must include the dates that you set up and tear down your booth; and, d. you must have a copy of your certificate with you at your booth for the full duration of the show, including set-up and tear-down.

We understand that it is not always possible to receive insurance coverage months before the show. If this is the case, please send in your application, and note that your insurance will follow by checking the box on pg 1. PAYMENT CALCULATION: If you are applying after the early bird payment date of August 31, 2017, please calculate your booth fee according to the increased payment amount as posted on the application form; HST: Include 13% HST when calculating your total payment; CHEQUE PAYEE: Make cheques payable to the Peterborough Horticultural Society; DEPOSIT: Include a cheque in the amount of $100.00 - which is part of the total payment amount - as a deposit to hold your booth(s); BALANCE: Divide the balance due into two equal payments and submit with post-dated cheques dated November 15, 2017, and January 15, 2018; TABLE & CHAIR RENTALS: Please indicate whether or not you will need to rent any tables or chairs. If you do not require table and chair rentals please check the box titled “No thanks” so that there is no misunderstanding of your rental requirements. Please note that table rentals are $15 and chairs are $2 – you are welcome to bring your own tables/chairs if you wish. If you choose to rent, the rentals are directly from the Evinrude Centre - please do not enclose your payment for tables and chair rentals with your application – payment for table and chair rentals will be made during the set-up times at the show. IMPORTANT - we cannot guarantee the availability of tables and chairs; FLYERS: Indicate whether or not you will need flyers to distribute to customers, family and/or friends, and if so, please note what month works best for you to receive the flyers; SIGNATURE: Please be sure to sign and date the application on page 1; COPY: Make a copy of the completed application for yourself and mail the complete original copy to our office with your original signature. If you email your application initially, please send the original in the mail. This application is a contract; EMAIL: Please note that your application will not be considered formally registered until we receive the original copy of your application along with the deposit and post-dated cheques; and, MAKE SURE WE CAN CONTACT YOU: Include your e-mail address in the application as this will be the primary method of contact between you and the show co-ordinator to keep you up to date with preparations during the months, weeks, and days leading up to the show.
