The American Bankruptcy Institute marked its 30th anniversary in service to
insolvency professionals during 2012 with a record number of programs, events and new features for our 13,000 members. This 14-month calendar
highlights some of these products so that members can maximize ABI’s benefits and plan to attend some of our many live conferences and programs.
New monthly “DISCOVER ABI” Webinars aimed at new and young members raise awareness of what ABI has to offer every practitioner; see the
calendar for these dates. On a policy level, of particular note and new this year is ABI’s Commission to Study the Reform of Chapter 11, an ambitious
two-year project to comprehensively assess how the law can be reformed to better effectuate success in corporate restructuring. As always, on behalf
of our volunteer leaders, we encourage all members to get involved in ABI.

The Single Asset Real Estate Case: Basic
Principles and Strategies explores the key issues
that arise in most commercial real estate cases, including
the highly complex issues surrounding the use of cash
collateral and how various courts have analyzed continuing
problems in rent assignments, as well as the application of
adequate-protection payments.
Burgeoning business ties between the United States
and Canada have created a need to develop a
better understanding of the Canadian legal system.
Insolvency Law in Canada: A Primer for Practitioners:
describes the complementary and sometimes competing
and conflicting pieces of legislation, both federal and
provincial, that have developed and evolved over the
course of the last century.
First Day Motions: A Guide to the Critical First Days of
a Bankruptcy Case, Third Edition provides practitioners
with a detailed look at the most common first-day motions
and relevant sections of the Bankruptcy Code. The book
includes a companion CD-Rom containing more than
4,400 pages of examples of filed motions and entered
orders from actual cases.
Bankruptcy Issues for State Trial Court Judges,
Fourth Edition was created through a grant from the
National Conference of Bankruptcy Judges to help state
trial court judges resolve the conflicts that arise between
bankruptcy law and family law, criminal restitution,
jurisdiction and many other issues important to federal/
state judicial relations.
The ABI Health Care Insolvency Manual, Third Edition
includes updates reflecting the U.S. Supreme Court’s
decision on key components of the PPACA, but also
details the many challenges confronting the health care
system, which has been reeling from a rising number of
bankruptcies. Mergers and acquisitions in the field have also
increased by more than 300 percent in the years between
2008 and 2010, a trend that is expected to continue over
the next several years.

The U.S. oil and gas industry is especially vulnerable to the effects of myriad internal and external factors,
ranging from global credit markets to domestic and foreign geopolitical events, and from technological
developments and limitations to population growth and even the weather. These factors contributed to
a dramatic increase in restructurings and bankruptcy filings. Bankruptcy cases involving exploration and
production companies raise unique issues, resulting from the interplay among the Bankruptcy Code,
federal and state laws, the regulatory structure governing the energy industry, and the political and
practical realities of the industry’s significance. When Gushers Go Dry: The Essentials of Oil and
Gas Bankruptcy provides a better understanding of what happens when an oil, gas or other natural
resources company goes bankrupt.
ABI offers more than 40 current publications covering commercial and consumer bankruptcy.
ABI titles are available on the newly redesigned online bookstore and through Westlaw®;
they can also be ordered on Amazon.com. Many are now available as e-books for the iPad®,
Kindle® and Nook®. New titles this year included:

The ABI Journal is the flagship publication of the American Bankruptcy Institute. Now
published each month in both print and digital formats, the Journal covers the entire range
of insolvency issues, featuring timely articles written by some of the most knowledgeable
professionals in the field.
The Journal launched a bold new look beginning with the April 2012 issue.
The American Bankruptcy Institute Law Review is the nation’s largest-circulation
bankruptcy law journal, with more than 5,000 subscribers. Top students at St. John’s
University School of Law compile and edit it twice a year, and Thomson West publishes it.
An advisory board of bankruptcy judges, scholars and practitioners helps plan theme issues.
Profs. G. Ray Warner and Keith Sharfman of St. John’s University School of Law serve as the
board chairs and faculty advisors.
The Spring 2012 issue included the final report of the
Consumer Fee Study, an article on bankruptcy and
divorce issues in same-sex unions and a separate essay
on “no look” attorneys’ fees in chapter 13.
The Winter 2011 issue included an essay on “Dodd-
Frank for Bankruptcy Lawyers,” awarded the annual
Judge Wes Steen Prize as the top article in 2011, and
featured a special section on the intersection of religion
and bankruptcy.

Judge Wes Steen Prize as the top article in 2011, and
featured a special section on the intersection of religion
and bankruptcy.

provisions that will better balance the goals of effectuating the effective reorganization of
business debtors—with the attendant preservation and expansion of jobs—and the
maximization and realization of asset values for all creditors and stakeholders.

This year, personal bankruptcies are on track to exceed 1.2 million new cases. Bankruptcy
filings have exceeded 1 million each year since 2008.
Consumer bankruptcy education and research has always been an ABI priority. That’s
why we’ve dedicated an entire section of our website to consumer bankruptcy news and
information. ABI helps practitioners meet today’s challenges head-on.
Optimized Consumer Focus
ABI has gathered all of its consumer bankruptcy resources and placed them into one concise
location, “The Consumer Bankruptcy Center.” The Consumer Bankruptcy Center has two
main sections: one for the consumer and the other for the consumer bankruptcy professional.
Consumers seeking information about the bankruptcy process or looking for a bankruptcy
attorney can visit the “For Consumers” section for links to valuable information. Consumer
bankruptcy professionals should visit the “For Consumer Professionals” section for a wealth of
resources for practice assistance. Some of this information is only available to ABI members.
Bankruptcy Pro Bono Resource Locator
During this era of rising household debt, foreclosures and personal bankruptcies, ABI provides a
valuable new feature on the ABIWorld website: the first interactive, national locator for consumers
needing pro bono bankruptcy services. The website lists more than 600 providers nationally.

Board Certification
The American Board of Certification (ABC) is the nation’s premier legal specialty certification
organization, certifying attorneys as specialists in business bankruptcy, consumer bankruptcy
and creditors’ rights law. The ABC serves the public interest by allowing potential clients
to make an informed decision in selecting bankruptcy and creditors’ rights counsel. ABC
certification encourages attorneys to strive toward excellence and recognizes those attorneys
who have met the ABC’s rigorous standards. The ABC is sponsored by ABI and the Commercial
Law League of America (CLLA), and all three ABC certification programs are accredited by
the American Bar Association and many states. ABC certification is available to all qualified
attorneys regardless of membership in ABI or CLLA.
The ABC continues to see strong demand for certified specialists from the public. The
ABC Website, www.abcworld.org, is continuously being updated and improved, with the
most recent changes designed to make it easier for attorneys to complete applications for
certification (and recertification).
Exam Schedule ABC Exams are held in conjunction with several ABI conferences. The exam dates are as follows:

John Tittle, Jr., (Tittle Advisory Group Inc.; New York) (r) received a 30th Anniversary Circle Endowment Award from ABI President Geoff Berman.
Dear ABI Members:
The American Bankruptcy Institute experienced a significant increase in its net assets during 2011 of
almost $1.4 million. Net assets rose from around $7.5 to over $8.8 million. This healthy growth helps ABI
continue to provide the highest-quality programs and services for our members.
In the annual audit of ABI by CliftonLarsonAllen LLP, an audit firm specializing in nonprofit organizations,
ABI was issued an unqualified “clean report” in conformity with generally accepted accounting principles.
The auditors found no matters involving internal controls and operations that were considered to be
material weaknesses. Additionally, the auditors commented that the financial position of ABI was very
healthy and its assets were very liquid, being primarily cash and cash equivalents.
In order to continue this strong financial position, ABI maintains three funds–General Operating Funds,
General Reserve Funds and the ABI Endowment Fund–and establishes and adheres to prudent guidelines
for the reserve levels of the two General Funds. These guidelines are based upon industry standards and
recommendations from outside financial advisors. The ABI Endowment Fund will continue to be kept in a
segregated account, and any expenditures of the principal of the Endowment Fund will continue to require
a two-thirds majority vote by the Board of Directors under the ABI bylaws.
The Audit Committee has selected CliftonLarsonAllen LLP for the audit of the 2012 Financial Statements.
Respectfully submitted,
John Tittle, Jr.Treasurer
