The American Bankruptcy Institute marked its 30th anniversary in service to

insolvency professionals during 2012 with a record number of programs, events and new features for our 13,000 members. This 14-month calendar

highlights some of these products so that members can maximize ABI’s benefits and plan to attend some of our many live conferences and programs.

New monthly “DISCOVER ABI” Webinars aimed at new and young members raise awareness of what ABI has to offer every practitioner; see the

calendar for these dates. On a policy level, of particular note and new this year is ABI’s Commission to Study the Reform of Chapter 11, an ambitious

two-year project to comprehensively assess how the law can be reformed to better effectuate success in corporate restructuring. As always, on behalf

of our volunteer leaders, we encourage all members to get involved in ABI.

Volo summarizes bankruptcy-related circuit court decisions and provides links to the full

opinion text. Utilizing a team of editors from around the country, the site acts as a circuit court

first-responder system, with decision summaries appearing within 24 hours.

This year, Volo achieved an important milestone with the posting of its 600th

circuit court decision summary.

The site is fully searchable by circuit, case name or topic, and practitioners can also set up

an RSS feed for their own circuit or read new summaries on the go.

describes the complementary and sometimes competing

and conflicting pieces of legislation, both federal and

provincial, that have developed and evolved over the

course of the last century.

a Bankruptcy Case, Third Edition provides practitioners

with a detailed look at the most common first-day motions

and relevant sections of the Bankruptcy Code. The book

includes a companion CD-Rom containing more than

Fourth Edition was created through a grant from the

National Conference of Bankruptcy Judges to help state

trial court judges resolve the conflicts that arise between

The ABI Health Care Insolvency Manual, Third Edition

includes updates reflecting the U.S. Supreme Court’s

decision on key components of the PPACA, but also

details the many challenges confronting the health care

system, which has been reeling from a rising number of

bankruptcies. Mergers and acquisitions in the field have also

increased by more than 300 percent in the years between

2008 and 2010, a trend that is expected to continue over

the next several years.

The American Board of Certification (ABC) is the nation’s premier legal specialty certification

organization, certifying attorneys as specialists in business bankruptcy, consumer bankruptcy

and creditors’ rights law. The ABC serves the public interest by allowing potential clients

to make an informed decision in selecting bankruptcy and creditors’ rights counsel. ABC

certification encourages attorneys to strive toward excellence and recognizes those attorneys

who have met the ABC’s rigorous standards. The ABC is sponsored by ABI and the Commercial

Law League of America (CLLA), and all three ABC certification programs are accredited by

the American Bar Association and many states. ABC certification is available to all qualified

attorneys regardless of membership in ABI or CLLA.

The ABC continues to see strong demand for certified specialists from the public. The

Has Been Awarded

The ABI Anthony H.N. Schnelling Endowment Fund was created in 1989 to provide resources

for research and education to the bankruptcy community. Your gift or pledge allows ABI to

meet new requests for funding, which may include studies relating to bankruptcy or insolvency;

surveys or other analytical investigation; the education of judges, court personnel, other

governmental personnel and the general public; or scholarships and other educational grants.

Current major projects include support for the Commission to Study the Reform of Chapter 11,

the Ethics Task Force and an empirical study of post-BAPCPA distributions to unsecured

creditors. Contributions may be paid in equal installments of up to five years. All gifts are

cumulative to allow donors to advance their level of contribution. All contributions are tax-

deductible. The ABI Endowment is a 501(c)(3) tax-exempt organization.

Dear ABI Members:

The American Bankruptcy Institute experienced a significant increase in its net assets during 2011 of

almost $1.4 million. Net assets rose from around $7.5 to over $8.8 million. This healthy growth helps ABI

continue to provide the highest-quality programs and services for our members.

In the annual audit of ABI by CliftonLarsonAllen LLP, an audit firm specializing in nonprofit organizations,

ABI was issued an unqualified “clean report” in conformity with generally accepted accounting principles.

The auditors found no matters involving internal controls and operations that were considered to be

material weaknesses. Additionally, the auditors commented that the financial position of ABI was very

healthy and its assets were very liquid, being primarily cash and cash equivalents.

In order to continue this strong financial position, ABI maintains three funds–General Operating Funds,

General Reserve Funds and the ABI Endowment Fund–and establishes and adheres to prudent guidelines

for the reserve levels of the two General Funds. These guidelines are based upon industry standards and

recommendations from outside financial advisors. The ABI Endowment Fund will continue to be kept in a

segregated account, and any expenditures of the principal of the Endowment Fund will continue to require

a two-thirds majority vote by the Board of Directors under the ABI bylaws.

The Audit Committee has selected CliftonLarsonAllen LLP for the audit of the 2012 Financial Statements.

Dear ABI Members:

The American Bankruptcy Institute experienced a significant increase in its net assets during 2011 of

almost $1.4 million. Net assets rose from around $7.5 to over $8.8 million. This healthy growth helps ABI

continue to provide the highest-quality programs and services for our members.

In the annual audit of ABI by CliftonLarsonAllen LLP, an audit firm specializing in nonprofit organizations,

ABI was issued an unqualified “clean report” in conformity with generally accepted accounting principles.

The auditors found no matters involving internal controls and operations that were considered to be

material weaknesses. Additionally, the auditors commented that the financial position of ABI was very

healthy and its assets were very liquid, being primarily cash and cash equivalents.

In order to continue this strong financial position, ABI maintains three funds–General Operating Funds,

General Reserve Funds and the ABI Endowment Fund–and establishes and adheres to prudent guidelines

for the reserve levels of the two General Funds. These guidelines are based upon industry standards and

recommendations from outside financial advisors. The ABI Endowment Fund will continue to be kept in a

segregated account, and any expenditures of the principal of the Endowment Fund will continue to require

a two-thirds majority vote by the Board of Directors under the ABI bylaws.

The Audit Committee has selected CliftonLarsonAllen LLP for the audit of the 2012 Financial Statements.

The American Bankruptcy Institute marked its 30th anniversary in service to

insolvency professionals during 2012 with a record number of programs, events and new features for our 13,000 members. This 14-month calendar

highlights some of these products so that members can maximize ABI’s benefits and plan to attend some of our many live conferences and programs.

New monthly “DISCOVER ABI” Webinars aimed at new and young members raise awareness of what ABI has to offer every practitioner; see the

calendar for these dates. On a policy level, of particular note and new this year is ABI’s Commission to Study the Reform of Chapter 11, an ambitious

The American Bankruptcy Institute marked its 30th anniversary in service to

insolvency professionals during 2012 with a record number of programs, events and new features for our 13,000 members. This 14-month calendar

highlights some of these products so that members can maximize ABI’s benefits and plan to attend some of our many live conferences and programs.

New monthly “DISCOVER ABI” Webinars aimed at new and young members raise awareness of what ABI has to offer every practitioner; see the

calendar for these dates. On a policy level, of particular note and new this year is ABI’s Commission to Study the Reform of Chapter 11, an ambitious

two-year project to comprehensively assess how the law can be reformed to better effectuate success in corporate restructuring. As always, on behalf

of our volunteer leaders, we encourage all members to get involved in ABI.
