    ENACTED by te parliament of Malaysia as follows:

    Part I

    pRELIMINARY

    Short title and commencement

    1. (1) Tis Act may be cite as te Renewable Energy Act2010.

    (2) Tis Act comes into oeration on a ate to be aointe

    by te Minister by notification in te Gazee, an te Ministermay aoint ifferent ates

    (a) for te coming into oeration of tis Act in ifferentarts of Malaysia;

    (b) for te coming into oeration of ifferent roisions orparts of tis Act; or

    (c) for te coming into oeration of ifferent roisions oftis Act in ifferent arts of Malaysia.

    Interpretation

    2. In tis Act, unless te context oterwise requires

    rescribe means rescribe by te Minister by way ofregulations mae uner section 60 or rescribe by te Autorityby way of rules mae uner section 61, as te case may be;

    electricity as te meaning assigne to it in section 2 of teElectricity Suly Act 1990 [ Ac 447];

    aointe auitor means any auitor aointe by te Autorityuner section 28;

    egression rate means te rate of te annual rogressiereuction of te fee-in tariff as secifie in te fift column ofte Sceule;

    fee-in aroal means an aroal grante uner section 7;

    ublic safety as te meaning assigne to it in section 2 ofte Electricity Suly Act 1990;

    riate safety as te meaning assigne to it in section 2 ofte Electricity Suly Act 1990;

    gri arity means, in relation to a articular renewable energyinstallation, te time at wic te fee-in tariff rate alicableto tat renewable energy installation is equal to or ceaer tante islace cost;

    islace cost means te aerage cost of generating an

    sulying one kilowatt our of electricity from resources otertan te renewable resources troug te suly line u to teoint of interconnection wit te renewable energy installation;

    Fun means te Renewable Energy Fun establise unersection 23;

    istribute means to oerate, maintain an istribute electricitytroug te electricity istribution network;

    Minister means te Minister carge wit te resonsibilityfor matters relating to te suly of electricity;

    Minister of Finance means te Minister carge wit teresonsibility for finance;

    autorize officer means any ublic officer, officer of teAutority or officer of te Commission autorize in writing byte Minister uner section 36;

    fee-in aroal oler means a erson wo ols a fee-inaroal;

    istribution licensee means te oler of a licence to istributeissue by te Commission uner section 9 of te ElectricitySuly Act 1990;

    eligible roucer means a erson wo is eligible to aly toarticiate in te fee-in tariff system uner section 4;

    renewable energy installation means an installation wicgenerates renewable energy an inclues any tecnical facilityof tat installation wic conerts mecanical, cemical, termalor electromagnetic energy irectly into electricity;

    renewable energy ower urcase agreement means terenewable energy ower urcase agreement between a istributionlicensee an a fee-in aroal oler uner section 12;

    Autority means te Sustainable Energy deelomentAutority of Malaysia establise uner te Sustainable Energydeeloment Autority Act 2010 [Ac ];

    electricity istribution network means a system or art of asystem at nominal oltage of less tan one unre an tirty

    two kiloolts of electric lines or cables, of substations an ofassociate equiment an builings for transorting electricity toany erson regarless of weter a generating lant is connecteto suc system;

    fee-in tariff system means te system establise unersection 3;

    renewable resources means te recurring an non-eletinginigenous resources or tecnology as set out in te first column

    of te Sceule;

    Commission means te Energy Commission establise unerte Energy Commission Act 2001 [ Ac 610];

    suly line as te meaning assigne to it in section 2 ofte Electricity Suly Act 1990;

    fee-in tariff means te secial tariff ayable to fee-inaroal olers in consieration for renewable energy generatean sol to a istribution licensee as secifie in te tir columnof te Sceule;

    fee-in tariff commencement ate means, in relation to afee-in aroal oler, te ate on wic te renewable energy

    installation first generates renewable energy for commercial saleursuant to te renewable energy ower urcase agreement wicas become effectie in accorance wit section 12;

    effectie erio means, in relation to a fee-in aroal oler,te erio commencing from te fee-in tariff commencementate as secifie in te fourt column of te Sceule;

    renewable energy means electricity generate or roucefrom renewable resources.

    Part II

    FEEd-IN TARIFF SYSTEM

    Establishment of feed-in tariff system

    3. (1) Tere is ereby establise a fee-in tariff system to

    roie for (a) te connection to suly line connection oints for te

    istribution of renewable energy generate by renewableenergy installations wic are owne by fee-in aroalolers;

    (b) te riority of urcase an istribution by istributionlicensees for renewable energy generate an sol byfee-in aroal olers; an

    (c) te fee-in tariff to be ai by istribution licensees tofee-in aroal olers for suc renewable energy.

    (2) Te fee-in tariff system sall be aministere animlemente by te Autority in accorance wit te roisionsof tis Act.

    (3) In carrying out its functions an obligations uner tisAct, te Autority sall gie ue consieration to

    (a) te objectie of tis Act;

    (b) te renewable energy olicies of te Goernment;

    (c) te amount of moneys aailable in te Fun from timeto time;

    (d) te nee for sustainability an iersity in renewable

    resources; an

    (e) te nee for fair cometition an transarency in teimlementation of te fee-in tariff system.

    Eligibility for participation in feed-in-tariff system

    4. A erson sall be eligible to aly for a fee-in aroalallowing te erson to articiate in te fee-in tariff systemif

    (a) te erson rooses to generate renewable energy from arenewable energy installation aing an installe caacityof not more tan tirty megawatts or suc iger installecaacity as may be aroe by te Minister; an

    (b) te erson meets suc oter criteria as may be rescribeby te Autority from time to time.

    Application for feed-in approval

    5. (1) An eligible roucer may aly to te Autority for a fee-in aroal uner section 7 by submitting a written alicationto te Autority in suc manner an accomanie by suc feesas may be rescribe by te Autority.

    (2) An alication uner tis section may be witrawn at

    any time before it is grante or refuse.

    (3) Te Autority may allow an alication uner subsection (1)to be furnise by an electronic meium or by way of an electronictransmission.

    (4) For te uroses of subsection (3), te conitions ansecifications uner wic an alication is to be furnise sallbe as etermine by te Autority.

    Additional information or documents

    6. (1) Te Autority may, at any time after te receit of analication for a fee-in aroal uner section 5, request te

    eligible roucer to gie to te Autority, witin te eriosecifie in te request, aitional information or ocumentsrelating to te alication.

    (2) If any aitional information or ocument require unersubsection (1) is not roie by te eligible roucer witinte erio secifie in te request or any extene time granteby te Autority, te alication sall be eeme to ae beenwitrawn an sall not be furter roceee wit, but witoutaffecting te rigt of te eligible roucer to make a fres

    alication.

    Grant or refusal of feed-in approval

    7. (1) Te Autority may, after consiering an alication for afee-in aroal uner section 5 an te aitional informationor ocuments roie uner section 6, aroe or refuse tealication.

    (2) Te Autority sall communicate its ecision unersubsection (1) to te eligible roucer an te releant istributionlicensee by written notice as soon as racticable.

    (3) Te written notice by te Autority uner subsection (2)sall secify

    (a) in te case were te alication is aroe, te fact ofsuc aroal an te conitions imose uner section 8;an

    (b) in te case were te alication is refuse, te fact ofsuc refusal an te reason for te refusal.

    (4) Te grant of a fee-in aroal uner tis section sall beersonal to te fee-in aroal oler an te fee-in aroalsall not be assigne or transferre to any oter erson excetwit te rior written aroal of te Autority.

    Conditions of feed-in approval

    8. (1) If te Autority ecies to grant a fee-in aroal unersection 7, te Autority

    (a) sall imose all te stanar conitions of a fee-inaroal as may be rescribe; an

    (b) may imose suc secial conitions as it tinks fit.

    (2) A fee-in aroal oler sall comly wit

    (a) te rescribe stanar conitions of te fee-in aroal;an

    (b) any secial conitions of te fee-in aroal,

    imose by te Autority uner subsection (1).

    (3) A fee-in aroal oler wo fails to comly wit anyconition of a fee-in aroal uner subsection (2) commits anoffence an sall, on coniction, be liable to a fine not exceeingfie unre tousan ringgit or to imrisonment for a term notexceeing tree years or to bot.

    Power to impose additional conditions and to vary or revokeconditions

    9. (1) Te Autority may, at any time

    (a) imose any aitional conitions on a fee-in aroal;or

    (b) ary or reoke any conitions imose on a fee-inaroal.

    (2) Before te Autority makes a ecision uner subsection (1),te Autority sall gie te fee-in aroal oler

    (a) a written notice of te Autoritys intention togeter wita raft coy of te imosition, ariation or reocationof conitions; an

    (b) an oortunity to make written submissions witin aerio secifie in te written notice wic sall notbe less tan tirty ays.

    (3) After te exiry of te erio secifie in te notice, teAutority sall, after consiering any written submission maeby te fee-in aroal oler, ecie weter to imose teaitional conitions, to ary or reoke any existing conitionsor to take no furter action.

    (4) Te Autority sall gie te fee-in aroal oler awritten notice of te Autoritys ecision uner subsection (3) assoon as racticable an te ecision sall take effect on a ateto be secifie in te written notice.

    Revocation of feed-in approval

    10. (1) Te Autority may reoke a fee-in aroal if

    (a) te fee-in aroal oler as faile to comly wit anyroisions of tis Act, te Electricity Suly Act 1990

    or any of teir subsiiary legislation;

    (b) te fee-in aroal oler as faile to comly witany of te conitions of te fee-in aroal;

    (c) te fee-in aroal oler a imroerly or illegallyobtaine te fee-in aroal;

    (d) te fee-in aroal oler as been conicte of anoffence uner tis Act, te Electricity Suly Act 1990or any of teir subsiiary legislation;

    (e) a receier, receier an manager, roisional liquiatoror like official as been aointe oer te wole orsubstantial art of te fee-in aroal olers assetsan suc aointment is not reoke or annulle witin aerio of sixty ays from te ate of suc aointment;or

    () tere as been a cange of circumstances suc tat tefee-in aroal oler woul no longer be entitle tobe grante a fee-in aroal uner tis Act.

    (2) Before te Autority makes a ecision uner subsection (1),te Autority sall gie te fee-in aroal oler

    (a) a written notice of te Autoritys intention to reoke

    te fee-in aroal; an

    (b) an oortunity to make written submissions witin aerio secifie in te written notice wic sall notbe less tan tirty ays.

    (3) After te exiry of te erio secifie in tewritten notice,te Autority sall, after consiering any written submission maeby te fee-in aroal oler, ecie weter or not to reokete fee-in aroal.

    (4) Te Autority sall gie te fee-in aroal oler writtennotice of te Autoritys ecision uner subsection (3) as soonas racticable.

    (5) Te fee-in aroal oler sall not be entitle to anyform of comensation from te Goernment, te Minister, teAutority or te Commission if te fee-in aroal is reokein accorance wit subsection (3).

    (6) Te reocation of a fee-in aroal uner subsection (3)sall take effect

    (a) on a ate secifie by te Autority in te written noticegien uner subsection (4); or

    (b) if no ate is secifie in te written notice gien unersubsection (4), on te exiry of tirty ays from te ateon wic te notice is sere on te fee-in aroaloler.

    (7) If te reocation of a fee-in aroal as taken effect,te fee-in aroal oler sall immeiately cease to be entitleto articiate in te fee-in tariff system an to receie fee-intariff ayments.

    Appeal

    11. (1) Any erson wo is aggriee by te ecision of teAutority in refusing an alication for a fee-in aroal unersection 7, in imosing any aitional conitions or in arying

    or reoking any conitions imose on a fee-in aroal unersection 9 or in reoking a fee-in aroal uner section 10 may,witin tirty ays of te ecision being notifie to im, aeal

    to te Minister in te rescribe manner.

    (2) Te Minister may, after consiering te aeal unersubsection (1), confirm, reerse or ary te ecision of teAutority.

    (3) Te ecision of te Minister uner subsection (2) sall befinal an bining.

    Part III

    CONNECTION, pURChASE ANd dISTRIBUTION OF RENEWABLE

    ENERGY

    Renewable energy power purchase agreement

    12. (1) Uon receit of te written notice by te Autorityuner subsection 7(2) tat an alication from a fee-in aroal

    oler as been aroe, te istribution licensee sall, witinsuc erio as may be rescribe by te Autority, enter intoa renewable energy ower urcase agreement wit te fee-inaroal oler.

    (2) Notwitstaning subsection (1), te istribution licenseesall not be oblige to enter into te renewable energy owerurcase agreement wit te fee-in aroal oler if

    (a) te fee-in aroal oler refuses to enter into teagreement; or

    (b) te Autority is of te oinion tat

    (i) tere as been a cange of circumstances suc tatte fee-in aroal oler woul no longer beentitle to be grante a fee-in aroal unertis Act; or

    (ii) it is just an reasonable for te istribution

    licensee not to enter into te agreement.

    (3) Te renewable energy ower urcase agreement salltake te form as may be rescribe by te Autority an anyeiation from suc form sall require te rior written aroal

    of te Autority.

    (4) Te Autority may rescribe ifferent forms of renewableenergy ower urcase agreements aing regar to te renewableresource to be use an te caacity of te roose renewableenergy installation.

    (5) Te fee-in aroal oler sall, witin suc erio asmay be rescribe by te Autority, submit a certifie coy ofte execute renewable energy ower urcase agreement to te

    Autority for registration.

    (6) Te Autority sall register any renewable energy owerurcase agreement submitte to it uner subsection (5) if teAutority is satisfie tat suc renewable energy ower urcaseagreement is consistent wit te roisions of tis Act an itssubsiiary legislation.

    (7) Te renewable energy ower urcase agreement sallonly be effectie an enforceable uon its registration wit te

    Autority in accorance wit tis section.

    (8) Te Autority sall maintain a register of all renewable energyower urcase agreements registere uner tis section.

    (9) A istribution licensee wo contraenes subsection (1)commits an offence an sall, on coniction, be liable to a finenot exceeing one million ringgit.

    Connection to supply line

    13. (1) Were te renewable energy ower urcase agreementas been conclue uner section 12, a fee-in aroal olermay aly to a istribution licensee for connection of is or itsrenewable energy installation to a suly line connection ointin suc manner as may be rescribe by te Autority.

    (2) Uon receiing te alication uner subsection (1), te

    istribution licensee sall connect te renewable energy installationto a suly line connection oint witin suc erio as may berescribe by te Autority.

    (3) Te location of te alicable suly line connection ointsall be etermine by te istribution licensee, witout rejuiceto section 15.

    (4) A istribution licensee wo contraenes subsection (2)commits an offence an sall, on coniction, be liable to a finenot exceeing one million ringgit.

    Priority of purchase and distribution

    14. (1) Were a renewable energy installation as been connecte toa suly line connection oint uner subsection 13(2), a istribution

    licensee sall, as riority oer te electricity generate fromresources oter tan renewable resources, urcase an istributetroug te suly line te entire aailable quantity of renewableenergy generate by a renewable energy installation owne by afee-in aroal oler unless exemte uner subsection (2).

    (2) Te Autority may exemt a istribution licensee fromcomliance wit subsection (1) for suc erios an uner succircumstances as te Autority tinks fit aing regar to ublicsafety an riate safety.

    (3) A erson wo contraenes subsection (1) commits anoffence an sall, on coniction, be liable to a fine not exceeingone million ringgit.

    Technical and operational requirements

    15. Te Autority may, wit te concurrence of te Commission,rescribe rules goerning tecnical an oerational requirements

    to be comlie wit by istribution licensees an fee-in aroalolers in te imlementation of tis part, incluing

    (a) te resectie uties an resonsibilities of istributionlicensees an fee-in aroal olers in resect of sucrequirements;

    (b) te time erios witin wic suc requirements are tobe comlie wit;

    (c) te aortionment of costs incurre in relation to suc

    requirements; an

    (d) te roceures an manner in wic lans, secificationsan oter ocuments are to be submitte.

    Part IV

    FEEd-IN TARIFF

    Payment and duration of feed-in tariff

    16. (1) Subject to aragra 21(3)(a), a fee-in aroal olersall, uring te effectie erio, be ai te fee-in tariff byte istribution licensee wit wom te fee-in aroal oleras entere into a renewable energy ower urcase agreementfor renewable energy generate by is or its renewable energyinstallation base on te alicable fee-in tariff rate as ajusteuner section 18.

    (2) Te Autority may rescribe rules setting out te criteriato be met by a renewable energy installation for te uroses ofascertaining te eligibility of a fee-in aroal oler to receiea articular fee-in tariff rate.

    Degression of feed-in tariff

    17. (1) Subject to subsection (3), te fee-in tariff rate sall bereuce rogressiely eac year base on te alicable egressionrate commencing on 1 January eery year after te ate of cominginto oeration of tis Act.

    (2) Te annual egression rates sall be subject to reiew inaccorance wit section 18.

    (3) No furter reuction sall be mae to a fee-in tariff ratealicable to a fee-in aroal oler after te fee-in tariffcommencement ate in resect of tat fee-in aroal oler.

    Review and adjustment of degression rates

    18. (1) Te Autority sall reiew te egression rates in resectof any category of renewable energy installation at least onceeery tree years after te ate tis Act comes into oeration forte uroses of imroing te oerall erformance of te fee-in

    tariff system to better aciee te objectie of tis Act.

    (2) In carrying out te reiew uner subsection (1), teAutority sall ae regar to

    (a) te matters set out in subsection 3(3);

    (b) te ability of te fee-in aroal olers to recoer teirinitial inestment on teir renewable energy installationsan receie satisfactory returns witin a reasonabletime;

    (c) te reailing costs of equiing, constructing, oeratingan maintaining renewable energy installations utilisingeac articular renewable resource;

    (d) te efficiency of renewable energy installations utilisingeac articular renewable resource base on reailingtecnology; an

    (e) any oter factor eeme releant by te Autority.

    (3) Uon comletion of te reiew uner subsection (1), teAutority sall submit a reort of te reiew to te Minister witor witout recommenations for ajustments to te egressionrates.

    (4) Te Minister may, after consiering te recommenationsfor ajustment to te egression rates mae by te Autorityuner subsection (3), aroe or refuse suc recommenations.

    (5) If te Minister aroes te recommenation mae by teAutority uner subsection (4), e sall as soon as racticable,reise te egression rates.

    (6) Te reise egression rates sall not aly to fee-inaroal olers existing before te reise egression rates comeinto effect.

    Recovery of moneys from Renewable Energy Fund

    19. A istribution licensee sall be entitle to recoer from teFun, a sum equialent to te ifference between

    (a) te amount of fee-in tariffs ai by te istributionlicensee to fee-in aroal olers in accorance witsection 16; an

    (b) te cost wic te istribution licensee woul aeoterwise a to incur to generate te same amount ofelectricity generate by suc fee-in aroal olers

    base on reailing islace cost,

    in accorance wit suc roceures an metos of calculationas may be rescribe by te Autority.

    Administrative fees

    20. Aministratie fees, to be carge on te Fun, may beai

    (a) to a istribution licensee, for aministering te aymentof te fee-in tariffs to fee-in aroal olers unersection 16; an

    (b) to te Autority, for imlementing an aministering tefee-in tariff system uner tis Act,

    base on te rates as may be etermine by te Minister by orerublise in te Gazee.

    Grid parity

    21. (1) Te Autority sall etermine weter a articularrenewable energy installation as aciee gri arity.

    (2) Uon te etermination by te Autority tat a articularrenewable energy installation as aciee gri arity, te Autority

    sall notify te releant fee-in aroal oler an istributionlicensee of suc acieement.

    (3) Notwitstaning anyting uner tis Act, uon notificationof te etermination of gri arity uner subsection (2)

    (a) a fee-in aroal oler wo owns suc renewableenergy installation sall not be entitle to be ai tefee-in tariff an sall instea be ai by te istributionlicensee a tariff tat is base on te reailing islace

    cost for te remaining uration of te effectie erio;an

    te ayment or iger ayment of fee-in tariffs from te istributionlicensee commits an offence an sall, on coniction, be liable

    to a fine not exceeing one million ringgit or to imrisonment

    The Renewable Energy Fund

    23. (1) A fun to be known as te Renewable Energy Funis establise an sall be aministere an controlle by teAutority.

    (2) Te Fun sall consist of

    (a) suc sums as may be roie by te parliament for teuroses of te Fun from time to time;

    (b) suc sums ai to te Autority uner subsections 22(4),24(1) an 24(5);

    (c) all moneys erie as income from inestments maefrom te Fun, incluing interest; an

    (d) all oter moneys lawfully receie by te Autority onbealf of te Fun.

    Allocation from electricity tariffs

    24. (1) Subject to subsection (6), a istribution licensee sall,if require by te Minister by orer ublise in te Gazee,allocate an ay into te Fun, in suc manner an at suc ratesas may be set out in te orer, a ortion of te tariffs leie byte istribution licensee uner subsection 26(1) of te ElectricitySuly Act 1990.

    (2) A istribution licensee wo contraenes subsection (1)commits an offence an sall, on coniction, be liable to a finenot exceeing one million ringgit.

    (3) A written statement by an officer of te Autority or anyerson autorize by te Autority secifying

    (a) te unai ortion of te tariffs uner subsection (1) ueto te Fun; an

    Expenditure to be charged on Renewable Energy Fund

    25. Te Fun sall be exene for te uroses of

    (a) sections 19 an 20; an

    (b) generally aying any exenses for carrying into effectte roisions of tis Act.

    Investment

    26. (1) Te moneys from te Fun sall, in so far as tey are notrequire or immeiately require to be exene by te Autorityuner tis Act, be ineste in suc manner as te Minister mayaroe wit te concurrence of te Minister of Finance.

    (2) Te Autority sall oen an maintain an account oraccounts to ol moneys in te Fun wit suc bank or banksin Malaysia as it tinks fit, after consulting te Minister an teMinister of Finance, an eery suc account sall be oerate insuc manner as may be autorize by te Autority.

    Part VI

    INFORMATION GAThERING pOWERS

    Performance audit

    28. (1) Te Autority may, at any time, carry out or aoint anauitor to carry out an auit on te oerations of

    (a) any istribution licensee to ealuate its comliance wittis Act an its subsiiary legislation; an

    (b) any fee-in aroal oler to ealuate is or its comliancewit tis Act, its subsiiary legislation an te conitionsof te fee-in aroal.

    (2) Te Autority sall gie not less tan twenty four oursrior written notice of an auit uner subsection (1) to te releantistribution licensee or fee-in aroal oler.

    Provision of information

    29. (1) Notwitstaning any oter written law, if te Autorityas reasonable grouns to beliee tat any erson

    (a) as any information or any ocument tat is releant tote erformance of te Autoritys functions an owersuner tis Act or its subsiiary legislation; or

    33. (1) Te Autority sall maintain a recor of all information or

    ocuments receie ursuant to te orers gien uner subsection 29(1).

    Publication of information

    34. (1) Te Autority may ublis any information receie by

    it in te course of exercising its functions an owers uner tispart.

    (2) Te Autority sall consier te commercial interest of tearties to wom te information relates before ublising sucinformation.

    (3) Te Autority sall not ublis any information or anyart of any information isclose to it if te ublication

    (a) is likely to rejuice te fair trial of a erson; or

    ENFORCEMENT

    Authorized officer

    36. (1) Te Minister may, in writing, autorize any ublicofficer, officer of te Autority or officer of te Commission toexercise te owers of enforcement uner tis Act or its subsiiarylegislation.

    (2) Any erson autorize uner subsection (1) sall be eemeto be a ublic serant witin te meaning of te penal Coe[ Ac 574].

    Authority card

    37. (1) Te Autority sall issue to eac autorize officer anautority car wic sall be signe by te Cief ExecutieOfficer of te Autority.

    38. (1) An autorize officer may inestigate te actiities of a

    fee-in aroal oler, istribution licensee or oter erson inrelation to te commission of an offence uner tis Act or itssubsiiary legislation.

    (2) In any case relating to te commission of an offence unertis Act or its subsiiary legislation, any autorize officer carryingout an inestigation may exercise all or any of te owers inrelation to olice inestigation, excet te ower to arrest witoutwarrant, gien by te Criminal proceure Coe [ Ac 593].

    Search and seizure with warrant

    39. (1) If it aears to a Magistrate, uon written informationon oat from te autorize officer an after suc inquiry as econsiers necessary, tat tere is reasonable cause to beliee tatan offence uner tis Act or its subsiiary legislation is beingor as been committe on any remises, so tat any eience orting wic is necessary to te conuct of an inestigation into

    (6) If, by te reason of its nature, size or amount, it is notracticable to remoe any book, accounts, ocuments, comuterizeata, signboar, car, letter, amlet, leaflet, notice, equiment,instrument or matter seize uner tis section, te seizingofficer sall by any means seal suc book, accounts, ocuments,comuterize ata, signboar, car, letter, amlet, leaflet, notice,

    Compounding of offences

    53. (1) Te Minister may, by regulations, rescribe any offenceuner tis Act or its subsiiary legislation to be a comounableoffence.

    (2) Te Autority may, wit te consent in writing of te

    public prosecutor, comoun any offence committe by anyerson uner tis Act or its subsiiary legislation an rescribeto be a comounable offence by making a written offer to teerson susecte to ae committe te offence to comoun teoffence uon ayment to te Autority an amount of money notexceeing fifty er centum of te maximum fine for tat offencewitin suc time as may be secifie in te written offer.

    (3) An offer uner subsection (2) may be mae at any timeafter te offence as been committe but before any rosecution

    55. (1) If a boy cororate commits an offence uner tis Actor its subsiiary legislation, a erson wo at te time of tecommission of te offence was a irector, cief executie officer,cief oerating officer, manager, secretary or oter similar officerof te boy cororate or was urorting to act in any succaacity or was in any manner or to any extent resonsible for

    (e) te grant or reocation of any fee-in aroal;

    () any eficiencies in te scoe or oeration of tis Act anits subsiiary legislation; an

    (g) oter matters te Minister tinks necessary.

    (4) Te Autority sall ublis te reort in a manner it eemsaroriate as soon as racticable following te ate on wicte Autority submits te reort to te Minister.

    Compliance with all other laws

    57. For te aoiance of oubt, te grant of a fee-in aroalby te Autority sall not exemt a fee-in aroal oler fromte obligation to comly wit all oter alicable laws, incluingte Electricity Suly Act 1990 an its subsiiary legislation.

    Directions by the Authority

    58. (1) Te Autority may from time to time issue irections inwriting to any erson about te comliance or non-comliance ofany conitions of te fee-in aroal, incluing te remeyingof a breac of a fee-in aroal conition or te roisions oftis Act or its subsiiary legislation.

    (2) prior to making a irection uner subsection (1), teAutority sall issue a notice in writing to te erson secifying

    te nature of te require comliance.

    (3) Te erson sall be grante an oortunity to be earor may submit a written submission on te reasons for is or itsconuct or actiity witin a reasonable time erio secifie in

    (4) After te exiry of te notice secifie in subsection (3),te Autority sall take into consieration any reasons roieby te erson before making a ecision in relation to te releantconuct or actiity of te erson.

    (5) After ue consieration of any reasons roie by teerson, te Autority may, by written notice, issue a irectionuner subsection (1) as soon as racticable requiring te erson to

    take a secifie action irecte towars ensuring tat te ersonoes not contraene or oes not continue to contraene any ofte conitions of te fee-in aroal or any of te roisionsof tis Act or its subsiiary legislation.

    (6) Te erson sall comly wit te irection issue by teAutority uner subsection (5).

    (7) A irection mae by te Autority uner tis part sallbe registere as soon as racticable.

    (8) Te irection sall be effectie from te ate of registration orsuc later ate as te Autority may secify in te irection.

    (9) Te irection sall exire on suc ate as te Autoritymay secify in te written notice or if no ate is secifie, teirection sall be in force until te irection is reoke.

    (10) Te Autority may ary or reoke a irection an teroceures set out in subsections (2), (3), (4), (5), (7), (8) an (9)sall aly uas uads in resect of any ariation orreocation of a irection.

    (b) to rescribe any matter relating to te Fun;

    (c) to rescribe te offences wic may be comoune ante forms to be use an te meto an roceure forcomouning te offences for te uroses of section 53;

    (d) to rescribe te manner of aeal uner section 11;an

    (e) to rescribe all oter matters as are necessary or exeientto be rescribe for giing effect to, or for te bettercarrying out of, te roisions of tis Act.

    Power of Authority to make rules

    61. Te Autority may make suc rules for all or any of tefollowing matters:

    (a) to rescribe all matters relating to te alication offee-in aroals, incluing te eligibility criteria ofte alicant, te manner of alication an uration,forms an stanar conitions of te fee-in aroal;
