New Orders/Substitutions: The key deadline forordering unrooted cuttings in the 1.5- or 3-inchspecification is Friday, February 4, 2011. Orders receivedafter this date will be filled based strictly on the availabilityof the requested size. If requested size is not available, asubstitution will be made for our standard 2-inch size.Pricing: Pricing stated as charge per one tray of invoicedcuttings, inclusive of Intellectual Property Fee (IPF), andis effective for products shipped weeks 21–39, 2011.Intellectual Property Fee (IPF) stated as charge per onetray of invoiced cuttings. Prices subject to changewithout notice.Point-of-Purchase (POP) Materials: A POP tag and tagelevator are included in the cost of Polar Bear. Pleasevisit the Ecke Ranch Poinsettia home page for furtherinformation on POP materials.Discounts: Volume discounts are set annually at thebeginning of the shipping season. Annual volumediscount tiers are based on a customer’s total purchasevolumes from the previous season. Freight costs are notsubject to discounts. Volume tier and EOD discounts arenot applicable to Specialty Collection varieties.Freight: Please refer to the 2011 Ecke Ranch SummerPoinsettia Program Guide for all freight details.Invoicing: Invoices will be mailed or faxed within five (5 )to seven (7) business days from the Monday of that shipweek.Claims/Returns: All claims are processed through ourEncinitas, CA office. All claims must be submitted inwriting within eight (8) business days of receipt of theshipment. To protect the integrity of our certifiedproduction systems, no returns are accepted.Cancellations/Changes: Cancellation or changes oforders can be made no later than the production dayprior to scheduled shipment. Warranty: All orders are subject to confirmation by PaulEcke Ranch and crop conditions. Paul Ecke Ranchwarrants, to the extent of the invoice price, that the plantmaterial is sold as described in the 2011 Poinsettiacatalog, within recognized tolerances.Paul Ecke Ranch makes no other warranty, express,or implied, concerning the cuttings, and expresslydisclaims any and all other warranties, including anywarranty of the merchantability or fitness for customer’sparticular purpose. Customer’s sole and exclusiveremedy for any breach of this order agreement,including but not limited to any claim under thewarranty in this paragraph, shall be return of theprice paid for the affected cuttings. Customeracknowledges and agrees that the maximum liabilityof Paul Ecke Ranch for any other claim of defectiveor non-conforming cuttings, non-delivery or latedelivery, or otherwise, shall be limited to the pricepaid for the affected cuttings. Customer acknowledgesthat customer shall not be entitled to recover anyother claimed consequential damages.
