Welcome to the 2009 Alliance Sale. Our numbers are not large for this sale, but the quality is up to the same high standards you have come to expect from the consignors.

Last year we saw the high quality genetics from this sale bring top dollar from some of Canada’s leading breeders. Look for more of the same this year.

We have an exceptional group of heifer calves that will make excellent show candidates for 4-H, CCYA or at major breed shows.

The bred heifers are right from the top of the consignors’ herds. They feature quality genetics - with the development and service to pay you dividends with their first calves. They present an exciting opportunity to lay in some young females with great pedigrees, top service sires and darn good numbers.

The spring of 2009 saw a huge demand for Charolais bulls. We sold more bulls for more money than we have in several years. Expect this trend to continue as the commercial industry is demanding a calf with the potential to put on pounds at weaning and in the feedlot. Charolais sired calves are getting this job done.

Delivery...Delivery is available to central points in Canada to a maximum of 300 km at a cost of $50/animal. Delivery is at the seller’s convenience, but will be as soon as practical. Extra costs are to the account of the purchaser. All risk is assumed by the buyer.

Pregnancy...All bred females have been pregnancy tested and their status will be confirmed sale day.

Purchase Option...Buyers will have the option of paying 50% on sale day and the remaining 50% on February 1, 2010 on approved credit. Post dated cheques are required sale day.

TERMS & CONDITIONSTERMS: The terms of the sale are cash or cheque payable at par at the sale unless satisfactory credit arrangements have been made previous to the sale. The right of property shall not pass until after settlement is made. All settlements must be made with the clerks of the sale before any cattle will be released. The Auctioneer shall have the right to refuse bids from anyone who has a previous record of default in payment or who has not made credit clearance prior to the sale with the owner or Sales Manager. All monies are in Canadian funds. Sale is not complete until final payment is received.

DISPUTES: In case of disputes, bidding will be reopened between the parties involved. If no further bid is made, the buyer will be the person from whom the auctioneer accepted the last bid. The auctioneer’s decision in such matters is final.

PURCHASERS RISK: Each animal becomes the risk of the purchaser as soon as sold. Animals will be cared for at the purchaser’s risk for a reasonable length of time.

ANNOUNCEMENTS: Errors discovered in the catalogue will be corrected by announcements from the auction stand at sale time and such corrections will take precedence over the printed matter in the catalogue. Buyers are cautioned to pay close attention to announcements.

CERTIFICATE OF REGISTRY: Each animal will carry papers issued by the Canadian Charolais Association. A certificate of registry duly transferred will be furnished to the buyer for each animal after settlement has been made.

DELIVERY: Assistance will be given in making shipments after the sale, but no risk is assumed by the Sale Management or Seller. Purchasers are requested to furnish shipping arrangements when making settlement. Purchasers can purchase insurance sale day. Although delivery is offered, extra costs such as export fees are to the account of the buyer.

FEMALES: Cows represented as being ”safe in calf” have been examined and declared safe by a licensed veterinarian. Pregnancy status is an estimation only, and is not a guarantee of due dates. They are considered breeders without further guarantee. Cows with calves at side shall be considered breeders without further guarantee. Cows and heifers represented as bred are not “safe in calf” but they and open heifers selling as individual lots are guaranteed to be breeders. No guarantees apply to sucking calves.

In the event a female is claimed to be a non-breeder after having been bred regularly to a bull known to be a breeder and after having been treated by a licensed veterinarian, the matter must be reported in writing within (6) six months of sale date, to the seller. Heifers under (12) twelve months of age and purchased as single lots and who fail to conceive to the service of a bull known to be a breeder, the matter must be reported in writing to the seller before the heifer reaches (18) eighteen months of age. The seller shall have (6) six additional months in which to prove any such

female a breeder and may use any registered Charolais bull available to him. Any female returned will be at the purchaser’s risk. No guarantee is given that a pregnant female will deliver live calves or that she will carry calves full term nor that the calf carried will not be mummified.

In no event shall the seller be responsible for more than the purchase price.

The seller is not responsible for damage caused by foreign bodies after the animal has been sold nor for sickness not apparent at sale time.

EXCEPTION GUARANTEE: In case where the animal is subjected to any hormonal or surgical reproductive techniques after the sale, this guarantee shall be null and void.

SETTLEMENT: Transportation charges on animals returned to the seller are for account of the purchaser. No incidental expenses such as feed, care, A.I., signing fees, interest, veterinary charges, etc., will be charged by either party when making settlement. If the seller is successful in proving the animal in question a breeder, the said animal will be reclaimed by the purchaser at his expense. Should the seller fail to so prove the animal a breeder, then the buyer is guaranteed a satisfactory replacement F.O.B. ranch or location of origin or a refund of the actual price. Should a dispute arise over the quality of a replacement animal, the Sale Management will appoint a mediator.

ACCIDENTS: Although every precaution will be taken to protect the safety and comfort of buyers, neither the sale manager, auctioneer, or sellers assume any responsibility in this matter and disclaim any liability, legal or other wise, in the event of accident or loss of property.
