DEDICATED TO GUARDING LOGAN MARTIN WATER QUALITY AND QUANTITY W ater W aves Covering Pell City, Talladega, Riverside and Lincoln OCTOBER 2008 Logan Martin Lake Protection Association DIRECTORY EDITION President's Message It happens every year about this time. An article appears in the local newspaper addressing the quality of the water in Logan Martin Lake. Case in point; the Daily Home front page report on 7/20/2008 entitled “How Clean Is Our Lake.” This is a rather long essay regarding the sta- tus of the water, the problems we have faced for many years and what has and can be done to improve the sit- uation. Unfortunately, it is misleading about the safety of swimming in the lake (paragraph 3). To my knowledge there has never been a warn- ing by ADEM or the Public Health Department about swimming in our lake except at the Dye Creek Water Treatment Plant after a heavy rain. In that situation a warning sign is posted for about three days because the plant cannot handle the excessive rain water runoff that flows into the system. Expansion and repairs are now underway, by order of ADEM, to correct that problem. The article indicates Logan Martin Lake is one of many lakes in our state on the “303d” list, indicating quality- impaired waters. The two reasons given in the article are (1) increase in nutrient levels and (2) the fish con- sumption advisory. We all are aware of the recommendation to limit con- sumption of certain species of fish. This is due to small residues of PCB's and mercury in certain fish. The latest advisory is presented in another section of this newsletter. Scott Hughes, spokesman for ADEM, stated that a high nutrient level in water does not pose a threat to humans, and is common in reservoirs, especial- ly in drought situations and limited down flow through the dams. The Water Quality Committee of the Logan Martin Lake Protection Association, chaired by Isabella Trussell continues to moni- tor our water quality monthly at many locations, and has not found any dan- gerous bacterial contaminants. In fact, it has been determined that the Pell City Dye Creek Wastewater Treatment Plant is the largest source of excessive nutriments in Logan Martin Lake. Pell City is under a con- sent order from ADEM to correct the problem of overflow into the lake, and improvements are in progress. New regulations regarding the total maximum daily load of permitted dis- charges from industries and munici- palities are being developed by ADEM. Permit limits are being tight- ened. According to April Hall, pro- gram director for the Alabama Water Alliance, once this new clean-up plan is established Logan Martin Lake will be removed from the 303d list since it has already been cited and is taking the required remedial steps. The article in the Daily Home sug- gests many ways home owners can help reduce the nutrient problems in the lake, Meanwhile, in my opinion, it is safe to enjoy our lake's many recre- ational activities, including swimming. General Meeting MinutesFebruary 21, 2008

The meeting was called to order by Johnny Beavers,

vice president. Donn Brascho was unable to attend. He

welcomed the large group who attended.

He asked Ann Moore to read the minutes for the last

meeting in November. As the General Meeting Minutes

for November 15, 2007 were published in the recent

newsletter, Ann asked that the minutes be approved as

published. The motion was seconded and approved.

Bill Hays, treasurer was unable to be at the meeting

and Johnny Beavers asked Ann Moore to read the

Treasurer's Report. She mentioned that a total of $7,900

has been collected to date in membership fees. We

have a total of 319 members who have renewed or

joined since the first of the year. A motion was made

and seconded to approve the report. A copy of the

report is attached to these minutes.

Isabella Trussell presented the report for the Water

Quality Committee. She said supplies were purchased

recently for the testing for 2008. The amount was higher

than before because we will have more bacteriological

testing at certain points on the lake. She asked that any-

one who was interested in being a monitor should sign

up at the table in the back.

Johnny Beavers asked for a report from the

Education Committee. Ann Moore said that she had

made presentations recently and was anxious to include

other groups who may be interested in learning about the

Association to contact her. She said that Ted Seay is

actively involved with the youth groups for the upcoming

lake cleanup.

Dianne DeShazer is working with the Water Festival

again this year and she was asked to make a report.

Dianne explained to the group how the Association has

been involved with the Water Festival and then intro-

duced Sarah Butterworth who is with the St. Clair Soil &

Water Conservation District. Sarah explained that the

Water Festival began 10 years ago with ADEM and UAH

who organized Alabama's First Groundwater Festival.

St. Clair County has been involved since 2001.

Talladega has participated in the past but is not currently

involved. The Water Festival is a day long program for

4th graders and teachers from both public and private

schools to learn where their drinking water comes from,

how to protect it and how to keep it clean for future gen-

erations. There are 'hands-on' classes, experiments and

festive activities to allow the students to retain the sur-

face and groundwater principles. This year the Festival

will be held on April 15th. The First Baptist Church of

Pell City and the First United Methodist Church will again

be the site for the Festival. Sarah said that they need

about 200 volunteers. The high school students and

adults will teach classes, and guide the students through

their day. Adult volunteers are desperately needed and

she urged anyone who was interested to contact Dianne

DeShazer. Dianne thanked Sarah for her hard work.

Johnny Beavers asked Ann Moore and Bud Kitchins

to begin the presentation for Renew Our Rivers - 2008.

A movie prepared by Alabama Power for Renew Our

Rivers was shown to the group. Following the movie

Ann continued the ROR presentation with the 2008 dates

for Logan Martin Lake as March 31st - April 5th and

explained ROR and LMLPA's approach this year as,

PRIDE = SUCCESS. She explained that Sam Smith

resigned recently as Chairman of the LMLPA Lake

Cleanup Committee due to a serious illness and asked

that he be remembered in everyone's prayers. Don

Greer is now the main contact person. Ann listed the

tonnage of trash collected over the last four years and

showed that the amount is decreasing, indicating that the

project is showing success. She explained that the

landowners, businesses and visitors have pride in Logan

Martin Lake and are showing this pride by keeping the

lake and its surrounding surfaces clear of trash year

round. Throughout the presentation she explained the

five main cleanup areas, the types of volunteers needed

and how to sign up. The main area volunteers are

presently needed as Street Captains and asked that any-

one who was interested to contact the person listed in

their collection site area. The flyers with the names are

available on the table in the back. She also said that

pontoon boats and drivers are needed to access remote

areas. She asked for anyone who is aware of remote

areas with a lot of debris to contact Don Greer. The

presentation ended with information about the picnic with

free food and music following the cleanup at Lakeside

Landing on April 5th.

Johnny Beavers thanked Ann and Bud for the pres-

entation and Al and Dot Read for their wonderful refresh-

ments. He announced that a Board Meeting would be

held following a short break and again thanked everyone

for attending. The meeting was adjourned.

LMLPA RECEIVESA $5,000 WINDFALL

The Logan Martin Lake Protection Association

received $5,000 from a court settlement between

the state and two defendants who violated

Alabama’s one-call notification system. St. Clair

County district Attorney Richard Minor said his office

was notified by Plantation Pipe Line Company that

someone had violated the one-call notification statue

which requires anyone excavating along the pipeline

easement to call the number on the posted sign

before excavating in the easement. A seawall and

pillings had been constructed within the easement

without knowledge of the pipeline company. Once

this was confirmed, Mr. Minor contacted all parties

involved.

Since the seawall poses no immediate danger to

the pipeline, it was agreed not to go to court over

the matter. The district Attorney negotiated a settle-

ment of $5,000 and the money would go to an

organization that protects the lake — the LMLPA.

The defendants agreed and the money has been

gifted. Emily Thompson, a spokeswoman for the

pipeline company said that the district attorney did a

great service to the people of St. Clair County by

imposing a fine instead of prosecuting those respon-

sible for building the seawall. She hopes the incident

will help bring attention to the importance of the one

call system before any excavating work is started

near an easement.

Dr. Donn Brascho, president of the LMLPA said

that District Attorney Minor established a great

precedent in this negotiation, and thanked him on

behalf of the officers and 485 members of the Logan

Martin Lake Protection Association.

Brascho indicated that the money will be used to

continue the ongoing activities of the organization

such as conducting the annual lake clean-up in

March, water monitoring, publishing a newsletter to

keep the membership informed about matters that

would be of interest to property owners and users of

the lake, holding quarterly meetings open to the

public with guest speakers, providing educational

programs for the youth of the community and pro-

viding financial grants to school teachers for special

activities to teach students methods of preserving

our valuable water asset. The Executive Committee

of LMLPA awarded Mr. Minor a lifetime honorary

membership in the organization in appreciation of

his support.

The Logan Martin Lake Protection Association re-ceived $5,000 from a court settlement between the state and two defendants who violated Alabama’s one-call notifi cation system. St. Clair County Dis-trict Attorney Richard Minor said his offi ce was notifi ed by Plantation Pipe Line Company that someone had violated the one-call notifi cation statue which requires anyone excavating along the pipeline easement to call the number on the posted sign before excavating in the easement. A seawall and pilings had been constructed within the easement without knowledge of the pipeline company. Once this was confi rmed, Mr. Minor contacted all parties involved. Since the seawall poses no immediate danger to the pipeline, it was agreed not to go to court over the matter. The District Attorney negoti-ated a settlement of $5,000 and the money would go to an organization that protects the lake — the LMLPA. The defendants agreed and the money has been gifted. After the low lake levels of sum-mer 2007, I thought the 2008 St.Clair County Water FestivalCommittee hit the nail on the headwhen it paired one well-recognizedadvertising question with a familiaranswer from the marketing world:Got Water? Priceless! So evolvedthe theme for the 2008 event, whichtook place April 15th.

When you expect over 1,000fourth grade school children tospend the day, planning needs tostart early. Representing LoganMartin Lake Protection Association,I joined with the committee inJanuary to get to work. Other mem-bers of the committee included stafffrom the St. Clair County Soil andWater Conservation District (the fes-tival’s organizer), area water worksand utility boards, and St. Clair andPell City school systems. SWCD’sSarah Butterworth coordinated the

committee’s efforts, and OdenvilleUtility Board’s Virginia Bratcherchaired.

Sarah and Virginia made surethat things such as the followingtook place long before April 15th:supplies counted; locations secured;food and drinks for volunteers pro-vided; bus loading, unloading, park-ing charted, teacher and sponsorinformation compiled and distrib-uted; volunteers recruited; and ofcourse, funds raised. A fun job waspicking a winning design from draw-ings submitted by the county’sfourth-grade artists for event t-shirts.

April 14th: one-day-to-go and itwas intense. The festival activitiestook place at Pell City First Baptistand First United MethodistChurches — 24 separate class-rooms to be set up and stocked.Several rooms needed plastic toprotect the floor from splashes; all

needed furniture moved in, out and around.

April 15th arrived, and with it awhirlwind. Volunteers took theirplaces at sign-in, the bus stop, andclassrooms. And the fourth-graderscame. They strung water cyclebracelets, built miniature water filtra-tion systems, and created edibleaquifers.

Then, they are gone. The hourspassed quickly in all the goings-on,and it was time to put the roomsback in their original state andclean-up. We gathered leftover sup-plies, already talking about 2009.

Lake residents are all familiar with theseasonal lowering of lake elevationsconducted by Alabama Power as aflood-control measure under thedirections of the U.S. Army Corpsof Engineers.

While lower water levelsmake way for the usualwinter and springrains, they some-times expose thelake beds to undesir-able activities —ATVs, dirtbikes,four-wheel-drive trucksand othermotorizedvehicle use— in areas usually covered by water.

Alabama Power Company owns the lakebeds and riders of unauthorized vehicles

are trespassing. These dirtbikes, etc., are damaging the lake bot-

toms and, in some instances, they are dam-aging piers and other facilities permitted by

River Trail Winds Through State

Canoeists and kayakers can now enjoy a 631-mile river trail from the Georgia state line,

down the Coosa and Alabama rivers to Fort Morgan at the southern end of Mobile Bay. The new

Alabama Scenic River Trail winds through incredible natural vistas such as steep stone bluffs,

magnificent wildlife preserves and southern timberlands.

Volunteers worked with the Alabama Department of Conservation and Natural Resources, the

Alabama Department of Tourism and Travel, Alabama Power, the U.S. Army Corps of Engineers,

the National Park Service and 21 cities along the rivers to establish the trail that opened in June.

Alabama Power provided land

access for portages — paths around

its dams — at Weiss, Neely Henry,

Logan Martin, Lay, Mitchell and

Jordan hydroelectric facilities on the

Coosa River. Alabama Power also

provided signs and buoys directing

kayakers and canoeists where to exit

and re-enter the Coosa. Alabama

Power and volunteers from the Boy

Scouts and other groups built the

portages.

2008 Lake Clean-up a Success

The annual Logan Martin Lake clean-up sponsored by the LMLPA was again a

success in March of this year. About 250 volunteers turned out in spite of

inclement weather. A total of 17.47 tons of trash was recovered. This

includes 10.08 tons of old tires, which are very difficult to remove from the lake bed

and dispose of. The weather forced cancellation of the picnic, but it was held at a later

date.

Many thanks to Sam Smith for his outstanding organization of this project over the

last three

years.

Next

year the

dates of the

clean-up will

be March 30th

to April 4th. And remember; don’t dispose

of tires in the lake. They are toxic to fish!

Better to use your old Christmas trees to

attract fish.

Workers enjoy a refreshing picnic.

LMLP members Donn Brascho, Don Greer, Dick Whatley, Larry Martens

and Isabella Trussell attended a USACE scoping meeting in Gadsden on

September 17th. This meeting provided an opportunity for the public to comment

about their issues and concerns regarding the review and update of the U.S.

Army Corps of Engineers’ Water Control Manual for the Alabama-Coosa-

Tallapoosa (ACT) River Basin.

LMLPA members are preparing comments supporting the proposed two-

foot increase in the winter lake level. LMLPA will also request that the Corps

postpone the individual water control manuals for the Coosa reservoirs until

after the Federal Energy Regulatory Commission relicenses Alabama Power’s

Coosa reservoirs so that any new license requirements can be incorporated

into the updated manuals. LMLPA will ask that a copy of the drafts of the

Master Manual and the individual manual for Logan Martin be available for our

study well ahead of the public comment meetings for the draft documents.

LOGAN MARTIN LAKE MAKES The New York TimesLogan Martin Lake was featured in a recent issue of the New York Times newspaper in the travel section under

“HAVENS”. The article is entitled “Most Days Are for Fishing and a Few for NASCAR.” The article is printed here for

our readers.

Most Days Are for Fishing and a Few for NASCARAs Interstate 20 slices through the pines of central Alabama, it crosses a bridge over the silvery brown water of

Logan Martin Lake about 40 miles east of downtown Birmingham. Fishermen are almost always out in their boats,

and less affluent anglers cast from the edge of the bridge, much as they have since 1964, when the lake was creat-

ed by the damming of the Coosa River. The lake has been a popular getaway for Alabamians since.

“I think about everybody in Birmingham at one time or another has had a boat up here,” said Lawrence Fields, a

real estate agent and a former mayor of Pell City. Mr. Fields vacationed there when he lived in Birmingham before

making it his family’s permanent home in 1972.

Away from the highway, the still, wooded shoreline is dotted with homes both old and new in the lakeside towns

of Pell City, Lincoln and Riverside, as well as other communities. There’s a variety of homes, from new develop-

ments to neighborhoods of 30-year-old midsize ranch houses, from three-story condos to one-room fishing shacks

and trailers.

In several lakeside swaths, especially on the east side, construction on houses and condos in gated communi-

ties ranges from the planning stages to almost complete.

Although the lake’s brief history is one of second-home owners, in the last decade the region has experienced a

rise in industry, most notably a Honda plant in Lincoln with 4,500 employees, and that has brought in many more

full-time residents. With the spate of new developments under way, the parts of Talladega and St. Clair Counties that

straddle the 17,000-acre lake are anticipating more second- and full-time homeowners.

“You can feel the winds of change here,” said Everett King, a real estate broker in Lincoln.

But Logan Martin Lake isn’t just fishing and water sports. The Talladega Superspeedway, a stop on NASCAR’s

Sprint Cup circuit, is seven miles east of the lake. Its mountainlike bank of red-and-blue stands spans a full mile.

A gated condo community under construction near the entrance to the track will include 48 units, eight of which

are penthouses with views of the speedway. Prices start in the high-$200,000s.

Twice a year, generally in April and October, the track draws more than 140,000 fans for races. “The races are

to the lake what spring break is to Fort Lauderdale,” said Bud Kitchin, a salesman of plumbing supplies who is a

native of Anniston in eastern Alabama.

Mr. Kitchin visited Logan Martin Lake regularly until two years ago when he and his wife, Debbie, moved to

Lincoln full time.

They built a 4,600-square-foot waterfront home with Caribbean touches for $600,000 on four acres they bought

14 years ago. The Kitchins’ coral-colored house features windows in the master bedroom that frame the sunset and

kitchen countertops made of granite from Namibia.

Dewey Barber, of Gardendale, a suburban town north of Birmingham, has owned four vacation homes on the

lake, going back 41 years. He bought his current home there, a 4,500-square-foot, one-story house in Pell City, in

December 2006 for $450,000. The five-bedroom, four-bath house includes a dock where Mr. Barber keeps a pon-

toon boat and a runabout he uses to tow water-skiers. He said there is good fishing from his dock. “You can catch

the crappie there about as fast as you can pull them out,” he said.

Mr. Barber, who owns a Chevrolet dealership and a golf course, has owned second homes in the Smoky

Mountains and on the Gulf Coast but said he prefers Logan Martin Lake because his lake house is only 50 minutes

from his main home. About twice a month, he takes some of his 15 great-grandchildren and 14 grandchildren for

long weekends at the lake. “It’s a great place to fish,” he said, “and a great place to swim for my grandchildren.”

Retail and dining options around the lake are on a par with those found in most small Southern towns.

The Ark, in Riverside, is widely regarded as one of the best of the few restaurants in the region. A catfish house

that has been around since the 1930s, it has checkered tablecloths and wood-paneled walls, and its rusted sheet-

metal sign outside has swung sideways since one of the hooks broke loose. But the fried catfish is moist and deli-

cious; the one-piece fried fillet served with fries, coleslaw and hush puppies, is $6.95 at lunch and $7.95 at dinner.

There is a Wal-Mart Supercenter just off the Interstate in Pell City, and there is a Kmart down Highway 231.

But there is no mall or even a quaint strip of stores as in many vacation areas. Locally owned shops includeLucky’s Guns and Tackle in Cropwell, south of Pell City, a large store where everything from fishing rods to hand-guns is for sale. There are various small bait shops and small groceries like Treadwell’s in Vincent, a community onthe south end of the lake. “The major part of our business is fishing and weekenders,” said Jack Orcutt, an ownerof Treadwell’s.

Mr. Orcutt said he moved to the lake from Birmingham seven years ago so his daughter, Leila, now 12, couldgrow up in a small town.

“I had a little girl I didn’t want to be in the video-game generation,” he said. “Out here, she climbs trees, rideshorses.”

Logan Martin Lake is only 40 minutes by car from Birmingham, and as little as 90 minutes from Atlanta. Forfans of stock car racing, being at the lake in April or October is akin to what a golf fan would feel living near the fair-ways of a Grand Slam tournament. And the lake is known for its fishing, frequently the site of bass tournaments.

For boaters, there are many marinas, including the Birmingham Sailing Club, founded in the 1960s. It is at aplace not far from the dam where the water spreads a mile wide.

As at most lakes in the Southeast, last year’s drought had a devastating impact on water levels. And even ingood rain years, homes that are not on the main channel — what was the course of the Coosa River — can havevery low water levels in winter. “Seasonal water” is how real estate agents describe it. But what that really means is

that in January or during a severesummer drought, a home’s dockmight be sitting in mud.

The rainy spring has raised waterlevels to a few inches below the nor-mal summer level, according toAlabama Power, which manages thedam.

Compared with property at otherregional lakes, especially those ofsimilar terrain and closer to Atlanta, real estate on Logan Martin Lake isreasonably priced. Small houses onthe water start at just under$200,000, though there are top-of-the-line houses that pass the $1 mil-

lion mark.“I’ve had several people going from lake to lake, and they decided Logan Martin is more affordable,” said

Sharon Thomas, a real estate agent in Cropwell.Six planned gated lakefront communities, as well as the one near the racetrack, are building and selling new

homes. These developments offer a range of condos, town houses and single-family homes. Prices range from lessthan $300,000 to more than $700,000; promised amenities include golf-cart-charging stations and stretches of light-ed shoreline.

The lakeside towns of Pell City, Lincoln and Riverside have a combined population of 18,780, according to2006 Census Bureau estimates.

The 17,000-acre lake is 48 miles long by a mile at its widest.Logan Martin Lake is about 40 miles east of Birmingham, and 105 miles west of Atlanta.WHO’S BUYING — Second-home owners and retirees from Alabama and Georgia and full-time residents mov-

ing there for work, some of whom commute to Birmingham or Anniston.

The Alabama Department of PublicHealth has issued the latest fish consumptionadvisories for Alabama lakes. The new advi-sories are in addition to advisories alreadylisted for the state. According to Dr. Neil Sass, the state epidemiologist for the Department ofPublic Health, the new advisories do not show anincrease in unsafe fish in Alabama but reflect a changein standards. One of the warnings for fish with high lev-els of mercury is for Choccolocco Creek, a tributary ofLogan Martin Lake. Fish consumption advisories havebeen in place for that area for years because of PCBcontamination. It is believed that eating fish contaminat-ed with high levels of mercury can cause problems withbrain development as well as behavior and learningproblems in the fetus of pregnant women and childrenless than 15 years of age. Others are advised to limittheir intake of fish containing high levels of mercury.

Current fish consumption warnings for our area areas follow:

Coosa River and its tributariesLocation—Choccolocco Creek in Calhoun and Talladega counties.

Where—Entire length of creek from south of Oxford to Logan Martin Lake.Fish species—AllContaminant—PCB's and mercuryConsumption level—Do not consume
