The basicformula forthe valuation oflandscovered byvasorCAshall be:LV = (CNI x0.60) + (CSx0.30) + (MVx0.10)Where: LV = Land ValueCNI = Capitalized Net Income(based on land use andproductivity)CS = Comparable Sales (based onfairmarketvalue equivalentto70% ofSIRZonalValue)MV = Market Value per TaxDeclaration (based onGovernmentassessment)A.1 ThreeFactors arePresent WhentheeNI, CSand MVare present, theformula shall be:LV = (CNI x0.60) + (CS x0.30) + (MVx0.10)A.2 TwoFactors arePresent A.2.1 When the CS factor is notpresentand CNI and MVare applicable,theformula shallbe:LV = (CNlxO.90) + (MVxO.10)A.2.2 Whenthe CNI factoris notpresent, and CS and MVareapplicable,theformula shall be:LV = (CSxO.90) + (MVxO.10)A.3 Only OneFactor isPresent When both the CS and CNI are notpresentand onlyMVis applicable, theformula shall be:LV = MVx2In nocase shall the value ofidle land using the formula (MV x 2) exceedthe lowest value of land within the same estate under consideration orwithin the same barangay, municipality or province (in that order)approvedbyLBPwithin one (i) yearfromreceiptofClaim Folder(CF.)1 A.4 PermanentCropsNotYetProductiveorNotYetFruitBearingWhen the land planted to permanentcrops is notyet productive or notyetfruit-bearing atthe time ofField Investigation (FI), the land value shall beequivalenttothe value ofthe land plusthe Cumulative DevelopmentCost(CDC) ofthe crop from land preparation up to the time ofFI. In equationform:LV = (MV x2) + CDCWhere:1. MV to be used shall be the applicable UMV classification of idleland.2. CDC shall be grossed-up from the date ofFI up to the dateofLBPCF receipt forprocessing butin no case shall the grossed-up CDCexceed thecurrentCDC industrybased data.In case the CDC data provided by the landowner could not be verified,DAR and LBP shall securethesaid datafrom concerned agency/ies or, intheabsencethereof, shall establishthe samethrough industrystudies.In no case, however, shall the resulting land value exceed the value ofproductive land similarin terms ofcrop and plant densitywithin the estateunderconsideration orwithin the same barangay, municipalityor province(in thatorder) approved by LBPwithin one (1) yearfrom receiptofCF.In case where CS is relevant or applicable, the land value shall becomputed in accordance with Item A.2.2 where MVshall be based on thelowestproductivityclassificationoftheparticularland use.A5 Permanent Crops Not Yet Productive or Not Yet Fruit BearingIntroducedbyFBsUnderTenancyArrangementWhen the land is planted to permanent crops introduced by the farmer-beneficiaries (FBs) under tenancy arrangement, as determined by DAR,which are not yet productive or not yet fruit-bearing, the land value shallbe computed by using the applicable UMV classification of idle land. Inequationform:LV = (MV x2)In no case, however, shall the resulting land value exceed the value ofproductive land similarin terms ofcrop and plantdensitywithin theestateunderconsideration orwithin the same barangay, municipalityor province(in thatorder)approved by LBPwithin one (1) yearfrom receipt ofCF.A6 PermanentCropsNoLongerProductiveorReadyforCuttingThe value of lands planted to permanent crops which are no longerproductive or readyforcutting shall be determined byusing theapplicableUMVclassification ofidle land plusthe salvagevalue ofthe standingtreesatthetimeofthe FI. In equationform:LV = (MV X 2) + SalvageValueIn no case, however, shall the resulting land value exceed the value ofproductive land similarin terms ofcrop and plantdensitywithin the estateunderconsideration orwithin thesame barangay, municipalityorprovince(in thatorder)approved byLBP within one (1) yearfrom receiptofCF.In case where CS is relevant or applicable, the land value shall becomputed in accordance with Item A.2.2 where MVshall be based on thelowestproductivityclassification oftheparticularland use.A.7 LandsPlanted toSeasonal Crops Without Recordof Production A.7.1 For lands with no historical record of production but planted toseasonal cropsatthe time ofFI orwhose annual production cannotbe established since the land has not completed at least onenormalcropcycle forcropswhose cycle is morethan oneyear, andat least two normal crop cycles for crops whose cycle is less thanone year immediately preceding the date of FI, the land shall bevalued based on the lowest productivity classification of theparticularland useperFI. In equationform:LV = MVx2In no case, however, shallthe resulting landvalueexceedthe valueof productive land planted to the same crop with history ofproduction within the estate underconsideration orwithin the samebarangay, municipality orprovince (in that order) approved by LBPwithin one (1) yearfrom receiptofCF.In casewhere the CS is relevant orapplicable, the land valueshallbe computed in accordance with Item A.2.2 where MV shall bebased on theapplicableclassification ofidle landA.7.2 For landsplanted to seasonal crops which are notyetproductive atthe timeofFI butwere previously planted to anotherseasonal cropfor at leasttwo (2) years immediately preceding the date of FI, theland valueshall bedeterminedasfollows:LV = (CNI x0.90) + (MVx0.10)Where:1. The CNI ofthe property shall be based on the annual grossproduction ofthepreviouscrop.2. The MV of the land shall be based on the applicable UMVclassificationofthe previouscrop.In caseswhere CS is relevant orapplicable, the land valueshall becomputed in accordance with Item A.2.2 where MVshall be basedon the lowestproductivityclassificationoftheprevious land use.If the previous crop failed to satisfy the two (2) year minimumperiod ofplanting, the land shall be valued in accordancewith ItemA.7.1.3 In caseswhere CS is relevantorapplicable, the land valueshall becomputed in accordance with Item A.2.2 where MVshall be basedon the lowestproductivityclassificationofthepresentland use.A.7.3 For lands planted to seasonal crops intercropped with otherseasonal crop/s, none ofwhich have record ofproduction, the landshall be valued in accordance with Item A.7.1 where the MV oftheland shall be based on the lowest productivity classification ofthecropwith the higherorhighestUMV.A.8 Thevaluation oflands utilized as homelotlswhich is/aresituated in an idleland orproductive land, shall be thesameas said idleorproductiveland.If the homelotls is/are situated in or adjacent to lands with different landuses, the value of the homelot shall follow the lowest land value of thelandwhere itis situated in oradjacentto.A.9 In all ofthe above, the computed value using the applicableformula shallin no case exceed the landowner's (LO) offer in case ofVOS. The LO'soffershall be grossed upfrom thedateoftheofferup tothe dateofreceiptofCF by LBPfrom DARforprocessing.A.10 The dateofreceiptofCF by LBP from DAR shall mean thedatewhen theCF is determined by the LBP - Agrarian Operations Centers' ClaimsValuation, Processing and Payment Division to be complete with all therequired documents and valuation inputs duly verified and validated, andreadyforfinal computation/processing.A.11 The basic formula in the grossing up of valuation inputs such as LO'sOffer, BIR Zonal Value and Market Value per Tax Declaration (MV) shallbe:Grossed-UpValuation = Valuation x Regional ConsumerInput Input Price Index(RCPI)AdjustmentFactorThe RCPI Adjustment Factor shall refer to the ratio of the most recentavailable RCPI for the month issued by the National Statistics Office(NSO) as of the date when the CF was received by LBP from DAR forprocessing and the RCPI for the month as of thedate/effectivity/registration of the valuation input. Expressed in equationform:Most Recent RCPI forthe Month as ofthe Date ofReceipt ofCF by LBP fromRCPI Adjustment DARFactor=.RCPI for the Month Issued as ofDate/Effectivity/Registration of theValuation InputB. Capitalized Net Income (CNI) - This shall refer to the difference between thegrosssales(AGPxSP) and total costofoperations (CO) capitalized at 12%.4 Expressed in equationform:(AGP x SP) - COCNI =0.12Where:CNI = Capitalized NetIncomeAGP = Annual Gross Production corresponding to the latestavailable 12-months' gross production immediatelyprecedingthe date ofFI.SP = The average of the latest available 12-months' sellingprices prior to the date of receipt of the CF by LBP forprocessing.CO = Cost of Operations corresponding to the latest available12-months'immediatelypreceding thedateofFI.The CO shall include the direct and indirect cost relatedto production.0.12 = Capitalization RateWheneverthe cost ofoperations could not be obtained orverified, the CNI shallbe computed based on the NetIncomeRate (NIR) Expressed in equationform_ (AGP xSP xNIR)CNI -- .. --------0.12Wherea. Forproductivecoconutlands, the applicableNIR is 70%;b. Forsugarlandsand rubber, referto pertinentexisting guidelines;c. Forothercrops, theassumed NIR is 20%.DAR and LBP shall continue to conduct joint industry studies to establish theapplicable NIRforeach cropcovered underCARP.B.1 The landowner shall be required to submit BIR-filed audited financialstatementofthe land subject ofacquisition for the purpose ofdeterminingtheannual grossproduction, selling price (farm gate) and costofoperationand such other data as may be required. These data shall bevalidated/verified by the DAR and LBP field personnel against LO'saccounting records, industrydataand field interview.In case of failure by the landowner to submit the statement fifteen (15)days prior to the date offield Investigation ofthe landholding per requestof the Municipal Agrarian Reform Officer (MARO) or the data statedtherein cannot be verified/validated, DAR and LBP may adopt anyapplicable industry data or, in the absence thereof, conduct an industrystudy on the specific crop which will be used in determining theproduction, costand netincomeofthe subject landholding.5B.2 Industry data on production, cost ofoperations and selling price shall beobtained from government/private entities. Such entities shall include, butnot be limited to, the LGU-Municipal/Provincial Agriculturist Office, theSugar Regulatory Authority (SRA), the Philippine Coconut Authority(PCA) , BAS-Provincial Agricultural Statistics Office and other privatepersons/entitiesknowledgeablein theconcerned industry.If possible, AGP and SP data shall be gathered from the barangay ormunicipality where the property is located. Agricultural machinery and transport equipment that areessential to carry out the intended farming operations, on-farm processing and marketing offarm products.2.
