Pursuant to Article V, Section 26, of the Constitution of the State of Oklahoma, the First Regular Session of the House of Representatives for the Fifty-first Legislature assembled in the House Chamber at 12:00 o'clock noon.

Representative Armes called the House to order. Prayer was offered by Pastor Tony Alvarez, First Assembly of God Church, Harrah. Pastor Alvarez was sponsored by Speaker-elect Cargill.

Representative Piatt moved that the Communications dated November 16, 2006, and November 22, 2006, to the Speaker of the House of Representatives and furnished to the Chief Clerk of the House of Representatives by the Secretary of the State Election Board listing the persons elected to the House of Representatives for the Fifty-first Legislature be accepted as prima facie evidence of membership in the House of Representatives and that said Members be seated in the House Chamber and the above-named Communication be printed in the House Journal, which motion was declared adopted. “First of all, I want to thank all of you for your service in this body. Some of us may have had our disagreements in the past, but none of us would be here

if we didn’t have a love and devotion for this state. I look forward to working together. I pledge today to be in communication with you and to work with you as a partner in the important job we have before us.

Let me also thank you for giving me the privilege of serving as Speaker. I am humbled, grateful and thoroughly excited about this opportunity.

My boys, Jackson and Henry, who are with me here today, are the fifth generation of my family to live in eastern Oklahoma County. I’m proud of my family, and their presence here today says a lot about our past but also about our future as a state.

When I think about my journey, my family’s journey, our state’s journey, I am amazed by the trials we’ve endured and the triumph of our people.

My own family – the Cargills – could have been the subject of John Steinbeck’s classic novel, but OUR story tells a more complete story about Oklahomans. Although my forefathers were born in Oklahoma, like so many during the first half of the twentieth century, they joined those who traveled to California in search of land, work, and dignity.

But the Cargills returned to Oklahoma because this was our home, and this is where our hopes and hearts remained. The lessons of Oklahoma have been passed down through the generations.

The Cargills are like most Oklahomans – determined, independent, committed to faith and eternally optimistic.

My father was a forklift driver at the grocery store warehouse right up the street here at 36th and Lincoln. My mother is the pianist and music director of our church, Harrah First Assembly of God. From my father and mother, I learned the value of faith and hard work.

Now my wife, Amber, and I live just down the road from my boyhood home. Amber stays at home and just like my mom did for my brother and me, she is always there for our boys, teaching them the values of honesty and hard work. I couldn’t do this without Amber, and I am grateful for her support.

I’d ask my entire family to please stand and be recognized. Thank you. Yesterday marked the first day of Oklahoma’s Centennial Year. Over the course of this

year we will celebrate, recognize and reflect on the achievements accomplished during our 100 years of statehood.

We have a lot to be proud of, but what I find truly exciting is what lies ahead. My hope is that during this landmark year we also consider how our great state will be defined during its second century.

When you consider our history, we started with a bang. Beginning with the land run, our state was full of energy, excitement and enormous growth. From the dust bowl days in the thirties, to the energy bust of the early eighties, we’ve had our ups and downs.


But our challenge as leaders, in this unique place, in this unique time, is to ensure that Oklahoma at the start of the 21st century is once again the beacon of hope, growth and opportunity that it once was 100 years ago.

Of course, this building usually doesn’t reward long-term outlooks. It rewards sound bites that read well in tomorrow’s papers

And there will always be pessimists and naysayers, people who say it can’t be done. But our history is different. Our history belongs to people like the land run pioneers who loaded up in covered wagons and risked everything they had to pursue their dreams.

When I think about Oklahoma’s future I envision healthy and prospering families; a world-class education system; safe communities, tough on crime but tough on the causes of crime too; a strong and diverse economy with the type of creative business culture and quality of life that attracts and retains the best and the brightest; and an environment where arts and culture thrive; an environment that inspires the creativity of our next Nobel Prize winning scientist, Pulitzer Prize winning author or Grammy award winning artist.

How do we make that vision a reality? I have some ideas on how to achieve these ambitious goals. But I know that others have ideas as well, and if we are serious about getting results then all ideas should be considered.

That’s why I’m launching an initiative that will solicit ideas from anyone interested in improving Oklahoma – business leaders, pastors and teachers, the people who work in the beauty shops and the barber shops, everyday workers and citizens. The best of those ideas will be selected and compiled to serve as a policy guide for the coming years. More on this in a bit.

Part of my vision for Oklahoma’s future includes improving how the state conducts its business and working to engage citizens in the process. I will strive to make Oklahoma’s government more accountable, more efficient and more inclusive.

As the first step towards this, the House has restructured its committee process so that more members and committees are able to provide input into the state’s budget. We will examine state agencies, boards and commissions with an eye towards cost savings and fiscal responsibility and identify ways to get better results from state government.

I also think there is emerging consensus that some of the old ways of looking at government just don’t work anymore. On the left, you had those who looked at government as the solution to all of our problems. On the right, there were those who perhaps undervalued investment in things like transportation and public education.

Today, I believe more people are recognizing that there is a third way, one in which government works in partnership with individuals, communities and the private sector to move this state forward. This is the philosophy that I embrace.

Governments can’t raise your family. Governments can’t build economies. Governments can’t change hearts. People do that.

And it’s individual people, especially those working in the voluntary sector, churches, charities and the faith community, that visibly and tangibly improve the lives of our citizens every day. We should be working with and inviting them in - not shutting them out - inviting them in to partner with us to build a safer, healthier, more prosperous Oklahoma.

Governments certainly do play an important role, but they do it by helping put the fundamentals in place. They help by creating an overall environment that is safe, healthy and rewarding.

To do all this, we’ll need strong leadership and good ideas. We know there’s power in ideas. As John Kennedy once said, “A man may die,

nations may rise and fall, but ideas live on.”

The New York Times Sunday Magazine recently published its sixth annual “Year in Ideas” edition. I have it here. It’s filled with the best, sometimes quirky, often brilliant and always innovative ideas of 2006.

I want 2007 to be the “Year of Ideas” for Oklahoma. You know, every year I’ve noticed here at the capitol that the same, tired rhetoric tends

to get recycled. We all do it – repeating the same political slogans. Oklahomans are tired of the same old, same old. They’re tired of a process inside this

building that doesn’t involve and engage them. That’s why over the next week, I’ll be launching the 100 Ideas Initiative. Oklahoma’s second century is full of promise, and it should be about creating an

Oklahoma that is innovative and forward-thinking. The 100 Ideas Initiative will help transform Oklahoma’s mindset -- to look ahead not just to the next few years, but to the long-term future of our state.

Through a series of town-hall meetings and interaction with our citizens, the 100 Ideas Initiative will begin to develop a comprehensive vision for our state’s future.

It’s a commitment to listen to the state’s citizens, to be guided by THEIR IDEAS. It’s a commitment to work to create a state government that boosts opportunity for the many, not just the few.

Within the next week, I’ll unveil additional details about 100 Ideas, along with a comprehensive website, 100ideasok.org, where Oklahoma’s citizens can log on and begin interacting immediately to offer their ideas and input.

Today, I am distributing blank notebooks to each of the 101 members of the House, as well as the 48 state senators, the governor, lieutenant governor, and other state office holders. I hope you’ll use these notebooks as a place to begin storing your ideas for our future.

I want to find the best ideas for Oklahoma, and we’ll be seeking pro-growth, pro-reform ideas from everyone, regardless of party affiliation. I want every person, from every corner of the state, to tell the State House how we can make Oklahoma better.

At the end of this year -- we will publish a book filled with the best 100 ideas from the 100 Ideas Initiative.

Oliver Wendell Holmes, the former Supreme Court justice, once said, “Every now and then a man’s mind is stretched by a new idea and never shrinks back to its former dimensions.”

That’s what the 100 Ideas Initiative is all about. And I pledge to you -- it’s what my term as Speaker will be all about.

It will be about finding the best in people – in all of the people of Oklahoma. I’ll be open to all of you here in this chamber – and be open to the innovations and ideas of all Oklahomans.

On my desk I have a famous saying by Ronald Reagan. I read it every day. It says, “There is no limit to what you can accomplish if you don’t care who gets the credit.”

Lately when I read that quote I’ve been reminded of one of the great success stories of this past year -- the OU football team. Now, OU winning a lot of games is, of course, not really that surprising, even to us Cowboy fans. But the way in which they won is notable.

You see, early in their season, OU lost their starting quarterback and their Heisman trophy-caliber running back. So what were they left with? They were left with a group of guys who didn’t care about how many carries they individually had, how many points they


personally scored or how many tackles they individually made. They cared about winning. And that’s what they did, win - together.

With the challenges and opportunities we face as a state we need to stop focusing on who scores the points or makes the touchdowns and focus on winning - winning as a state. The truth is in twenty years no one will remember the political fights and the election victories. They will remember what we did to move this state forward.

And isn’t the future of our state worth every bit of effort we pour out in this building. I love this state and its people. It’s what brought me back here after spending a few

years out of state for school and my first job. I call it “Oklahoma love.” What’s Oklahoma love? It’s taking a sunny, Saturday afternoon drive down old route 66. That’s Oklahoma love. It’s going to the Braum’s ice skating rink in downtown Oklahoma City each winter,

seeing generations of families sipping on hot chocolate, enjoying the season. That’s Oklahoma love It’s also seeing people on that same rink who have obviously lived in the South all their

lives, have never even seen a pair of ice skates before, and watching them get out there and try.

It’s going to the Civic Center or the Performing Arts Center with your family and catching a nice jazz concert.

It’s running in the Oklahoma City Memorial Marathon and supporting the work, the memory and the sacrifice of so many Oklahomans on that fateful day ten years ago.

That’s Oklahoma love. It’s going up to Jenks and taking your kids to see the sharks at the Oklahoma

Aquarium. It’s driving out to Choctaw and having a great meal at Old Germany restaurant. It’s heading up to Grand Lake and spending the Fourth of July weekend with about

fifty thousand of your closet friends and neighbors. That’s Oklahoma love. It’s driving out to the Great Salt Plains in Northwest Oklahoma and digging for salt

crystals with your kids. It’s heading down to Broken Bow and doing some trout fishing on the Mountain Fork

River. It’s following the Sooner football team all across the country as they compete in

championships and bowl games. That’s Oklahoma love. And yes, it’s going up to Stillwater, week after week after week, even in the 0-10-1

years, putting your orange jersey on and representing. That’s Oklahoma love. We have so much to offer. Abundant green space, lakes and parks - plenty of room to move and grow. Our major cities have the best commute times in the country. We have an NBA basketball team, and, I’m happy to say, the ownership group of

another one. Oklahoma City was recently listed in the Wall Street Journal as one of the ten fastest

growing communities for the development of patents and intellectual property in the entire country.

BRAC is bringing a renaissance to Lawton and our research and economic development efforts in Ardmore are attracting national and even international attention.

In nearly every corner of the state, progress and opportunity are beginning to flourish. As we look back on the first century of our state’s history, thinking about the pioneers

who settled the land, those who worked through the hardships of the Great Depression, the oil field workers and factory workers who built this state, the small business owners who provided work and opportunity … we know their toil has become our triumph.

So this year, the year of our Centennial Legislature, I challenge all of you to consider whether the ideas brought forth in this chamber will make us a leader among states or enhance our competitiveness among nations.

I challenge us as a legislative body to develop and support proposals that are forward-thinking, that lay the groundwork for the next generation and help propel Oklahoma into its next 100 years.

I look forward to taking new and aggressive approaches to tackling the issues that confront our state.

“Oklahoma is celebrating its first 100 years of statehood in the greatest nation that has ever existed on earth. During that time, the Oklahoma House of Representatives has served as catalyst to move Oklahoma upward and onward.

I am humbled and honored to be elected, by my peers, as Speaker Pro Tempore of the House of Representatives for the first legislative session in the second century of Oklahoma’s history. I would like to thank each of the members for this honor and your faith in me to preside over the sessions in a fair and impartial manner.

I would also like to thank those in my family who have helped me in innumerable ways to be able to stand here and serve you in this capacity. First I would like to thank my parents for all they did to shape and mold my character. My mother, Myrl Blackwell, is here today in the balcony. My father, MSGT Carl Blackwell passed away twenty-three years ago, this month. However, both instilled in me discipline and determination, combined with a desire for excellence and education.

I would also like to thank my wife of 16 years, Joanna Blackwell. She is here with our precious children, Corissa, Carson, and Caleb. She has been a uniquely gifted and loving partner to help me through all the trials and tribulations of political life.

Thanks also to two of my sisters who were able to come today…Stella Bass and Carla Blackwell. I also appreciate the attendance of the Beaver County Commissioner, my brother-in-law, Brad Raven. I extend a special thanks to District Judge Greg Ziglar, from Texas County, who swore me in. I appreciate the embodiment of justice he symbolizes in the panhandle and for the state of Oklahoma.

Most of all I would like to thank God and His providence, which has put me in this position to serve Him. As George Washington stated, “Whereas, it is the duty of all nations to acknowledge the Providence of Almighty God, to obey his will, to be grateful for his benefits, (and) humbly implore his protection and favor.” My prayer is a hope I will be able to follow the directives of Christ to be someone who protects the helpless, provides

justice for the hapless, and presents liberty for all. I also pray, as a body, the House of Representatives will be able to fulfill those responsibilities this session.

I believe our challenge this session is to be morally responsible and financially accountable. During the past 100 years, the state has seen economic ups and downs. However, overall, Oklahoma remains a poor state which lags behind other states within our region in terms of both population and economic growth. The last two years have seen this trend starting to be reversed.

To continue this metamorphoses, the House of Representatives needs to continue to lead the state with legislation designed to provide just laws and judicious budgets. For as the Nobel Prize-winning economist, Friedrich von Hayek observed, “Economic and political freedom are inseparable.”

In terms of legislation, we need to be a four-fold test to assure the legislation passed by this body will do exactly what it is supposed to do. The tests are: to limit the scope and size of government, provide equitable tax relief, protect the structure of the family, and assure personal responsibility is maintained.

A government limited in size and scope is necessary. Limitation because of the inherent flaws found within a strongly centralized government allowed unlimited growth. Our founding Fathers knew the government had only specific, legitimate functions. As Thomas Jefferson said, “A government big enough to give you everything you want is big enough to take everything you have.”

One of the reasons for the American Revolution was a revolt against unfair and unchecked taxation. It’s also necessary for government to make sure it taxes citizens in a fair and equitable manner. The recent tax cuts, championed by the House last year, represent a step in the right direction. Tax cuts have shown, throughout history, to not be a zero sum game, but a stimulus to the economy and results in revenue growth.

The third test of just laws is morality. Does the law strengthen and maintain the family structure in our society? As George Washington forcefully maintained in his farewell address, “Of all the dispositions and habits which lead to political prosperity, Religion and Morality are indispensable supports. In vain would that man claim the tribute of Patriotism, who should labor to subvert these great pillars of human happiness, these firmest props of the duties of Men and Citizens.”

The last test of legislation is: Does it maintain and protect personal responsibility? Individual liberty can only be maintained within the sphere of individual responsibility. The removal of one by necessity results in the annihilation of the other. Any law removing personal responsibility also limits personal liberty.

However, the biggest challenge facing our legislature is to spend, appropriate, and invest the tax money of its citizens in a wise and prudent manner. In the past 100 years the state of Oklahoma has only had its Rainy Day Fund at maximum funding during the past two years. The past economic booms have resulted in spending sprees on dubious projects. It is imperative our present prosperity be used wisely. Oklahoma must pay its debts and fund those legitimate functions of government at fiscally responsible levels.

I know the House will respond again this year in leading the state in passing fair and just laws and a prudent budget. It will be an honor to oversee the process that will result in a morally responsible legislation and a financially accountable budget. Thank you once again for the opportunity to serve you as the Speaker Pro Tempore in the 51st Session of the Oklahoma State Legislature.”

JOINT SESSION

The First Joint Session of the First Regular Session of the Fifty-first Legislature assembled in the House Chamber on Tuesday, January 2, 2007, and was called to order by Speaker Cargill.

Senator Laster moved that the attendance roll call of the Senate be considered the

attendance roll call of the Senate in Joint Session, which was the order. Representative Piatt moved that the attendance roll call of the House be considered the

attendance roll call of the House in Joint Session, which was the order. Speaker Cargill declared quorums of the Senate and House present and the Joint

Session duly assembled. Invocation was given by Pastor Tony Alvarez, First Assembly of God Church, Harrah.

Pursuant to Article VI, Section 5, Oklahoma Constitution, Speaker Cargill announced

the canvassing of the returns of the General Election held on November 7, 2006, as certified to the House of Representatives and transmitted to the Speaker of the House of Representatives by Secretary of the State Election Board Michael Clingman.

Senator Laster moved to dispense with the reading of the election results and ordered

same printed in the Journals of the House and Senate respectively, which motion was declared adopted.
