June 28, 2005 Facts: UNILA B hi red a priv ate investigat or to inv est igate a place pur ported to b e manufacturing f ake UNILAB pro duc ts, especia ll y Revicon multivitamins . The agent to ok some pho tog raphs where the clandest ine manufacturing oper ati on was taking place. UNILAB then sought the he lp of the NBI, which there after filed an application f or t he issuance of sear ch warrant in the RTC of Manila. After finding pro bable cause, the c ourt i ssued a sear ch warrant direc ting the polic e to seize ― fi nishe d o r unfinished pro duc ts of UNILA B, particularl y RE VICON multivitamins.‖ No fake Rev icon was howe ver found; instead, sealed b oxes where seized, whic h, when opened c ont ained 60 ml bottles of D isudrin and 20 0mg tablets o f Inoflox, both were brands used by UNILA B. NBI pray ed that some of the sized items be turned ov er to the c ustody of the Burea u of Food and Drugs (BFAD) for ex amination. The cour t granted the motio n. The respo ndents then fil ed a mo tion to quash the search warrant or to suppress evidenc e, alleg i ng that the seized item s are c onsidered to be fruit of a poiso nous tree, and therefore inadmissib le for any purpo se in any proce eding, whic h the petitioner s opposed allegin g that the b oxes of Disudrin and I noflox were seized unde r the plain v iew doct rine. The cou rt, howeve r, granted the motion of the respondents. Issue : Whether or no t the seizure o f the sealed boxes which, when ope ned, cont ained D isudrin sy rup and Inoflox, we re valid under the plain v iew doctrine . Held: I t is true tha t things not de scr ibe d in the warrant may be seized under the plain v iew doctrin e. Howev er, se ize d things not described i n the warrant c annot be presumed as plain view. The State must adduc e ev i dence to prove that the elements f or the doctrine to apply are pre sent , namely : (a) the ex ecuting law enforcement off icer has a p rior justific ation for an initial intrusion or o therwis e pr operl y in a p osition fro m which he c an view a particular order; (b) the officer must discover incriminating evidence inadv ertent ly; and (c) it must be imm ediately apparent to the po l ice that the items they observe may be ev idence of a crime , contraband , or o therwise subject to seizure It was thus incumb ent on the NBI and the petitioner to pr ove that the items were se ize d on plain view.
