Shipper vs. Carrier Responsibilities

Carrier Requirements

• Keep in mind that carriers may impose requirements that are stricter than the the 49CFR Hazardous Materials Regulations.– For example, UPS™ does not ship HazMat

Internationally.

Shipper’s Acting As Carriers

• If you ship or deliver an Air bag module in your own vehicle, such as your own pick-up truck or delivery van, then you MUST comply 100% with these regulations.

• Failing to comply with these regulations can cost up to $27,500/day/incident.

Structure of the HMR

• The U.S. DOT Hazardous Materials Regulations (HMR) are found in Title 49, CFR, Parts 100 – 185.

What are Hazardous Materials? §171.8

“HAZARDOUS MATERIALS”- are any substance or materials, which has been determined by the Secretary of Transportation to be capable of posing an unreasonable risk to health, safety, and property when transported in commerce, and which has been so designated.

Materials are Classified Based on Their Hazard Characteristics

• There are 9 DOT hazard classes (HC):

1) Explosives;2) Gases;3) Flammable &

Combustible Liquids;4) Flammable Solids;5) Oxidizers &

Organic Peroxides;6) Poisons;7) Radioactives Materials;8) Corrosives; &9) Miscellaneous Materials.

Air bag modules, pyrotechnic are DOT Class 9 Hazardous Materials

• Air bag modules, pyrotechnic, Air bag inflators, pyrotechnic, & Seat-belt pretensioners, pyrotechnic are classified as Class 9 Miscellaneous hazardous materials.

Air bag modules, compressed are DOT Division 2.2 Hazardous Materials

• Air bag modules, compressed gas, Air bag inflators, compressed gas, & Seat-belt pretensioners, compressed gas are classified as Division 2.2 Non-Flammable Gas hazardous materials.

• A shipping paper is one method of communicating that what we are shipping is a hazardous material. There are many different kinds of shipping papers that we can use.

• Each person who offers for transportation a hazardous material must prepare a hazardous materials shipping paper.

• For Driver Side air bag modules or seat-belt pretensioners, you may use the 1DAB UN Specification packaging.

• For Passenger Side air bag modules or seat-belt pretensioners, you may use the 1PAB UN Specification packaging.

• You must follow the packaging closure instructions exactly (49CFR173.166). Be sure to contact the package manufacturer for authorization of any substitutions to be made with any component of the packaging.

Overpacks §173.25(a)(1)

• Overpacks are used to provide protection or convenience in handling of a package or to consolidate two or more packages.

• To be able to use an overpack for authorized packages containing hazardous materials, the following five conditions must be met:

1) The package meets the general packaging requirements (cushioning & absorbent used, properly closed, won’t leak, etc.).

• UPS NOTE:– For UPS, when non-specification packaging is

authorized, the outer container for packages weighing no more than 20 Lb must meet or exceed a minimum 200 Lb burst strength or 32 ECT rating. Packages weighing 21 to 70 Lb must have an outer container of at least 275 Lb burst strength or 44 ECT.

– Any non-specification package that displays the ISTA seal indicating the package has been tested and certified to ISTA Procedure 1A is not subject to the minimum ECT or burst strength requirements.

Overpacks §173.25(a)(2)2) For each hazardous material contained in the

overpack, the overpack must be:
