South Africa’s coal industry continues to develop to meet domestic energy demands and the thermal coal needs of India, Europe and Asia.

India’s thermal coal imports in 2010 were thought to have been approximately 75mt and with imports for 2011 projected to reach around 90mt, South Africa is looking towards securing a large part of this tonnage.  South Africa continues to have the advantage over its competition when port load rates and ship draft are compared. But the continuing question is the ongoing reliability of Transnet.

The talk of nationalisation in South Africa seems to continue and is gaining momentum. This is starting to strangle inward investment and increasing South Africa’s market risk.

With a greater range of coal qualities being accepted by utilities, Eskom is under pressure to secure its domestic coal resources. What impact does this have on the Black Empowerment coal producers?

Terms and Conditions

By registering for or by attending the Event, receiving the Event materials(“Event Materials”), or hearing speaker comments/presentations, and inconsideration for the privilege of participating in the Event, the delegate(“Delegate”) and delegate’s employer (“Client”) agree to be bound by theseTerms and Conditions (the “Agreement”). This Agreement may not bemodi�ed except by express written agreement signed by the parties. ThisAgreement is in addition to any written agreement between the partiesgoverning subscription to IHS’s services or products.

EVENT PARTICIPATION; CANCELLATION; REFUNDS; SUBSTITUTION:Delegate participation in the Event is at the sole discretion of IHS. IHSreserves the right to terminate this Agreement or to vary, postpone, orcancel the Event at any time and for any reason. Speakers and/or topicswere con�rmed at the time of publishing, however, circumstances beyondthe control of the organizers may necessitate substitutions, alterations orcancellations of the speakers and/or topics. As such, IHS reserves theright to alter or modify the advertised speakers and/or topics. IHS mayterminate this Agreement for cause if a Delegate or Client breaches theseterms and conditions. If IHS terminates this Agreement (except for cause)or cancels the Event, Delegate or Client will be entitled to receive a refund.IHS accepts no other liability for the Event not taking place. ShouldDelegate wish to cancel his/her Event seat, a refund will be grantedprovided IHS receives written noti�cation thirty (30) days prior to the startof the Event. IHS will charge a processing fee equal to ten (10) percent ofthe original fee. Inability of Delegate to secure the required Visa for entryinto the country where said Event is scheduled to be held is not groundsfor requesting a refund within thirty (30) days or less of the Event. Eventseats may be transferred to a substitute colleague within Client’sorganization, provided that IHS is noti�ed of, and approves in writing, thesubstitution forty eight (48) hours prior to the start of the Event. IHSreserves the right to refuse attendance to the Event to substitutions whohave not been expressly authorized by IHS. . Delegate and Client agreethat no badge swapping is allowed, and only the Delegate may haveaccess to the Event and must provide proof of identity if requested, forsecurity reasons.

PAYMENTS; TAXES: Delegate and Client shall be jointly and severallyliable for (i) payment of all fees due to IHS within 30 days from the date ofinvoice and shall additionally be liable for interest on past due sums at thelesser of the maximum legally chargeable interest rate or 18% per annum,and (ii) any and all applicable value-added or other taxes. If a Delegate

requests permission to make registration payment via bank transfer, IHSwill add an additional fee of two (2) percent to the total registration amountdue to cover bank fees.

ACKNOWLEDGMENT; CONSENT TO USE NAME AND LIKENESS: IHSreserves the right to acknowledge Delegate and Client at the Event.Delegates who participate in the Event shall, as a condition of and inconsideration for participation, be deemed to consent to IHS ownership ofall rights in and to his or her appearance or other involvement therein. IHSshall have the right, and may permit others, to reproduce and otherwiseuse any such person’s name, voice, likeness, photograph, and otherpictures or video of the Event, except with respect to videos, in which caseIHS will obtain the consent of the Delegate before such use.

COMPLIANCE; NO UNAUTHORIZED EVENTS: Delegate and Client agreeto comply with all applicable conventions, laws, rules, and regulationsincident to any or all of the activities contemplated by this Agreement,including without limitation anti-corruption, anti-bribery, anti-boycott,antitrust, and export control laws and regulations. Delegate and Clientfurther agree to comply with and be bound by all rules and regulationsapplicable to the premises on which the Event is held. Delegate and Clientagree not to host any unsanctioned hospitality suites, receptions, or similarprivate events, unless prior written consent is provided by IHS. Delegateand Client agree not to distribute or display any marketing materials orlogos without the prior written consent of IHS.

EVENT MATERIALS: Delegate and Client agree that the Event Materialsand information conveyed during the Event are con�dential, copyrighted,and/or proprietary to IHS or a third party. Delegate and Client shall not usethe Event Materials or information conveyed during the Event exceptpursuant to a nonexclusive, nontransferable right and license herebygranted by IHS solely for Client’s internal business purposes, and not forsale, sublicense, commercial purpose, or other disclosure, distribution, orrepublication to or for a third party. Delegate and Client agree not toremove any copyright, trademark, or other proprietary notices of IHS orany third party contained in the Event Materials. Client and Delegateassume all liability associated with any misuse of the Event Materials.

NO WARRANTIES; LIMITATION OF LIABILITY: ALL EVENT MATERIALSARE PROVIDED “AS IS.” IHS DISCLAIMS ALL WARRANTIES OF ANYKIND, EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDINGBUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF TITLE,MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. IN NO EVENT SHALL IHS OR ITS REPRESENTATIVES,

AGENTS, PRESENTERS, SPEAKERS OR CONTRACTORS BE LIABLEFOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, LOST PROFIT,LOST ROYALTIES, LOST DATA, PUNITIVE, OR OTHER CONSEQUENTIALDAMAGES. IHS’s total aggregate contractual liability shall not exceed thefees paid by Delegate or Client hereunder.

RELEASE; INDEMNIFICATION: Delegate and Client hereby fully andforever release, discharge, hold harmless and defend IHS and itsemployees, directors, of�cers, af�liates, representatives, and agents, andtheir respective successors and assigns (the “Released Parties”), from andagainst any and all liabilities, losses, claims, demands, litigation, damagesand judgments, present or future, known or unknown, foreseen orunforeseen, valid or invalid, direct or consequential, together withreasonable costs and attorneys’ fees, which result directly or indirectlyfrom any injuries, illness, disability, death or other harm (the “Claims”) toDelegate or Client (including Client’s directors, of�cers, af�liates,representatives, agents) or their respective successors and assigns or theirrespective property, that any of such parties may, in any manner and fromwhatever, sustain in connection with the Event. Delegate and Client furtherindemnify the Released Parties against any and all Claims brought by athird-party and related in any way to the acts or omissions of Delegate orClient at, or in connection with, the Event.

FORCE MAJEURE. If the performance of any obligation under thisAgreement, except the making of payments, is prevented or interfered withby a force majeure (i.e., any act or condition whatsoever beyond thereasonable control of and not occasioned by the fault or negligence of theaffected party, including, without limitation, acts of God, acts of terrorism,acts of nature, acts of a government, curtailment of transportation facilities,medical crisis, �res, §oods, wars, or other catastrophes, or actual orthreatened labor strikes/disturbances), the party so affected shall beexcused from such performance.

GOVERNING LAW: This Agreement shall be governed by and construedaccording to the laws of the United Kingdom without regard to its choiceof law provisions.
