I. INTRODUCTION

1.1 General introduction of the project:

1. The objective of the proposed project would be enable to focus on

rehabilitating and increasing the capacity of existing distribution networks of110, 22 and 22kV at rural areas to enable them to meet the growing demandmore efficiently, provide better quality and quantity of electric power.

Investing in the project (a) for rehabilitating, improving and enlargingDak Lak provincial power system in order to meet the demand of supplyingthe socio- economic development with electricity up to year 2020;(b) forincreasing the reliability and quality of power network, mitigating the energyloss on the network; (c) raising the electrical business effect.

Transmission and Distribution Project 2 in Dak Lak province consistsof: Newly built 11 OkV substations and network under EVN assumption.

2. Transmission and Distribution Project 2 of Dak Lak province:

For making socio-economic development of Dak Lak province achieveaverage growth speed of Gross Domestic Product (GDP) 10.8% at the stageof 2006-2010 and 13% at the stage of 2011-2015, with the provincial loaddemand of 374.714 million kWh in 2005, 813 million kWh in 2010 and1,302.089 million kWh in 2015. Dak Lak province took part in Transmissionand Distribution Project 2. The project would be enable to meet the growingdemand more efficiently, increase the reliability of electrical supply, improvevoltage class and mitigate the energy loss. Owing to the project, electricalbusiness effect of Dak Lak province as well as Electrical Sector increases.

Hoa Thuan 110KV substation and its branch line in Dak Lak provinceconsists of two main parts of construction:

1.3.1 I1OKVSubstation:Newly built substation : 01Capacity : 1 x 25 MVAVoltage class : 11OKV

1.3.2 I1OKVline:The length of high voltage line: 2,576m

1.2 Ethnic Minority Development Plan (EMDP):For the project is located in the area of Ethnic Minorities so it is

necessary to limit the involuntary resettlement as well as limit the

harmfulness for Ethnic Minorities in the process of design, constructionmeasures and construction schedules. However, some adverse impacts onland would not be avoidable.

Among 02 communes/precinct located in the project area - Buon MaThuot City, only 01 commune having affected Ethnic Minorities. Among 11affected households of the whole project, there are only 04 Ethnic Minorityhouseholds (including 29 persons) belonging to Kronga highland village, that's E De group.

2. De facto, the construction of 110KV network and substation onlyaffects to the individuals and at the low level. Almost the land affection of 04Ethnic Minority households is of temporality. Some Ethnic Minorityhouseholds lose land permanently because of setting the poles/towers up andbuilding the substations, but this occupies a very low rate of total area oflandholdings. None of households loses more than 20% of landholdings.Therefore, the project subcomponents would not cause any culturally specificimpacts on the affected Ethnic Minority households and the nature of impactsdoes not result in community-wide socio-economic affects.

For the project in Dak Lak province, the WB's policy on EthnicMinorities is to establish Ethnic Minority Development Plan (EMDP) forensuring the followings:

+ The development process fosters full respect for their dignity, humanrights and cultural uniqueness.

+ Ethnic Minorities do not suffer adverse impacts during thedevelopment process.

+ Ethnic Minorities will receive culturally compatible social andeconomic benefits.

4. The document of Ethnic Minority Development Plan (EMDP) ofDak Lak Province will be established in accordance with the WB's guidelineof Policy OD 4.20 and Vietnamese Constitution about Ethnic Minorities. Thisdocument will be established at the same time with Construction InvestmentProject for meeting the objectives of WB's Policy OD 4.20 to ensure that thedevelopment process full respect for their dignity, human rights, culturaluniqueness. The establishment of Ethnic Minority Development Plan (EMDP)based on the results of investigations, large interviews, discussions with therelated people in all ranks in the region, the Local Authorities, MassOrganizations and affected Ethnic Minorities of commune for collecting theirmain information and feedback on the project; potential impacts,disadvantages that lay on Ethnic Minorities, solutions of overcoming project

II: SOCIO-ECONOMIC SITUATION OF ETHNIC MINORITIES11.1 Socio - Economic situation of Ethnic Minorities in Buon Ma Thuotcity.

Socio-economic speed and situation of Buon Ma Thuot city in 2006maintains stably at fair level. Economic structure changes positively to thetendency of industrialization and modernization; technical and materialfacilities, economic infrastructure are continually developed. Growth speed ofGross Domestic Product (GDP) in 2006 increases 14.89%, in which: Industry-Construction increases 25.24%, agriculture-forestry decreases 9.27%, servicesincrease 17.7%. Economic structure changes fast, intensity of Industry -Construction is 35.43%, agriculture-forestry is 15.35% and services are49.22%.

Ethnic Minority components in Buon Ma Thuot City have receivedmany benefits as a result of county development and have better materialstandards of living. However, they are still not catching up with the Kinhbecause of many reasons such as: communications system on socio-economyis still self-contained, their life depends much upon drained resources,academic standard is low, lots of mouths and economic starting-point is low.That is the reason why we must take special interest in Ethnic Minorities forensuring that they are equal in treatment and receive many benefits as a resultof project development.

According to survey results, Ethnic Minority components in projectaffected communes always settle in groups and make up separate hamlets. Atfew places in some communes, they live together with the Kinh. EthnicMinority economies are still of self- provided production. They themselvesuphold the characteristics of their own lifestyle in socio-economy and culture.

At present, most of Ethnic Minorities wear traditional clothes and speaktheir own language. Each Ethnic Minority have their own language andwriting. Though, they daily speak national language. At present, manyteenagers have chance to go to schools, they speak national language andexchanges between ethnic groups are more popular, only some people can notspeak national language.

In community of Ethnic Minorities, village patriarchs play an importantmoral role. They are the psychological advisers, peacemakers and activeparticipants in bring out decisions, so all villagers respect them. They areconsulted about house building, marriage, including family affairs. To carryout the State policies, development programmes, tasks and responsibilities,

the administrative organizations should rely upon cooperation andinformation exchanges with village patriarchs.

On the other hand, falling in line with other ethnic groups as well as theKinh is also a popular tendency at the host project communes (Ea Tucommune). By this way, Ethnic Minority components in host project zonereceive many benefits such as increase of socio-economic awareness,production and professional skill.

II.2Population and population structurePopulation in project zone (Buon Ma Thuot City, Dak Lak province) is

321,370 persons, in which, there are 160,869 men that occupy 50.06% and160,501 women that occupy 49.94%. In Buon Ma Thuot City, there are 34different ethnic groups, the Kinh make up the majority (84.38%), next E De(10.59%). 32 rest ethnic groups make up small rate of City total population(5.03%). For example: Nung (1.7%), Muong (1.41%), Tay (0.89%). Khmer(0.0413%), Gia Rai (0.1%), M'Nong, Xe Dang, San Chay, Cham, Dao, Ngai,H'Re, Co Ho ... The basic characteristics of these inhabitant groups arebased on the rural community, the organizational structure is relativeindependence, separated and self-contained on the area of cultivation andresidence with the close social institution.

Although they have their own language, cultural traditions, customs,habits and lifestyle, in almost aspects they live in harmony with the Kinh.

Almost their children and the Kinh's children learn at the same school,they take part in all common cultural activities, share in existing economicopportunities and together receive public benefits.

By result of screening surveys on losses, among 02 host projectcommunes in Dak Lak province there is 01 commune having affected EthnicMinorities because of temporary and/or permanent land acquisition and assetslost.

The average members of each Ethnic Minority household is lightlyhigher (7.25 persons/household) than the Kinh (4.75 persons/household)

Results of screening research show that at the affected communes (EaTu Commune), the main affected Ethnic Minorities are E De people ofKronga Highland village. The other ethnic groups are living outside theaffected area.

11.3 Common characteristics of representative Ethnic Minority - E

De ethnic group

In Buon Ma Thuot City, there are 34 different ethnic groups, however,

in this project only study 04 affected Ethnic Minority households of E Deethnic group. Population of E De ethnic group are the most populated of

Ethnic Minority Community in Buon Ma Thuot City as well as in Dak Lak

province.

E De ethnic group are under different name such as Rade, De, Kpa, A

Dham, Krung, Ktul, Dlie, Blo, Epan, Mdhur, Bich. The E De language is a

member of the Malayo-Polynesian branch.

Economic characteristics:Tilling the fields is the popular cultivation type of the E De minorities.

As for Bich minorities, they grew rice plants in swamped paddy fields in the

primitive way, they use buffaloes for soil stamping instead of ploughing.

Besides cultivation, the people breed, go hunting, go fishing, knit and weave.

Marriage and Family:In E De family, woman is the owner, according to matriarchy, children

bear the mother's family name, sons do not receive an inheritance. After

marriage the man must move in with the woman's family. If the wife dies and

there isn't anyone to be instead of her, the husband will have to live with his

sisters. If he dies he will be buried next to his maternal family's relatives.

Culture:E De people have got a treasure of rich oral culture: mythology, legend,

folk-songs, proverbs, especially famous epics such as Dam San, Dam Ktel

Mlan ones. The people love singing and performing in a concert. Their

musical instruments are gongs, drums, flutes, pan-pipes, play music. These

are 5 popular musical instrument sorts of E De people and to be loved by lots

of people.

Besides, they have a writing system which was transcribed later and

used widely from the time of France, America up to now.

Houses:

The house is a traditional Ede long house. The long houses are always

divided into three parts: verandas, visitors' corners and bedrooms. There aretwo verandas attached to each house: front (dring gah) and back (dring ok).

The dring gah is often large, used to sundry the families' harvest, prepare the

rice for meals in the morning and rest in the afternoon. The dring ok is oftensmaller and provides space for the bathroom and kitchen. There are often twosets of stairs leading up to the dring gah while there is only one to the dringok reserved for family members only. Dring gah is connected to the mostimportant space, the visitors' corner (called gah) that occupies from one-thirdto half of the total space. This is the place to welcome visitors and for thecommon activities of the large family. It is also where visitors can have a lookat valuable and holy objects of the Ede people like drums, gongs, liquor jars,antlers, etc. Next to the visitors' corners are bedrooms (ok) for branch familiesalong the aisle that leads to the back veranda. The long houses are placeswhere community activities are often organized.

Clothes:There are lots of fashion types and representative aesthetic styles for

Ethnic Minorities in Central Highlands. The E De people's clothing are inindigo-blue colors with gaudy patterns. Women wear shirts and skirts. Menwear loin-clothes and shirts. The people love jewellary of silver, copper andglass-bead. In the past, everybody had to file their teeth that means toamputate 6 teeth of upper jaw, nowadays the young people do not file theirteeth.

Men's clothing: Men wear short hair, wind indigo-blue turban. Theirclothing consist of loin-clothes and shirts. There are two main sorts of shirts:T-shirt with long-sleeved, split lap covering over upper half of the body andLong T-shirt (over the knee), normnal sleeves without any decorations. Thereare many kinds of loin-clothes and they are distinguished by short or longlevel and different gaudy patterns. The most beautiful ones are Kteh, Drai,Drech, Piek.

Women's clothing: Women wear long hair and to be tied up at the scarfof their necks. They dress in daily costumes for daily activities and field'stilling. They dress couture clothing in traditional days and festivals.

Men as well as women wear necklace of beads, men wear ear-rings andnecklace, women wear silvered and brass jewellaries.

11.4 The systems of the Land TenureEnjoying the equal right as the Kinh in the region, according to the

Land Law of Vietnamese State, the peasants of Ethnic Minorities in Buon MaThuot City are also supplied with the cultivated land and the certificate ofLand Tenure for a long tern. Ethnic Minorities in all affected communes arealso supplied with the agricultural land as equal as the other people. Theiraverage area of cultivating the wet rice is as equal as the Kinh.

Due to the results of the long term co-ordination process on theagriculture, all the project communes had to go through the collectivization sothat all the previous land belonged to the co-operative. After having the policyof innovation, the cultivated land had divided equally for the peasants to usepermanently for agriculture, so that, nowadays, the Land Tenure which aredifferent from the previous traditional rights of agricultural land use are stillexisted.

11.5 ProductionEthnic Minorities live in Buon Ma Thuot City have got higher living

standards than other ones (14,200,OOOVND/person/year) and their source ofincomes are more multiform than other zones in Dak Lak province, theirincomes not only comes from agriculture but also from industrial branchesand other services ...

Trees of rations and crops at the region consist of dry and wet rice,corns, cassavas and some sorts of trees. Besides, Ethnic Minorities who livein the host project zone also cultivate some sorts of industrial plants which areof high economic value, such as: coffee... Crop plants structure transfer hasmade considerable progress, area of dry rice decreases fast, instead of dryrice; other short-day crops with higher quality are cultivated. In EthnicMinorities the cross-breed is strongly developed, cultivation achieves 50%,breeding achieves about 15%.

11.6 The living standard and living conditionAt present, all communes in host project zone where the affected

Ethnic Minorities live in (Ea Tu commune), the lines of communication isvery convenient. All the communes have got water supply systems, (well,water pipes) primary, secondary schools, kindergartens, house of culture,broadcasting station and communal medical centre, 85% of Ethnic Minorityhouseholds are supplied with electricity by National Grid. The people'sincome has made positive changes, their living standards are increasedremarkably, the average income is (14,200,OOOVND/person/year). However,almost Ethnic Minorities are farmers, occupied 60% and the rest ones workfor other social fields such as in government agencies 15%, services 15% ...The rate of Ethnic Minority households under poverty occupied 10% of totalpopulation in the City.

11.7 EducationAccording to the general situation in Vietnam and Dak Lak province,

the components of Ethnic Minorities enjoy the policies of treatment and priorin the educational system, including the free school fee, prior to the

competitive examination of entering the universities and higher schools.Almost Ethnic Minorities children go to schools, the region pay attention tobuilding the specious educational system and near the people'saccommodation. Primary education schoolgirls are 73, secondary educationschoolgirls are 52, Primary education schoolboys are 65, secondary educationschoolboys are 48.

III. Law structureEthnic Minorities Development Plan was made up on the basis of

Operational Directive OD 4.20 of WB on Ethnic Minorities and the Statepolicies for Ethnic Minorities.

II.) LAW OF SOCIALIST REPUBLIC OF VIETNAMThe policy of anti-discrimination and the equality has been clearly

stated in the Law of Vietnam. Article No 5 of the constitution of SocialistRepublic of Vietnam (1992) declares that: " The Socialist Republic ofVietnam is a united State of all nationalities living on the territory ofVietnam. The State carries out a policy of equality and solidarity and mutualassistance among all nationalities, and forbids all acts of discrimination andseparation. Every nationality has the right to use its own language and systemof writing, to preserve its national identity, and to improve its own finecustoms, habits, traditions and culture. The State carries out a policy ofcomprehensive development and gradually improves the material andspiritual living conditions of the national minorities.

Article 94 in the Constitution 1992 states that: Ethnic PeopleCommittee has the right to submit proposals, plans or related issues ofindigenous peoples to the National Assembly, monitor, control theimplementation of national policies, development programs on various fieldssuch as: education, health care, etc.

The presence of Ethnic People Council in the National Assembly andCommittee for ethnic minorities and mountainous area in the Government,with many programs of socio-economic development, natural resources in thesolitary and remote area and mountainous area where Ethnic Minorities areliving is the proved evidence of the consistent policy for Ethnic Minority'sequality and anti-discrimination, with the undertaking of improving EthnicMinority's situation which is pursued by the Vietnamese State.

According to the Government of Vietnam, Ethnic Minorities have thefollowing characteristics:

- An intimate understanding and long stay in the territory, land or areaof their ancestors, closed attachment to the natural resources.

- Self-identification and recognized by the neighboring members bytheir distinctive culture.

- A language different from the national language.

- A long traditional social and institutional system.

- A self-provided production system.

The decisive policies concerned with Ethnic Minorities from the pastup to now consist of: the Decision No 327, dated September 15th 1992,Guideline No 525/TT, dated November 2nd 1993, the Decision No 556/TT,dated September 12th 1995, the Decision No 661/QD-TTg, dated July 2 9 th

1998 and the latest Decision No 135/1998/QD-TTg.

Since 1968, the Government has promulgated the sedentarizationpolicy for ethnic groups, reducing the tendency migration trends of ethnicpeople. One of the most important policies on relation with ethnic groups isthe Government Guidance No 525/TTG on November 2nd 1993 regarding indetail on implementation guiding of development in the high land areas withthe following characteristics:

- Develop the infrastructure, especially the transportation road systemand fresh water supplying;

- Gradually increase food security.- Consolidate the education system; adjust the education program

basing on the characteristics of each province; create favor condition andsupport the non-formal education programs and develop the internaleconomy.

- The Decision No 135/1998/QD-TTg paid special attention to povertyreduction for Ethnic Minorities, basing on the strengthening of theinfrastructure construction with small size for the poor villages of EthnicMinorities. The common objectives of this Decision consist of:

a/ Rapidly improve the material and spiritual living conditions of thenational minorities who live at the poorest villages in the mountainous areaand in the solitary and remote area.

b/ Create good conditions for these areas in order to escape frompoverty, backwardness and slow development.

c/ Make Ethnic Minorities integrate the common development of thewhole country.

d/ Contribute their part to the work of keeping the peace and order aswell as to the national defense security.

The objectives of stage 1998-2005 consist of:i/ Poverty reduction with the annual rate of 4-5%.

ii/ Supporting the construction of the infrastructure (fresh water used inthe families, the traffic-way to the communal centre, development of ruralmarket system).

iii/ Stimulating the children to go to school when they are of age,training most of Ethnic Minorities, raising their knowledge and professionalskill.

iv/ Restraining the dangerous diseases.

111.2 Operational Directive OD 4.20 of World Bank on Ethnic Minorities.The WB objective is to ensure that the development process fosters full

respect for Ethnic Minority's dignity, human rights and cultural uniqueness.The important part of this Operational Directive is to ensure that EthnicMinorities do not suffer adverse impacts during the development processespecially the projects used WB capital sources, at the same time, to ensurethat Ethnic Minorities will receive culturally compatible social and economicbenefits.

The strategy of WB for addressing the issues pertaining to EthnicMinorities must be based on the informed participation of Ethnic Minoritiesthemselves when they are supplied with sufficient information. Thus,identifying the local preferences through direct consultation, incorporation oftheir knowledge into project approaches, and appropriate early used ofexperienced specialists are the essential activities for any project that affectsEthnic Minorities and their rights to natural and economic resources.

In summary, there is no significant divergence between World Bank(OD 4.20) and Vietnam policies for Ethnic Minorities.

IV: The project's impacts on the resettlement of Ethnic MinoritiesIV.1 IMPACTS ON LAND AND RESETTLEMENT

The project of Hoa Thuan 110KV substation and its branch line wouldnot cause any wide and deep impacts for the resettlement of the affectedEthnic Minorities. This project only impacts Ethnic Minorities communities

of one commune belonging to Buon Ma Thuot City. Table 4-1 and 4-2 wouldshow the brief data of lost land and the impacts Ethnic Minorities. Please, seethe detail project impacts for Ethnic Minorities in the Annexes from Nol toNo 6.

IV.1.1 IMPACTS FOR ETHNIC MINORITIESThere are 04 affected Ethnic Minority households in total (29 people)

because of losing the land permanently or provisionally, losing the assetsenclosed with lost land.

There are 0.9 hectares of land to be affected, in which there are 0.04hectares of land to be permanently affected and 0.86 hectares of land to beprovisionally affected. None of Ethnic Minorities households is seriouslyaffected because of resettlement or losing more than 20% of production landor losing the establishment.

IV.1.2 Impacts on landThere are 04 households losing the land provisionally, the total

temporary affected land is 0.9 hectares. There are 04 households losing theland permanently because of building the pole foundations and substation.The total permanent affected land if 0.04 hectares (The average affected areaof land for each household is about I OOm2 /household), this area isunremarkable comparing with the area of holding land (44,825m 2).

None of Ethnic Minorities households is affected more than 20% of thetotal area of agricultural land.

IV.2 ACTIVE IMPACTS OF THE PROJECTTo continue the program of poverty reduction, the Vietnamese

Government is looking for the assistance from the international field. Theproject of Hoa Thuan 1 OKV substation and its branch line that is financed byWB aims at the objective of raising the living standards at the rural area, inwhich there are some poorest and hardest communes, through supplying withthe basic infrastructure, electricity, these are the supported factors ofstrengthening the socio-economic activities in the project area.

According to the results of consultation and group discussions, EthnicMinorities as well as the Kinh show their point of view that they completelysupport for the project investibility, even when they lose some area ofcultivated land. According to their opinions, in the future, the strengthenedelectric source would bring about more benefits, positive impacts for the lifeand economic condition than the small negative impacts caused by theproject.

V. Community participation and consultationDuring the stage of project preparation, some discussions and

consultation with the Local Authorities and Ethnic Minorities in someaffected communes have been carried out. In the community of EthnicMinorities, the village patriarchs are respected most, and they play important

role in social consultation. The village Patriarchs and hamlet Heads areinvited to the meeting for being announced with the project information,resettlement plan and Ethnic Minority Development Plan. The consultantswould state the information about the anticipated location of the project andthe policy of resettlement. All the members attending the meeting arerequested to give their opinions on the impacts that may be caused by theproject so that to bring out the mitigation measures and development program.

In Local Authorities, there are many Ethnic Minorities, they participateactively in gathering the data on the project potential harm for EthnicMinorities.

Ethnic Minorities in all affected communes completely support theproject. The Local Authorities as well as Ethnic Minorities participateactively in all the discussions about the demand, difficulties and their desirethat concerned the project in order to make use of the project and develop thebenefits that are brought in by the project for increasing their income andsocio-economic-cultural life. Therefore, the people who are consulted haveshown their desire of borrowing the credit capital with small size fordeveloping the activities of building the farmhouses and the constructionoutside the farmhouses. Ethnic Minorities are paid much attention to theconsultation with the measures of improving the present agriculturalproduction. Ethnic Minorities and the Local Authority's feedback have beenput in the content of the following development plan.

VI: Mitigation measures and development planEthnic Minorities Development Plan is not only for the direct displaced

persons who lost land but also for Ethnic Minorities who live in affected areaof project. As stated in resettlement plan, establishment of Ethnic MinoritiesDevelopment Plan is based on Ethnic Minorities and Local Authorities'participation and consultation.

There are many special Articles on Ethnic Minorities' resettlement planfor ensuring the consideration of people's point of view on every matters andexpressing the interests in accordance with the Law.

Through consultation with participation of Local Authorities andEthnic Minorities in the affected area, people would bring out their feedbackon the harm of project that may be happened as follows:

- Danger of electric shock.

- Accidents during the process of construction.

- Obstruction caused by the project and executive workers at thevillages.

All feedback and mitigation measures for environment had put in thisEthnic Minority Development Plan.

VI. 1 Policy for the people whose land is affected1. All the people who lost land are entitled to compensation and

resettlement program as stated in resettlement plan. At this stage, there isn'tany severe impact to Ethnic Minorities. However, at the next period, if thereare any severe impacts to Ethnic Minorities (impact more than 20% ofproductive land), the severe affected Ethnic Minority households will besupplied with assistance of agricultural development, work training andemployment conversion for ensuring stable life and income.

2. The people who chose the solution of land for land would bearranged right in the village.

3. All the people having land acquisition for project would be suppliedwith free-fee certificate of Land Tenure for their landholdings and newlybought land or would be compensated for land in a new place.

VI.2 The development plan for Ethnic Minorities who live in affectedproject area

A special program would be established for only affected EthnicMinorities or those are living in host project zone, including the followingparts:

1. Spreading the project information:The information announcement of Ethnic Minorities Development Plan

(EMDP) would be carried out for the Ethnic Minorities. The informationcampaign on Ethnic Minorities Development Plan (EMDP) need to beannounced broadly to Ethnic Minorities. To carry out this activity,information booklet on Ethnic Minorities Development Plan, ResettlementPlan and information announcement document for Ethnic Minorities must beput at the place that would be complied with their living standard and culture.Information announcement of the project would be carried out in parallel withthe progress of resettlement plan in the general information campaign forresettlement. Consultative specialists, Power Network Project ManagementBoard's members and Construction Agency must co-ordinate with concernedcommunes for the task completion. The cost for this activity would besupplied by the Power Sector.

2. Electrical safety trainingAlmost people in the host project area are supplied with electricity from

local network. However, for electrical safety, it 's necessary to providetraining on electrical safety for Ethnic Minorities. In order to get good resultsat training, Power Network Project Management Board of PC3 must co-ordinate with Consultant Units and Ea Tu commune in defining trainingdemand of electrical safety for Ethnic Minorities. Electrical safety trainingconsists of:

- The leaflets would introduce the measures on electrical safetyregulations, guideline of emergency in the case of electrical shock. Allfamilies in the host project area are supplied with the leaflets.

- Provide training on electrical safety and first aid when being shockedby electricity at each commune and for local people as well as pupils in theprimary and secondary schools.

- Budget for this activity would be supplied by Power Sector.

VI.3 Mitigation measures1/ The period of project construction must be carried out after the

harvest (establish sensible implementation schedule).

2/ Draw up traffic safety regulations during the period of projectconstruction.

3/ Put the signal boards at the dangerous places.

4/ In the contract signed with the construction contractor, there musthave necessary articles for limiting impacts caused by project construction.

5/ Monitoring closely/explicitly the implementation of Ethnic MinorityDevelopment Plan.

VII: Implementation arrangement

In order to implement thoroughly Ethnic Minorities development plan,PC3 and Power Network Project Management Board can discuss, co-ordinateor work independently to:

- Hold a training course on electrical safety for the Ethnic Minorityhouseholds.

- Monitored routinely by internal and external monitoring agencies.

- Ensure the explicitness and obviousness in the process ofimplementation, through the information campaign.

- Ensure that Heads of Ethnic Minorities would participate in theprocess supervision and implementation for Ethnic Minorities DevelopmentPlan.

VIII: Supervision and appraisementMonitoring the implementation of Ethnic Minority Development Plan

is one part of resettlement plan implementation.

Power Network Project Management Board employs the independentmonitoring organizations, which have professional cadres in sociology orethnology. Independent monitoring organizations must check and appraisePower Network Project Management Board of PC3' report on schedule ofresettlement plan implementation and Ethnic Minority Development Plan;interview representatives of Ethnic Minority peasants, displaced persons;evaluate the implementation of Ethnic Minority Development Plan andcapacity of the participators in implementing Ethnic Minority developmentplan.

IX: Cost estimationPower Network Project Management Board and Organizations

concerning with Ethnic Minorities Development Plan need to spreadinformations on EMDP, prepare leaflets and hold meetings on EMDP, holdtraining courses on electrical safety (total Ethnic Minorities living in Kgongahighland village is 1,305 persons and will be devided into 8 courses).

Total cost estimation for training programme/actions of EthnicMinorities Development Plan is 52,464,500VND. (Detail of the costestimation: see Annex 6). This total cost estimation consists of 10% forarising cost.

Feasible project not only meet the increasing demand of infrastructure,small industry, minor handicrafts but also improve material and spiritual lifeof the community along the project zone.

Annex 3: Proposed Action Plan

Mitigation measures

Information from the SIA and meetings with the ethnic minoritycommunities will be used by the Project Engineer in preparing the design,construction schedule and construction measures for the subprojects and theestimated cost of required work. These will include:

a. Recommendations for changing line alignments, locations,construction measures and construction schedule for subprojects toaccommodate needs and preferences of ethnic minorities:

Community consultation and prior considerations to ethnic minoritycommunities will be enforced during the period of preliminary design forpower line, supporting towers.

Construction schedule should under consideration for preventing fromcrop time. Project implementation schedule is anticipated to last 18 months,however, to start executive work right after the harvest and complete beforecultivation of next crop, the increase in labor force - two shifts should beconsidered. However, temporary losses for crops are compensated at marketprice.

b. Identify areas for particular cultural, spiritual or ecologicalsensitivity, which should be considered in design and construction activities:

Areas for sensitivity should be considered carefully during process ofproject construction. However, areas for sensitivity are far from project ROW.

c. Develop a program for communication, information and educationby the commune for the ethnic minority community in the zone of influenceon electric safety, potential health and social problems.

d. Land acquisition and compensation: Where there is land acquisitionin ethnic minorities, the project will ensure that their rights will not beviolated and that they will be compensated for the use of any part of their landin manner that is culturally acceptable to them. The compensation will followthe Resettlement Policy for Project Affected Person under the Project. Ethnicminority leaders will assist with consultation of affected households and withcompensation activities.

* Land compensation at full replacement cost is stated in theResettlement Plan. All 04 affected Ethnic Minority households have got LandUse Registration Certificate for their total landholdings.

* Representatives of Project Affected ethnic minorities of eachcommune in the project area.

* Ethnic minorities receive legal framework, rights of complaints andgrievances as well as supervision and monitoring as stated in ResettlementPlan.

3. Technical Identification of Development AssistanceDevelopment program will provide assistance to ethnic minorities,

living in the sub-project areas. e.g., priority for those living nears theinfluenced areas in getting employment in subproject construction andmaintenance. For Ethnic Minorities whose incomes are affected severely willbe provided with assistance for agricultural development, employmentconversion as stated in Resettlement Plan.

Training: The Project will provide trainings for EM in the influencedareas on training on electric safety, agricultural extension. It will also includeethnic minority leaders in training sessions on SIA, resettlement, andparticipatory monitoring for EMDP implementation.

inhabitants of Dak Lak province with electricity. The project is put under themanagement of the Power Network Project Management Board of PowerCompany No3.

Investment structure:+ Electricity of Vietnam (Getting the World Bank loan from theGovernment): Building 110KV substation and high voltage line.

1/ Who do project affected households include?

The PAPs include the households, organizations, individualspermanently or temporarily lost land and associated assets such as houses,structures, trees, crops because of the project construction ( line, pole/towerfoundations, substation) or because of laying in ROW.

2/ Who will define the affected areas as well as affected assets?+ Power Network Project Management Board (of Power Company

No3) co-ordinates with People's Committees of Communes/Districts indefining project affected areas and numbers of affected households on thebasics of power line and substation location. Then, responsibly forpreliminary survey, detail measurement survey and entitlement definition ofaffected households before project construction.

+ The project affected areas are the ones laid in ROW. ROW isdetermined as a safety corridor along a power line with the distance of 4mfrom outermost conductor to two sides (The Decree No 106/2005/ND-CP,dated August 17th 2005).

3. Impact categories:+ Permanent impacts: land, houses, structures and trees (higher than 4 meters)are in the ROW of line/tower foundations as well as substation.+ Temporary impacts: trees, crops and other assets are impacted during theprocess of project construction.

4. Are lands in ROW of line/tower foundations as well as substation acquiredfor the project?

No. However, the displaced persons can only use these lands for growingtrees and crops that are lower than 4 meters and can use residential land withlimited purpose.

5. Who will/will not be eligible to compensation?+ The displaced or project affected households, organizations, individualseligible for compensation and or assistance will include those who have

formal legal rights to assets (land, houses, structures and trees, crops); thosewho initially do not have formal legal rights to land or other assets but canprove their right of using project affected land and owning the affected assetsbefore the cut-off date (March, 9 th, 2007) will be entitled to compensation andassistance.

+ Those who encroach on the areas after the cut-off date defined in RPs arenot entitled to compensation. The owners must demolished these assetsthemselves.

6. Compensation price level:+ The level of compensation price is made out by Dak Lak ProvincialPeople's Committee based on the regional market price.

+ All project displaced persons will be compensated with the conversion cost,that means cash compensation for the affected assets at actual market price atthe time of resettlement implementation, plus trading cost (if there is), withoutany discount as well as the deduction for the salvageable materials.

+ Cash compensation or "Land for Land" with the same area which PAPoccupied.

7. For affected houses:+ Ensure technical measurements for not relocation, however if anyhouseholds need to relocate, the following measures will be carried out:

+ Cash compensation for the affected parts plus the costs for house/buildingrepair, in case, the partial area of the impacted house/building does not impactto the remaining house/building.

+ Cash compensation for the whole impacted house/building, in case, thepartial area of the impacted house/building impacts to the remaininghouse/building, the remaining house/building is out of use.

8. When will the displaced persons receive the compensation payment andtransfer to other places?

+ Full compensation payment for impacted land, house, structures, trees,crops to the PAPs who need to be resettled at least three months before landclearance.

+ Full compensation payment for impacted land, house, structures, trees,crops to the PAPs whose houses are fully or partially impacted and they have

to rebuild their houses on the rest land at least two months before landclearance.

+ Full compensation payment for impacted trees and crops to the PAPs atleast one month before project construction.

9. For the displaced persons, will they receive other entitlements besidescompensation?

Severe displaced persons (lose more than 20% of landholdings) will beentitled to development assistance. All development assistances are obviouslystated in RP and EMDP.

10. Whether the PAPs have to transfer or carry out Site Clearance when theyhave just received a partial compensation and assistance?

The PAPs have to hand over land or carry out Site Clearance when they havereceived full compensation payment and other entitlements.

11. When receiving compensation payment, whether the PAPs are requestedby Compensation Board to pay administrative fees to any organizations?

Nobody has the right of getting back or reducing compensation payment andother entitlements of the PAPs.

12. Who will inform the schedule of compensation, Land acquisition, SiteClearance and other concerned information to the PAPs?

Power Network Project Management Board, Communal Peoples'Communities will be responsible for informing schedule of resettlement plan,policy of compensation and resettlement, entitlements; schedule ofcompensation payment, land acquisition, site clearance and projectconstruction to the PAPs.

13. Where could the PAPs lodge their complaint and grievances with, if theyare not satisfactory with the results of detail survey?

+ Be able to lodge their complaint and grievances with CommunalPeople's Committee.

+ If the PAP is still not satisfied with the decision at Commune level,he/she can appeal to District People's Committee (DPC) and PNPMB.District People's Committee (DPC) and PNPMB will reach a decision on thecomplaint within fifteen days.

+ If the PAP is not satisfied with the decision of District level, the casemay be submitted for consideration by the Court.

The PAP will be exempted from all administrative and legal fees.

14. Who will monitor the compensation work?One Internal Unit of Power Network Project Management Board

should be established to undertake internal monitoring for resettlement plan.

One External Independent Agency should be employed by PowerNetwork Project Management Board to undertake the external monitoring forresettlement plan.

15. The PAPs' responsibilities.+ Participate in all meetings that have related contents and read all theconcerned information.

+ Prepare concerned documents such as Land Tenure Certificate, family-register, certificate of owning other assets.

+ Read and understand all inventories of socio-economic survey, detailmeasurement survey, assets' inventory, commitment on resettlement andcompensation and participate in all these activities.

+ Site Clearance and transportation in due time after receiving all sufficientcompensation payment and other entitlements.

16. If there are any problems, the PAP can come to the following Organs atevery time:

- Communal Peoples' Committee, District Peoples' Committee.

- Power Network Project Management Board, PC3.
