2404/17; A. & F. 1627/16.WHEREAS by Section 6 of "The Gaine Act, 1912-13,"it is provided that the Governor may from time to time,by proclamation, declare the close season for any par-tieular native game either generally throughout theState or in any one or more districts thereof to be de-fined in any such Proclamation : And whereas by aProclamation dated the 31st day of December, 1917,inter aiia, the close season for Finches and WeaverFinches (exclusive of Silver-eyes) was declared as beingfrom the beginning of May to the end of September inevery year: And whereas it is desirable that that por-tion of the said Proclamation referring to Finches andWeaver Finches (exclusive of Silver-eyes) be revoked:Now therefore I, the said Governor, by and with theadvice and consent of the Executive Council, do hereby,in exercise of the powers aforesaid and of every powerenabling me in this behalf, revoke that portion of thesaid Proclamation relating to Finches and WeaverFinches (exclusive of Silver-eyes), and proclaim anddeclare as follows:

W HEREAS by "'The Plant Diseases Act, 1914,'' it isprovided that the Governor may, by Proclamation, pro-hibit either absolutely or except in accordance withregulations the bringing into any specified portion ofthe State from the rest of the State generally, or fromany specified portion thereof, of any specified kind ofplant, fruit, or other thing which would in his opinionbe likely to introduce any disease into the State or intothe specified portion thereof as the case may be: Andwhereas in the opinion of the said Governor and of theExecutive Council, the bringing (contrary to any pro-hibition hereinafter contained) of the fruits hereinaftermentioned into any portion of the State wherein theirintroduction is hereinafter prohibited would be likelyto introduce disease, namely, fruit-fly, therein: Nowtherefore I, the said Governor, acting with the advice ofthe Executive Council, do by this Proclamation:

(1.) Prohibit absolutely the bringing into that por-tion of the State South of the 33rd parallel of SouthLatitude from that portion of the said State describedin the Schedule hereto of loquats, apricots, peaches,plums, nectarines, figs, pears, quinces, plantains, pome-granates, guavas, tacsonins, and persimmons;

(2.) Prohibit the bringing into that portion of theState South of the 33rd parallel of South Latitude fromthat portion of the State described in the Schedule here-to (except in accordance with the regulations made onthe date of this Proclamation and published contem-poraneously therewith) of apples, citrus fruits, grapes,tomatoes, bananas, pineapples, and passiflora fruits.

Schedule.All that portion of -Western Australia bounded on

the South by the 33rd parallel of South Latitude fromthe West coast to a point immediately South of Saddle-back Hill; on the East by a straight line drawn frmnthat point to it point midway between Baker's Hill andClackline; on the North by a straight line drawn atright angles to the Eastern boundary line from thatpoint to the West coast, and on the West by the coastline.

No. 2443/19.WHEREAS it is enacted by Section 14 of `The VerminAct, 1918,'' that the .Governor may, by Order in Council,constitute any defined portion of the State a VerminDistrict for the purposes of the said Act and specifythe boundaries of any such District: And whereas it isenacted by Section 45 of the said Act that the Governormay appoint the Board of any Road District situatedwithin the South-West Division of the State to be theBoard of any Vermin District the boundaries whereof

are the same as those of the Road District: And whereasit is deemed expedient that that portion of the Statesituated within the said South-West Division and knownas the Albany Road District should be constituted aVermin District under the name of the Albany VerminDistrict and that the Board of the said Road Districtshould be appointed the Board of such Vermin District:Now, therefore, His Excellency the Governor, actingwith the advice of the Executive Council, doth hereby,in exercise of the powers conferred by the said Act,constitute the Albany Road District to be a VerminDistrict under the name of the Albany Vermin District,and cloth appoint the Road Board of the said AlbanyRoad District to be the Vermin Board of the said Ver-min District the boundaries whereof are the same asthose of the Road District.

No. 2861/9.WHEREAS it is desirable that the Regulations madeunder "The Plant Diseases Act, 1914,'' oil 10thday of March, 1.915, and published in the GovernmentGazette on the 12th day of March, 1915, should be re-pealed and that the Regulations following should besubstituted in lieu thereof: Now, therefore, His Excel-lency the Governor, by and with the advice and consentof the Executive Council, and in exercise of the powersconferred by ''The Plant Diseases Act, 1914," and allother powers enabling mum in this behalf, doth orderand declare that the Regulations made under the afore-said Act oil 10th day of March, 1915, and publishedin the Government Gazette on the 12th day of March,1915, be repealed, and the same are hereby repealed, andthat theRegulations following be substituted in lienthereof.

Regulations.I Any person desirous of bringing or sending any

apples, citurus fruits, grapes, tomatoes, bananas, pine-apples, or passi-flora fruits into that portion of theState South of the 33rd parallel of South Latitude fromthat portion of the State described in the Schedule here-to shall make application to all for approval.

2. The Inspector shall satisfy himself before grant-ing approval

(a) that the coverings of the fruit are new andhave not been previously used;

(b) that in the case of apples, such apples havebeen for a period of six weeks placed into acold store at a temperature of not more than32 degrees; and

(c) that in the case of citrus fruits (except lemons)such fruits were not grown inside the areadescribed in the Schedule hereto.

3. On the Inspector's approval being granted thefruit may be brought or sent into the portion of theState into which the applicant is desirous of bringingor sending it.

Tegulations in relation to Public Fisheries.1. No person shall fish or take any oysters in or

from any public oyster fishery unless his action in sodoing is authorised by the terms of a license grantedto him under these Regulations.

2. All oyster beds other than those included inprivate fisheries shall be deemed to be included in aPublic Oyster Fishery, whether so declared or not.

3. Applications for licenses shall be according to theform in the Schedule hereto and shall be forwarded tothe Chief Inspector of Fisheries at the Fisheries De-partment, Perth, and be accompanied by the perseribeclfee.

4. The fees payable in respect of the license shallbe as follows:-

(a) Four Pounds on each license granted on orbefore the thirtieth day of June in eachcalendar year.

(b) Two Pounds in each other case.5. The license shall be duly issued in the form-to

the effect of the form-prescribed by the said Act, butmay embody conditions or stipulations not repugnant toor inconsistent with the said Act and Regulations.

6. All licenses shall terminate on the thirty-first dayof December following the date of the grant thereof.

7. The whole of the State or its waters containingoyster beds or fisheries shall be divided into two Dis-

tricts, namely: `The Northern District," from theFremantle Harbour northward and eastward, and "TheSouthern District," from such harbour southward andeastward, and the Chief Inspector of Fisheries is solelyauthorised to sign and issue licenses for such Districts.

8. Two or more fisheries shall not be included in anylicense unless they are situated in the same district.

9. The granting or refusing of a license shall, as re-gards the applicant, be in the discretion of the ChiefInspector of Fisheries.

10. Any applicant who shall have included morethan one oyster bed or fishery in his application notapproved shall be allowed to amend and re-submit hisapplication without further charge and without obliga-tion in any way upon the said officer or the Governmentto approve such amended application or necessarily tonotify any applicant of any non-approval.

11. Nothing in these regulations shall prevent anyperson from fishing for or taking oysters for his per-sonal consumption on the spot where they are gatheredand not for barter or sale.

12. No license shall be deemed to give the licenseean exclusive right in respect of any oyster fishery.

13. The references "applicant" or ''person''throughout these or future regulations do and shallalso apply to, mean, and include all the members of afirm partnership or syndicate and any corporation.

14. Every applicant who applies as Trustee or Agentfor or with, the authority or for the benefit of othersshall fully disclose the same in or with his applicationand, if requested by the said officer, shall disclose thecestui que trust or principal, as the case may be, to suchofficer's satisfaction, and the onus shall be upon theapplicant of proving to or satisfying such officer of hisbona fides and also the bona fides from time to time ofevery person allegedly or presumably fishing or takingoysters from the licensed area by virtue of the saidlicense.

15. These Regulations may be cited as "The PublicOyster Fishing Regulations, 1919.''

(a) The District of the Fremantle Municipal Coun-cil;

(b) The lands vested in the Fremantle Harbour TrustCommissioners; and

(c) Such of the lands vested in the Honourable theMinister for Railways on behalf of HisMajesty as are comprised in, abut on, adjoin,or are contiguous to the district and lands be-fore mentioned or any of them or any part orparts thereof respectively.

3. To empower the Company to acquire compulsorilyor by agreement easements in respect of the lands ad-joining or contiguous to the property to be acquired bythe Company.

In pursuance of the powers in that behalf containedin "The Municipal Corporations Act, 1906," and theActs amending the same, the Mayor and Councillors ofthe City of Perth do hereby order that By-law No. 37shall be amended as follows:-

1. By-law No. 37 shall be divided into Part I., dealingwith "signs, signboards, awnings, blinds, and otherthings over or near any footway or roadway other thanilluminated signs," and Part ZI. dealing with "illumi-nated signs."

2. Part I. shall comprise the whole of By-law No. 37(including the schedules thereto) as it now stands, withthe following amendments

(a) the words "Part I." shall be inserted abovethe word "signboards";

(b) in Clause 2 the words "overhanging lamp"shall be deleted and the words "except anilluminated sign" shall be inserted after theword "thing'' in line three thereof.

(e) Clauses 4, 5, and 9 are deleted.(d) Clause 7 is amended by the insertion of the

words "other than an illuminated sign,"after the word "sign" in line one.

(e) Clause 11 is amended by the insertion of thewords "other than an illuminated sign,"after the word "attachments" in line twothereof.

(f) Clause 12 is amended by the insertion of thewords "other than illuminated sign," afterthe word "signboards" in line one thereof.

(g) Schedules 1 and 2 are amended by the inser-tion of the words "other than illuminatedsigns," after the word `signboard" where-ever that word occurs.

3. The following clauses shall be added to and shallform part of the By-law:

Part II.—Illumninated Signs.1. For the purposes of this By-law illuminated sign

shall mean and include any sign or signboard which isilluminated and shall include an overhanging lamp.

2. No person shall erect or maintain any illuminatedsign over or near any public place, footway, street, orroad without a permit in writing issued by the Counciland signed by the Building Surveyor.

3. Application for permits in the form of ScheduleNo. 1 of Part II. of this By-law must be made to theCouncil. Such application shall lie in writing addressedto the Building Surveyor signed by the applicant andshall state:

erect the sign.(3) The dimensions of the sign.(4) The inscription or device to be inscribed on

the sign.(5) '.[he materials of which it is proposed to make

the sign.The application shall be accompanied by a plan to a

scale of not less than one-quarter of an inch to the foot.If required so to do by the Building Surveyor, the ap-

plicant shall furnish any further particulars in additionto those above detailed.

4. In the ease of illuminated signs on roofs (here-inafter called "roof signs"), applications must be ac-companied by

(1) A drawing to a scale of not less than one-quarterof an inch to one foot, showing the position,design, and method of construction.

(2) A certificate from a recognised architect that thebuilding upon which it is proposed to erect thesign and the roof thereof are sufficiently strongand structurally sound to support such signunder all conditions, and that the design ofsuchl sign itself is structurally sound.

5. The following requirements must be complied withbefore permits for illuminated signs will be issued:

(a) Illuminated signs under verandahs on balconies.—These shall follow the contour of the roof orceiling of verandah or balcony; shall not exceeda depth of 12 inches from the under side ofsuch roof or ceiling; shall be fixed so that theircentre conicides with the centre of such veran-dah or balcony; may extend over the full widthof such verandah or balcony; must be con-structed of approved materials (as to the framework must he solely of metal), and of an ap-proved design.

(b) Horizontal illuminated signs (excluding those onawnings and roofs) shall conform with the fol-lowing scale as to diniensions

12ft. up to 40ft. inclusive; 2ft.; Gin.40ft. up to 60ft. inclusive; 3ft.; 6in.60ft. up to Soft. inclusive; 4ft.; 6in.Soft. up to 100ft. inclusive; 5ft.; 6in.

100ft. and over; 6ft. 6in.; Gin.Only one such sign, will be permitted to each

storey of a building, but such sign may oc-cupy laterally the full width of the storey.

(c) Vertical illuminated signs (excluding those onroofs) shall not extend vertically beyond thelevel of the floor lines immediately above andbelow the storey occupied by them; shall nothave a projection of more than 21 inches be-yond the face of the building to which they arefixed, excluding embellishments thereon, shallnot have a width of more than 2 feet 6 inchesmeasured on the face of the building to whichthey are fixed; shall not be fixed within sixfeet of the point at which a building abuts onan adjoining building; shall have a clear hori-zontal space of not less than 12 feet betweeneach sign if more than one is fixed.

(d) Illuminated signs on roofs shall not be of aheight greater than 20 feet measured from theeaves of the building on which they axe fixedor, in the event of there being on such buildinga parapet wall, then 20 feet measured from thetop of the lowest portion of such parapet wall;provided that the top of such sign shall in nocase be higher than 150 feet from the groundlevel; shall not extend laterally beyond thewalls of the building on which they are fixed;may be used for general advertising purposes,subject to the approval of the Council of thesubject matter to be displayed on them.

(e) Flashing or intermittent illuminated signs shallbe allowed only above the first floor level.

(f) Doctors and chemists shall be allowed to exhibitan approved lamp showing a red light and sofixed as to be seen up and down a street.

(g) The wording on all illuminated signs (exceptthose on roofs) shall be confined to

(a) the names of the occupier or occupiers;(b) the business carried on by such occupier

or occupiers.The latter may in addition be notified by

symbols.(h) Materials and designs.—All illuminated signs

shall be constructed of materials and after adesign to be approved of by the Building Sur-veyor; with the exception of the insulation ofwires all materials shall be incombustible;lamps must not be enclosed with bunting orother combustible material.

(i) Construction and instaliation.—llluminated signsshall be constructed, installed, and maintainedin a safe, secure, and workmanlike manner andto the satisfaction of the Building Surveyor.

(j) Electric installation.—The electric installation inconnection with illuminated signs shall be car-ried out in a workmanlike manner to the satis-faction of the officer of the City of Perth incharge of the Gas and Electricity Departmentand in accordance with the regulations of theCity of Perth and of the Fire Underwriters'Association of Western Australia.

6. The maintenance and use of illuminated signsshall be in accordance with the following conditions:

(a) The light from illuminated signs shall at no timebe sufficiently intense to cause annoyance tothe public.

(b) Illuminated signs shall be illuminated each andevery night (Sundays excepted) from sunsetuntil 9 o'clock p.m. and for no less time.

(e) Flashing amid intermittent illuminated signs shallbe allowed to continue the flashing and inter-mittent effects only between such hours as theCouncil shall at their discretion from time totime prescribe.

(d) Illuminated signs shall at all times be maintainedas illuminated signs and shall be kept in a safe.secure, proper, and cleanly condition to thesatisfaction of the Building Surveyor and inaccordance with the provisions of the By-law.

7. Permits shall be granted, continued, and renewedat the absolute discretion of the Council, and on anyfailure by any permit holder to comply with all or anyof the conditions or requirements set forth in this By-law the Council may serve on such permit holder noticein writing to conform to the By-law or to remove theilluminated sign in respect of which the breach of thisBy-law has been committed within three days, and on thefailure of such permit holder to comply with the require-nmcnt.s of such notice the Council may forthwith, at therisk and expense of such permit holder, remove or haveremoved such illuminated sign, provided that if anyilluminated sign is, in the opinion of the Building Sur-veyor, in a condition dangerous to the public, the Build-ing Surveyor may forthwith, without any notice to thepermit holder and at the permit holder's expense andrisk, remove or have removed such illuminated sign.

8. Permits shall be granted for the balance of theyear in which they are issued and shall expire on Octoberthe 31st of such year, and may be renewed yearly. Theyshall he in the form of Schedule No. 2 of Part TI. ofthis By-law.

9. The holder of any permit shall, upon demand ofany officer of the City of Perth, produce such permit forinspection.

10. Where anything by this By-law is directed to bedone or forbidden to be done or where authority is givento any officer to direct anything to be done or to forbidanything to be done and such act so directed to be doneremains undone or such act forbidden to be done is done,in every such case the person making default as to suchdirection and prohibition respectively shall be deemedto be guilty of a breach of this By-law, and every per-son guilty of a breach of this By-law shall be liable forevery such offence besides any costs which may be in-curred in the taking of proceedings against such personguilty of such offence as well as any costs or expenseswhich may be incurred in the execution of the workdirected to be so executed and not so executed to apenalty not exceeding twenty pounds for every breachof any such By-law or to a penalty not exceeding twopounds for each day during which such breach shall becommitted or continued.
