CITY OF SUNSET VALLEY 14 AGENDA DATE: December 4, 2018 SUBJECT: Consider authorization to apply for Flood Mitigation Assistance program grant funds from the Federal Emergency Management Agency (FEMA) to complete construction to the Sunset Valley Detention Pond Dam. (Council Members Rosengarten and Bruner/Administration and Public Works and Environmental Services) BACKGROUND: Project: Sunset Valley Regional Pond Dam The Sunset Valley Regional Detention Pond is an existing stormwater control facility owned and operated by the City. The pond is located along the Sunset Valley Tributary to Williamson Creek just south of City Hall. The pond was originally designed in 1998 by Bury+Partners, Inc. (BPI) and, subsequently permitted by the City as part of the Sunset Valley Village development project. The pond includes an inline earthen and concrete dam. The Texas Commission on Environmental Quality (TCEQ) issued a letter dated June 30, 2016, to the City stating that the existing regional pond dam is classified as a smallsized structure with a “high” hazard classification due to the estimated number of houses in the downstream dam breach zone. The “high” hazard classification is not a description of the condition of the structure, but rather, it is a description of the potential for loss of downstream life or property in the event of a failure of the dam. Based on the size and hazard classification, this dam is required to safely convey 75% of the Probable Maximum Flood (PMF) per TCEQ criteria. According to a hydrologic and hydraulic study performed by BPI, by design, the dam conveys 42% of the PMF as submitted and approved by TCEQ. At a later date, TCEQ’s hazard classification of the dam changed from “significant” to “high”; therefore, TCEQ has now deemed the structure as hydraulically inadequate. TCEQ has directed the City to design additional discharge capacity so that the dam can safely convey 75% of the PMF and to coordinate approval of any such analysis and design with TCEQ prior to construction. In FY 1718, the City contracted with Miller Gray LLC to perform engineering analysis and preliminary design services to satisfy TCEQ requirements. This engineering work is completed. The project has been reviewed the Public Works Committee and is ready for construction. A cost estimate of $303,370 has been provided by CHASCO Constructors. Grant Information The Flood Mitigation Assistance (FMA) grant program under the Federal Emergency Management Agency (FEMA), provides federal funding to fund cost effective measures to reduce or eliminate the longterm risk of flood damage to structures insurable under the National Flood Insurance Program (NFIP). The Texas Water Development Board administers the FMA grant program for the State of Texas on behalf of FEMA.

Eligible Activities 

There are two types of requests that can be funded: the FMA Planning Grant and FMA Project Grant. Two years ago, the City participated in the development of the multi‐jurisdiction Hazard Mitigation Plan Update with Travis County. Travis County applied for and received funding under that program for that planning effort. This application to be submitted by Sunset Valley will be for a project grant.  

Applicant Eligibility  

Any political subdivision (including any Indian or authorized tribal or native organization) that has zoning and building code jurisdiction over a particular area having special flood hazards and is participating in the NFIP, is eligible to apply for an FMA grant.  Communities that are suspended or on probation from the NFIP are not eligible to apply for an FMA grant.  A community applying for an FMA Project Grant must have an approved Multi‐Hazard Mitigation plan in accordance with 44 CFR Part 201.  

Cost Sharing and Funding Limitations 

FEMA may contribute up to 75 percent of the total eligible costs.  At least 25 percent of the total eligible costs must be provided by a nonfederal source; of this 25 percent, no more than half (12.5 percent) can be provided as in‐kind contributions from third parties. 

Due Date: December 5, 2018 to the Texas Water Development Board
