    REGISTRATION OF AIRCRAFT

    1. INTRODUCTION

    1.1 The Rules require that no person shall fly or assist in flying any aircraft in Nepalese airspace unless the aircraft:

    a) has been registered and the Certificate of Registration is carried on board the aircraft, and

    b) bears the nationality and registration marks, affixed in accordance with the rules of the State of Registry of the aircraft.

    1.2 This chapter prescribes the requirements for the registration of aircraft in Nepal.

    1.3 Registration of an aircraft does not permit it to fly without a valid Certificate of Airworthiness kept in force.

    1.5 A Certificate of Registration is not subject to renewal and shall remain in effect untill such time as there is request for transfer of ownership of the aircraft. The Certificate of Registration is cancelled if the aircraft is removed from the Nepalese Civil Aircraft Register.

    1.6 Where an aircraft is registered in accordance with this chapter, the owner or operator of the aircraft shall manufacture an identification plate for the aircraft which is made of a fireproof metal or other fireproof material of suitable physical properties and shall secure it to the airframe of the aircraft in a prominent position near the main entrance door or, in the case of manned free balloon, affixed conspicuously to the exterior of the payload. The owner shall have inscribed the following on the identification plate:

    a) The nationality and registration marks of the aircraft, b) The manufacturer of the aircraft, c) The type, model and serial number of the aircraft, d) The date of aircraft manufacture.

    1.7 The provisions of this Chapter shall not apply to meteorological pilot balloons used exclusively for meteorological purposes or to unmanned free balloons without a payload.

    1.8 While an aircraft first of its type is entrerd in the Nepalese civil aircraft register, CAA Nepal shall advise the State of Design that it has entered such an aircraft on its egister..

    2. REGISTRATION OF AIRCRAFT

    2.1 Subject to paragraph 2.2 an aircraft may be registered:

    a) by the Nepalese Air Operator, or b) by any Company, on behalf of Nepalese Air Operator.

    Note : The Director General does not issue any Certificate of Ownership or endorse any information with respect to the ownership on a Certificate of Registration. The Director General issues a Certificate of Registration to a person, organization or enterprise who has provided evidence of ownership pursuant to paragraph 2.2 (b) Note-2 "Evidence of the Ownership" as recorded at the Nepalese Civil Aircraft Register of Civil Aviation Authority of Nepal. In this paragraph the Owner shall include a buyer in possession, a bailee or a lessee of an aircraft under a contract of conditional aircraft sale and the assignee of that person.

    2.2 The owner of an aircraft which is to be registered in Nepal must apply in writing to the Director General. The application which should be made in Form B.5.1 as shown in Appendix-1 of this Chapter B.5 must be accompanied by the following necessary documents:

    a) A copy of Nepalese Type Certificate for the type concerned. b) A copy of the Bill of Sale or Conditional Sales Contract.

    Note 1. : Where an aircraft to be registered is subject to a lease or lease purchase agreement, a copy of the lease or lease purchase agreement shall be provided will this application.

    Note 2. : "Evidence of Ownership"; The buyer in possessing or the bailee or the lessee of an aircraft under a contract of conditional sale must submit a copy of the contract. The assignee under a contract of conditional sale must submit both the contract and his assignment from the original buyer, bailee, lessee or prior assignee that bears the written assent of the seller, bailer, lessor or assignee thereof, under the original contract

    c) Proof of cancellation of previous registration Note : The satisfactory evidence of cancellation of previous registration may be a

    statement by the Airworthiness Authority of the previous State of Registry that the aircraft has been deregistered.

    d) Copy of the aircraft insurance policy acceptable to the Director General. e) Proof of Nepalese custom clearance. f) A copy of voucher against the payment of aircraft registration fee. g) A statement that it meets the requirement of paragraph 10 of Chapter B.2.

    h) A statement that all placards, instructions and documents related to the aircraft are in English.

    i) Any other necessary documentation as requested by the Director General.

    3. NEPALESE CIVIL AIRCRAFT REGISTER

    3.1 The Airworthiness Inspection Division shall maintain a current civil aircraft register showing each aircraft registerd by the Authority, the information recorded in the Certificate of Registration. The register of unmanned free balloons shall contain the date, time and location of release, the type of balloon and the name of the operator.

    3.2 Where a Certificate of Registration is issued, it shall be in English language and in a Form B.5.3 as shown in Appendix - 3 to this Chapter B.5.

    3.3 Upon transfer of ownership full detail of the new owner and operator will be entered in to the Nepalese Civil Aircraft Register.

    3.4 Where the Certificate of Registration of an aircraft is cancelled the aircraft will be removed from the Nepalese Civil Aircraft Register.

    4. NATIONALITY AND REGISTRATION MARKS

    4.1 The nationality and registration mark shall consist of a group of characters.

    4.2 The registration mark shall consist of a set of letters. The registration mark shall be preceded by a hyphen

    4.3 The nationality mark for Nepal shall be '9N'

    4.4 The registration mark shall be combination of letter as assigned by CAA Nepal.

    4.5 While alloting registration mark , letter combinations shall not be used which might be confused with the five-letter combinations used in the International Code of Signals, Part II, the three-letter combinations beginning with Q used in the Q Code, and with the distress signal SOS, or other similar urgent signals, for example XXX, PAN and TTT.

    4.6 The Nationality and Registration Marks shall be painted on the aircraft or shall be affixed by any other means ensuring a similar degree of permanance. The marks shall be kept clean and visible at all times.

    4.7 The provisions of Nationality and Registration Marks shall not apply to meteorological pilot balloons used exclusively for meteorological purposes or to unmanned free balloons without a payload.

    4.8 Location of Nationality and Registration Marks :

    4.8.1 Lighter-than air aircraft :

    4.8.1.1 Airships : The marks on an airship shall appear either on the hull or on the stabilizer surfaces. Where the marks appear on the hull, they shall be located lengthwise on each side of the hull and also on its upper surface on the line of symmetry. Where the marks appear on the stabilizer surfaces, they shall appear on the horizontal and on the vertical stabilizers; the marks on the horizontal stabilizer shall be located on the right half of the upper surface and on the left half of the lower surface, with the tops of the letters and numbers toward the leading edge; the marks on the vertical stabilizer shall be located on each side of the bottom half stabilizer, with the letters and numbers placed horizontally.

    4.8.1.2 Spherical balloons ( other than unmanned free balloons ) : The marks shall appear in two places diametrically opposite. They shall be located near the maximum horizontal circumference of the balloon.

    4.8.1.3 Non-spherical balloons (other than unmanned free balloons) : The marks shall appear on each side. They shall be located near the maximum cross-section of the balloon immediately above either the rigging band or the points of attachment of the basket suspension cables.

    4.8.1.4 Lighter-than-air aircraft(other than unmanned free balloons) : The side marks shall be visible both from the sides and from the ground.

    4.8.1.5 Unmanned free balloons : The marks shall appear on the identification plate

    4.8.2 Heavier-than-air aircraft

    4.8.2.1 Wings : The marks shall appear once on the lower surface of the wing structure. They shall be located on the left half of the lower surface of the wing structure unless they extend across the whole of the lower surface of the wing structure. So far as is possible, the marks shall be located equidistant from the leading and trailing edges of the wings. The tops of the letters and numbers shall be toward the leading edge of the wing.

    4.8.2.2 Fuselage (or equivalent structure) and vertical tail surfaces : The marks shall appear either on each side of the fuselage (or equivalent structure) between the wings and the tail surface or on the upper halves of the vertical tail surfaces. When located on a single vertical tail surface, they shall appear on both sides. When located on multivertical tail surfaces, they shall appear on the outboard sides of the outer surfaces.

    4.8.2.3 Special cases : If a heavier-than-air aircraft does not posses parts corresponding to those mentioned in a) and b) , the marks shall appear in a manner such that the aircraft can be identified readily.

    4.9 Measurement of Nationality and Registration Marks :

    4.9.1 The letters and numbers in each separate group of marks shall be of equal height.

    4.9.2Lighter-than-air aircraft :

    4.9.2.1 The height of the marks on lighter-than air aircraft other than unmanned free balloons shall be at least 50 centimetres. 4.9.2.2 The measurements of the marks related to unmanned free balloons shall be determined by CAAN, taking into account the size of the payload to which the identification plate is affixed.

    4.9.3 Heavier-than-air aircraft :

    4.9.3.1 Wings : the height of the marks on the wings shall be at least 50 centimetres

    4.9.3.2 Fuselage (or equivalent structure) and vertical tail surfaces : the height of the marks on fuselage (or equivalent structure) and on the vertical tail surfaces shall be at least 30 centimetres.

    4.9.3.3 Special cases : If a heavier-than-air aircraft does not posses parts corresponding to those mentioned in a) and b) above, the measurements of the marks shall be such that the aircraft can be identified readily.

    4.10 Type of characters for Nationality and Registration Marks :

    4.10.1The letters shall be capital letters in Roman characters without ornamentation .Numbers shall be Arabic numbers without ornamentation.

    4.10.2 The width of each character (except the letter I and the number 1) and the length of hyphens shall be two-thirds of the height of a character.

    4.10.3 The characters and hyphens shall be formed by solid lines and shall be of a colour contrasting clearly with the background. The thickness of the lines shall be one-sixth of the height of a character.

    4.10.4 Each character shall be seperated from that which it immediately precedes or follows, by a space of not less than one-quarter of a character width. A hyphen shall be regarded as a character for this purpose.

    4.11 Identification Plate

    4.11.1 An aircraft shall carry an identification plate inscribed with at least its nationality or common mark and registration mark. The plate shall be made of fireproof metal or other fireproof material of suitable physical properties and shall be secured to the aircraft in a prominent position near the main entrance or, in the case of an unmanned free balloon, affixed conspicuously to the exterior of the payload.

    5. ISSUE OF DUPLICATE CERTIFICATE OF REGISTRATION

    5.1 Subject to paragraph 5.2, where a Certificate of Registration has been lost the owner or operator may apply to Airworthiness Division, Aviation Safety Directorate, Civil Aviation Authority of Nepal for the issue of a duplicate certificate,

    5.2 Where application is made in accordance with para.5.1, an affidavit attesting that the Certificate of Registration has been lost shall be presented with the application for issuance of duplicate certificate.

    5.3 Where the Certificate of Registration has been mutilated, the owner or operator may apply for issue of a duplicate certificate.

    5.4 The owner or operator shall be required to pay the prescribed fee for the issuance of a duplicate Certificate of Registration subject to paragraph 5.1 and 5.3 above.

    6. APPLICATION FOR CANCELLATION OF CERTIFICATE OF REGISTRATION

    Where an aircraft is damaged beyond repair or is sent abroad by the owner of the aircraft and is to be registered in a foreign country an application for the removal of an aircraft from Nepalese Civil Aircraft Register shall be made in writing to the Director General by the owner of the aircraft and the original Certificate of Registration must be returned to the Director General for cancellation and retaintion.

    Note :- Notification of cancellation of an aircraft registration i.e.removeal of an aircraft from Nepalese Civil Aircraft Register to a foreign State of Registry will be made if requested by the owner or the foreign State of Registry.

    7. TRANSFER OF OWNERSHIP

    The Certificate of Registration becomes ineffective when an application is made in writing to the Director General for the transfer of ownership of a Nepalese registered aircraft. In such a case the previous owner of the aircraft must return the original Certificate of Registration to the Director General. The aircraft may not be flown untill such time as the transfer of ownership is decided and entered in to the Certificate of Registration and issued to the new owner. In such a case the Nationality and Registration Marks normally will remain the same unless otherwise requested by the new owner.

    The transfer of operatorship may also be carried out by Civil Aviation Authority of Nepal upon receiving request by both current and proposed operator. The change of operatorship shall be recorded in the Certificate of Registration.

    8. SIGNATURE AND INSTRUMENTS MADE BY REPRESENTATION

    Each signature on an application for aircraft registration or for transfer of ownership or a request for cancellation of a Certificate of Registration or on a document submitted as supporting evidence under this paragraph must be in ink. When one or more persons doing business under a trade name submits an application for aircraft registration or for transfer of ownership or a request for cancellation of a Certificate of Registration, the application on request must be signed by or on behalf of each person who shares title to the aircraft.

    8.1 When an organization or enterprise submits an application for an aircraft registration or for transfer of ownership or a request for the cancellation of Certificate of Registration, it must

    i) have an authorized person sign the application or request, ii) show the title of the signer's office on the application or request, iii) submit a copy of authorization from the Board of Directors to sign for an

    organization or enterprise, iv) provide evidence that the signer of the application or request is a corporate

    officer or other person in a managerial position in the organization or enterprise and the title of his office is as stated.

    9. MAXIMUM PERSMISSIBLE AGE OF AIRCRAFT

    The maximum permissible age of an aircraft, in terms of aircraft flight hours, cycles or calender life, that a Nepalese operator may register shall be in accordance with National Civil Aviation Policy 2063 Article 3.3 and any amendments made thereto.
