Upon purchase of a qualifying Samsung Home Appliance product within the promotional period, the consumer receives proof of purchase from the participating retailer. The consumer must then send an SMS with the Samsung product model code (as stated on the product purchased) to 33230, by 31 December 2015. SMS is charged at R1.50. If the SMS is not sent by 31 December 2015, the reward cannot be claimed.

Customer Redemption Steps:

Consumer will receive a return SMS with a link to a website, where an on-line form will need to be completed. The site will have a built-in image upload mechanic to submit an image of both the proof of purchase and a picture of the serial number on the product that has been purchased.

Oncetheentryhasbeenverified,theconsumerwillreceivearewardregistrationpincodeviaSMSwithatelephonenumberoftheSamsung Concierge Service, to call when ready to book their reward. The consumer has 12 months to redeem the chosen reward from date of receiving pin code. Flight or accommodation bookings must be made 4 weeks prior to booking dates requested.

TERMS AND CONDITIONS FOR THE SAMSUNG HOME APPLIANCES “BUY AND GET NOT WIN GET” PROMOTION

These Terms and Conditions will govern your participation in the Samsung South Africa Home Appliances Buy and Get Not Win Get [“Promotion”]. You are deemed to have read and consented to these terms and conditions prior to entering into this Promotion. Please refer to this website for the current Terms and Conditions for the Promotion. [www.samsung.com/za/promotions].

All participants during the term of the Promotion agree to be bound by the following terms and conditions:

1. The Organiser of the Promotion is Samsung Electronics South Africa [Proprietary] Limited, Registration number: 1994/003872/07 [“Samsung”] and/or its agencies [“Organisers”].

2. The Promotion will run throughout participating retailers nationwide from Sunday 1 November [00h00] to Thursday 31 December 2015 [23h59] [“the Promotion Period”] whilst stocks last, in South Africa. The duration of the Promotion may be extended or curtailed at the discretion of the Organisers without prior notice.

3. To be eligible to participate in this Promotion the participant must;

3.1 Be 18 years or older and be a legal resident of the Republic of South Africa.3.2 Purchase any of the following Samsung refrigerators, washing machines, dishwashers and air conditioners [refer to the qualifying models

listed below] through a participating retailer in South Africa during the Promotion Period [for a full list of the participating retailers visit www.samsung.com/za/promotions] and retain their proof of purchase to redeem the corresponding Reward as follows:

3.3 Be a natural person and not a juristic entity, which juristic entity includes but are not limited to a Business to Business [B2B] partner, cross border partner or retail partner.

3.4 Purchase any of the qualifying models from a participating store while stocks last only before 31 December 2015.

4. There are 3 Tiers [Blue, Silver, Gold] of Reward Levels and 2 Rewards from each Tier which the participant can choose one from, namely, either Accommodation or Flight/s. For tier breakdown please refer to table under clause 3.2 above: as indicated on page 2.

5. ToredeemtheRewardasperthetableaboveinclause3.2[the“Offer”],asoutlinedonthepointofsalecommunicationmaterialin-storeinparticipatingretailers,the participant must do the following:

Step 1: Upon purchase of a qualifying Samsung refrigerator, washing machine, dishwasher or air conditioner within the promotional period, the participant receives proof of purchase from the participating retailer and then must send an SMS with the product model code which will be as per the corresponding code in the table above in 3.2 to 33230 [SMS is charged at R1.50], by 31 December 2015 to validate the reward registration.

Step 2: The participant will be sent a responding SMS with reference number and a link to an online form. The participant will be required to complete the online form and submit a copy of their proof of purchase as well as a photo of the serial number found on the actual product [out of the box] that they purchased. If the product purchased is one of the participating Air Conditioner products, the participant will be required to also submit the photo of the serial number on the installed outdoor unit.

Step 3: Once the reward registration process has been validated and completed, the Samsung Concierge Service will provide a pin code via SMS to the participant with a contact telephone number to call when ready to book the corresponding reward as per clause 3.2, which is provided by the Organiserstotheparticipantbasedonthespecificproductcodeoftheproductpurchasedduringthepromotionalperiod.

Step 4:WhentheparticipantcallstheSamsungConciergeService,theywillbeaskedtoconfirmthepincode,therewardchoice,bookingdatesandtocomplete a booking form. The participant will be required to book their reward 4 weeks in advance. A copy of the participant’s ID document will have to be submitted when making the booking. Call Centre Number: 087 943 7629

6. The participant has one year from reward registration to redeem the reward, on condition that the registration must have taken place by 31 December 2015. No late registrations will be accepted.

7. ThisOfferisprovidedatthesolediscretionoftheOrganisers.Everytimeaparticipantpurchasesthespecificmodelsasperclause3.2,theyareentitledtoredeemthe corresponding Reward. The Organisers accept no responsibility should point of sale communication materials be placed on the incorrect or non-participating products or any other communication materials concerning this promotion. All Rewards are based exclusively on clause 3.2 above, per participating product.

8. TheOfferisnottransferableandmaynotbesubstitutedorexchangedforanythingelse.InnowaycanthisRewardbedeductedofftheproductpurchasepriceinany retailer.

9. The Accommodation Reward entitles the participant plus one guest to a complimentary two night stay at any of the participating Protea Hotels [Blue Reward Tier to the maximum value of R 4,000], Protea Hotel Fire and Ice [Silver Reward Tier to the maximum value of R 7,000] or African Pride Hotels [Gold Reward Tier to the maximum value of R 12,000] for the two nights inclusive. This two night stay has the following conditions:

9.1 Accommodation for two people for two nights.9.2 Breakfastfortwopeople,onlyifspecifiedinthepackagechosen.9.3 All other costs not mentioned including hotel upgrades, laundry charges, landline calls made from the hotel room, mini bar charges,

transport to and from the participants home and the hotel, in-house movies, entertainment, travel insurance, travel, spending, meals not specifiedandalcoholwillbefortheparticipant’sownexpense.

9.4 All bookings need to be made via the Samsung Concierge Service at least four weeks prior to the stay. The booking procedure will be explained by the Samsung Concierge Service at the time of booking.

9.5 Bookings are subject to availability at time of booking. 9.6 One of the guests staying must be the person who purchased the product and cannot be transferred or exchanged for cash.9.7 Two nights must be taken together one day after the other.

10 The Flight RewardconsistsofflightslimitedtoreturneconomyclassandwillbebookedonBritishAirwayssubjecttoavailability,entitlingtheparticipanttoacomplimentary1domesticreturnflight[BlueRewardTier],2domesticreturnflights[SilverRewardTier]or4domesticreturnflights[GoldRewardTier],withthefollowing conditions:

10.2 IntheeventofaBritishAirwaysflightnotbeingavailableforPortElizabethandBloemfonteinflights,analternativeairlinewillbeusedattheOrganiser’s sole discretion.

10.3 Theseflightsarenotsubjecttorefundsorchangesonceconfirmed.10.4 All bookings need to be made via the Samsung Concierge Service at least four weeks prior to travel. The booking procedure will be

explainedbytheSamsungConciergeServiceatthetimeofbookingandflightsaresubjecttoavailabilityattimeofbooking.10.5 InthecaseoftheBlueRewardTier,theflightcanonlyberedeemedbythepersonwhopurchasedtheproduct.InthecaseofSilverandGold

Reward Tiers, one of the travellers has to be the purchaser.

11. Information regarding the Promotion that is published on authorised advertising material will also form part of the terms and conditions of the Promotion.

12. Anyfraudulentbehaviorwillresultinanimmediatecancellationofanyflights/accommodationbookedandtheOrganisersreserveanyrightsinlawtopursueappropriate compensation and / or institute criminal proceedings. The Organisers accept no responsibility for incomplete registrations, lost, misdirected, illegible, late,oraltered.RegistrationsthatdonotcomplywiththeseTermsandConditionswillbedisqualified.TheOrganisersreservetherighttoinvestigateanyparticipant’sactions regarding any aspect of the Rewards and the redemption thereof.

13. Any participant who returns a product purchased during the promotional period forfeits their Reward accordingly. Regarding the Promotion returns policy, where participants purchase qualifying products and return these products to the participating retailer, the following rules will apply:

13.1 If a participant returns or exchanges their purchase for any reason whatsoever with the participating retailer after the registration process of theReward,theparticipantmustcalltheSamsungConciergeServiceon087 9437629tocanceltheirregistrationandacknowledgethattheyarenolongerabletoclaimtheRewardcorrespondingtotheproductmodelcodereturned;

13.2 If the participant has already redeemed the Reward and then returns or exchanges their purchase, the Organisers reserve the right to claim back the value of the Reward from the participant.

14. InaccordancewiththeconfidentialitypoliciesandpracticesoftheOrganisers,noneoftheentrydetailsofanyparticipantinthisPromotionwillbedisclosedorused by the Organisers for any other purpose than for entry into the Promotion. Details of Participants will not be used by the Organisers for Organisers related communication should the Participants opt-out to receive further communication from the Organisers.

15. The Organisers may in their sole discretion amend these terms and conditions at any time, without notice, and such amendments shall be deemed to have taken effectfromthedateofpublicationoftherevisedtermsandconditionsontheOrganiserswebsitewww.samsung.com/za/promotions

16. The Organisers reserve the right to cancel, suspend or terminate this Promotion, without notice at any time and no liability shall lie against the Organisers in favour of any participant and/ or third party arising from such cancellation, suspension or termination. Therefore the participant waives his/her right which they may have against the Organisers and hereby acknowledge that they will have no right of recourse or claim of any nature whatsoever against the Organisers.

17. To the extent permitted by law, the Organisers exclude all warranties [express or implied], representations and liabilities regarding this Promotion [other than for death or personal injury caused by its negligence and/or fraud].

18. This Promotion is governed by these terms and conditions, as well as those of the relevant authorised participating service providers, associated with this promotion. TheparticipantherebyindemnifiestheOrganisersagainstanydirect,indirect,special,incidental,consequentialorpunitivedamagesorlossofanykindregardlessofhow this was caused, and whether it arose under the law of contract or delict or otherwise.

19. Any dispute or claim arising out of or in connection with the Promotion shall be governed by and construed in accordance with the laws of South Africa.

20. If part or all of any clause of these Terms and Conditions is illegal, invalid or unenforceable:

a. Itwillbereaddowntotheextentnecessarytoensurethatitisnotillegal,invalidorunenforceable,butifthatisnotpossible;itwillbeseveredfromtheseTermsandConditionsandtheremainingprovisionsoftheseTermsandConditionswillcontinuetohavefullforceandeffect;

b. Your entry into the Promotion and/or your acceptance of the Reward [in the event that you purchase a participating product] constitutes your acceptance of the terms and conditions on behalf of yourself and your partner/any person with whom you may share the Reward.

21. Prizes are not transferable and the recipients may not substitute the prize for cash.

22. The Organiser reserves the right to change the prize should they deem necessary, to a prize of similar economic value.

23. Information regarding the Competition that is published on authorised advertising material will also form part of the terms and conditions of the Competition.

24. TheOrganiserand/oritsappointedagentscollectcustomerinformationtoconducttheofferandmay,forthispurpose,disclosesuchinformationtothirdparties,includingbutnotlimitedto,agents,contractors,serviceproviders,offersuppliersandasrequired,toSouthAfricanregulatoryauthorities.

25. TheOrganisermayrequirethewinnerandthewinneragreesbyenteringtheCompetition[atnocost],tobeidentified,photographed,filmedandtheaforegoingtobe published in any media and the winner’s name and image may be published on www.samsung.com/za/promotions, Winners may however at any time decline the use of their name, likeness or image by the Organisers.

26. If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of theOrganisers,includingbutnotlimitedtotechnicaldifficulties,unauthorisedinterventionorfraud,theOrganisersreservetheright,initssolediscretion,tothefullestextentpermittedbylaw:[a]todisqualifyanyentrant;or[b]tomodify,suspend,terminateorcanceltheCompetitionasappropriate,subjecttotheapprovalofrelevant regulatory authorities.

27. The Organisers, their directors, members, partners, employees, agents, consultants, any other person who directly or indirectly controls or is controlled by them or any supplier of goods and services in connection with the Competition and their spouses, life partners, parents, children, siblings, business partners or associates are not eligible to participate in or enter the Competition.

28. TheOrganisersreservetherighttowithholdthePrizeuntilitisentirelysatisfiedthattheclaimantofthePrizeisthebonafidewinner,andreservestherighttocallforsuch proof as it may deem necessary.
