TI1C undersigned is directed to say that Rule 38 and Rule 49 of the CentralCivil Services (Pension) Rules, 1972 have been amended vide Notification No.211li2016-P&PW(F) dated 4th,h'urllary.~2019 (copy enclosed). The proviso to theamended Rule 38 of the CCS(Pensjon ) Rules· provides thai a Governmentservant, who retires from service on account of any bodily or mental infirmitywhlch permanently incapaeitates him tor the service before completing qualifyingservice often years, may also be granted invalidpension ill accQrdance with sub.rule (2) of'rale 49, su~ject to the conditions that the Government servant:
(a) was examined by the appropriate medical authority either beforehis appointment or .aft~r his appointment to the service or post andwas declared fit by that authority for Government service" and
(b) fulfils all other conditions mentioned in this rule lor grant ofinvalid pension.
2, In this cennectton, it is clarified that the conditipn ofq:uulifying service often years for grant of pen.sionunder Rule 49(2) of the CCS (pension) RuJes,1972shall not be applicable in the case of a Gevernmeat serveru retiring on InvalidPension on account of ail}, beidi!)' or mental itlfimlit)'; tinder Rule 38,Accordingly, Invalid Pension at the rate of $0% of CnloJul1'lent$ Of averageemoluments, whichever is more b¢11eiiciaJ, subject to a minimum of ninethousand rupees per rnensem and Olaximum of one Iakh twenty five thousandrupees per mensem, shall be payable to a Government Servant who retires underRule 38 of CCS (Pensiml) Rules, 1972 even before completing a qualifyingservice of ten years.
