CEQA
CEQA applies to CalRecycle’s decision on the proposed Landfill
Under CEQA, CalRecycle is a “Responsible Agency”; the LEA is the “Lead Agency”
The Lead Agency prepares the EIR for the project
A Responsible Agency must use the Lead Agency’s Environmental Impact Report except in unusual circumstances (such as the project changes before the Responsible Agency acts on it or new information is learned)
A Responsible Agency can impose mitigation measures only on matters within its jurisdiction
