Description

On 08-05-15, I was contacted by the Missouri State Highway Patrol Troop F Headquarters at 00:10 hours. They advised the Osage Beach Fire Protection District was on the scene of a structure fire and was requesting an investigator to respond. I was asked to make contact with the Osage Beach Dispatch Center for further information. I made contact with the Osage Beach Dispatch Center. The dispatcher said the Osage Beach Fire Protection District had been dispatched to a condominium fire located at 1123 Passover Road in Osage Beach at 23:21 hours on 08-04-15. The dispatcher went on to explain there were possibly four fatalities and that the fire department was requesting an investigator to respond. I arrived on the fire scene at 02:18 hours and found the scene secured by the Osage Beach Fire Protection District as well as the Osage Beach Police Department. I began my fire scene investigation at that time.

Description

As I arrived on the fire scene I spoke to Osage Beach Fire Chief Jeff Dorhauer. Chief Dorhauer said his department was dispatched to this fire on 08-04-15 at 23:21 hours. He said Lake Ozark Fire Protection District and Mid-County Fire Protection District were called in by mutual aid to assist. He said at his department’s arrival they found the fourth story of the breezeway as well as the roof over it totally involved with fire. He said they established a water supply and began suppression. He said they used their ladder and tower trucks and began spraying water in the breezeway and on the roof. Chief Dorhauer said it was brought to their attention there were victims trapped in the third level on the east side unit. He said they conducted a ladder rescue of those occupants. Chief Dorhauer said once a large amount of the fire was suppressed in the breezeway, fire fighters attempted to travel up the stairway to check all of the units for occupants. He said as they began to go up onto the third level stairway they found it to be unstable so they had to back down. Chief Dorhauer said minutes later it was brought to their attention there may be children in the fourth level, west side unit. He explained fire fighters made entry by ladder through that unit’s window and located two juvenile females, who were carried down and transported by Osage Beach Ambulance to Lake Regional Medical Center. He went on to say just after the two females were brought down they were advised there should have been four children in that unit. He said another crew climbed up the ladder and re-entered the unit. He said those fire fighters searched for and located the other two children. Chief Dorhauer said those children were also carried down the ladder where they too were transported by Osage Beach Ambulance to Lake Regional Medical Center. Chief Dorhauer advised that fire fighters continued to extinguish the fire and hot spots as well as checked all of the units within the structure for other occupants or victims. He said he had been told by law enforcement that an adult male had been in the unit with the children but had self-rescued by climbing down the balcony to the ground. He said that male subject had been located by law enforcement and was taken by them to Lake Regional Medical Center.

Chief Dorhauer explained as the situation de-escalated, he began to hear that neighbors might have heard an explosion although he does not know at what point in the event that was heard. Description

The structure involved with this fire was a four-story, multi-family condominium of wood frame construction. The exterior of the structure was covered in vinyl siding materials while the roof was covered in asphalt composition shingles. At the time of the fire the structure had electricity connected to all eight of the individual units. For the purposes of this report the front of the structure faced to the south. Exterior Examination This structure was a four-story condominium. The parking lot access to this structure was on the front or south side, which was even with and attached to the second story. The first story was located below grade on the front but on the main level to the back. There were two condominiums on each level with one on each side of a common breezeway, which went up through the middle of the structure. As the front of the structure was examined, all windows on all levels were found to have been broken out by the fire department. Fire damage was observed on all levels of the breezeway with the most severe damage being located on the fourth story level. Fire damage had extended out from the breezeway and traveled to the east and west along the roof’s edge. While most of the roof over the structure remained intact, the area over the breezeway had been consumed by the fire. As the west side of the structure was examined, the windows on the third and fourth story had been broken out by the fire department. The first and second story windows remained intact. Each of the four stories had a screened in balcony to the north end on this side. While the first, second and third stories screens remained intact, the fourth story balcony had been heavily damaged by fire. Fire damage extended up from the fourth story balcony and traveled to the south along the roof’s edge to the front of the structure.

More fire damage was observed to the west side of the breezeway than the east side. While most of the roof over the structure remained intact, the area over the breezeway had been consumed by the fire. While examining the back or north side, the balconies to all eight units were visible on the east and west ends of the structure. The balconies on the east end all had their screens intact except for the fourth story level. This balcony’s screen had melted from the top down due to the smoke, heat and fire spreading along the roof’s edge. The first and second story balconies on the west end of the structure remained intact. The third level balcony screen remained intact except for near its east end, where it was torn from the top down. The fourth story balcony received heavy fire damage. This damage originated on its east end, which was in line with the door that led into that particular condominium. The fire damage appeared to have traveled to the west and consumed part of the balcony structure as well as all of the screen material. As the east side of the structure was examined, the windows on the third and fourth stories had been broken out by the fire department. The first and second story windows remained intact. Each of the four stories had a screened in balcony to the north end. While the first, second and third stories screens remained intact, the fourth story balcony and screen had been damaged by fire. Fire damage extended up from the fourth story balcony and traveled to the south along the roof’s edge to the front of the structure. Interior Examination I began the interior examination by entering unit three, which was located on the second story and west of the breezeway. This unit had received light smoke damage and heavy water damage throughout. The smoke damage occurred as a result of the fire in the breezeway, which caused the smoke to enter through the unit’s door. Unit four was across the breezeway and its door was in the locked position.

I went down to the first story level and found the doors to both units one and two were also locked and secured. In this lower section of the breezeway, all of the electric meters for all of the condominiums were located. All of the electric meters and bases remained intact and undamaged. These were not involved with this fire. Because of the fire damage and instability of the stairway in the breezeway, I gained access to the fourth story, west side condominium by use of a fire department ladder truck. We entered the unit through the unit’s west side window. Once inside, I found I was located in the unit’s southwest bedroom. This room had received smoke damage throughout with heat damage high and along the ceiling. This bedroom was the location where the three female juveniles were located by fire fighters. A bed was located in the center of the room with its head end up against the south exterior wall in front of a window. There was a set of louvered doors in this room’s north wall, which led into the unit’s bathroom. The top of this door had received fire damage from the bathroom side but was extinguished before extending very far into this room. This room’s main door had been torn down by the fire department. As the door was examined it was found to be in its locked position. The door had received fire damage high near ceiling level on its hallway side while the interior had only received minimal smoke damage. Standing on edge near the door was a small toddler bed. Due to its location and the size of the room I am unsure of its location prior to the fire. The bathroom was then examined and was found to have received heavy smoke damage throughout as well as fire damage high and along the ceiling. The fire damage to the room indicated the fire had spread into the room through the main door from the hallway. Once in the hallway I found there was a bedroom located to its south end. The door remained intact but had received smoke, heat and fire damage to the hallway side. The door lock was in its unlocked position. This is the room the juvenile male was located by fire fighters. This bedroom had received smoke damage throughout while no fire damage was observed. There had been a full size bunk bed in this room’s southwest corner, which had collapsed to the north and in front of the door. The other contents to this room indicated they had been knocked over from south to north away from the window. There were indications in the sheetrock as well as the contents the fire department had used a straight stream, which had moved these items around in this room. The hallway was then examined and was found to have a small utility closet located in its east wall. In this closet was a water heater along with a heat and air unit. The damage to this closet indicated the fire had traveled from the north end of the hallway and had spread into the closet.

At the north end of the hallway were the living room and kitchen areas of the condominium. The ceiling in this section of the house was approximately fifteen feet in height at its tallest point. The ceiling and roof slanted downward to the north. The floor had approximately six inches of water standing on it. The floor felt as if it was unstable. Due to the instability I took the bathroom door as well as one of the bedroom doors and laid them from the end of the hallway into the living room. To the west of the hallway was the kitchen. The south wall of the kitchen had a small closet, which contained a washer, dryer and the condominium’s circuit panel. The damage to this closet indicated the fire had spread there from the east. The circuit panel had multiple breakers in their tripped position. The remainder of the south wall of the kitchen contained kitchen cabinets. The west wall contained cabinets, an electric cook stove as well as a refrigerator. The north wall had a doorway, which led out onto the balcony. The doorway had received heavy fire damage with the burn patterns indicating the fire had spread from the interior of the unit out onto the balcony. East of the hallway and kitchen was the living room. The combustible items within the living room had been consumed by the fire. I observed the metal frames and springs to a sofa against the living room’s north wall. The remains to a table were observed in the northeast corner of the room while it appeared there was a television and entertainment center near the center of the east wall. The south wall of the living room had a fireplace, which was covered in rock fascia. The rock had started pulling away from the fireplace frame high and near the ceiling. To the east of the fireplace and in the east wall was the entrance door into the unit from the breezeway. The living room’s east wall studs had received heavy fire damage but had been knocked over to the north. Some of these wall studs remained on this level while others had been knocked down and into the breezeway. This damage appeared to have been caused by the fire department’s suppression activities. The fire damage I observed from the center of the room appeared to become more severe to the south end of the east wall. Due to the instability of the floor I was unable to get near the east wall or the doorway. At this time I returned to the exterior of the structure. Due to the weather conditions and lack of light, I maintained the fire scene until daylight. At daylight the fire department reset their ladder truck and lifted me up into the breezeway. As this was being done I found minimal damage on the first story. The fire damage became greater the further up the breezeway I examined. The most severe fire damage was located on and above the fourth story landing

within the breezeway. I found that all of the condominiums had air conditioner condensing units located just outside their doors on their landings. The fourth story landing frame remained intact but had been heavily damaged by fire. The most severe fire damage to this landing was located to the south of the west side condominium’s door. The damage appeared to have originated on or near the landing floor. The floor decking materials had for the most part been consumed. The exterior wall in this location had been covered in vinyl siding over sheet style foam insulation. This covered the original wood sheet style siding materials which were attached to the wood studs. All siding materials in this location had been consumed by the fire. The damage to the wall studs indicated the heaviest fire damage was near the floor level of the landing. This fire damage was south of the unit’s door and extended in upward and outward directions. As this area of the exterior wall was examined, electrical wiring and copper tubing were located. The wiring in this location appeared to have gone to that unit’s condensing unit. There were indications of arcing observed on that wiring. The copper tube was the condensing tube, which traveled between the air handler and the condensing unit. This tube had been heavily damaged by fire and had melted in two. The condensing unit is no longer in this location. It appeared the top cover was knocked into the doorway of the west unit on the fourth story. At this time it is unknown where the remaining components are located. The east side of the fourth story landing to include the exterior wall of unit eight was then examined. This side of the breezeway received less damage than the west side. The damage to this side of the landing was consistent with the fire spreading there from the west and the roof over it collapsing then burning in place. All fire damage indicated the fire originated in the area of the fourth story landing and south of the west side unit’s doorway. Due to the extent of the damage in this area I was unable to identify an exact cause for this fire to originate in this location. I was also unable to eliminate the electrical for the condensing unit as a possible cause. Conclusion Due to the extent of the damage, this fire is listed as undetermined.

Davis said he had officers on the scene by 23:25 hours who reported heavy smoke and fire coming from the top of the breezeway in the center of the structure. Chief Davis said Sr. Officer Sam Ford had his dash camera on, which recorded what he would have observed as he pulled in and parked. Davis said they would have a copy of the video put on a disk for me later in the day. A short time later Chief Davis said the adult male was being cooperative. He said the man did have smoke on him and his clothing. He said the man had told the detectives he had drank alcohol earlier in the evening so they asked for his consent to draw blood which they had done. Nothing further was obtained.

As I made contact I found this person was Perry Lee and was the condominium association’s maintenance person. Lee explained that each condominium in this structure is owned by a different person. I explained to Lee we had been trying to make contact with the property manager but have been unable to do so. Lee said the manager’s name is Mindy Stone and provided me with a phone number of 573-434-2426. He said he could try to make contact with her and have her come see me. I asked Lee if he was aware of any problems with the structure. He replied no. He went on to say these condominiums were older and that the construction was not the best. He pointed out they did not have central alarm or sprinkler systems in case of fire. He said a few years ago a storm had come through the area and the siding as well as some of the roof had to be replaced. He said the original cedar sheet style siding materials were still attached to the exterior. He said they had foam panel insulation as well as vinyl siding attached over the original siding. I asked if he had done any maintenance work to this structure. He said he had, but nothing very recent. He said that maintenance has consisted of siding repair, trash pickup, breezeway platform repair and maintenance. Nothing further was obtained.

She said that she is current on her rent and does not have any renters insurance. Buckman said Morrow’s phone number is 816-651-9034. She explained on the night of the fire she was in her unit and was getting ready to turn out a light because she was going to bed. Buckman said all at once she began hearing a man yelling “get my baby, my baby. Help me get my baby!” She said she looked out her window to the parking lot and grabbed her phone. She said she did not see anything so she went to her unit’s door and opened it. Buckman said when she opened the door she could see a fire on the breezeway platform directly above her. She said embers were falling from above her door while the vinyl siding directly above her door appeared to be melting and distorting in shape. Buckman said she grabbed her shoes and ran out of her unit through the door. She said as she went out the door, embers were falling down on her back. She said once she got out to the parking lot she looked back and observed heavy fire on the platform directly above her door, which was spreading up the wall to the breezeway ceiling. I asked if she could see what was burning or if the air conditioner condensing unit was on fire. She said she could not tell what was burning other than it appeared to be on the platform and burning up the wall next to it. Buckman was asked if she had ever been up on the fourth story platform in the breezeway. She replied no. I asked if she ever saw anything up on the platform other than the air conditioner condensing units. Buckman said she believes she has seen a child’s scooter, which sat between the two condensing units. I asked if she recalled hearing anything prior to the man screaming. She replied no. I asked if she knew if anyone else was in any of the units at the time of the fire. She said the only ones she knew were home, was Mike and Sue Hays who were in the unit below her.

Morrow went on to explain the owners of the units pay association fees to the Compass Pointe Condominium Association. He said as owners they own from the sheetrock in and that the association owns from the wood stud walls out. He said the association provides insurance on the structure and that they use American Family Insurance. I asked Morrow if he was aware of any problems with the structure or his unit. He replied no. I then asked Morrow who owns the air conditioner systems for the units. He said the air conditioners are owned by each unit owner as that is a part of the unit and not the structure. Morrow was then asked if he was ever on the fourth story landing within the breezeway. He said he had been up there to see the owner of unit #8. I asked if he had ever observed any type of ash trays or cigarette butt cans when he was up there. He replied no. I asked Morrow if he observed what had happened that evening. Morrow said he is a firefighter in Kansas City and was at work and was notified while there. He said when he got off work he drove down to check on his unit and the structure. I asked Hays what he had heard or observed the night of the fire. He said that they were at home and were getting ready for bed. He said he heard a noise that sounded like a big piece of metal falling onto a hard surface. Hays said he looked out his bedroom window at which time he could see what looked like fire flickering off car windows, which were parked in the parking lot. I asked if she would give me consent to do so. She said that would be fine and to do whatever I needed to. This interview concluded and a short time later she returned and gave me a copy of the owners and their information. While at the Osage Beach Police Department I was told they had someone report to them they heard a person talking about this fire. The police department said this person was to have been in communication with Paul Henderson and knew he and Jacob Helton were not at the unit at the time of the fire. The police department identified this person and had him come in so he could be interviewed. I was asked if I would conduct the interview. This person was identified as Zach Pacheco and he was in an interview room waiting to be talked to. I made contact with Pacheco and introduced myself. I asked him to tell me what he knew about this fire. Pacheco said he believes the father of the kids left the unit and took his roommate Paul Henderson to Wal-Mart. He said if he had done this the children would have been left in the unit by themselves. I asked Pacheco to explain why he believes this. He originally said he was talking with Paul and wanted to meet him because Paul owed him money. Pacheco then said he was just going to be honest with me. He said he had contacted Paul because he wanted to buy one gram of marijuana. I asked what time he had contacted Paul. He looked on his phone and said 23:14 hours. Pacheco went on to say Paul told him he was going to Wal-Mart to buy some Rumple Minze (peppermint schnapps). Pacheco said he and Paul agreed to meet at the condominium. Pacheco said he texted Paul again at 23:19 hours and said he would be there in about fifteen minutes. He said Paul texted back at 23:20 and said “ok, I’m stopping by Wal-Mart we should be there about the same time”. Pacheco said when Paul made the reference to “we” he assumed he meant Jacob. He said he arrived at the condominium and found it on fire. He said he observed Paul and Heather by the swimming pool, crying. I asked Pacheco if he had ever been to the condominium before. He said he goes about once every two weeks. He said the last time he was there was about one and a half weeks ago. When asked why he was there that time he said he and Paul were supposed to go play ball. Pacheco was asked if he knew Jacob. He said not really. I asked if he had ever made any deals to by marijuana

Kernan said the man ran around the building and then went up to the parking lot west of the condominium where Kernan thought he stopped and spoke to someone. Kernan said he did not see where the man went after that. I asked if he knew the people in that unit. He replied no. I asked if he could see what was originally on fire. Again, Kernan replied no. On 08-06-15 I met with Joshua Kenutson and Heather Hendrickson at the Osage Beach Police Department. Hendrickson is the mother of three of the children, which passed away in this fire. Kenutson is Heather’s boyfriend but is not a biological father to any of the children. Hendrickson said her three children are Joshua R. Hendrickson, date of birth 10-20-09; LeeAnn M. Hendrickson, date of birth 12-30-10, and ZeZa M. Bradshaw, date of birth 12-03-12. Hendrickson said the father of Joshua and LeeAnn is Christopher Bradshaw of Crocker while ZeZa’s father is Robert Bradshaw who is deceased. She said Christopher Bradshaw has been notified of the deaths. She said the other child who passed away is the daughter of Jacob Helton and Brigette Hendrickson. She said Brigette is her sister while Joshua Kenutson and Jacob are brothers. I asked for them to explain their day prior to the fire to me. They said they had gone to Jacob and Brigette’s at approximately 13:00 hours. She said Brigette was going to watch LeeAnn and ZeZa while she and Joshua took her son Josh to register for school. I asked if anyone else was at the residence while they were there. They said Jacob along with his and Brigette’s roommate, Paul Henderson, were both working at Little Rizzo’s. She said no one else was there other than Brigette’s daughter Kairi. They said they returned to Brigette’s at about 16:00 hours. She said they picked up the kids and that Brigette was going to pick up her sister, Hanna. They said after picking up the kids, they went to Little Rizzo’s and picked up Jacob from work. They said they went to Wal-Mart to pick up a birthday cake, candles and some paper towels for Kairi’s birthday party. They said they all returned to Jacob and Brigette’s where they got the kids ready to go swimming at the pool. They said they, along with their children, Jacob, Kairi, Brigette’s sister, Hanna, and her son, Jackson, all went to the pool to swim. They said Brigette stayed in the condominium so she could shower and get things ready for Kairi’s party. They said they swam until about 18:30 hours when they returned to the condominium. Within a few minutes of them returning, Hanna’s husband, Jason, showed up. They said Jason, Hanna, and Jackson all left because

Jason had to go to work. Joshua and Heather said they began cooking some bratwursts and hamburgers but found they needed some condiments. Heather and Brigette left while Jacob and Joshua continued to cook the food on the grill out on the balcony. They said Brigette had a pot of oil heating up to fry some potatoes in so they told Josh and Jacob not to forget about it. Brigette and Heather then went to Dierbergs where they picked up some vegetables, ketchup, and mustard. Josh said he and Jacob were watching the children who were playing all through the house as well as out on the balcony. He said they did forget about the oil but when they remembered they began to fry the potatoes. He said Jacob put one potato in the pot and everything was fine. He said Jacob then put all of the rest of the potatoes in all at once which caused the oil to boil over the sides of the pot. Josh said as the oil boiled over it got to the burner and filled the condominium with smoke. He said a small bit of oil on the stove top caught fire but they patted it out with their hands. He said the entire condominium filled with smoke so they had to open the windows and doors to air it out. Josh said when the residence filled with smoke he took the pot off of the burner and moved it to the kitchen sink. Heather said when she and Brigette returned the residence was full of smoke so they went out on the landing in the breezeway and smoked a cigarette. She said they went to the breezeway because it was raining so instead of going out on the balcony where the guys were cooking they went there instead. I asked if she recalled about what time they smoked the cigarettes. She said she believed it would have been about 19:00 to 19:30 hours. She said when she and Brigette finished their cigarettes they put them in a “butt can” next to the door. I asked where this “butt can” was located. She said it was a plastic coffee can and that it was on the landing floor between the air conditioner condensing unit and the wall. I asked what size of coffee container was being used. She said it was the one-pound size container. I asked if she was aware if anything other than cigarette butts was in the container. She said she did not know. They said once the smoke cleared they all went back inside and that Brigette tried to fry the potatoes again but that they were already ruined. They said they all ate supper, ate cake, and that Kairi had opened her birthday presents. Josh and Heather said they all hung out there for a while and then decided it was time for them to go home.

They said as they were gathering their things the kids all started begging to stay there. They said Jacob told them that it was fine if they wanted to stay because he was going to be there with Kairi while Brigette went to work. They said they believed they left at about 21:00 hours. Josh said he and Heather went home. He said they got to thinking about the kids so he texted Jacob at 21:29 hours and asked how ZeZa was doing. Josh showed me his phone at which I confirmed this text message. I asked if I could look at the other texts, which he said was fine. At 21:51 Jacob texted back and said “good they watching monsters university & rocking and rolling”. At 21:52 Josh texted back and said “right on that’s awesome thank you for watching them”. At 21:53 Jacob texted back and said “ni prob man”. At 21:53 Jacob sent another text which said “no”. At 21:53 Jacob texted and said “Kairi loves it”. At 21:53 Josh texted back and said “I bet she does”. They said at 23:58 hours Heather had a missed call from Brigette. They said immediately after that Josh was called by Brigette and told about the fire. They said they went straight there where they found the fire department trying to extinguish the fire. They said Jacob was at the top of the hill at the condominium entrance talking to the police. I asked if they had spoken to Jacob about what had occurred. They said Jacob told them he had put the kids to bed and was watching television. He told them he smelled smoke so he went in search of the cause when he found a fire on the breezeway landing outside of their door. They said he told them he got a pot of water and poured on the fire but that the fire just came right back. They said he told them he went back inside but by that time the residence was full of smoke. He told them he tried to get to the kids but it was just too hot and that he could not breathe so he had to climb down the balcony to get out. I asked them if anyone drank alcohol while at the party. They said Jacob drank a couple of beers and had a shot of Rumple Minze with Josh. I asked if anyone else was at the party that they had not told me about. They replied no. I asked if Paul ever showed up. They said while they were there he had not. They said they saw Paul once they got there after being called about the fire and that Brigette told them he had got there about the time the fire department did. I asked Joshua and Heather if there was anything else that we might not have spoken about yet in regards to this incident. They replied no. I asked if they had any questions for me. After speaking to Heather and Joshua, I interviewed Brigette Hendrickson. Hendrickson is the mother of one of the children, which passed away in this fire. She said Jacob Helton is her boyfriend and is the father of their daughter. Hendrickson said her daughter is Kairi M. Helton and her date of birth was 08-06-13. She said her sister, Heather Hendrickson, is the mother of the other three children who passed away in this fire. She said Heather’s boyfriend is the brother of Jacob. Brigette said she lives in this residence with her boyfriend, Jacob, their daughter, Kairi, and a friend who is their roommate whose name is Paul Henderson. She said they rent this condominium from Eric Hartung who lives in St. Louis. She said their rent is $755.00 a month and that they did not have any renter’s insurance. Brigette said they have lived in this residence since November. I asked Brigette to tell me about their day prior to the fire. She said that morning she got up with Kairi and took Jacob and Paul to work at Little Rizzo’s. She said they had to be at work by 09:00 hours. She said her and Kairi went back home and stayed there until about 13:00 hours. Brigette said at 13:00 hours Heather and Joshua brought LeeAnn and ZeZa over for her to watch while they took their son Josh to school registration. She said she believes they came back at around 15:00 hours and then stayed for about an hour. Brigette said they left with their kids to pick up Jacob from work and then go pick up the cake for Kairi’s birthday. She said she went and picked up her other sister, Hanna, and her son, Jackson. Brigette said once they all returned back to the condominium all of them got ready and went to the pool to go swimming. She said she stayed at the condominium so she could prepare some things for the party as well as take a shower because she had to go to work later in the evening. She said they all returned from the pool so they began to cook hamburgers and hotdogs. Brigette said Hanna’s husband, Jason, showed up and had to go to work so they left with their son, Jackson. She said they were going to fry some potatoes but did not have any oil. She said she ran to the store,

She said they told her it smoked up the residence as well as caused a small fire on the stove top, which they had put out. Brigette said the smoke was pretty bad so they opened all of the doors and windows to air the residence out. She said as they waited for the residence to air out, she and Heather went out onto the breezeway landing outside their door and smoked a cigarette. I asked if she recalled about what time they smoked the cigarettes. She said she believed it would have been about 19:00 to 19:30 hours. She said when they finished their cigarettes they put them in a “butt can” next to the door. I asked where this “butt can” was located. She said it was a plastic coffee can and that it was on the landing floor between the air conditioner condensing unit and the wall. I asked what size of coffee container was being used. Brigette was asked if anyone was drinking while at the party. She said Jacob drank two beers as well as one to two shots of Rumple Minze. Brigette said now that we were discussing this she remembered she had gone to Wal-Mart too during the evening and picked up the beer and schnapps for Jacob. She said she purchased a six-pack of Bud Light as well as the bottle of Rumple Minze. I asked Brigette what was on the landing in the breezeway outside of their door. She said theirs and their neighbors air conditioners were on the landing as well as two scooters and the plastic coffee container they put their cigarette butts into. Brigette was asked what Jacob had told her about that evening. She said he told her he smelled smoke so he went to see where it was coming from. She said he told her he found the wall next to the door on fire and that he tried to pour water on it to extinguish it. She said he told her by that time the residence was full of smoke so he opened the balcony door to air it out. She said he told her the smoke had gotten so bad he could not see or breathe but tried to get to the children anyway but was unable to. She said he told her he ended up having to climb down the balcony to get away from the fire. I asked Brigette if she or Jacob do any type of illegal drugs. She said they will occasionally smoke marijuana. I asked if either of them had smoked any that day. She said earlier in the evening she and Heather went to her bedroom while Josh was playing with the kids. She said she smoked a little bit from a bowl. I asked how much marijuana they had in their residence. She said they had about an eighth of a gram. She went on to say they keep it up on top of their dresser so the kids could not get to it. I asked if Jacob had smoked any. She said she did not believe so. Nothing further was obtained.

He said that he and the kids were eating chips and were watching “Monsters University.” He said he put the kids to bed somewhere between 22:00 and 22:30 hours. He said Joshua was put in the bed in Paul’s room while he put the girls in his and Brigette’s bed. Jacob said he went back to the living room where he was watching television and flipping through channels. He said all of a sudden he smelled smoke so he looked through the condominium to see where it was coming from. He said they have had problems with the plastic coffee container they use for cigarette butts smoking so he went and opened the front door to see if it was smoking again. Jacob said when he opened the door he immediately saw the wall to the right of the door on fire. He said he could not tell how low the fire was burning but the top of the flames were about shoulder to head high. I asked if the fire went all of the way to the floor. He said he could not see that low because of the fire up near his head. I asked if the air conditioner condensing unit was on fire. He said no. I asked if the cigarette butt container was on fire. He again said he could not see down past the flames which were next to his head. He said he closed the door, went to the kitchen, and grabbed a pot out of the sink and put some water in it. He said he went back to the door, opened it and poured the water on the fire. He said when he did this the fire turned to a heavy black smoke and then reignited.

Jacob said he turned around and ran back to the kitchen to get more water. He said that time he forgot to close the door and the residence began to fill with smoke. He said he opened the balcony door to get rid of the smoke like he had done earlier but it just caused the smoke to get worse. Jacob said the entire living room and kitchen were full of smoke and with it being dark he could not see. He said he stepped out on the balcony to get a breath of fresh air and attempted to go toward the bedrooms and get the kids. He said he is not sure what happened but that he got turned around and ended up back at the balcony. He said he again got another breath of air and tried again but could not make it to the bedrooms to get the kids. He said he began to yell for help but he was getting to where he could not breathe. He said he finally decided to tear the balcony screen and start climbing down the balconies. Jacob said he does not recall even climbing down all of the balconies or much after that. I advised Jacob I was told the police had stopped and talked to him at the entrance to the condominiums. He said he did not even recall how he had got to the entrance. I asked where he was going. He said he truthfully could not tell me. He went on to say the only thing that even makes a little sense was that he was trying to go tell Brigette what was going on. He again pointed out he really does not have an answer for that. As we spoke to Jacob I observed some blisters to his hand. His right hand had blisters to the bottom of his palm that were round in shape. The size and shape of this blister was similar to that of someone who had grabbed a hot door knob. I asked Jacob how he had got the blister. He said he did not know. I even went as far as asking him if the door knob was hot when he grabbed it. He again said he did not recall. I also observed the insides of the upper half of each arm were severely bruised. When asked how he had gotten those bruises he again said he did not know. He said the only thing he can figure out is that he got them when he was climbing down the balcony. Jacob was then asked if he recalled hearing the smoke detectors ever going off. He replied no. I asked if he knew how many smoke detectors were in the unit and where they were located. He said he could not recall how many there were but thought there may have been one in the kitchen and another in the hallway. I asked if he had ever heard them go off. He replied no. I asked if they had gone off when he boiled the oil over on the stove. Again he said no. I asked if he knew if the smoke detectors were battery operated or were hard wired in. He said he did not know because he never messed with them. Jacob was asked what else might have been on the breezeway landing outside of their door. He said there were the two air conditioner condensing units as well as two scooters and the cigarette butt container. I asked

He said he had done a couple of shots on his own and then Josh had done one with him as well. I pointed out that would mean there was only about four shots drank out of that new bottle. He said that was correct. I asked where this bottle would have been located. He said he had put it in the freezer. I asked if he drank anything after everyone left. He said no. I then asked Jacob if he or his girlfriend ever used any illegal drugs. He said they both smoke marijuana occasionally when Kairi is not around. I asked when he had last smoked any marijuana. He said it had been a few days. I asked if they had any inside the house. He said they have a lock box they keep up on a dresser. He said there is a pipe in that box. As I was concluding this interview I asked Jacob if he had any questions for us. He asked how he was to go on from here. I explained that he and Brigette needed to talk about what was on their minds and that getting professional counseling could possibly help. He agreed and said that they had already discussed that. On 08-11-15 a joint meeting of the involved agencies took place at the Osage Beach Police Department. This meeting was to share information and see what other interviews or investigation needed to be conducted. Those attending this meeting were Osage Beach Police Chief Todd Davis, Osage Beach Detectives Tracy Robinette and Brian Salerno, Osage Beach Fire Chief Jeff Dorhauer, ATF agent Kevin Savage and I. Detectives Robinette and Solerno advised they had attended the children’s autopsies on 08-05-15 and 08-06-15. They advised the preliminary autopsy results are indicating smoke inhalation as the possible cause of death on all four children. During this meeting it was decided the police detectives would follow up with all of the 911 callers as well as gather their individual officers’ reports. Fire Chief Dorhauer obtained statements from other fire departments, which mentioned the bedroom doors were locked while one of those had a large bed pushed up against it. With this information I was going to return to the fire scene to check on those issues. I was also going to see if we could determine if the amount of alcohol Helton said he had not drank was still present. I was also going to attempt to make contact with all of the unit owners and occupants as well as pick up the written statements from the firefighters who located and removed the children from the fire scene. Nothing further was obtained.

On 08-11-15 at approximately 12:00 hours I returned to the fire scene. There were multiple insurance investigators present as they were conducting their joint examination. Those investigators present were fire investigator Robert Helmkamp with ACS, Terry Decker with T. Decker Investigations, Mike Searcy with Anderson Investigations, and Paul Carney with Fire Consulting and Case Review International. American Family Special Investigator Shane Knoll, as well as other consultants were present. Property Manager Mindy Stone as well as Shane Knoll who had control of the scene allowed me in to further my investigation. Stone had received permission from the occupant at 1121 Passover Road Unit #7 to enter and examine her unit as a comparison to the involved unit and structure. As that structure was examined the peak of the breezeway ceiling over the fourth story landing was approximately three feet above the tops of the doorways. Unit #7 had an exterior light located to the north side of the doorway. The condensing unit was located to the south of that unit’s doorway. The condensing unit was approximately twelve to fourteen inches away from the wall next to the door. On this unit the electrical wiring was in plastic conduit, which ran out from a hole in the wall, down near the floor, up to a small breaker box. Another piece of conduit ran from the breaker box down and to the condensing unit. The condensing tube ran straight from the hole in the wall over to the condensing unit and was covered with foam insulation. As I entered into Unit #7 I found the layout to be similar as to what was observed with the involved unit. I found that this unit had one battery operated smoke detector, which was located at the south end of the hallway just outside the bedroom doors. Photographs were taken of the comparison structure. Nothing further was obtained.

The insurance company had a private construction company there assembling scaffolding just inside the breezeway against the west wall and landings. Once the scaffolding was secured, the insurance investigators began their examinations. Once there was room for me, I climbed the scaffolding up to the fourth story. I began in the southeast bedroom. The bed in front of the door was confirmed to be a full size bunk bed. The bed had sat in this room’s southwest corner and appeared to have been knocked over, which caused it to collapse in front of the door. There were marks in the ceilings and walls were the fire department’s straight stream had hit them and was going in the same direction as the bed had fallen. Just outside this bedroom’s door the floor was examined. I was looking for any remains to a smoke detector although none were located. The insurance investigators were clearing the remainder of the floor but I do not believe they ever located any components to a smoke detector. I went to the refrigerator, which had been destroyed by the fire. I found the contents of the freezer had also collapsed down into the refrigerator. As I examined the contents of the refrigerator I believe I located the bottle to the Rumple Minze, which Helton said would have been in the freezer. The bottle had broken so all of the liquid inside was no longer present. I searched for the four beer cans he said were in the refrigerator from the six-pack of cans he had been drinking from. I located four cans of beer within the refrigerator debris. I then went over near the door, which led out onto the landing in the breezeway. In the doorway was the top to an air conditioner condensing unit. As the top cover to the condensing unit was turned over, it was found to still have the fan motor attached. The wiring in the area of the wall, which led to the condensing unit, was examined. This wiring had received heavy fire damage as well as having indications of arcing.

I returned to the top of the scaffolding and examined the landing again. All damage to the landing and the west exterior wall indicated the fire originated in this location. Due to the heavy fire damage in this area and the lack of the condensing unit components, I could not confirm or deny it may have been involved with this fire. I was also unable to locate any components to the plastic coffee container, which the occupants said they had been using as a trash receptacle for their cigarette butts. Due to the extent of the damage, this fire is still listed as undetermined.

On 08-11-15, I made contact with Joshua and Heather. I asked if I could meet with them as I had more questions I needed to ask them. They agreed to meet me so we met at Little Rizzo’s Restaurant in Osage Beach. Joshua and Heather preferred to be together so their interviews were done at the same time. Joshua was asked about the pot he and Jacob had used to fry the potatoes earlier in the evening the night of the fire. He said once the oil in the pot had bubbled over he had moved the pot to the kitchen sink. He said he did not recall what had happened with the potatoes. I asked if he recalled what they had done with the oil. He said they normally dump the oil down the drain but he did not remember if that was done or not. He said he knew he had not dumped the oil. I asked if when the oil had bubbled over and smoked up the residence if the smoke detectors had gone off. He said they were afraid it would so they immediately opened the balcony door, windows and the front door to get the smoke out. Joshua said the smoke detectors never went off. I asked if they knew where the smoke detectors were located but neither one of them did. I asked Joshua and Heather if Jacob smoked cigarettes. They both replied no. I asked if they recalled where the coffee container was located, which was used to put cigarette butts in on the landing in the breezeway. They said it was located just outside the door between the wall and the air conditioner unit. I asked how much space was located between the container and the wall. They said there was about an inch, maybe two between it and the wall. I asked if there was a lid on the container or not. She said there was a lid on it but that it had a small hole cut in it to put cigarette butts into. Heather said she and Brigette smoked while in the breezeway while they waited for the condominium to air out from the smoke. I asked if she knew what time they had gone to the breezeway to smoke. She said it was when they returned from picking some things up from the store but was unsure as to the time. I thanked them for speaking with me again and this interview was concluded.

I asked if it had ever gone off or if they had ever changed the battery. Both replied no. I asked them if they recalled what had happened with the pot of oil they used to fry the potatoes. Brigette said after she got home and got the smoke out of the residence, she had moved the pot from the sink back to the stove. She said she tried to fry the potatoes again but they tasted bad so they were just thrown away. She said she had been using a front burner but moved the pot to one of the back burners. I asked if either of them had dumped the oil out of the pot but both of them replied no. I asked if they had ever had any problems with the electrical in their unit to include appliances and the air conditioner. They replied no. I asked if they had ever changed the air filter on the air conditioner system. Neither one could recall ever changing the filter. Jacob was then asked about the children’s locations when he had put them to bed. He said Joshua was on the bottom bunk of the bunk bed in Paul’s room. He said the girls were all in his and Brigette’s bed in their room. He said LeeAnn was in the middle while Kairi was to her left and ZeZa to her right. I asked if the bedroom doors were closed and if they were locked. He said the bedroom doors were both closed because he was watching television. He said Paul’s room was not locked. Jacob and Brigette both said their bedroom door may have been locked because Kairi’s toddler bed was in front of it in the bedroom.

Brigette said Kairi had a habit of standing on the bed and playing with the lock so neither one knew for certain if it was locked. They went on to say because of Kairi’s bed being in front of the door they used the door between their room and the bathroom as their entrance. Jacob said he believed the bathroom door and the door between it and the bedroom were both open. I asked them about Jacob being a smoker at which they both denied him smoking. I asked about the location of the coffee container on the landing outside of their unit’s door. They both said the coffee container was one of the large ones. They said there was a lid on the container that had a hole cut in it to put the cigarette butts into. They said the container was located about midways between the wall and the air conditioner condensing unit. When asked for an approximate distance between it and the wall they both said “maybe one to two inches”. I asked them if there was anything else they may have remembered but had not told me. Both replied no. Nothing further was obtained.

On 08-11-15, I made contact with Fire Chief Mark Amsinger with the Lake Ozark Fire Protection District. Amsinger said he had received written statements from his firefighters who were involved in locating and removing the children who were located in unit #7. The firefighters who had written statements in regards to this incident were Battalion Chief Ryan Vaughn and Captain Caleb Freese. Vaughn reported his first assignment was to attempt to conduct a search but due to heavy fire he was reassigned to exterior fire suppression. Vaughn said they were again reassigned to attempt to make entry into the fourth story west side unit by use of the breezeway. He said due to the damage within the breezeway the stairway was found to be unstable and inaccessible. Vaughn advised a ladder was then extended up to a window of that particular unit where he and Captain Freese made entry. Vaughn reported Freese located one victim and handed her to him to carry down the ladder. He said another firefighter climbed up and received a second child from Freese and carried her down as well. Vaughn advised both he and Freese were emotionally distressed and were sent to the rehab area by command. Freese’s statement was similar to that of Vaughn’s. Both written statements will be added to this report.

On 08-11-15, I made contact with Fire Chief Scott Frandsen with the Mid-County Fire Protection District. Frandsen said he had received written statements from his firefighters who were involved in locating and removing the children who were located in unit #7. The firefighters who had written statements in regards to this incident were Matthew Marra and Kelton Hays. The firefighters’ statements indicated upon their arrival they assisted in establishing a water supply. They said they assisted in setting up a ladder, which two Lake Ozark firefighters climbed up and into the window of the fourth story west side unit. They said those firefighters located and carried down two victims. They said those firefighters reported the unit was clear so they moved the ladder down to the third story west side unit. The firefighters said by the time they were finishing in setting up the ladder they were told there were two more victims in the fourth story unit. They said they reset the ladder to the fourth story, which they climbed up to and made entry. They reported finding one victim next to the window, which they passed down to the awaiting ambulance. They went back into the unit and forced open that bedroom’s door because it was locked. The firefighters located another bedroom, which they believed was locked and had to force it open. They said a bunk bed had fallen against the door, which slowed their entry efforts. The firefighters advised while searching that room they located a juvenile male under the bed. They said they removed the child from under the bed at which time they carried him out and to the ambulance. Both written statements will be added to this report.

On 08-26-15, I was contacted by Osage Beach Police Detective Brian Salareno. Salerno said he and Detective Robinette are almost done speaking to the 911 callers. He said he was able to locate Jacob and Brigette’s roommate, Paul Henderson and conduct an interview of him too. Salerno said they are still waiting on the results from Helton’s blood they had taken the night of the fire along with the children’s autopsy results. He said they will be putting their reports together and make them available to me when that is completed. Nothing further was obtained.
