FROM THE CEO’S DESK ‐ 7 FEBRUARY 2019

JANUARY COUNCIL MEETING: Council had a very full agenda for their first meeting for 2019. It was great to see so many members of the community take an interest and come along as observers. At this meeting Council, amongst other things, determined to commence community and stakeholder engagement on the intent to lease land on Home Island for a renewable energy facility and to get community feedback on a proposal for a resort on Direction Island. These are both interesting and complex projects so the engagement processes have been designed to ensure input is well informed and considers all aspects of the projects. More information about how you can input can be found in this edition of the Atoll or please contact me for more information.

Council received the Shire’s Audited 2017/18 Financial Statements, Annual Report and set the Annual Electors Meeting for Wednesday 27 February at 3.45pm at the West Island CRC.

MITINGAN COUNCIL BULAN JANUARY: Council mempunyai ajenda yang penoh untuk mitingan pertama mereka untuk 2019. Ia sangat mengembirakan untuk melihat banyak penduduk masyarakat mengambil keminatan dan hadir sebagai pemerhati. Dimitingan ini Council, diantara banyak perkara lain, memutuskan untuk bermula menghubungi masyarakat dan stakeholder mengenai tujuan untuk menyewakan tanah untuk fasiliti energi ‘renewable’ (dibarukan semula) dan untuk mendapatkan pandangan masyarakat mengenai cadangan untuk sebuah resort di Pulu Tikus. Kedua-duanya ini merupakan projek yang menarik dan susah, justeru itu proses perhubungan telah di disain untuk memastikan pandangan yang diberikan adalah yang terbaik dan mempertimbangkan semua bahgian projek-projek ini. Keterangan selanjutnya tentang bagaimana kamu boleh mengambil bahgian boleh didapati dalam edisi Atoll ini atau silahkan hubungi saya untuk keterangan selanjutnya.

Council menerima Statement Keuwangan Audited Shire untuk 2017/18, Laporan Tahunan dan menetapkan Miting Tahunan Pengundi untuk diadakan pada hari Rebo 27 February pada 3.45 soreh di CRC Pulu Panjang.

MAJU PULU KITA / ADVANCE OUR ISLANDS: Recruitment for the design workshop on Saturday 23 February on Home Island is progressing well. A reminder that Working collaboratively with the community and stakeholders lies at the heart of the process. So register for this important forum by contacting the Shire and start thinking about what infrastructure this community needs, now and into the future.

MAJU PULU KITA / ADVANCE OUR ISLANDS: Recruitment untuk workshop desain pada hari Sabtu 23 February di Home Island berkemajuan dengan baik. Sebuah peringatan yang Bekerjasama dengan masyarakat dan stakeholder merupakan sebagai kepentingan dari proses tersebut. Jadi, rejista untuk forum penting ini dengan menghubungi Shire dan melai memikirkan infrastruktur apa yang masyarakat ini memerlukan, sekarang dan dimasa hadapan.

AUSTRALIA DAY: My first Australia Day on Cocos was incredible. Firstly for the amazing community spirit and the efforts or our volunteers. Thank you to Aindil for representing Council, Shane, Wendy for the activities; Tony our MC, Trevor, wonderful singer and guitar playing and Leah for the music, Neale and Ian the BBQ chefs. And sincere thanks to all who attended despite the rain that was hovering. A special thanks to Luluk Sloan for all her tremendous organising. And the inaugural women’s beach cricket was fantastic. What a team!

COASTAL VULNERABILITY ASSESSMENT: Further to information provided several months ago, please find below update on the work being carried out to measure coastal vulnerability. The team arrived in Cocos on Friday for a field visit and provided the following information on their work:

Between the 1st and the 4th, the four shallow water sites accessible from West Island were all retrieved, serviced and redeployed. 100% data capture was achieved at each of these sites;

A drone survey was completed at the southern tip of West Island (Scout Park + Kite Beach);

Topographic surveys (drone + beach transects) will continue on West Island;

Servicing of offshore monitoring sites are all going well and is expected to take two days but could be longer (weather dependent). The final data report should be available early next year.

PENILAIAN PENDEDAHAN PANTAI: Menerusi keterangan yang diberikan berberapa bulan yang lalu, silahkan dapatkan dibawa berita terkini tentang kerjaan yang sedang dijalankan untuk mengukuri pendedahan pantai. Kumpulan ini hadir di Cocos pada hari Jumaat untuk pelawatan dan memberi keterangan seterusnya mengenai kerjaan mereka:

Diantara 1hb dan 4hb, empat kawasan ayer kering dari Pulu Panjang semua diambil kembali, di serbis dan di letak kembali. 100% data yang didapat dan dihasilkan disetiap tempat;

Survey menggunakan drone diselesaikan di hujung selatan Pulu Panjang (Scout Park + Kite Beach);

Survey Topographic (drone + beach transects) akan diteruskan di Pulu Panjang;

Pemeriksaan kawasan monitoring dilaot semua berjalan dengan baik dan diharapkan untuk menjakau dua hari tetapi mungkin lama (tergantung kepada cuaca). Laporan data terakhir mungkin akan disediakan awal tahun datang.

PUBLIC TOILETS: We are aware that there have been a few complaints regarding the lack of public toilet facilities near the airport and we are working with the Club and IOTA to try and find a solution. Please bear with us as we work with these other agencies.

ASDD LOGO: Back in December of last year the Administrator of Christmas Island and Cocos (K) Islands, Mrs Natasha Griggs, in partnership with the Shire of Cocos (K) Islands and CKI Community Groups invited

entries in a logo design competition for the upcoming 35th Anniversary of the Act of Self Determination Day.

The Administrator offered a very generous $250 cash prize for the winning entry. The winner will be invited as a special guest at the opening ceremony to accept their prize.

Thank you to all twelve entries received. With so many great designs to choose from it was a very hard decision by the organising committee to have had to vote for a winning design.

Congratulations to Madeenah Sari Kenny!

Desain oleh Madeenah ini akan digunakan oleh Shire dan sedia untuk digunakan oleh Kumpulan Masyarakat Cocos dalam alat-alat perdagangan untuk semua acara yang berkenaan dengan Perayaan Ulang Tahun Ke35 ini.

WORKS UPDATE: The Shire has been contracted to undertake the excavation and rehabilitation works at the West Island Play group. These works are expected to be carried out over the next month. There will be traffic management signs in place over this period. Caution should be taken when placing the West Island play group through working hours.

Work has commenced on the filling of sand bags at the end of Jalan Malati near the entrance of Pulu Gangsa and is expected to be completed towards the end of February. There will be machinery movements in this area between the hours of 6.45am to 3.30 pm Mondays to Thursday and between 6.45 am and 11.45 on Friday. The public is asked not to enter this site through this period.

The new EWP has now been delivered and the Shire mechanics are busy preparing the machine for the hand over and training. This new piece of equipment will be invaluable in our efforts to manage Paper Wasps and in the de-nutting program.

It is very exciting to note that work has begun on the West Island Play group Rehabilitation project with the Shire delivering 150 cubic meters of sand to the site in preparation for the remediation. It will be great to see this community building being used to its full capacity again.

Some new tables and bin surrounds have arrived and will be installed to add small but important touches that improve the visual amenity around Home Island and West Island.

WORKS UPDATE: Shire telah dikontrekkan untuk menjalankan kerjaan penggalian dan rehabilitasi di West Island Play Group. Kerjaan ini diharapkan untuk dijalankan dalam berberapa bulan. Bakal ada sain-sain traffik yang akan diletakkan dimasa kerjaan ini. Kami harap semua berhati-hati dikawasan West Island Playgroup dimasa kerjaan ini dijalankan.

PUBLIC NOTICE - DISPOSAL OF PROPERTY LEASE OF PORTION OF LOT 103 FOR A RENEWABLE

ENERGY FACILITY PUBLIC SUBMISSIONS INVITED

Under the provisions of the Local Government Act 1995 (WA) (CKI) as amended, Council hereby gives public notice of the intent to dispose (by lease) of property.

At the Ordinary Meeting of Council on 23 January 2019, Council resolved to give public notice of the intent to dispose (by lease) of property. Details of the proposed lease are as follows:

Property: A Portion of Lot 103 Home Island in two parts (Part One: 7,500sqm; and Part Two: 12,500sqm - giving a total lease area of 2.00 Hectares);

Proponent: Island Power Co Pty Ltd on behalf of project company Island Power Co HI Pty Ltd;

Period: 15 Years Plus 15 Years;

Lease value: $4,200 ($0.21psqm) per annum as determined by the independent professional valuation by Opteon and subject to annual CPI review;

Purpose: For the development of a renewable energy facility.

DIRECTION ISLAND RESORT PROPOSAL

Community and Stakeholder Engagement

At the Ordinary Meeting of Council on 23 January 2019, Council considered a request from Chris Blakeman of Cocos Boronia Resort that Council lease land on Direction Island for the purpose of building a resort. Council resolved to implement a comprehensive community and stakeholder engagement strategy and is therefore seeking community views on the concept, of what may or may not be acceptable to the community. Council understands that this is a very sensitive and potentially emotive topic and therefore is keen to ensure community input is informed and deliberative.

Community and stakeholder input will be used to assist and inform Council decision-making.

Our Commitment:

The proposed community engagement model is aligned with the “Involve” public participation goal as defined by the IAP2 Spectrum. The “Involve” goal commits the Shire to working directly with the public to ensure that community views are understood and considered, along with all other information, in Council decision-making processes.

Our Values:

1. Public participation is based on the belief that those who are affected by a decision have a right to be involved in the decision-making process.

2. Public participation includes the promise that the public's contribution will influence the decision.

3. Public participation promotes sustainable decisions by recognizing and communicating the needs and interests of all participants, including decision makers.

4. Public participation seeks out and facilitates the involvement of those potentially affected by or interested in a decision.

Methodology:

The methodology involves two parallel processes:

1. A Citizen’s Jury/Community Reference Group comprising of informed, demographically representative residents collaborating to present a report to Council; and

2. An open call for public submissions from any member of the community or from stakeholder agencies.

Community Reference Group: A Community Reference Group (CRG) of up to 30 people, reflective of the diverse community demographic composition, will be provided with detailed information on the proposal and will then deliberate and debate the issue. The selection process for the CRG will be transparent and will include self-nomination and random selection via a recruitment process with the aim of achieving a group profile that reflects the age, gender and cultural diversity of the community. Technical experts in the areas of economic development, tourism, environment and infrastructure will be asked to act as ex-officio advisors. The CRG will be provided with information and can ask for additional information to assist with their deliberations. After considering all information, the group will collectively develop a set of recommendations for Council’s consideration. The aim is for the CRG to achieve a consensus view on the recommendations however, if consensus cannot be achieved, recommendations will be put to the vote so that Council can gauge the level of support for each recommendation.

It is likely that the CRG will be required to commit to a full day to consider all information and to develop recommendations. The recommendations will be presented to Council and made available for the broader community.

Public Submissions: Public submissions from members of the community and from stakeholder agencies are invited. Detailed information can be provided to assist with informing public submissions. Any submissions received will be provided (anonymously) to the CRG and presented to Council. Submissions are to be marked confidential to:

News from Geof’s Bird’s

There have been many new birds seen by Geof this year. Here are two little Flycatchers , one from Home Island and one from West. They like to sit near a road and dart out and catch a fly or a mosquito then back to its perch. The green background bird is a Dark-sided Flycatcher and the one on a piece of wood is a Grey-streaked Flycatcher. They have both been seen on Cocos before and they have flown from Japan where they breed.

Environmentally-Friendly

Office The Biggest Challenge

When going green, the biggest challenge is getting user buy-in. As with anything new, it is going to take time for everyone to adapt.

The easiest way to make the whole procedure as seamless as possible is by educating everyone and being patient with individuals.

Have a clear objective in mind (reduce the energy bill by X% or cut the amount of paper being thrown away by half etc) and ensure everyone knows the goal.

Prove it isn’t a passing fad and show staff these are permanent changes. Before you know it, your office will be eco-friendly.

There are lots of advantages to making your business as green as possible:

Being eco-friendly is good PR, which is always good for business;

Being eco-friendly makes you look good to potential employees and business partners;

When done properly, green practices are cost-saving practices. It’s cheaper, in the long run, to be kind to the environment.

And, of course, you’re helping the planet!

Criminal offences of assault I

These are short articles about legal issues that may interest you. They are not legal advice. You should always get individual legal advice for your situation.

This article and the next articles are about the criminal offences of common assault, assault occasioning bodily harm, assaults with intent (to do another offence) and “serious assaults”. This article will deal with the definition of assault, what are circumstances of aggravation and two types of assault.

What is an assault?

An assault can involve physical contact, but does not have to involve actual physical contact. The definition of assault is:

any striking or touching or applying force directly or indirectly to someone without their consent (or with their consent if the consent was obtained by fraud) or

any threatened or attempted applying of force to someone without their consent in circumstances where it appears that the person threatening is capable of carrying out the assault.

An example of a common, or simple assault, is slapping someone. An example of an assault where the consent to the touching was gained by fraud is someone posing fraudulently as a doctor and doing a physical examination on a person.

An example of an assault where there is no actual physical touching is where someone raises something to throw at you, and they are close enough so that if they throw it, it could hit you.

You can “apply force” to someone (assault them) by using heat, light, electricity or gas or anything else that causes injury or personal discomfort. For example, you can assault someone by spitting on them.

An assault is a criminal offence, unless authorised, excused or justified by law. An example is that in many situations, police are allowed to use reasonable force to carry out some of their functions, which would otherwise be assaults. Another example is that you may assault someone in self-defence, which may then not be an assault.

Circumstances of aggravation

Assaults can be committed in circumstances of “aggravation”. This means that they are treated more seriously and attract higher penalties.

The circumstances of aggravation are as follows:

The offender is in a “family relationship” with the victim. “Family relationship” is defined in the Restraining Orders Act 1997 (WA)(CI) – see below.

A child was present when the offence occurred.

The victim was 60 years old or older.

The offence was also a breach of a restraining order under the Restraining Orders Act.

A family relationship is between 2 people and includes spouses, ex-spouses, de facto spouses and ex de facto spouses, people related (“related” has a special definition), children and someone with whom they live, or lived, or stayed, or a guardian, people who have had an intimate personal relationship and people who have had another personal relationship (eg carer and person cared for). We will not discuss the definition in detail here.

Racial aggravation

There is also a circumstance of racial aggravation. This is where either:

Immediately before, during or after the assault the offender shows hostility based on the victim being a member of a racial group or

The offence is motivated by hostility towards people of a racial group.

Common assault

There are a number of offences involving assault. The least serious offence is called “simple” or “common” assault. People are charged with common assault where the victim does not receive any injuries.

The maximum penalty is imprisonment for 18 months and/or a fine of $18,000, where there are no circumstances of aggravation or racial aggravation. The maximum penalty is imprisonment for 3 years and/or $36,000, where there are circumstances of aggravation or racial aggravation. This offence can only be dealt with by a Magistrates Court.

Assault occasioning bodily harm (AOBH)

There are 2 elements to this offence:

an assault

which thereby causes bodily harm.

The bodily harm only has to interfere with a person’s health or comfort. It can be as little as a bruise, or a small laceration. Note that pain is not sufficient to satisfy the definition of bodily harm.

Note as well that you do not have to intend to cause bodily harm to be convicted of assault occasioning bodily harm. For example, if you push someone, and did not mean to bruise them, but you leave bruises, you can be convicted of AOBH.

This offence will be dealt with by the Magistrates Court unless either you or the Prosecution ask for it to be dealt with on indictment (by the District Court) and the Magistrate agrees. There are rules that the Magistrate must apply in making this decision.

If dealt with by the Magistrates Court, the maximum penalty is 2 years imprisonment and/or $24,000, or 3 years imprisonment and/or $36,000 if there are circumstances of aggravation or racial aggravation.

If dealt with by the District Court, the maximum penalty is 5 years imprisonment, or 7 years imprisonment if there are circumstances of aggravation or racial aggravation.

In the next article we will deal with assaults with intent, and what are called serious assaults.

Choose life

There is nothing more damaging to a long, healthy life than smoking, which is estimated as the reason for death or disability in half the people who smoke. The dangers of smoking tobacco are so significant that it is the most important public health problem in the world, which ironically, is largely avoidable.

Smoking not only cuts your lifespan by affecting your internal organs, but it also ages you on the outside by causing skin damage. Tobacco smoking can give you wrinkles, create pucker lines around your mouth, stain your teeth and fingers, rob your skin of nutrients, break down youth-enhancing collagen and make your skin look grey. It makes you wonder how smoking is often marketed as glamorous and attractive.

It takes courage to quit smoking, as it’s not an easy journey – but it’s a brave and sensible choice. Some of the positive changes will happen quickly, while others will be more gradual, but all the changes will benefit your health and well-being.

Keep the following 4 Ds in mind when you have a craving.

Delay: remember that the worst cravings last for only a few minutes and will become even less frequent the longer you have quit.

Deep breathe: this should help you relax and focus your mind on something else.

Drink water: it is a good idea to drink plenty of fluids to help flush the nicotine and other toxins out of your system.

Do something else: you could go for a walk, to the movies or visit a supportive friend. Try eating an apple or cleaning your teeth when you would normally have a cigarette. You could hold something else, such as a pen or beads, to replace the need to hold a cigarette, or chew some gum or eat or drink a healthy snack to have something other than a cigarette in your mouth.

Ada juga keadaan penyerangan bangsa. Inilah bilamana:

Langsung sebelom, dimasa berlaku atau selepas penyerangan itu orang yang bersalah menunjukkan kemarahan yang berdasarkan mangsa itu seorang daripada kaum bangsa atau

Pelanggaran disemangatkan oleh permusuhan terhadap orang-orang dari bahgian bangsa.

Penyerangan biasa

Ada berberapa pelanggaran yang melibatkan penyerangan. Pelanggaran yang kurang serius dipanggil penyerangan “sederhana” atau “biasa”. Orang-orang didakwa dengan serangan biasa dimana mangsa tidak mengalami kecederaan.

Hukuman maksimum ialah penjara selama 18 bulan dan/atau denda $18,000, dimana tidak ada keadaan penyerangan atau penyerangan kebangsaan. Hukuman maksimum adalah penjara 3 tahun dan/atau $36,000, dimana ada penyerangan atau penyerangan kebangsaan. Pelanggaran ini hanya boleh diurusi oleh Magistrates Court.

Penyerangan menyebabkan kecederaan badan (AOBH)

Ada 2 bahgian untuk pelanggaran ini:

sebuah penyerangan

yang dengan demikian menyebabkan kecederaan badan.

Kecederaan badan hanya mengganggu kesehatan atau keselesaan seseorang. Ia boleh sekecil belauh, atau tegaris yang kecil. Perhatikan bahwa rasa sakit tidak cukup untuk memenuhi keterangan kecederaan badan.

Perhatikan juga yang kamu tidak seharusnya berniat untuk menyebabkan kecederaan badan untuk dihukum dengan penyerangan menyebabkan kecederaan badan. Contohnya, jika kamu menolak seseorang, dan tidak berniat untuk mereka belauh, tetapi kamu meninggalkan belauh, kamu boleh dihukum menurut AOBH.

Pelanggaran ini akan diurusi oleh Magistrates Court kecuali kamu atau Prosecution meminta untuk diuruskan dengan dakwa (oleh District Court) dan Magistrate bersetuju. Ada aturan yang Magistrate harus turuti dalam membuat keputusan ini.
