Minutes of the Regular Meeting
East Sac County Community School District
Board of Education
May 27, 2015
The regular meeting was called to order by Rodman at 12:00 p.m. at the East Sac County HighSchool – Lake View. Present were Rodman, Wilhelm, Drost, and Lynch. Stoltenberg wasabsent. Also in attendance were Supt. Kruthoff, two media representatives, and one visitor.
Drost moved to approve the agenda as presented, Lynch seconded; motion carried 4-0.
The consent items were reviewed and discussed. Wilhelm moved to approve the bill to AlbrechtOil for $697.40, Lynch seconded; motion carried 3-0-1 with Drost abstaining. Drost moved toapprove the 4/30/15 financial statements, the Minutes of the April 13 Public Hearing andRegular Meeting and the May 18 Public Hearing and Regular Meeting, and bills on account of$403,161.48. Wilhelm seconded to motion which passed 4-0.
Mrs. Kruthoff reported on the professional development plans for this week and next.
A list of summer projects was presented for approval. Two bids were received for replacementof the boilers at the Sac Elementary School: Carroll Control Systems $65,850 and CHMcGuiness Co. $76,230. Wilhelm moved to approve the bid from Carroll Control Systems andto approve the remaining smaller projects as presented, Drost seconded; motion carried 4-0.
A list of Schedule A (Teaching) and Schedule B (Coaching) contracts was presented to theBoard for approval. Wilhelm moved to approve the lists as presented, Drost seconded; motioncarried 4-0.
A list of contracts for classified staff was presented for approval. Drost moved to approve thecontracts as presented, Wilhelm seconded; motion carried 4-0.
Wilhelm moved to approve the early graduation requests of Kashmir Daggett, Cordell Boom,and Alyssa Sexton pending successful completion of all requirements following the firstsemester of 2015-16, Lynch seconded; motion carried 4-0.
Wilhelm moved to accept the resignations of Robert Nyblom (bus driver), Colin Martin(associate and coach), and Melissa Rath (associate) as presented, Lynch seconded; motioncarried 4-0.
The next regular meeting has been scheduled for 6/24/15 at 12:00 p.m. in the East Sac CountyElementary School – Sac City.
Wilhelm moved to adjourn, Drost seconded; motion carried 4-0. Meeting adjourned at 12:28 p.m.

ESC Board of Education-Goals
The following district goals were approved by the East Sac County Board ofEducation on July 25, 2012.
1. The number of ESC students classified as proficient in
reading, math, and science will increase.
2. ESC will implement a K-12 concept-based curriculum in
English/Language Arts and develop a five-year curriculum
review/implementation cycle for all academic areas.
3. The district will continue providing professional
development focused on concept-based teaching and
learning.
4. ESC will develop a Facilities Improvement Plan including
timelines, cost estimates, and suggested funding sources.
5. ESC will invest in updating and expanding teaching materials
and technology, while maintaining a position of financial
stability.
6. In an effort to remain financially stable, the district will
investigate and pursue all funding options available to Iowa
schools.

THE INTERGOVERNMENTAL
AGREEMENT

parties
to the Intergovernmental

hereinafter
referred

the
School District and
the
City of
Sac
City
hereinafter
referred

pursuant

of the

Iowa and located
in Sac
County;
and
WHEREAS,
the
original
Intergovernmental Agreement
and
the
pursuing Amendment
have
both
expired
in
the duration referred
to as Section 8

Financing;
NOW,
THEREFORE,
the
parties
hereto agree
to the
following
amendment:
Section 8

Financing.
The
cost
and expenses incurred
in
furtherance
of the intent
and
purpose
of the original Agreement shall be
paid
from the
Sac
Community Recreation
Fund
(representing
contributions and
pledges
obtained by the
parties
or the Board
of Directors)
and
from
grants, gifts,
revenues
generated
by the operation of the facility.
Neither the
School
District
nor
the
City
shall
have
any
continuing
liability
or
financial obligation
for
the
obligation
of
maintenance
of
the
facility
except
as
follows:
For the
following
fiscal
year
commencing
with
the
fiscal
year
beginning
July 1,2015,
each
of the
parties
shall appropriate the
funds
as
follows:

Usage
of
a
corporate membership will be
offered
as
part
of
the
program.
The
Community
Center Board
shall
keep in a reserve
fund the
amount
of
$45,000,
which
has
already been accumulated
through the
prior
fiscal
years.
This
fund shall
be maintained by the
Community
Board. An
account
shall
be
maintained by
the
Community
Board
for the
demolition
should this Agreement
be terminated
or
should the
parties
determine
that this Agreement
should
be
terminated according
to the terms thereof.
The East
Sac
County School
District agrees
to the
following
conditions:
1.
The
East
Sac
County
School
District
will
have
access
to the
Community
Center
at
any
time during regular hours of operation
including physical
education
with one-week
notice unless needed
in an emergency.
2.
Students
of
the East
Sac County Schools
participating
on
youth
teams
(either
associated
with or not associated
with
the school)
will
not
be
charged
to
use
the Community
Center
for
practice
purposes.
3.
The
School
District
will
provide
adequate supervision
of students, faculty
and activities
during use of the facility.
4. The School
District
will
be responsible
for
any
damages
to
equipment
or
facilities
by
either the
participants
or supervisors during the
scheduled
use of the facility.

5.
The
School
District
will
provide
to the
Community
Center
Director
a
schedule
of
all
games
and practices
of
the
MS
athletic
programs,
at least
30
days
in
advance

use.

activities
will
then
have priority
of
the
described
area.
Additional
times
may

allowed,
but
priority
will
not
be
given
to
the
activity.
6. The
School
District
will
provide
adequate
supervision
of
all
MS
athletic programs
including

main
area
used

locker

AGREEMENT
This
Agreement is made and entered into

DISTRICT
subsequently

COMMUNITY
SCHOOL
DISTRICT,

RECITALS
NF and
ES
wish
to share a
TALANTED AND
GIFTED
(TAG)TEACHER
to the
advantage
of both
districts. The intention
is for this agreement
to
serve as
an agreement
under
Chapter
28E
of
the
Code
of
lowa.

by and between NF and ES as
follows:

services of a
TAG TEACHER,
SHAD COPPOCK.

This Agreement
shall commence
on July

Secretary of State.

The
duration of this
Agreement shall be one
year.
However,
provisions
of this

The
provisions
of this
Agreement
shall
remain
the
same
unless written modification,

The sharing

be

a

of 50% with
NF
and
50% with ES. The
exact
time
allocation
will be
assigned
bythe Superintendent.
Salary and related
expenses
will
be
divided on a 50/50 basis.

interest of economy and administrative efficiency
and in
the
interest
of
not
attempting to administer
two
separate contracts, NF
shall hold
the
full-time
employment
contract
of
TAG TEACHER,
SHAD
COPPOCK,
and shall receive
reimbursement
from ES. This
staff
member
shall
at
alltimes
be an employee
of
NF
ratherthan
an
employee
of
ES,
but shall
be
subjecttothe
policies
of both NF and ES. ES
shall
pay
NF
50%
of
the
TAG TEACHER'S
contract the
first
year
in
addition
to
50%
of
FICA, IPERS,
health
insurance,
life/ADD
insurance,
and all
expenditures related
to
the
contract.
6. Each
school district shall ensure
that
their respective
worker's
compensation
and
liability
policies
shall fully cover the
TAG TEACHER
during
the
course of
their
duties
for
the respective school
districts.

ANTI-BULLYING/HARASSMENT POLICY
Harassment and bullying of students and employees are against federal, state and local policy, and arenot tolerated by the board. The board is committed to providing all students with a safe and civil schoolenvironment in which all members of the school community are treated with dignity and respect. Tothat end, the board has in place policies, procedures, and practices that are designed to reduce andeliminate bullying and harassment as well as processes and procedures to deal with incidents of bullyingand harassment. Bullying and harassment of students by other students, by school employees, and byvolunteers who have direct contact with students will not be tolerated in the school or school district.
The board prohibits harassment, bullying, hazing, or any other victimization, of students, staff, andvolunteers based on any of the following actual or perceived traits or characteristics, including but notlimited to age, color, creed, national origin, race, religion, marital status, sex, sexual orientation, genderidentity, physical attributes, physical or mental ability or disability, ancestry, political party preference,
political belief, socioeconomic status, or familial status.
This policy is in effect while students or employees are on property within the jurisdiction of the board;while on school-owned or school-operated vehicles; while attending or engaged in school-sponsoredactivities; and while away from school grounds if the misconduct directly affects the good order,efficient management and welfare of the school or school district.
If, after an investigation, a student is found to be in violation of this policy, the student shall bedisciplined by appropriate measures which may include suspension or expulsion. If after aninvestigation a school employee is found to be in violation of this policy, the employee shall bedisciplined by appropriate measures which may include, termination. If after an investigation a schoolvolunteer is found to be in violation of this policy, the volunteer shall be subject to appropriate measures
which may include, exclusion from school grounds. “Volunteer” means an individual who has regular,significant contact with students.
When looking at the totality of the circumstances, harassment and bullying mean any electronic, written,verbal, or physical act or conduct toward a student which is based on any actual or perceived trait orcharacteristic of the student and which creates an objectively hostile school environment that meets oneor more of the following conditions:
Places the student in reasonable fear of harm to the student’s person or property;
Has a substantially detrimental effect on the student’s physical or mental health;
Has the effect of substantially interfering with the student’s academic performance; or
Has the effect of substantially interfering with the student’s ability to participate in or benefitfrom the services, activities, or privileges provided by a school.
“Electronic” means any communication involving the transmission of information by wire, radio, opticalcable, electromagnetic, or other similar means. “Electronic” includes but is not limited to communicationvia electronic mail, internet-based/social media communications (i.e., Facebook, Twitter, YouTube,YikYak, Snap Chat or similar sites now or in the future), pager service, cell phones, electronic textmessaging or similar technologies.

ANTI-BULLYING/HARASSMENT POLICY
Harassment and bullying may include, but are not limited to, the following behaviors andcircumstances:
Repeated remarks of a demeaning nature;
Implied or explicit threats concerning one's grades, achievements, property, etc.;
Demeaning jokes, stories, or activities directed at the student; and/or
Unreasonable interference with a student's performance.
Sexual harassment of a student by an employee means unwelcome sexual advances, requests for sexualfavors, or other verbal or physical conduct of a sexual nature when:
Submission to the conduct is made either implicitly or explicitly a term or condition of thestudent’s education or benefits;
Submission to or rejection of the conduct is used as the basis for academic decisions affecting thatstudent; or
The conduct has the purpose or effect of substantially interfering with the student’s academic performance by creating an intimidating, hostile, or offensive education environment.
In situations between students and school officials, faculty, staff, or volunteers who have direct contactwith students, bullying and harassment may also include the following behaviors:
Requiring that a student submit to bullying or harassment by another student, either explicitlyor implicitly, as a term or condition of the targeted student’s education or participation inschool programs or activities; and/or
Requiring submission to or rejection of such conduct as a basis for decisions affecting thestudent.
Any person who promptly, reasonably, and in good faith reports an incident of bullying or harassmentunder this policy to a school official, shall be immune from civil or criminal liability relating to suchreport and to the person’s participation in any administrative, judicial, or other proceeding relating to thereport. Individuals who knowingly file a false complaint may be subject to appropriate disciplinaryaction.
Retaliation against any person, because the person has filed a bullying or harassment complaint orassisted or participated in a harassment investigation or proceeding, is also prohibited. Individuals whoknowingly file false harassment complaints and any person who gives false statements in aninvestigation shall be subject to discipline by appropriate measures, as shall any person who is found tohave retaliated against another in violation of this policy. Any student found to have retaliated inviolation of this policy shall be subject to measures up to, and including, suspension and expulsion.Any school employee found to have retaliated in violation of this policy shall be subject to measures upto, and including, termination of employment. Any school volunteer found to have retaliated inviolation of this policy shall be subject to measures up to, and including, exclusion from school grounds.

ANTI-BULLYING/HARASSMENT POLICY
The school or school district will promptly and reasonably investigate allegations of bullying orharassment. The building counselor or designee will be responsible for handling all complaints bystudents alleging bullying or harassment. The building counselor or designee will be responsible forhandling all complaints by employees alleging harassment.
It also is the responsibility of the superintendent, in conjunction with the investigator and principals, todevelop procedures regarding this policy. The superintendent also is responsible for organizing training programs for students, school officials, faculty, staff, and volunteers who have direct contact withstudents. The training will include how to recognize harassment and what to do in case a student isharassed. It will also include proven effective harassment prevention strategies. The superintendent willalso develop a process for evaluating the effectiveness of the policy in reducing bullying and harassmentin the board.
The board will annually publish this policy. The policy may be publicized by the following means:
Inclusion in the student handbook,
Inclusion in the employee handbook
Inclusion in the registration materials
Inclusion on the school or school district’s web site,and a copy shall be made to any person at the central administrative offices at 801 Jackson, Lake View,IA.

ANTI-BULLYING/HARASSMENT INVESTIGATION PROCEDURES
Individuals who feel that they have been harassed should:
Communicate to the harasser that the individual expects the behavior to stop, if the individualis comfortable doing so. If the individual wants assistance communicating with the harasser,the individual should ask a teacher, counselor or principal to help.
If the harassment does not stop, or the individual does not feel comfortable confronting theharasser, the individual should:-- tell a teacher, counselor or principal; and-- write down exactly what happened, keep a copy and give another copy to the teacher,
counselor or principal including;o what, when and where it happened;o who was involved;o exactly what was said or what the harasser did;o witnesses to the harassment;o what the student said or did, either at the time or later;o how the student felt; ando how the harasser responded.
COMPLAINT PROCEDURE
An individual who believes that the individual has been harassed or bullied will notify the buildingcounselor, the designated investigator. The alternate investigator is the building principal. Theinvestigator may request that the individual complete the Harassment/Bullying Complaint form and turn
over evidence of the harassment, including, but not limited to, letters, tapes, or pictures. Thecomplainant shall be given a copy of the completed complaint form. Information received during theinvestigation is kept confidential to the extent possible.
The investigator, with the approval of the principal, or the principal has the authority to initiate aninvestigation in the absence of a written complaint.
INVESTIGATION PROCEDURE
The investigator will reasonably and promptly commence the investigation upon receipt of thecomplaint. The investigator will interview the complainant and the alleged harasser. The alleged
harasser may file a written statement in response to the complaint. The investigator may also interviewwitnesses as deemed appropriate.
Upon completion of the investigation, the investigator will make written findings and conclusions as toeach allegation of harassment and report the findings and conclusions to the principal. The investigatorwill provide a copy of the findings of the investigation to the principal.

ANTI-BULLYING/HARASSMENT INVESTIGATION PROCEDURES
RESOLUTION OF THE COMPLAINT
Following receipt of the investigator's report, the principal may investigate further, if deemed necessary,and make a determination of any appropriate additional steps which may include discipline.
Prior to the determination of the appropriate remedial action, the principal may, at the principal'sdiscretion, interview the complainant and the alleged harasser. The principal will file a written reportclosing the case and documenting any disciplinary action taken or any other action taken in response tothe complaint. The complainant, the alleged harasser and the investigator will receive notice as to theconclusion of the investigation. The principal will maintain a log of information necessary to complywith Iowa Department of Education reporting procedures.
POINTS TO REMEMBER IN THE INVESTIGATION
Evidence uncovered in the investigation is confidential.
Complaints must be taken seriously and investigated.
No retaliation will be taken against individuals involved in the investigation process.
Retaliators will be disciplined up to and including suspension and expulsion.
CONFLICTS
If the investigator is a witness to the incident, the alternate investigator shall investigate.

APPROPRIATE USE OF COMPUTER NETWORK AND THE INTERNET-EMPLOYESS
I. Responsibility for Internet Appropriate Use
A. The authority to enforce appropriate use of District technology resources is delegated to trained personnel and/or other adults designated and trained by the District.
B. All users are expected to practice appropriate use of District computers, computer networks and theInternet.

C. Employees are prohibited from sending or soliciting sexually oriented messages or images.
D. Employees are prohibited from making or distributing illegal/unauthorized copies of softwaresuch as, but not limited to, software that has been downloaded or copied or is in the possession ofthe user without the appropriate registration or license.
E. Employees are prohibited from sharing a personal user account with anyone other than thenetwork administrator.
F. Employees are prohibited from using instant messenger services, Internet Relay Chat or other
forms of direct electronic communication or enter a chat room while using the District’scomputers, computer network systems or Internet connection unless authorized by the networkadministrator.
G. Employees are prohibited from vandalizing the District’s computers or its computer networksystem including the use or attempted use of computer viruses or participation in hacking.
H. Employees are prohibited from using the District’s computers and/or computer network forany commercial or for profit purposes, personal or private business, product advertisement or political lobbying.
I. Employees are prohibited from using the District’s computers or computer network or stand-alone computer for any illegal activity.
J. Employees are prohibited from altering, modifying, corrupting or harming in any way thecomputer software and data files stored on the District’s computers or computer networksystems. technology staff.
K. Employees are prohibited from using any encryption software from any access point withinthe District.
L. Employees are prohibited from downloading any programs from the Internet without prior permission from the District’s technology coordinator or other appropriate personnel. Any programs downloaded from the Internet shall be strictly limited only to those that have received permission from the technology coordinator or assigned technology personnel.
III. On Line Etiquette
A. It is the employee’s responsibility to abide by the policies and procedures of any network thatis being accessed. The use of the network may be taken away for violation of board policy orregulations.
B. Employees should adhere to online protocol1. Respect all copyright and license agreements2. Cite all quotes, references and sources3. Adhere to reasonable time limits in gathering needed information or conducting business4. Apply the same privacy, ethical and educational considerations utilized in other forms
of communication
C. When accessing electronic mail, employees should adhere to the following guidelines:1. No expectation of privacy is implied; private messages should be limited toeducational or business usage2. Delete unwanted messages immediately3. Use of objectionable language is prohibited4. Unauthorized use of another person’s e-mail is strictly prohibited5. Always sign messages when authorized to use another person’s e-mail
D. Employees should use good and sound practices when using social media on district-owed
computers or other electronic devices and should adhere to the following guidelines:1. Employees should understand that they are personally responsible for the content they post or publish on social media. Only predetermined staff members are to act asrepresentatives of or spokespersons for the District.2. Employees should not post or publish content that is deemed defamatory or obscene orcould cause imminent violence or a true threat, violates copyright or other intellectual property laws.

Disclosure of confidential or protectedinformation may result in liability for invasion of privacy or defamation.4. Employees may create a social media site for a school, class, or program only with the prior approval of the District Superintendent or designee. No school logos, mascots,
photographs of the facilities, or other graphic representations or images associated withthe District may be used without permission.5. Employees should carefully consider the pro and cons of accepting current Districtstudents as “friends” through social media. Employees are expected to maintainappropriate professional boundaries in the electronic communications with students.6. Employees should consider whether a particular posting on social media or otherelectronic communication puts their professional reputation and effectiveness as aDistrict employee at risk.
Employees found to have engaged in inappropriate use of social media or other electroniccommunication may be subject to disciplinary action by the District, up to and including
termination.
IV. Unauthorized CostsIf an employee gains access to any service via the Internet which has a cost involved or if anemployee incurs other types of costs, the employee will be responsible for those costs.

STUDENT CONDUCT
The board believes inappropriate student conduct causes material and substantial disruption to theschool environment, interferes with the rights of others, or presents a threat to the health and safety of
students, employees, and visitors on school premises. Appropriate classroom behavior allows teachersto communicate more effectively with students.
Students will conduct themselves in a manner fitting to their age level and maturity and with respect andconsideration for the rights of others while on school district property or on property within the jurisdiction of the school district; while on school owned and/or operated school or chartered vehicles;while attending or engaged in school activities; and while away from school grounds if misconduct willdirectly affect the good order, efficient management and welfare of the school district. Consequencesfor the misconduct will be fair and developmentally appropriate in light of the circumstances.
Students who fail to abide by this policy and the administrative regulations supporting it may bedisciplined for conduct which disrupts or interferes with the education program; conduct which disruptsthe orderly and efficient operation of the school district or school activity; conduct which disrupts the
rights of other students to participate in or obtain their education; conduct that is violent or destructive;conduct which interrupts the maintenance of a disciplined atmosphere; or conduct which violatesfederal, state and local laws and the rules, regulations and other directives of the District, including all board policy and student handbook provisions. Disciplinary measures include, but are not limited to,removal from the classroom, detention, suspension, probation, and expulsion.
A student who commits an assault against an employee on school district property or on property withinthe jurisdiction of the school district; while on school-owned or school-operated chartered vehicles;while attending or engaged in school district activities will be suspended by the principal. Notice of thesuspension is sent to the board president. The board will review the suspension to determine whether toimpose further sanctions against the student which may include expulsion. Assault for purposes of thissection of this policy is defined as:
an act which is intended to cause pain or injury to, or which is intended to result in physicalcontact which will be insulting or offensive to another, coupled with the apparent ability toexecute the act; or
any act which is intended to place another in fear of immediate physical contact which will be painful, injurious, insulting or offensive, coupled with the apparent ability to execute the act; or
intentionally points any firearm toward another or displays in a threatening manner anydangerous weapon toward another.
The act is not an assault when the person doing any of the above and the other person are voluntary participants in a sport, social or other activity, not in itself criminal, when the act is a reasonablyforeseeable incident of such sport or activity, and does not create an unreasonable risk of serious injuryor breach of the peace.
Removal from the classroom means a student is sent to the building principal's office. It is within thediscretion of the person in charge of the classroom to remove the student.
Detention means the student's presence is required during non-school hours for disciplinary purposes.The student can be required to appear prior to the beginning of the school day, after school has beendismissed for the day, or on a non-school day. Whether a student will serve detention, and the length ofthe detention, is within the discretion of the licensed employee disciplining the student or the building principal.

STUDENT CONDUCT
Suspension means; either an in-school suspension, an out-of-school suspension, a restriction fromactivities or loss of eligibility. An in-school suspension means the student will attend school but will betemporarily isolated from one or more classes while under supervision. An in-school suspension will notexceed ten consecutive school days. An out-of-school suspension means the student is removed from theschool environment, which includes school classes and activities. An out-of-school suspension will notexceed ten days. A restriction from school activities means a student will attend school and classes and practice but will not participate in school activities.
Probation means a student is given a conditional suspension of a penalty for a definite period of time inaddition to being reprimanded. The conditional suspension will mean the student must meet theconditions and terms for the suspension of the penalty. Failure of the student to meet these conditions andterms will result in immediate reinstatement of the penalty.
Expulsion means an action by the board to remove a student from the school environment, whichincludes, but is not limited to, classes and activities, for a period of time set by the board.
Students with current Good Conduct Violations will not be allowed to participate in activities not covered by the Good Conduct Policy during their ineligibility period. Sponsors of activities that do not fall underthe Good Conduct Policy will notify students in writing about this guideline. Notification will also occurin the student handbook.
Following the suspension of a special education student, an informal evaluation of the student's placementwill take place. The Individual Education Program (IEP) is evaluated to determine whether it needs to bechanged or modified in response to the behavior that led to the suspension.
If a special education student's suspensions, either in or out of school, equal ten days on a cumulative basis, a staffing team will meet to determine whether the IEP is appropriate.
It is the responsibility of the superintendent, in conjunction with the principal, to develop administrativeregulations regarding this policy.

Students must successfully complete the courses required by the board and the Iowa Department of
Education in order to graduate.
It shall be the responsibility of the superintendent to ensure that students complete grades one through twelve
