As such Pamela Stapleton, Gloria & ThelmonFugate, and Trustees of Pine Creek Holiness Church is entitled to 100% of the CBM royaltiesattributable to their gas claims that are now in escrow and as may be hereafter payable. See Va.Code Ann. () 45.1-361.22:2.A.b. That CNX Gas Company LLC has previously given the notice(s) required by rJ 45.1-361.22:2.Ato all conflicting coal claimants identtfied in the above referenced pooling Order and anysupplemental Orders pertaining thereto.c. That when the Board granted Petitioner's Miscellaneous Petition in VGOB 05-0T19-1475-02, itdismissed the coal claimant(s) Swords Creek Land Partnership as a Respondent to theseproceedings.
