OPERATIONAL GUIDELINES FOR BANKS

GUIDELINES FOR CAPITAL SUBSIDY CUM REFINANCE SCHEME FOR INSTALLATION OF SOLAR OFF-GRID & DECENTRALISED APPLICATIONS UNDER JAWAHARLAL NEHRU NATIONAL SOLAR MISSION

1. Implementation Period

The scheme will be co-terminus with phase-I (initially upto March 2013) of the Jawaharlal Nehru National Solar Mission and will cover projects specifically approved by MNRE. In other words, schemes sanctioned by banks on or after 1 November 2010 and up to 31 March 2013 are eligible for assistance under the scheme by way of Capital Subsidy and subsidized interest on term loan.

2. Unit Cost

2.1 Models to be eligible for funding support under the scheme will need prior approval of MNRE. The model approved by MNRE are indicated in Annexure I. The financing banks can finance units conforming the conditions/stipulations laid down in the model projects and more specifically under the Special Terms and Conditions and declaration (Annexure II & III) without seeking prior approval from MNRE.

2.2 In case units are financed with cost over and above the approved unit cost, capital subsidy and bank loan carrying reduced interest will be limited to the maximum capital subsidy ceiling and maximum bank loan ceiling as indicated in these models. In such cases, the additional cost would have to be borne by the beneficiary. If the entity/or beneficiary of the scheme is able to access funds from other source to cover full or part of the gap between the project amount and available funds, then he will be free to do so. However, in cases where the actual cost is less than the indicative cost of the approved models, the eligible capital subsidy and bank loan will be on the basis of actual cost of the project. Purchase of systems manufactured by companies not listed by MNRE will require prior approval by MNRE.

3. Location of the unit

The unit could be located both in urban and rural areas.

4. Pattern of Assistance

4.1 The pattern of assistance will be as under: Margin - 20% Subsidy - 30% Bank Loan - 50%

100% refinance will be provided for the bank loan by NABARD at 2% rate of interest per annum.

4.2 The above subsidy pattern will be the same for all categories of borrowers (SC/ST, women, small farmers, physically handicapped, etc.) irrespective of the location of the unit. 4.3 Assistance under the scheme would be “Capital Subsidy plus Refinance” i.e without any “Either or Option”.

5. Margin

The borrowers are required to bring in 20% of the total cost of the project as the margin money.

6. Security

Banks may follow RBI guidelines in this regard.

7. Insurance

Borrowers should ensure that the units are insured and bank will ensure to obtain a copy of the policy before releasing the final instalment.

8. Eligible Institutions

All Commercial Banks and Regional Rural Banks are eligible to avail capital subsidy. These institutions are also eligible to avail refinance from NABARD subject to the eligibility criteria for refinance as stipulated by NABARD from time to time.

9. Release of subsidy

9.1 The entrepreneurs/eligible organisations shall apply to the banks for sanction of the project. The bank shall appraise the project as per their norms and if found eligible, sanction the total outlay excluding the margin, as the bank loan. The benchmark cost for SPV systems during 2011-12 will be Rs.300 per Wp. The Ministry will continue to provide 30% subsidy and 50% loan of the benchmark cost to the beneficiary through NABARD.

9.2 After sanction of the loan including subsidy, the bank shall approach NABARD for capital subsidy to be released upfront in the specified format (Annexure IV). On receipt of subsidy the same would be credited to the Subsidy Reserve Fund Account of the borrower. 9.3 On receipt of subsidy from NABARD, the bank shall disburse the loan ensuring that no interest is charged by them on the capital subsidy component.

9.4 Based on the field visit and after satisfactory installation of the unit, the bank shall arrange to make payment directly to the supplier that would also include the subsidy amount.

10. Interest Rate and Lock in period of Bank Loan

The loans extended by the banks would carry an interest rate of 5% per annum and would be extended with a repayment period not exceeding 5 years. The loan repayment period would have a minimum lock in period of 3 years from the date of disbursement of the first installment of the loan. No interest will, however, be charged by the financing banks on the capital subsidy component.

11. Misutilization of subsidy and loan

In case the unit is found to be incomplete or the subsidy is misutilised, Bank will arrange to recall the subsidy and loan amount and refund to NABARD as soon as it is recovered.

12. Release of refinance

12.1 The banks would be eligible to draw 100% of the loan outstanding (excluding the capital subsidy) as refinance from NABARD on an automatic basis subject to compliance with the usual terms and conditions governing release of refinance from NABARD.

12.2 The refinance claims under the schemes are to be preferred in the drawal application formats as per Annexure V. The financing banks may prefer refinance claims on a monthly basis.

13. Repayment of refinance

The refinance availed as per the eligibility by the banks will be repayable in suitable installments not exceeding 5 years. The banks may fix the repayment schedule of the loan having regard to the household cash flow of the borrowers so as to ensure full repayment of the loan along with interest thereon within 5 years.

14. Utilisation Certificate

Banks have to submit the utilization certificates for capital subsidy in the specified format indicated in Annexure VI.

15. Monitoring A State Level Monitoring Committee will be constituted by NABARD for smooth implementation of the scheme. Apart from NABARD and officials from the nodal agency of MNRE (Annexure-VII), the Committee will also include officials from the controlling offices of the major Commercial Banks, Chairmen of participating RRBs and SLBC convenor. NABARD Regional Office would convene the meeting under the chairmanship of Officer in charge. The committee will meet at least once in a quarter. The Committee besides other issues would also look in to issues like actual cost to the end user and strategy for coverage of the most needy and poor.

2. In case the actual cost of the system is less than the indicative costs mentioned above, the capital subsidy and loan eligibility will be calculated @ 30% and 50% respectively of the actual cost.

3. For invoices with amounts higher than those prescribed ,the subsidy will be limited as worked out according to the benchmark cost of Rs. 300 (maximum) per Wp for the year 2010-11 and the loan @ 5% will be limited to 50% of the benchmark cost. However the banks at their discretion, may consider financing the remaining amount at their prevailing interest rate.

ANNEXURE II

Special Terms and Conditions

1. The models could be home lighting systems or inverter based systems capable of

handling general AC loads.

2. Manufacturers to provide Compact Fluorescent lamps (CFLs) of 9 W/11 W and

LED (Light Emitting Diode) for home lighting systems.

3. The battery will be lead-acid of flooded electrolyte type, positive tubular plate

or gel type Valve Regulated Led Acid and low maintenance.

4. Inverter should be of quasi sine wave/sine wave type.

5. PV module (s) shall contain crystalline silicon solar cells.

6. PV modules must be warranted for their output peak watt capacity, which

should not be less than 90% at the end of 10 years and 80% at the end of 25 years.

7. The balance of systems provided must be warranted against any manufacturing/

design/ installation defects for a minimum period of 5 years.

The manufacturer has to give an undertaking with the invoice (Annexure III) that

the system offered meets the Technical requirements/ standards contained in

ANNEXURE-3 of the MNRE guidelines Ref. 5/23/2009 – P&C Dated: 16.6.2010 on off

grid SPV power plant systems under National Solar Mission.

It is certified that I/we have read the guidelines issued by the Ministry vide 5/23/2009/P&C dated 16th June, 2010 and the related provisions/terms and conditions for availing financial support from the Ministry of New and Renewable Energy and I/we agree to abide by these guidelines and related terms and conditions.

I/we confirm that the proposed solar PV system(s) for which subsidy/ subsided loan is being claimed have not been installed/supplied earlier .

A detailed site survey has been done/or will be undertaken to identify the beneficiary before actual supply and installation takes place.

11. The project has been appraised and found to be technically feasible and financially viable. 12. All the terms and conditions stipulated under the scheme are satisfied in case of the loan for which capital subsidy is claimed with this application and that the capital subsidy claimed are within the monetary limits prescribed under the scheme.

13. We have not applied earlier for capital subsidy covered by this claim/application from NABARD or any other institution.

14. We agree to promptly avail of refinance from NABARD as per the provisions of the scheme under ARF in the prescribed proforma, on disbursement of the term loan at an interest rate of 5% p.a.

15. We agree to release the subsidy amount on receipt of the same from NABARD, to the supplier directly, only after a spot visit and finding that the installation is functioning satisfactorily.

vii. NABARD shall have the right to inspect books and loan accounts covered under this application and /or call for copies of the related memoranda/ sanction notes/ any other relevant information in this behalf.

viii. Loans granted under DRI scheme have been excluded.

ix. All the units financed under the scheme in respect of which refinance is claimed are eligible under Jawaharlal Nehru National Solar Mission scheme of Government of India for refinance.

x. Refinance has been claimed at 2% only for the bank loan upto the specified amount. The rate of interest charged to the beneficiaries in respect of the loan for which refinance has been claimed is 5%.

xi. We certify that capital subsidy in respect of the units for which refinance is claimed has already been released.

3. We further certify that the amount of refinance already availed by us and outstanding as on date together with the proposed availment would be within the borrowing limit of our Bank.

4. We also certify that the rate of interest charged on the loan amount conform to the rates stipulated by NABARD under the captioned scheme.

5. We agree that if on verification of our records and of our constituents, NABARD comes to the conclusion that the accounts against which the disbursement of capital subsidy/ loan does not conform the guidelines laid down by MNRE from time to time, NABARD will have the right to recall the entire capital subsidy/ refinance disbursed in respect of such accounts.
